Minutes & Discussion Notes from Meeting held
Tuesday, December 9, 2025 at 7:00 p.m.
This Regular Meeting was held in the Annex Executive Board Room, located on the 2nd floor at Southold
Town Hall Annex, 54375 Route 25 (Main Road), Southold, New York.
The public had access to view and listen to the meeting as it was happening via Zoom. If an attendee did
not have access to a computer or smartphone, there was an option to listen in via telephone.
Comments from the public may not be solicited nor received without an appointment. It is expected that
the Committee will enter into Executive Session*at some point after opening the Regular Meeting for the
purpose of discussing applications regarding proposed acquisitions of real property where publicity
would substantially affect the value thereof. The public is not allowed to attend, view, or listen to
Executive Session.

Committee Minutes and Administration
• Acceptance of LPC meeting minutes from October 14, 2025
MOTION made by Eric Keil, seconded by Kim Krupski, to accept the October 14, 2025 LPC
meeting minutes.
Motion carried: 4/0/1 (Carol Festa abstained)

Tabled until a quorum of Committee members eligible to approve these minutes is achieved.

General Preservation
• None
Inquiries/Applications for Uses or Structures on Preserved Property
• 2340 Ackerly Pond LLC
SCTM# 1000-69.-3-9.3—Request to Install Utilities and Construct Storage Barn
Lilly reviewed, with the landowners present, the site plan and structure/use application for a
2,100 square foot storage barn to be used for equipment storage and egg washing/packing. The
landowners intend to clear less than an acre of trees throughout the property to accommodate
the barn and pasture-raised egg operation. The owner plans to access the site from Jasmine Ln.
The Committee members reviewed the survey, site plan, and applicable development rights
easement, and discussed the landowner's farm operation. The Committee determined that the
request is not in conflict with the terms of the easement.
MOTION made by Sam McCullough, seconded by Eric Keil, to find that the applicant's proposed
use as discussed is not inconsistent with the development rights easement.

SCTM # 107.-10-9.1 —ZBA Referral re: Conversion of Barn into Accessory Apartment
The Committee reviewed a referral from the ZBA for plan to convert the second floor of an
agricultural storage barn into living space. The barn is located on a development rights intact
reserve area associated with a Town development rights easement area. The Committee
confirmed the proposed use is not located on land subject to the Town's easement or covenants
and restrictions.

SCTM # 102.-2-16.3—Potential Easement Violation
The Committee discussed recurring instances of retail parking on land subject to a Town
development rights easement. The Committee directed Lilly to notify the landowner and prepare
a memo for the Town Attorney on the behalf of the Committee regarding enforcement provisions
in Chapter 70.
