SOUTHOLD TOWN BOARD MQNUTES
Meeting of December 9, 1975
A regular meeting of the Southold Town Board was held on Tuesday,
December 9, 1975 at the town board meeting room, 16 South Street,
Greenport, New York. Supervisor Martocchia called the meetigg to
order at 3: 00 P.M. with the following present:

Absent: Justice Francais T. Doyen
On motion of Councilman Rich, seconded by Councilman Homan, it was-
RESOLVED that the minutes of the November 18, 1975 Town Board meeting
be and hereby are approved.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the next regular meeting of the Southold Twon Board
will be held at 3:00 P.M. , Tuesday, December 23, 1975 at the town
board meeting room, 16 South Strebt, Greenport, New York.

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the reports of Supervisor Martocchia, Justice Suter,
Town Clerk Boken, and Building Inspector Terry be abd hereby are
accepted and placed„o.on file.

This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board approves the action of the
Fishers Island Ferry District in appointing Mrs. Ruth Pickett to
the position of reservation clerk which was vacated by the resignation
of Mrs. McCloskey; salary for said position to be $3.00 per hour for '
a 15 hour week.

This resolution was declared duly adopted.
Supervisor Martocchia reported;;
1 . Receipt of a letter from the Southold Public Schools advising .of
the defeat of the proposition to sell the buildings on Peconic Lane
to the Town and notification that the funds deposited by the Town
shall be returned in full.
2. Letter from the Long Island Lighting Company stating- they
have filed' with the Public Service Commission a modification of their
demand clause, which, if approved, will reduce their former 85% to
17% in 1976, 34% in 1977, 51% in 1978, 68% in 1978, and the full
86% in 1980. The east End Supervisors and the Southold Town Board will
pursue this further as they do not like the 85% in five years.
On motion of Councilman- Homan, seconded by Justice Suter,
WJIEREAS, a joint Energy Research and Development Administration
(ERDA) and National Academy of Sciences Study is now underway to
determine where to locate the Solar Energy Research Institute (SERI) ,
an institute whose prime thrust is to provide the method by which
solar research and development can be quickly translated into
production; and
WHEREAS, the preliminary National Academy of Sciences report endorses
locating the SERF -near major research installations, preferably near
a national laboratory to facilitate rapid start-up. SERI also needs
an environment providing exeeptional research facilities, academic
inputs and a sophisticated industrial base capable of marketing solar
energy equipment; and
WHEREAS, Long Island has all the resources. and site parameters to
allow it to compete with massive out-of-state competition for this
industry. However; this competition demands overt and tangible
support by the State of New York; and.
WHEREAS, the establishment of a Solar Energy industry would be
particularly beneficial to Long Island, whose economy is tied to
some extend to governmental contracts; and
WHEREAS, it is estimated that the SERI' S budget will be approximately
$50 million annually; and
WHEREAS, the SERI will have a staff of approximately 1 ,000 consisting
of highly trained..professional .persons. to be hired from the local
region, with a "ripple effect" of approximately 59000 new jobs; and
WHEREAS, a fa il.ity located on approximately 100 acres will be created
to house the -ERI, involving about $25 million in construction costs;
and
WHEREAS, the $50 million operating budget for SERI will translate
into approximately a $200 million operating improvement to the Long
Island economic area.
WHEREAS, the Town Board of the Town of Southold will strongly
encourage the application of solar energy throughout the Town of
Southold, in both new and existing structures; now therefore be it
RESOLVED, that the Town of Southold hereby urges the Governor of
the State of New York and the Federal Energy Research and Development
Agency to join in a 'unified effort to attract the 8ERI to this region
where it will not only be welcomed and supported by the community of
Southold, but will also provide anew and long term stimulus to Long
Island' s economy.

Supervisor Martocchia reported:
3. In connection with the new street lighting plan for the town,
use of telephone poles is necessary. The New York Telephone Company
indicated their willingness to discuss with the town use of their poles.
4. Report from Chief Cataldo relative to a study he has made of
traffic in Southold Village at the post office and a new site proposed
for the post office.
5. Letter from the Orient Fire District thanking the town
officials for their help in securing a generator for their fire house.
6. Letter from Don Acuri a property owner at Horton' s Point,
Southold. He is asking for less parking, more signs, no -picnicing
on the beach, garbage cans at the end of the road.
7. Letter from the Suffolk County Girl Scout' s Council asking
for Southold Town' s bikeway plan.---This plan has been submitted to
the Suffolk County Planning Department for evaluation.
On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that Supervisor Martocchia be and he hereby is authorized
to have the police boat placed in storage at the Port of Egypt
Marine, Inc. , Southold for a fee of $200.00 per year; said boat to
be placed in an area where it can be taken out and launched for an
emergency in a matter of minutes; at $10.00 for each launching.

Supervisor Martocchia reported:
8. Letter from William Collins, Mattituck, .citing problems of
road washout at his property. Steps will be taken to have the

problem corrected by the developer who is causing it.
9. Letter from David V. Huschle of the Suffolk Convention &
Visitors Bureau asking for an inventory of accomodations from Laurel
to Orient for the purpose of answering, inquiries from out-of-town
people seeking what the n-orth fork has to offer. The letter will be
referred to the president of the chamber of commerce for a reply.
OnJinotion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that upon the recommendation of the 'Sou.thold: Town Fire-Chiefs
Council, the following be appointed to succeed themselves -as Deputy
Fire Coordinators for the Town of Southold: Edward A. Lademann, Jr. ,
Southold, Leander B. Glover, Jr. , Cutchogue, Gerrge Lessard, Mattituck,and
IT IS FURTHER RESOLVED that Anthony Blados, Cutchogue, be and he
hereby is appointed the Southold Town representative on the Suffolk
County Fite Adivsory Board.

Supervisor Martocchia reported:
10. Study made by Chief Cataldo and Patrolman Sidor relavive
to signs for the Baywater Avenue . and Bayview. Road. ar-ea,Southold.
11 . Letter from Reverend Donald S. Stacey supporting the proposed
leash law.
12. Requests for improvements to be made in traffic safety at
the Orient school. Plans have been submitted to the Department of
Transportation at Hauppauge, and the plans ,have been accepted and
put on the work order.
13. There will be a meeting Dec. 10 at 4:00 P.M. , St Peter' s
Lutheran Church, Greenport, in reference to the Southold Town Community
Health Council. The town board embers have been invited to attend
this meeting.
On motion of Councilman Homan, seconded by Councilman Rich, it 'was
RESOLVED that the agreement between the Town of Southold, and the
,Civil Service Employees Association, Inc. , Suffolk Chapter, Southold
Town Unit dated January 31 , 1975 be amended by adding a new paragraph
thereto to provide as follows: (c) For the one-year period commencing
on January 1 , 1976, the wage rate of all full time employees represented
by CSEA shall be increased by the sum of $.40 per hour.

Supervisor Martocchia reported::
14. Due to the unfavorable vote for a new town hall at Peconic, in
an attempt to provide additional temporary space, the town attorney
and building inspector will draft specifications for a large office
trailer to be located at the town hall site in Southold.
15. Letter:'-from the President of the Fishers Island Civil
Association stating he has written to Assemblyman Perry Duryea and
Ant]}ony Taromenna about a possible lobster permit in the Fishers
Island area, He also thanked the board for may help they may have
given to obtaining the new boat for emergency use.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that $1 ,050.00 be and hereby is transferred from Highway
Item IV, Miscellaneous Contractual (DS5140.4) to Item IV, Snow and
Ice Control Contractual (DS5142.4) .

On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that $2.1 ,000.00 be transferred from unexpended balance to
FI-shers Island Ferry District to .Operation of the. Ferry - Fishers
Island Ferry District.

On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board execute an. agreement with the
County of Suffolk .in which the Town of Southold agrees that monkes
levied .and' collected for the repair and improvement of highways, and
received from .the state for the .repair and improvement of highways,
shall be expended in the sum of $411 ,600.00 for the general repairs
upon 177.06 miles of town highways, including sluices, culverts and
bridges having a span of less than fl-k-eafeet and boardwalks or the
renewals thereof.

Supervisor Martocchia reported:
16. Recippt of. report from the New°York State Department of
Audit and Control indicating the Town of Southold has complied .fu�tly
with the regulations of the Federal governemtn and New York State for
the town' s revenue sharing program.
17. . Town Attorney Tasker is drawing up an easement for the
purpose of draining water at Wolf Pit Lake, Mattituck.

RESOLVED that the -Southold Town Board approves the proposed, ,grant
agreement betw.e:en the .State of New 'York and Fishers Island Ferry.
District as to form and language. Said 4.greement" would obligate the
State to provide $100,000.00 for improvements to the Fishers Island
Ferry District terminal at Silver, Eel Pond.

On motion of Justice Demarest, secondedbby Councilman Rich, ft was
RESOLVED that Bond No. 73 S-7262 BCA issued by the Aetna, CasFalty
and Surety Company in the' name of George Mellas, Receiver of 'Taxes
of the TOwn of Southold, in the amount of $100,000.00 be and the same
is hereby approved as to its form, manner of execution, and sufficiency
of saaneiities therein.

WHEREAS Henry C. Weismann applied to the Southold Town Board for a
permit under the provisions jdf the Wetland Ordinance of the Town
of Southold, application dated August 1 , 1975, and.
WHEREAS the said application was referred to the Southold Town Board
of Town Trustees and the Southold Town Conservation Advisory Council
for their 'findings and recommendations, and
WHEREAS a public hearing was held by the Town Board with respect to
said application on the 18th day of November 1975, at which time all
interested persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that Henry C. Weismann, 145 W. Main St. ,
Smithtown, New York, be granted a permit under the provisions of the
Wetland Ordinance of the Town of Southold to remove material from an
existing canal and deposit same behind a proposed new bulkhead at his
property on the southeast terminus of Tarpon Drive -at Arshamomaque,
fronting on an existing canal on' the south side of the property..

Supervisor Martocchia reported:
18. Request for status of the bond of Elijah Lane Estates„
Section I, Mattituck, for roads and improvements, will be referred
to the town engineer for recommendation.
19. Application of Alfred R. Towle to the Department of
Environmental Conservation for permission to construct a one-family
residence at Cutchogue. Objections must be received by December 22;
hearing December 29.
20. Application of Cross Sound Ferry Service, Inc. to the
Department of Environmental Conservation for permission to df'edge
and reconstruct and expand the present facilities. Objections must
be received by December -31 ; hearing January ,7, 1976.
21 . Notification that the L.I.R.R. overpass at Arshamomaque
is to be constructed, the project to start next June or July, and
should last for one to one and one half years. It is guaranteed
two lanes will be kept open. -- Mrs. Gladys Csajko questioned the project.
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that a ,recess be taken at 3: 30 P.M. for the purpose of
holding a public hearing on the application of Leander Glover, Jr.
for a permit to excavate sand, gravel, stone, or other materials.
Meeting;',to reconvene following this hearing.

Meeting reconvened at 3:40 D.M.
Moved by Justice Suter , seconded by Councilman Rich,
WHEREAS Frank Sturm has made application to the Town Board to
dedicate certain highways at Greenport-,- -to be -known -as--Green Hill
Lane, Inlet Pond Road, and Homestead Way, more fully described in said
petition, together with release executed by the, owners thereof, and
WHEREAS the- Highway Superintendent has inspected the said highways
and has advised the Town Board that said proposed highways comply
in all respects with the specifications for the dedication of highways
in the Town of Southold,
NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and she hereby
is authorized and directed to forthwith cause the dedication, release
and deed to 'be recorded in the 'office of the Clerk of the County of
Suffolk.

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that. a public hearing will be ehdl by the Town Board of the
Town of Southold, Suffolk County, New York, at the Supervisor' s Office,
16 South Street, Greenport, New York, on the 23rd day of December, 1975,
at 3: 30 o ' clock P.M. . of said day, for purpose of considering .a
contract with the Villageof Greenport, Suffolk County, New York, for
fire protection ' to be. furnished by said Village to the Fire Protection
District established in said Town and known as "East-West Greenport
Fire Protection District, , Town of Southold, N.Y. " upon the following,
general terms, to wit:
(a) The Fire Department of said Village shall be subject to
call for attendance upon any fire occuring in said District
with a minimum of three pieces of apparatus and suitable men
and equipment when notified by alarm or by telephone call from
any person within said District.
(b hen notified by silent alarm or alarm other than a general
alarm, said Department shall respond with such men and apparatus
as shall be deemed suitable by the Chief of , said Department.
(c) The contract shall be for a term of five years commencing on
January 1 , 1976.
(d) For such servicec,the Village of Greenport shall receive the
following sums annually, to wit: 1976 - $18,000.00; 1977. -$219000.00;
1978-$24,000:00; 1979 - $27,000.00; 1980 - $30,000.00.
(e) Such other incidental terms as may be necessary or proper in
connection with such contract.
All persons interested in this matter should appear at the time and
place above stated.

RESOLVED that the Southold Town Board authorize the hiring of two
buses by the Southold Senior Citizens for an outing to the Coe Estate -
Planting Fields at Oyster .Bay on December 19, 1975•

WHEREAS, the Planning Board at a meeting thereof held on the 17th
day of November, 1975 .adopted amendments to the Southold Town Land
Subdivision Regulations, after a public hearing by .said Board on dire

NOW, THEREFORE, BE IT RESOLVED that the Town Board does. hereby approve
of the amendments to the Town of .Southold Land Subdivision:- Regulations
adopted by the Planning Board of the Town of Southold on November 17, 1975•

On motion of Councilman Rich, seconded .by Justice Suter, it was
RESOLVED that- the Town Board of the Town of Southold will hold a
public hearing -� at the Greenport Public
School,,, Front Street,. Greenport, New York on the 20th day of January,. '
1976 at 8:00 o' clock P.M. , at which time and place all interested
persons will be heard upon the following matter: "A Local Law
regulating the running at large of dogs. "
Said Local Law provides that it shall be unlawful for any person
owning or harboring a dog in the Town of Southold to permit or allow
such dog to: (A) Run at large elsewhere than upon the premises of the
owner or custodian. unles's such dog shall be on a leash or accompanied by
a person at least twelve years of age, having adequate control of such
dog, or unless it be upon the premises of another person with the
knowledge. and consent of such person; that a dog or dogs hunting in
company' with a hunter or bhnters .shall be considered as accompanied
by its"owner; (B) Engage in habitual howling or barking or 'to habiutally
annoy any"person other than the owner or person harboring such dog;
(C) Cause damage or destruction to property other than the property
of the -owner or •person harboring such dog; (D) Chas-.e or otherwise
harass any person"In such manner as reasonably to cause intimidation
or 'to put such person .an reasonable apprehension 'of bodily harm or
injury.
Said logal Law further provides that the same shallfbe enforced
by the Dog .Warden; provides for the filing of signed complaints with .
a Torun Justice; provides that a. Town Justice, upon receipt of any
complaint, may summons the alleged owner ' or 'person harboring a dog
to appear in person before him, and if such summons is disregarded,
to issue a warrant for the arrest of such person; 'exeppts Seeing Eye
dogs from the provisions,sof .such 'Law; provides for the seizure 'of dogs
by the Dog Warden; provides that doge may be impomnded and thereafter
redeemed by the owner orhharborer of such dog in accordance with the
Agricultural and Markets Law; provides. that an offense against such
Local Law shall be a violation punishable by a fine not exeeeding
$250.00 or by imprisonment not exceeding. fifteen (15) days, or both'
such fine and imprisonment.

WHEREAS the Southold Ameri6an Legion, Griswold-Terry-Glover Post
#803 has applied to the Town Clerk for a Bingo License, and
WHEREAS the Town Board has examined the application, and diter
inves tigation, duly made findings and determinations as required
by law,
NOW, THEREFORE., BE IT RESOLVED that the Supervisor be and he hereby
is authorized and directed to execute on behalf of the Town Board
the findings and determinations required by law, and it is further
RESOLVED that the Town Clerk be and she hereby is directed to issue
a Bingo License to the Griswold-Terry-Gl•ouer Post. ## 803 American
Legion, Southold, � New. York.

On motion of Councilman Homan, seconded by Justice Suter,
WHEREAS the Southold American Legion Auxiliary, Gttswold-Terry-Glover
Post #$03, Southold, New York has applied to the Town Clerk for a
Bingo License, and
WHEREAS the Town Board has examined the application and after
investigation, duly made findings and determinations as required by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby is '
authorized and directed to execute on behalf of the Town Board of the
Town of Southold the findings and determinations required by law, and
it is further
RESOLVED that the Tawn Clerk be and she hereby is directed to issue_.

Moved by Councilman Homan, seconded by Councilman Rich,
WHEREAS Leander Glover, Jr. has, by written application, applied to
this board for a renewal of his permit to excavate- sand, gravel, stone
or other materials fromfpermises located on the north side of Middle
Road, at .Ctitchogue, New York, and
WHEREAS a public hearing was- held on the original application on
July 139 1971 and the Town Clerk issued a permit as authorized by
resolutions dated October' 26, g971 , August 8, 1972, September 11 , 1973,
and September 24, 1974, subject to the terms and conditions set forth in
said resolutions,
NOW, THEREFORE, BE IT: RESOLVED that the Town Clerk .be' and she hereby
is authorized 'and directed to issue a renewal permit to said Leander
Glover, Jr. for the excavation of sand, gravel, stone, or other materials
from the above described premises for a term of one year, subject to
the same terms and Oonditions set forth in said resolutions of October
26, 1971 , August 8, 1972, Seppember 11 , 1973, and September 34, 1974.

On motion of Justice Demarest, seconded by Justice Suter; it was
RESOLVED that the Southold Town Board accepts'- the resignation, effective
December 31 , 1975, of Henry F. Moisa, Vice-Chatm,= of the Southold
Town Planning' Board; and extends their appreciation and thanks to Mr.
Moisa for his many years of faithful and dedicated service to the Town
of Southold.

On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the Town of Southold enter into a contract with the
Raymond Cleaves Post ¢#861 , American Legion, Mattituck, for the rental
of a justice office, at $1720.00 per year with four:; one-year options,
rent payable annually.-.

On motion of Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to �dy and recommend to the Town
Board the necessary sanitary facilities needed for the town beaches
in 1976.

Councilman James Homan reported on his trip to Hendersonville, North
Caroline (,at his own expense) to shady street lighting at the G.E.
Street Lighting Division. At this location G.E. has a Panorama of
Lights and Hall of Lights showing the various types of lights used
throughout the country. He spent considerable time with the G.E.
..erespresontatives going over what they have to offer for .Southold Town

in street lighting and he has several recommendations for the Board.
Mr. David Driscoll asked if the trip, was not at the invitation of
the General Electric Company?---Councilman Homan answered that General
Electric had a symposium on,November 6,7,8„ at which people were
invited and they would pay for the meals and transportation from the
airport; the towns were to pay the transportation down and motel room:;
He was unable to go at that time.
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that a recess be taken at 4: 25 P.M. , meeting to' jteconvene
following the public hearings at (7; 30 and 8:00 P.M.

RESOLVED that the following audited bills .be approved for payment;
General Fund bills in the amount of $38,561 .86; •Highway Department
bills in the amount of $23,689.05 Fishers Island .Ferry bills in
in the amount of $20, 308.57; Special District Fund bills in the amount
of $310.'62; arid Federal Revenue Sharing Fund bills in the amount of
$810.00

WHEREAS Michael F. Colattto applied to the Southold Town Board for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated June 18, g975, and
WHEREAS the said application was referred to the Southold Town Board of
Trustees and the Southold Town Conservation Advisory Council for
their findings and recommendations, and
WHERE a public hearing was held by the Town Board with respect to
said applicationccn the 18th day of November 1975, at which time all
interested persons weregiven an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED _thet Michael F. Colavito,. 198 Derby
Street, East Williston, New York, be granted a permit under the
provisions of the Wetland Ordinance of the Town of Southold on his
application no. 23 forconstruct a bulkhead at the end of a dredged
canal off Bayview Road, on. Corey Creek, Southold, New York.

WHEREAS Michael F. Colavito applied. to the Southold Town Board for a
Permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated March 27-, 1975, and
WHEREAS the said application was referred to .the Southold Town Board
of Town Trustees and the Southold Town Conservation Advisory Council
for their findings and recommendations, -and
WHEREAS a public haering was held by the Town Board with respect to
said application on the 18th of November 1975, at which time all
interested persons were given an opportunity to be heard, and
WHEREAS this .Board has thereafter examined all statements and
documents submitted with respect to such application and has also
visited the premises in question and is therefore familiar with theO
permises and the affects upon the same which would result by reason
of the granting of said application,
NOW, THEREFORE, BE IT RESOLVED that wetland application #22 of Michael
F. Colavito to fill his property to the southerb property line
is DENIED in all respects as tl�efill would result 'in the complete
elimination of a natural drainage area, and ,disturb the natural
ecmlogy of that area..
