Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James Homan Justice Martin Suter Justice Louis M. Demarest Town Attorney Robert W. Tasker' Highway Superintendent Raymond C. Dean Town Clerk Judith T. Boken Absent: Councilman flames H. Rich, Jr. (death in the familyQ Justice Francais T. Doyen(enroute to this °uneeting from Fishers Island) On motion of Councilman Homan, seconded by Justice Demarest, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3: 00 P.M. , Tuesday, November 18, 1975 at the Town Board meeting room, 16 South Steeet, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman H6m:an, Justice Suter, Justice Demarest. This resolution was declared. duly adopted. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that this town board meeting recess at 3: 02 P.M. for the purpose of holding the budget hearing. ` ,Meeting to reconvene following said hearing. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. (Justice Doyen arrived shortly after the budget hearing began) On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the budget hearing be recessed at 4: 30 P.M. , to reconvene at 8:00 P.M. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This Southold Town Board meeting reconvened at 4: 35 P.M. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the reports of the Building Department, Justice Suter, Supervisor Martocchia, Town Clerk Boken be accepted and placed on file. Vote of the Town Board: Ayes: Supiervisor Martocchia,' Councilman Homan, Justice Suter,,, Justice Demarest, Justice Doyen. This resolilati6n was declared duly adopted. . Supervisor Martocchia reported: 1: Rec.bppt of a petition from over 50 concerned citizens of Southold requestin that a police officer be stationed in front of the post office. There is a police officer there most of the time) . The letter will be referred to'i-the police department for study and recommendation. 2. Letter from Sacred Heart School, Cutchogue, requesting a slide presentation of the bicentennial: r - 3. Receipt of a letter from County Executive Klein confirming the appointment of.Magdaline Goodrich as historian, and placing her name on the County Bicentennail Committee. 4. . Letter from the Long Island Cablevdsion Corp. stating they have received permission from the Federal Communications Commission fDV the construction of a microwave system which will be a major improvement of their reception of signals to their antenna site, which is passed on to the subscribers. The microwave system will be fully operational by March 1 , 1976. . They also received a certificate '350 N0V 61975' of liability insurance issued by the Allstate Insurance Co. to the Times MirrorCCompany and Long Island Cablevision Corporation. 5. Letter from the Mqttituck-Cutchogue Little League stating they have divided the groups, as they were getting too large; and would like to be included in the town funding for 1976. 6. Letter from the Suffolk County Department of Public Works confirming the discontinuance of the plan to dredge Petes Neck at Orient. 7. Considerable correspondence from Assemblyman 'Duryea' s office relative to the Long Island Lighting Company demand charges. The East End Supervisor's will meet on November 12, 1975 at 10:30 AM at Brasby' s in Aquebogue with representatives of the LILCO to further discuss the demand charges. 8. Letter from the Suffolk County Department of Fire Safety indicating the term of 'office has expired for the two Fishers Island deputy fire coordinators. Since one of the present coordinators is no longer a resident of New York State, the Board will ask Fire Chief Wall to make his recommendations. �. Letter from Cedar Beach Park Association expressing dis- approval of a possible radio tower in their area; whereas Mr. Joseph Sullivan has received permission for such a tower. The letter will be referred to the Southold Town Board of Appeals. 10. Letter from the New York State Department of Civil Service approving employment of retired radio operator William Allen whose total earnings may not exceed $2,400.00 per year. On motion of Justice Doyen, seconded by 'lTustice Suter, it was RESOLVED that the Southold :Town Board approves the action of' -the Fishers Island Ferry District in appointing Phyliss Griffin, effective November 3, 1975, at $3.20 per hour, to substitute for Mrs. Ione Horton while she is on leave of absence. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. P On motion of Councilman Homan, seconded by Justice Doyen, it was RESOLVED that $13,000.00 of the Fishers Island Ferry District buildings account funds be transferred to the Fishers Island Ferry District operation of the ferry account. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman ' Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Doyen, it was RESOLVED that $770.00 be transferred from the Fishers Island Ferry District bonded indebtedness account to the Fishers Island Ferry District office account. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Demarest, it was RESOLVED that $300.00 be transferred from the Fishers Island Ferry District state retirement account to Fishers Island Ferry District accounting. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED- that the following resolution adopted by the Southold Town Board on October 28-, 1975-,be rescinded: "On motion of Councilman Rich, seconded by Justice Demarest, it was RESOLVED that t public hearing will be held by the Southold Town Board at the Supervisor' s Office, 16 South Street, Greenport, New York, at 7:30 P.M. November 18, 1975, in the matter of the application ofPierce Yacht Basin, Inc. for a permit under the provisions of the Wetland Ordinance of the Town of Southold for the purpose of dredging to a depth of 6 feet below mean low water, bulkheading, and installing piles to provide 38 additional slips for sailboats, at the Pierce Yacht Basin, Manhasset Avenue and Beach Road, on Stirling Basin, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, NQV , 61975 3 l Councilman Homan, Justice Suter, Justice Dmearest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Homan , it was RESOLVED that the .following resolution adopted by the Southold Town Board on 0&tober 28, 1975 be rescinded: "On motion of Justice Demarest, seconded by Councilman Richmp it was RESOLVED that a public hearing will be held by the Southold Town Board at the Supervisor' s Office, 16 South' Street, Greenport, New York, at 8:00 P.M. , November 18. 1975 in the matter of the application of Gus X. Hartofelisaand John Giannaris for permission to establish and operate a tourist camp on the north side of Main Road, East Marion, property bounded north by land .of Island' s End Golf and Country Club, Inc. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the application of Minnie Wilson for a single trailer renewal on her property on the crest side of private road, off the north side of Middle Road (CR27) Cutchogue, New York, be and hereby is granted for a period of six (6� months. Vote of the Town Board: Ayes: Supervisor' Martocchia, Councilman Homan; Justice Suter, Justice. Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Doyen, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in entering into an agreement with William J. Faulkner for the rental of the easterly half of building no. 383 located south of Whistler Avenue, and known as Fishers Island Airport, for the term of one year from January 1 , 1976 thvuug,13 December 31 , 19%, at the annual rent' of $1 ,200.00; to be. paid quarterly; with two one year renewals. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice ,Doyen. This resolution was declared dulyaadopted. Justice Doyen mentioned the application of the town crew on Fishers Island for taking care of the dump; and upon approval of the F.A.A. - the use of the gun pits on the town property for the town to have as a dumping site for non-burnable materials.--- The matter will be discussed with Town Attorney Tasker. Questions from the audience: Mrs. Gkadys Caajko asked when the dog pound will be ready?--- Councilman ,Homan and Supervisor Martocchia stated there are still some adjustments to be made', such as cages, doors to be adjusted, fix the air conditioners and heaters. They cannot accept the pound as complete until everything is in good working order according to the specifications. The contractor has fixed the air conditioning and heaters--but the cages must be corrected. Mrs. Csajko again asked about the public notice of 'the Southold School vote, brought before the Board at the last meeting by Mrs. Lytle. Mrs. Csajko feels this .might lead to a faulty hearing.--- Town Attorney Tasker stated: The notice is not defective; what you have is dual registration. If you are registered under the general election with the Board of Elections, you can vote in the .school election. If you are registered in the school district and not a general registered voter, you can vote. If you are not registered in either place you can't vote. Therefore,_ a person presently, who is not registered in .either. place, the school district, before it holds its election, has to provide for registration. This is what the notice is .for - thos'e persons who are not registe ed in either place now. --The Town of Southold does not have anything to do with .the legal notice, nort.the vote. Supervisor Martocchia stated that in regard to -the letter read by Dr. Shahan relative to a leash law, at the last meeting, the board discussed it lightly but there -are two members of the board missing, and it will be discussed again prior to the board' s next meeting. Mr. .William Pell asked when would be the best time and where could a person see the reports the Town Board accepted at this meeting. --- Supervisor Martocchia stated they are on file in the Town Clerk' s Office and may be seen Monday through Friday from 9AM to 4PM. The same question was asked relative to the schedule of bills .-- The bills. are in Greenport and the schedule is. in Southold. On motion of .Councilman Homan, seconded by Justice Demarestf). it was RESOLVED that -this* Southold Town Board meeting be recessed at 4:45 P.M. ,' for the purpose of auditing -the bills, to reconvene at 5: 30P.M. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Meeting reconvened at 5: 30 P.M. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the following audited bills b:e approved for payment; General Fund bills in the amount. of $27,346.63; Highway bills in the amount of $35,447.76; Fishers Island Ferry District bills in the amount of $21 ,463.07; and Special District bells in the amount of $1 ,486.38 Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice 'Suter, JusticeDDemarest, Justice Doyen. This ,resolution was declared duly adopted. On motion of. Justice Suter, seconded by Justice Demarest, it was RESOLVED that there being no further to . come before this Town Board meeting, "said meeting be adjourned at 5:35 P.M.
