(631) 765-1809 }(� Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 20,2025 ZBA FILE: #8069 NAME OF APPLICANT: Town Creek Real Estate Inc./Michael Liegey PROPERTY LOCATION: 480 Ackerly Pond Lane, Southold,NY SCTM No. 1000-69-3-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 10, 2025. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The LWRP Coordinator also commented that while the location of the pool relative to the wetlands is consistent with the policies of the LWRP,the location of the pool with respect to the zoning is not. "Policy 1 is to foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure; makes beneficial use of a coastal location and minimizes adverse effects of development. The Proposal is out of character with the community and does not minimize adverse effects of development. The pool is proposed in the side yard only 15' from the street...Similar to the subject parcel,the neighboring lots on either side have houses close to the road due to the headwater of Jockey Creek running through the back of-the parcels, but neither parcel has a pool. To minimize the potential adverse effect of this)development of the pool, and thus be able to find this action consistent with the LWRP, consider the following options: 1. Remove the pool entirely... If the Board is inclined to give a variance, reducing the size of the pool and reducing the area that is fenced in around the pool could be an option." The Board has determined that the placement of the swimming pool complies with the standards set forth by the Town of Southold Board of Trustees relative to the wetlands, and therefore, is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 32,440 square foot parcel located in an R-40 Zoning District. The property has a road frontage along Ackerly Pond Road of 240.02 feet, it then turns northeast for 115.72 feet where it crosses into freshwater wetlands,then turns southeast for 270.1 feet before returning 150.22 feet back to Ackerly Pond Road. The property is improved with an existing two-story residence with a covered front porch and an attached one-story garage as shown on survey prepared by Donald J. Metzger last revised November 10, 2025. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's July 11, 2025, Notice of Disapproval based on an application for a permit to legalize an "as built" accessory swimming pool; at: 1) located in other than the code permitted rear yard; located at: 480 Ackerly Pond Lane, Southold,NY. SCTM No. 1000-69-3-13. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built"pool that is located in a side yard, where a rear yard location is required. ADDITIONAL INFORMATION: At the public hearing, testimony was given by the owner that the pool is technically not"as-built",but a fiberglass pool that is currently being stored on the site prior to installation. The pool has received a Southold Town Trustees permit,#10860, dated October 15, 2025, for the current proposed location. On November 12, 2025, the applicant submitted an amended survey last revised November 10, 2025 indicating lot coverage calculations and locations of the pool equipment and dry wells,pursuant to the Board's request. On November 2, 2025 the Board received written comments from two neighbors of the property expressing opposition to the proposed pool. On November 6,2025 the Board received written comments from another neighbor of the property expressing opposition to the proposed pool FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is comprised of lots of different shapes and sizes, with none being consistent throughout. The property in question is a narrow lot backing up to wetlands and is elevated well above the grade of the road. The proposed side yard location for a pool,with proper landscape screening along the road frontage, will not be visible to passersby and will not create a change to the character of the neighborhood. The Southold LWRP report states that the pool is consistent with Town policies in relation to the wetlands, and this Board finds that the side yard location will not create any undue change on the character of this neighborhood. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the lot backing up to wetlands, there is no place in Page 3,November 20,2025 #8069,Town Creek Real Estate/Michael Liegey SCTM No. 1000-69-3-13 the allowable rear yard for locating a pool. The proposed pool meets all the setback requirements in the bulk schedule, and with the exception of the side yard location is in full compliance with the Code. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100% relief from the code. However,due to the fact that it has already received Board of Trustees approval(permit#10860)and the fact that the LWRP says it is consistent with the intent of the wetland setbacks,a variance in this instance would be the least non-conformity needed for the owner to have an accessory swimming pool. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this Board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect, and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate enable the applicant to enjoy the benefit of an accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to GRANT the variance as applied for and shown on the survey drawn by Donald J. Metzger, LLS, last revised November 10, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Evergreen screening shall be planted and continuously maintained along the entire road frontage of Ackerly Pond Road. 2. Pool pump equipmendmechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure landward of the dwelling and with a lot line set back that is in conformance with the bulk schedule for accessory structures. 3. Drywell for pool de-watering shall be installed. 4. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 5. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of Occupancy in the time allotted. 6. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. To minimize the potential adverse effects of this development of the pool, and thus be able to find this action consistent with the LWRP, consider the following options: 1. Remove the pool entirely. Construction of the pool was begun without a permit. The applicant has applied for permits in the past including on this parcel, and should have been aware that the pool would require a building permit, a wetland permit, would not be permitted in the side yard and 15' from the street without significant variances. 2. If the Board is inclined to give a variance, reducing the size of the pool and reducing the area that is fenced in around the pool could be an option. We oppose the Board approving this application on the grounds it is 1) not "as-built" ; 2) a self- created hardship; and 3) not the minimum relief required for the developer to make a return on the property. 1) Not An As-Built Use: Prior to and during construction, the developer stored unsafely a trailer and a fiberglass pool form on the side and back of the site. We submitted a complaint to the Town at one point since the pool was stored above-ground and was filled with rainwater making it a drowning hazard for children and animals. The developer flipped the pool on its side and continued storing it there for over 2 years. During a 2022 Town Trustees hearing, a pool was never brought to the Trustees' attention. The pool is clearly not as built. We understand approvals are decades old. Given today's more stringent zoning, building and environmental rules, this property would have never been permitted to be built. While finishing construction, the builder violated the rear non-disturbance buffer and now wants to do the same on the north side of the property. This use is only a few feet from the road and exacerbates an unsafe pedestrian experience. The proposed in-ground pool illegally so close to the road will only disturb the bucolic setting of one of the most beautiful and historic roads in Southold. There are public beaches just a few blocks away. I request the town of Southold reject the variance for this pool.
