Trust PROPERTY LOCATION: 825 Munn Lane, Orient, NY SCTM: 1000-17-2-7.1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject irregular-shaped, conforming, 59,317 square feet, 1.359 acre parcel located in the R40 Zoning District measures 156.00 feet along the Terry Hill Cemetery (now or formerly belonging to the Oysterponds Historical Society),then runs east 96.16 feet along a residential (developed) lot to the north, then runs northwest 72.85 feet along the same parcel to the west and then continues northeast 109.58 feet, along the same lot,then returns southeast 148.80 feet and continues 98.76 feet and 41.95 feet along another developed residential lot to the northeast and follows southwest 50.00 feet, 79.87 feet, 39.20 feet along a park area to the east, then returns northwest 48.75 feet,and then runs west 140.76 feet to the point of origin,along a residentially developed lot to the south. The site is improved with a two-story frame house with a covered entry, an attached screened-in porch, a small attached wood deck, brick paver walkways, a small frame shed (12 feet by 8.5 feet) located north of the residence, a small plastic enclosed portable greenhouse (11.6 feet by 8.5 feet) located west of the residence, an in-ground pool with stone terrace(subject of this application)measuring 18 feet by 36 feet and a frame shed(subject of this application) measuring 12.4 feet by 8.4 feet with attached wood platform deck measuring 12.4 feet by 6 feet (subject of this application),all located to the south of the residence's front yard,pool area fencing,a small fish pond, multiple stockade fences a crushed stone driveway and multiple right of ways bisecting the property, as illustrated on the survey prepared by Nathan Taft Corwin, III, Licensed Land Surveyor, and last revised March 12,2025. BASIS OF APPLICATION: Request fora Variance from Article III, Section 280-15 and the Building Inspector's July 10,2025 Notice of Disapproval based on an application for a permit to legalize an"as built"accessory in-ground swimming pool and an "as built" accessory shed with an attached deck; at: 1) both structures are located in an area other than the code required rear yard; located at: 825 Munn Lane, Orient,NY. SCTM No. 1000-17-2-7.1. Page 2,November 20,2025 98050, Rowsom SCTM No. 1000-17-2-7.1 RELIEF REQUESTED: The applicant requests variances to recognize the `as built' improvements of an in-ground swimming pool measuring 18 feet by 36 feet, a storage shed measuring 12.4 feet by 8.4 feet, and a deck attached to the shed measuring 12.4 feet by 6 feet, all in a front yard location where such improvements shall be located in a_ compliant rear-yard. ADDITIONAL INFORMATION: The applicant provided a schematic of the `as built' pool design, labeled S-1,and the `as built' shed,labeled S-2,prepared by Louis G. Schwartz,Licensed Professional Engineer,dated.July 15,2025. Improvements on the subject parcel are covered by Certificate of Occupancy #Z-4111, dated January 14, 1971, covering a private one family dwelling. An open building permit, file #51115 issued August 22, 2024 covers the installation of the `as built' improvement of a generator. In support of their application,the applicant provided the following examples of prior Zoning Board of Appeals relief for a swimming pool located in other than a compliant rear yard location, in the immediate area: #4411 dated September 19, 1996 granting a swimming pool in a front yard location. #5358 dated September 4, 2003 granting a swimming pool to be located in a partial side yard. #6634 dated April 22, 2013 granting alternative relief for a swimming pool to be located no closer than 20 feet from a right of way. The applicant's agent informed the Board that the children of the owners are working to settle their parents' estate. During the dissolution of assets, it was discovered that the pool and the shed with attached deck were not covered by a Town of Southold Certificate of Occupancy. The agent further explained that it is believed that the pool was installed in 1972 and that the storage shed is serviced with basic electricity for pool area lighting. Munn Lane (also known as Dexter Lane) is a private right of way that leads from Main Road north and services several homes. The right of way and a second right of way bisect the subject parcel which has steep shifts in the natural terrain. Area homes are sited to take advantage of the natural geography and benefit of the area's coastline. As the result of an earlier lot line modification, a right of way was extinguished,which at the time of the installation of the pool may have influenced its placement. No member of the public or immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel and the various right of ways that lead to it and other neighboring parcels in this waterfront community were established long before zoning was adopted by the Town of Southold. Given the site's natural terrain and coastal geography,the `as built' improvements take advantage of the location and are placed in the only natural, level spot,a shallow hollow in the front yard. As a result of access via the right of way, it is difficult to discern where the front yard actually is and passersby or those using the roadway will not be able to recognize the relief sought which also benefits from mature landscaping and the fact that there is no regularity in anything within the natural or developed environment. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The swimming pool, shed, and attached deck have been Page 3,November 20,2025 #8050, Rowsom SCTM No. 1000-17-2-7.1 located in their present location for over fifty years without any known issue or disturbance and cannot be relocated without substantial and costly effort. Furthermore, based on applicant testimony, the existing right of ways are potentially different from the original descriptions; for example one has been extinguished, and as a result,when the pool was installed,the pool may have been presumed to be located in a compliant location. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for both subject structures. However,the `as built' improvements are located in a`level' hollow located in the front yard, the only logical location to place an in-ground swimming pool and storage shed with attached deck. Several homes in the immediate area have also benefited from Board relief to place an in-ground swimming pool in a front yard location. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool measuring 18 feet by 36 feet and a storage shed with attached deck, all located in a front yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Planamento,seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for,and shown on the survey prepared by Nathan Taft Corwin,III, Licensed Land Surveyor, and last revised March 12, 2025 and the schematic of the `as built' pool design, labeled S-1, and the `as built' shed, labeled S-2,prepared by Louis G. Schwartz, Licensed Professional Engineer, dated July 15,2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 2. Drywell for pool de-watering shall be installed. 3. The applicant shall submit a revised signed and sealed survey or site plan locating both the pool equipment and dry well(s) on subject parcel. 4. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date'of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 5. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of Occupancy in the time allotted. 6. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. 7. The subject shed shall remain unconditioned non-habitable space with only basic electrical service and no plumbing. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year,the Board may require anew application. IMPORTANT LIMITS ON THE APPROVAL(S)GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The benefit sought by the applicant cannot be achieved by some other method feasible for the applicant to pursue, other than the area variance because: When the house was built in 1971 and the pool installed in 1972 there were several right of ways, dirt lanes and gravel driveways. According to the adult children there was a right of way along the north east property line and this is reinforced by a fragment of a survey. (Attachment#2). That right of way no longer exists and there is now a gravel right of way that runs through the subject property on the west side. Munn Lane is referred to as Dexter Rd. a Private Rd. leading to the Main Rd. on the current survey by Nathan Corwin dated May 29, 2024. A copy of this survey is included in the application. All of this is to say that when the prior owners located the swimming pool it was in a different configuration of access roads and they may not have been aware of the legal definition of their front yard at`that time. The topography of the property and the location of the existing residence were, I believe, the reasons for the current location of the swimming pool. 3. The amount of relief requested is not substantial because: The subject property could be considered to have multiple front yards if we include North Lane, Munn Rd., Dexter Rd. and the western right of way but, in its favor, it is located in a neighborhood where the majority of the homes are on large lots and have swimming pools newer and in some cases much more visible. I have attached the Certificates of Occupancy for the properties at 700 Bird's Eye Rd., 900 Bird's Eye Rd.,908 Bird's Eye Rd.,330 Maple Lane, 725 Maple Lane, 495 Maple Lane, 1025 Pvt. Rd. #4 (Munns Lane) and a final CO for property without a street number for"Private ROW Munn Lane (North Lane). These CO's were issued between 1976 and 2015 and the properties at 908 Bird's Eye Lane and 330 Maple Lane received Zoning Board Variances for the locations of the pools. I have attached the ZBA determinations with the CO's for these properties (Attachments # 3 through #10) 4. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. There is no other place for the applicant to locate this pool other than the front yard. However,the pool can be moved to a location that is farther away from the private road. 3. Town Law. 267-b(3)(b)(3) The variance requested therein is mathematically substantial representing 100% relief from the code requirements. However,the property has two front yards and the proposed location is the only flat area on the site that would minimize land disturbance and runoff to the adjacent wetlands. The substantially of the variance will be mitigated by the required landscape plantings which will visually screen the pool from the ROW and adjacent properties. 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance requested in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The.altemative relief granted herein mitigates the privacy concerns of the adjoining neighbors. The applicant will adhere to the town code requirement of storm water management. 5. Town Law&267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 267-b. Grant of alternative relief, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
