As existing, the current residence has a front yard setback of 24.9 feet, a single side yard setback of 5,5 feet to the
garage, and a combined side yard setback of 23 feet. Relative to Gross Floor Area (GFA) the Proposed alterations
conform to the limitations of the code, however, the alterations propose a lot coverage of 22.67%.
Public hearings on this application were held or, April 3, 2025,JUne 5, 2025 (adjourned without a date ill anticipation

hearings, the applicant substantialiy amended their application and also removed various accessory structures from
their site plan and redesigned the aftf-rations to the residence from a two-story home to a one-story ranch-type
structure.

The Zoning Board of Appeals held a public hearing on this application on April 3), 2025, June 5, 20?5. and 10,
2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, p July ersonal

inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the
following facts to be true and relevant and makes the following findings:
1. Town Law 267-b ' I Grant of the variances, as amended, will not produce an undesirable change in the
character of tile neighborhood or a detriment to nearby properties. The Captain Kidd Estates neighborhood is a
community of homes developed on a grid-like plan popular in the mid-20rr' Century. The majority of area homes
were 'built in the '1960�'s through 1990's and are on substandard, less than code conforming lots developed with a
variety of house styles, sizes and amenities, many of which have been updated and modernized, requiring Board
relief. The applicant's home was built in 1960 and added onto with a garage, which the applicant proposes to
attach via a breezeway, along with the addition of a small roofed-over entry porch and a rear sunroom. The
requested relief is in keeping with the community character and will aesthetically update an older home to meet
modern standards with little to no impact discernible to those passing by or using the roadway.

for the applicant to pursue, other-than an area variance. As a result of the initial placement of the existing residence
on the: lot, almost any addition to the home will require some form, of Board relief., As evidenced during the site
inspection and as shown on the survey and the site plans submitted, the existing house has non-conforming front,
side and combined side yard setbacks.
3. T ov+rnu 1Ca 27 b l5 The variances granted herein are mathematically substantial, representing 41.4.5%
relief"from the cede relative to the reduced front yard setback of 20.5 feet; 45% relief from the code relative to the
reduced single side yard setback of 5.5 feet; 3.2% relief from the code relative to the reduced combined side yard
setback of 24.2 feet;and 13.35% relief from the code relative to the excessive lot coverage of 22.67%. However, the
existing horne, as it is presently sited, has similar setbacks and the applicant is not proposing to encroach upon those
setbacks except for the modest addition ofa roof-over entry porch measuring 5 feet by 8 feet, All other setbacks

community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Towns Storm Water Management Code.

Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at tine time of acquisition,
