This correspondence is to address the Positive Declaration issued by the Town of Southold Planning Board on July 9. 2024 (July 2024 Positive Dmo|onaUon)' and the submission of revised plan to address the major components of the proposed project. The proposed action subject to the July 2024 Positive Declaration includes the merging of two tax lots (1000-122-07-1 and 3.2) and site improvements for the purpose of improving the function and aesthetics of the existing gas station and convenience store. A DBB evaluation and process cannot remedy the triangular configuration of the lots, which is resulting in the need for front yard setback variances as well as the increased visibility of the site with the |ot'm hypotenuse along Main Road. With a lot frontage ofG15±feet along Main Road, e maximum lot depth of65.B feet, and Old Main Road bordering the southern parcel boundary, any redevelopment would require e front yard setback. In faot, the existing gas station convenience store does not meet the front yard setback requirement. Also, with o maximum lot depth of 558 feet, the placement of e smaller canopy or canopies perpendicular to Main Road with adequate drive aisles is possible but cannot meet the front yard setback requirement. Also, the impacts to aesthetic resources and community character are identified as potentially significant and adverse; however, seems to ignore the existing viewshed today. Based on the photo simulations of how the site will change upon implementation of the proposed plan, the proposed action clearly improves the view from Main Road.The proposed architecture of the new convenience store is of residential feel and compliments the buildings on the north side of Main Road.Also,the proposed site improvements to curbing, formalized eoomss. and |endacaping, replaces e site devoid of all such features. It is not understood hmw, when comparing to the existing condition to what is proposed, there can be a determination of potential significant adverse visual impacts. Regarding lighting, the Positive Declaration indicates that impacts are likely even if compliance with Town Code is achieved. From the applications already approved by the Planning Boord, including the Southold Gas Station and Convenience Store, it is well documented that lighting design can be modified to eliminate adverse impacts. A lengthy DEIS process is not necessary for desired lighting modifications to be made. Regarding the consistency with Community Plans, the Town Code permits the convenience store in the General Business(B)zoning district with a gas station outside the Hamlet Center. The Positive Declaration states that the ^proposed new construction convenience store portion and appurtenant build-out of the action is likely to result in a large conflict with the community's current plans or goals as specified in the Southold Town Comprehensive Plan (2020)` resulting in potential moderate to large adverse impacts on aesthetics,economics and growth patterns in Mattituck...Southold Town has defined a new direction based on community input to prevent sprawl and direct retail uses within or near the Hamlet Centers. The lot is not located within the Hamlet Center or HALO." (p 3). VVh||e it is recognized that the Plan is the vision, the Town did not implement zoning changes after the adoption of the 2020 Comprehensive Plan. Accordingly, the zoning regulations permit the current use that will continue to exist but in an improved form. Furthermore.the Positive Declaration ignores the fact that e gas station with convenience store has existed on the property for over 60 years. The DEIS evaluation and process will not modify the purpose and intent of the proposed aotion, which is to modernize the existing gas mtetion, improve the functionality of an existing buoinmeo, and to replace the existing complimentary and customary convenience store use tna gas station use. Nqoreover, the replacement ofa one-story, 1.500 8F convenience store with a two-story, 51000 SF convenience store with the entire second floor (2,1100 SF or 42% of the building) to be used for the owner's office is not nstoi| sprawl. The utilization of the second floor as an owner's office has been communicated to the Town in documentation including the Traffic Assessment prepared by Dunn Associates. The narrative elaboration on the inconsistency with the 2020 Comprehensive Plan further states that to convenience store's relocation and expansion could n*au|t in retail sprawl." The project relocates the convenience store from the east side to the south side of the same triangular lot on Main Road and proposes to expand the store by 1.400 SF (from 1'500 SF to 2.900 BF, as the remaining 2.100 SF constitutes the second-floor owners office). (2) The existing nonconforming front yard setback and the triangular configuration of the merged lot makes it physically impossible to meet the front yard setback requirement for any building of usable size. (3) The photo-simulations of the proposed project demonstrate an architectural design that is compatible and complimentary tothe surrounding land ueeo, including the overhead canopy that serves eea weather barrier for the convenience ofpatrons. (4) The proposed improvements to landscaping and access/circulation results in an improvement to an existing gas station and convenience store use that seeks to continue but, in a form, and layout that improves the functionality and aesthetics. (5) The Town Zoning Code permits the convenience store in the General Business (B) zoning district with agaa station outside the Hamlet Center. (G) The Town did not implement any zoning changes after the adoption of the 2020 Comprehensive Plan.Accordingly,while it is recognized that the Plan is the vision, the zoning regulations permit the current use that will continue to exist but in an improved form. (7) As the gas station with convenience store use has existed and operated for over 60 years on this property, the improvements to such uses should not be considered retail sprawl. (B) The convenience store exists in a smaller form and the improvements to same results in an elimination of additional vehicular trips for the goods and products that are customarily bought by gas station patrons and provides a formal office area on the second floor for the business owners. FinaUy, in the absence of a public hearing after the site plan application was deemed comp|ate, it is respectfully submitted that a critical step was eliminated. Moving directly to e lengthy DE|8 process without allowing the applicant to present its plan or receipt of any public comments only delays consideration of the application and desired actions of the applicant for an improved business. Revised Plan In response tothe Positive Declaration and a desire to improve the existing business in o timely manner. the applicant has elected to revise the proposed site design("prior plan")to address the major components of the project. As indicated on the revised site plan, the new design addresses the overhead canopy and the location of the convenience store. Specifically, the overhead canopy has been modified from 152 ft L x 24 ft W to 82 ftLxGOftVV and has been repositioned from the original parallel placement toPWein Road toaperpendicular placement.
