SOUTHOLD TOWN BOARD MINUTES
Meeting of September 8, 11 , 1975
A regular meeting of the Southold Town Board was held on Monday,
September 8, 1975 at the town board meeting room, 16 South Street,
Greenport, New York. Supervisor Martocchia opened the meeting at
9:00 A.M. with the following present:

On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the following audited bills be approved for payment:
General Fund $31 ,401 .89; Highway $16,751 .97; Fishers Island Ferry
District $28,006. 17; Special Districts $7,439. 12; Federal Revenue
Sharing Fund $1 ,026.57.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich; Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that this meeting be recessed at 10:00 A.M. , to reconvene
at 3:00 P.M. , Thursday, September 11 , 1975 at the town board meeting
room, 16 South Street, Greenport, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice "Suter, Justice Demarest.
This resolution was declared duly adopted.
The Southold Town Board meeting of September 8, 1975 reconvened
at 3:00 P.M. , Thursday, September 11 , 1975. Supervisor Martocchia
called the meeting to order with the following present:

On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the minutes of the Southold Town Board meetings of
August 20, 1975 and August 26, 1975 be and hereby are approved as
submitted.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.
This- resolution was declared duly adopted.
On motion of Councilman Rich, seconded by Justice Suter, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M. , Tuesday, September 23, 1975 at the town
board meeting room, 16 South Street, Greenport, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.

Supervisor Martocchia reported the following:
1 . Receipt of a letter from the Greenport Village Planning
Board relative to proposed dredging by Pierce Yacht Basin, stating
(1 ) Careful consideration be given to possible violation of the
Southold Town and New York State wetland ordinances; (2) That the
proposed dredging does occur in part within the boundary of the
Village of Greenport, and they strongly urge that no further
encroachment upon the uplands be allowed.
2. Rec.bppt of a letter from the Southold Town Trustees
relative to the application of A.B. Rosenberg to dredge his
property at Sterling Basin, Greenport. The Trustees advise that
Mr. Rosenberg has applied to the U.S. Corps of, Army Engineers-
to excavate 800 yards, and his application- to the Town Trustees
states 350-400 yards will be excavated. The Trustees have
registered their objections with the Army Engineers; and further
question whether this might also be a violation of the Zoning
Ordinance.
3.Receipt of applications to the Corps of Army Engineers to
dredge the mouth of Petes Neck (objection date October 9) ; Downs
Creek (objection date October 9) , and West Creek (objection date
October 6. )
4. Letter from Virginia Tabor, school crossing guard,
relative to a problem at the Orient school crossing. The matter
has been referred to the Orient Board.- of Education for study.
5. Letter from Cynthia Pirillo protesting the traffic problem
at the Greenport school crossing. The matter will be referred to
the police .department.
6. Letter from Cleaves Point Association reporting the
deterioration of the bulkhead tt '.the inlet to Gull. Pond, causing
the fill to fall into the channel. The matter has.- been referred
to Highway Superintendent Dean for study and recommendation.
7. Letter from the Suffolk County Department of Health
Services advising they are having a program on community mental
health. The board will. ask Mr. John Appelt, President of the
Eastern Long Island Hospital to send a rrepresentative to the
meeting which willlbe held Tuesday, September 29, 1975 at 2.:00
P.M. , at the Suffolk County Center, Riverhead,
8. Letter from the Civil Service Employees Association
requesting an' appointment to discuss their 1976 salary with
Supervisor Mar:tocchia. and Councilman Rich.
9. Letter from the New Yotk State Department of Transport-
ation stating that. on September 19, . 1975, during National Transport-
ation Week (Sept. -22- Sept. 2.6) ' they will be heldigg an art show
at the State Office Building, Hauppauge; and on September 24
there will be a meeting of all elected officials to update their
knowledge of the services provided by the Department of
Transportation.
10. The Town is still looking for a Town Historian, Salary
$1 ,800.00
A member of the audience asked how the town could
get someone for such a -small salary, and Supervisor
Martocchia advised that ,the job consists of a relatively
few hours work. The town has hired another individual
to catalogue the material on hand, and it will also be
microfilmed. -- Mrs. Gladys Casjko asked what objection
the Town. Board has to Mr'. Walter Goebel, Supervisor
Martocchia advised' he 'has interviewed Mr. Goebel, but
would like the opportunity to interview other. applicants.,
11 . Receipt of a letter from County Executive Klein relative
to q request from the Fishers Island Ferry District for subsidy
for the ferry rates. Mr. Klein states that it is out of the
question this year as it is too late for this years funds, but
possibly next year.
12. Letter from the Fishers Island Fire Department
commending the two town constables on Fishers Island for their
fine work at a recent "Beer Festival" .
13. Announced a proclamation to be placed in the newspapers
this week, proclaiming October as Oyster'Festival Month. . The
Festival is to be held October 11 , 1975 at the Greenport Legion
Hall.

On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that $2,000.00 be transferred from the Fishers Island Ferry
District Theatre Account to the Airport Account.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Councilman Rich, seconded by Justice Demarest, it was
RESOLVED that the Fishers Island :Ferry District be granted permission
to advertise for bids for the 'haulout and. repairs of the ferry boars
Olinda and Mystic Isle, and the advertisements shoald be placed in
the local papers, and the Greenport Shipyard to be notiff ed.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, anstielb Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Justice Demarest,
WHEREAS the Marian Council Knights .of Columbus, Cutchogue, New York
has applied to the Town 'Clerk for a Bingo License, and
WHEREAS the.: Town Board has examined the application and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE; BE IT RESOLVED that the Supervisor be and he
hereby is authorized and directed to execute on behalf of the
Town Board the findings and determinations required by law, and
it is further
RESOLVED that the Town Clerk be and she hereby is directed to
issue a Bingo License to the Marian Council #3852, Knights of
Columbus, Cutchogue, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
.Rich, Justice Suter, Justice Demarest.
On motion of Justice Suter, •seconded by Councilman Rich,
WHEREAS Florence Steiner has applied, to the Town Board for a single
trailer renewal permit dated September 6, 1975,
NOW, THEREFORE, BE IT RESOLVED that the application of Florence
Steiner to locate a single trailer on her property on private road
(John' s 'Road) , off the east side Main Road, Mattituck, New York
be renewed for a period of six (6) months.
Vote of the .Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded' Ly Justice Demarest,
WHEREAS John C. Tuthill has applied to the Twon Board for a single
trailer renewal permit dated August 22, 1975,
NOW, THEREFORE, BE IT RESOLVED that the application of John C.
Tuthill to locate a single trailer on his own property on the east
side of. Elijah' s' Lane, Mattituck, New York, be renewed for six (6)
months. '
Vote of the Born Board: Ayesl Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demareat.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Councilman Rich,
WHEREAS. Sophie T. Saunders has applied to the Town Board for a
single trailer renewal permit dated September 2, 1975,
NOW,THEREFORE, BE IT RESOLVED that -the application of Sophie
T. Saunders to locate a single trailer on her property on the
north side of Main Road, Laurel, New York, be renewed for a
period of six (6) months.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
Supervisor Martocchia asked if anyone wished. to address the Board.
Question: Has the Town, County, of State changed the method of
bidding on the dredging projects (referred to .Hames Creek)?
Supervisor Martocchia stated that he is not aware of such a change.
He understood the dredging was approved at James Creek; but will
call the County following' the meeting to determine what is being done.
Question: Why has the dog ,pofnd not opened, when will it open,
and who will run it?
Supervisor Martocchia and Councilman Rich stated that Highway

Superintendent Dean has stated he is going to give the contractor
a deadline. The contractor has changed locations since taking the
bid, which has caused a 12 month delay.. -- one of the cages is at
the site, and the slab has been put in for the runs.
Question: Mr. David Driscoll commented on the dog. pound delay and
then questioned the damaged office trailer the town went to
bid on.
Supervisor Martocchia stated. that it is damaged, but the company
has asked for the opportunity to repair it; then the Town Board
will decide whether it is satisfactory and if they should accept
the trailer.
Question: Mr. Driscoll asked the Town Board whether they are
satisfied with the enforcement of the justices, the police
committee, or pplice department.
Councilman Rich stated that the Town Justices are elected by the
people, they attend seminars, are well trained and are fair in
their decisions, evaluate each case, and the board is completely
satisfied and would not try to change them or -influence them.
As for the police department, they are constantly working to better
the department, however the board is of the opinion the police
department is in good shape. Justice Demarest further commented
on this subject, citing recent justice court cases.
Question: Mrs. Gladys Csajko asked whether the town has considered
condemning the property near the Goose Creek Bridge.
Supervisor Martocchia stated that the town is presently being
sued by the owner of that property, and had not considered
condemnation.
Question: Mr. Driscoll asked how many times the Town Planning
G Board recommended as a desirable site for the purpose applied
for, the property on Queen Street, Greenport.
Councilman .Rich stated that the Planning Board made their
recommendation to the Town Board only once, prior to the public
hearing.
Mr. Driscoll then referred to a letter dated March 10, 1975
in which the Southold Town Planning Board wrote to the Suffolk
County Planning Commission stating they "again recommend. "
Supervisor Martocchia stated that there might have been two
recommendations to the County prior to the public hearing, due to
the question of sewage facilities.
On motion of Councilman Rich, seconded by Justice Demarest, it was
RESOLVED that the August reports of Justice Suter, Supervisor
Martocchia, Town Clerk Boken and the Building Department be accepted
and placed on file.
Vote of the. Town Board: Ayes: Supervisor Martocchia, -Councilman
Rich, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
Supervisor Martocchia asked if anyone else wished to be heard.
There was no response.
On motion of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that there being no further business to come before this
town. board meeting tha adjournment be called at 4: 30 P.M.

Rich, Justice Suter, Justice Demarest.
