HomeMy WebLinkAboutTB-08/26/1975 u,G�..2.0975 SOUTHOLD TOWN BOARD MINUTES Meeting of August 26, 1975 A regular meeting of the Southold Town Board was held on Tuesday, August 26, 1975 at the Town Board meeting room, 16 South-.Street, Greenport, New York. Supervisor Martocchia called the meeting to order at 3:00 p.m. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James F. Homan Justice Martin Suter Justice Louis M. Demarest Town Attorney Robert W. Tasker - Highway Superintendent Raymond C. Dean Town Clerk Judith T. Boken Absent: Justice Francis T. Doyen On motion of Councilman Rich, seconded by Justice Suter, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at the Town Board meeting room, 16 South Street, Greenport, New York, at 9:00 a.m. , Monday, September 8, 1975 for the purpose of auditing bills. The meeting will then be recessed to 3:00 p.m. , Thursday, September 11, 1975. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: 1. This past weekend there had been considerable vandalism at town beaches - Gull Pond, Town Beach and Kenney' s Beach. The beaches are heavily patrolled by about nine -policemen up to 1:00 a.m. , therefor, the damage must be taking place after 1:00 a.m. Offenders will be heavily prosecuted if caught. This vandalism is causing a heavy burden on the taxpayers of Southold Town. 2. The dog pound should be completed this week, based on the reports of the construction people. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the bill of the Greenport Ice Company in the amount of $49.00 and the bills of Eric S. Tyrer in the amount of $205.00 and $467.32 for- expenses of the Fishers Island trip and dedication of the S. Wentworth Horton park be and hereby are ordered paid. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked if anyone wished to address the Board. Ms. Sherley Katz asked for a detailed account of the vandalism at town beaches. Gull Pond: Smashed the entry booth, smashed the fence where fishing is done, broke benches and threw them in the creek, threw garbage cans into the canal. Town Beach: Broke swings and seesaws were broken in half. Kenney' s Beach: Cut the life lines in the protected area, knocked over the life guard station. Mrs. Gladys Csajko questioned an article in Newsday which stated the bay constables do not have jurisdiction in Nassau and Suffolk. She stated that under Town Law, Southold Town can regulate the vessels up to 1500 feet from shore. Mrs. Csajko asked who actually owns the water after 1500 feet from shore, and is there any way the town can apply to get jurisdiction if `Ak2'.91975 we do not have. The Town Board members and Town Attorney Tasker explained .that the State of New York owns the water below highwater mark. As to the state law, it provides certain regulations as to boaters on navigable waters. Under this state law the definition of navigable waters is all of the waters, lakes and so forth of the State, and Atlantic Ocean and waters tributary thereto except the waters surrounding Nassau and Suffolk Counties. Therefore, we have not bee in navigable waters, so the towns have enacted their own waterway ordinances as to the operation of boats. If the New York State Legislature removes that exception, it would only mean the Conservation Law applies everywhere. Also, the town bay con- stables, as peace officers, can give out summons beyond the 1500 limit. In -effect, the Newsday article is basically in error and misleading to the public. Supervisor Martocchia asked if anyone else wished to address the Board. No° response. He then reported- the following: 1. Receipt of a letter from Mr. Don Arcuri, a property owner next to the Horton Point park. He is concerned about the park district closing the park on weekends due to destruct- ion, overcrowding and .pollution. The area is heavily patrolled by the police and tickets are issued. Mr. Arcuri feels every- one should be barred from the area, but that would not be possible. . 2. Application to the Corps of Army Engineers by A. B. Rosenberg for permission to dredge an- area 260 feet by 100 feet, removing approximately 800 cubic yards of fill to a. 4 foot level at his property on Sterling Creek, corner of Robinson Road and, Champlin Place, Greenport. Final date for filing objections is September 12, 1975. 3. Letter from the Southold Town Planning Board supporting the Building Department and Board of Appeals' request for adoption of an ordinance to control portable signs. The matter is being studied'. 4. Receipt of an environmental impact questionnaire to be completed for the County of Suffolk- relative to the HUD program, -where money is being allocated to the Town of Southold for the proposed senior citizen-youth building and land. 5. Receipt of a report from,-the Chief. of Police for the status of the time-off he has due. The report has not .been- reviewed as yet.- ,6. -Receipt- of a , notice ) from the Civil Service Department reporting a precedent setting case whereby if the Civil Service Department of Suffolk County does not approve some of the personnel on the payroll, they -will serve the town with one notice of disapproval, if. payment is continued, each member of the Town Board will be fined $100.00. T., Receipt of a decision from the Civil Service Department placing Ione Norton in a non-competitive class as secretary to the Fishers Island Ferry District. 8'. '. Letter from Ronald Lajda, Cutchogue, protesting the manner of control of the launching ramp at New Suffolk. He is a resident of Southold Town and must wait in line while out-of- towners pay to use the ramp. There seems to beno solution to this problem, as everyone must wait their-turn to use the ramp. On motion of Justice Suter, seconded by Councilman Homan, WHEREAS the Sacred Heart R. C. Church, Cutchogue, New York, has applied .to the Town Clerk for a Bingo License, and WHEREAS the Town Board has examined the application and after investigation, duly made findings and determinations as required by law, 19OW-";_,THBREFORE, BE IT RESOLVED that the Supervisor be and he hereby is authorized and directed to execute on behalf of the TownBoard the findings and determinations required by law, and it is further RESOLVED that the Town Clerk be and she hereby is directed to issue aBingo License to the Sacred Heart R. AUG ., 619T ; On motion of 'Justice Demarest, seconded by Councilman Rich, WHEREAS Oscar Goldin has applied to the Town Board for a single trailer renewal permited dated August 20, 1975, NOW, THEREFORE, BE IT RESOLVED .that the application of Oscar Goldin to locate a single trailer:,on his -property at Lot #60, Greenport Driving Park, south side Linnett Street, Greenport, New York, be and hereby is granted for a period of six (6) months. Vote of. the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest This resolution was -declared duly adopted. On motion of Justice Demarest.; seconded by Justice Suter, it was RESOLVED that $2500.00 be and hereby is transferred from the General Fund Contingent account to. a. new line item for the intervener at the Long Island Lighting Company nuclear plant hearings Vote of the Town Board: Ayes:- Supervisor Martocchia, Councilman Rivh; Councilman-. On motion of Councilman Rich, seconded by Councilman Homan, It wa-s RESOLVED that the following monies be transferred from the General Fund Contingency_ Account to: A7110.2 - Parks, Equipment---------------$1,090.00 A7110.4 -: Parks, Contractual Expenses---- 1,500.00 A5610.4 Airport, Contractual Expenses-- 300.00 A8530.4 - Shellfish---------------------- :2,000.00 Vote of the. Explained that the $2,000.00 transfer to Shellfish is an expenditure for clam transplants which the town must first pay. in the amount, of $4,000..00. However, through a' contract with the State -of York they will match the town' s expenditure, therefore, there will be a .$2,000.00 reimbursement from the State. . - 2., The Town is still looking for a dog enumerator for the area from Orient Point through Greenport. Fee is 500 per dog and puppy. 3. - Receipt of a.:petition from the Mattituck Grand Avenue bridge area. They would like to have 'the abuttments taken down from the old bridge as; they are a navigational hazard. The petition was referred to Highway Superintendent Dean with a request that he contact the County of ' Suffolk for their study. Justice Suter stated that there was a larger petition a year ago requesting that- one of the:_abuttments remain as a fishing bridge.
