Supervisor Albert M. Martocchia called the meeting to order with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James F. Homan Justice Martin Suter Justice Louis Demarest Justice Francis T. Doyen Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Boken On motion of Councilman Rich, seconded by Justice Suter, it was RESOLVED that the July 29, 1975 minutes of the Southold Town Board meeting be approved and accepted as submitted by the Town Clerk. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the following audited bills be and hereby are ordered paid: General Fund in the amount of $25,796.79; Highway Department in the amount of $32,777.69; Fishers Island Ferry District in the amount of $31,929.17; Federal Revenue Sharing in the amount of $539.72; and Special Districts in the amount of $7,322.19. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Justice Doyen, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 1:00 p.m. , Wednesday, August 20, 1975 at the Fishers Island School, Fishers Island, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia asked if anyone present wished to address the Town Board. Mrs. Gladys Csajko asked for the status of the Rath property that is in litigation, indicating the area at the turn in the road is extremely dangerous. Supervisor Martocchia advised the litigation has to do with an area of encroachment near the Goose Creek Bridge and the town had worked out a survey proposal with Mr. Rath and his attorney, but it was rejected. The matter is still in litigation, however, the Town Board will pursue the matter. Supervisor Martocchia asked if anyone else present wished to address the Board. There was no response. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the July 1975 reports of the Building Department, Justice Suter, Super;ri.§or Martocchia, Town Clerk Boken, Police Department, and Fishers Island Ferry District be accepted and placed on .file. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice AUG f2`1975 Doyen. This resolution was declared duly adopted. Supervisor Martocchia reported the following: 1. Receipt of a thank-you letter from the Nassau Farms Association for a dredging project that the Town of Southold participated in. 2. . Letter from George Wagner, Director of the Southold Historical Society, recommending Mr. Walter Goebel for the position of Southold Town Historian. 3. Report of Jean Tiedke, Southold Town respresentative at the New York State Department of Public Service hearings on the LILCO - Jamesport nuclear plant; and a -list of extended hearing dates up to December 12, 1975. 4. Receipt of a petition from approximately 112 residents of Orient requesting one-patrolman on each of the three work shifts, to patrol only from Dam .Pond Bridge to Orient Point, including Orient Village and side roads. The request is being referred to Chief Cataldo for study of the situation. 5. Notice from the Fishers Island Electric Corp. stating they are increasing their street lighting rates from $40.00 per fixture to $56..00 per fixture effective January 1, 1976. 6. ' Letter from Henry F. Moisa, Secretary of the Southold Town Fire District Officers Association inquiring as to the possible availability of federal revenue sharing funds to be applied to public safety in fire emergencies by the fire districts. The matter is being referred to Town Attorney Tasker for study. Moved by Justice Suter, seconded by Justice Demarest, WHEREAS the Town of Southold has requested the County of Suffolk to dredge a navigation channel in Deep Hole Creek, Town of Southold; and WHEREAS the County of Suffolk proposes to do said dredging of Deep Hole Creek, in the -Town of Southold at a nominal cost to the Town of Southold; and WHEREAS in order to accomplish said dredging, plans, specifi-. cations, agreements and other documents must be executed on behalf of the Town of Southold; now, therefore, be .'it . . RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to execute, on behalf of the Town of Southold, all necessary. plans and specifications, spoil area agreements, assurances to the County of Suffolk, license and/or dredging permit applications to Federal and State agencies and all other documents that may be •required to accomplish said dredging work. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Moved. by Justice Suter, seconded by Justice Demarest,. WHEREAS, the Town of Southold has requested the County of Suffolk to dredge a navigation channel in James Creek, Town--of Southold; and WHEREAS, the County of Suffolk proposes to do said dredging of James Creek, in the Town of Southold at a nominal cost to the Town of Southold; and WHEREAS, in order to accomplish said dredging, plans, specifi- cations, agreements and other documents must be executed on behalf of the Townoof Southold; now, therefore, --be it RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to execute on behalf of the Town of Southold all necessary plans and specifications, spoil area agreements, assurances to the County of Suffolk, license and/or dredging permit applications to Federal and State agencies and all other documents that may be required to accomplish said dredging work. Supervisor Martocchia reported the following:. 1. At Brushes Creek, Laurel, where the Town-has recently completed maintenance dredging of the "channel, the Brushes Creek Owners Association, Inc. have applied to the New York 306 AO•G``I',Z 1975 District, Corps. of Army Engineers for permission to reconstruct a section of an existing rock jetty at the mouth of Brushes Creek by raising it to a height of about two feet above mean highwater mark. Objections. should be filed by 'September 9th. . .2. The. Town Board and. Town Attorney are studying the street lighting problem in Southold Town, pursuing various options that are available, to determine which will be the most economical for the town. A decision should be forthcoming within the next two meetings. 3. . Receipt of a letter from Suffolk County Executive John V.N. Klein in reference to the HUD program whereby the funds have been allocated. to the County of Suffolk ;by the federal government, and Suffolk County will be passing a resolution to accept the funds on August 26th. After that, the. Town of Southold will make- their application, for the purpose specified, to the county for the town' s share, which is $23,760.00 for the first year; three times that. amount . for. the second_ year, and three times the amount of the first year for the third year. 4. On Saturday, ' August 23, 1975 at 3:,30 p.m. the Southold Town Officials. will dedicate. a park on Route 25, West Greenport, in memory of and tribute to the late former State Senator and former Southold Town Supervisor Schuyler Wentworth Horton. Many state and county officials have been invited, as well as fire departments, senior citizens and all the ' people of Southold Town. 'Senator Leon Guiffreda will be. the keynote speaker. On motion of Councilman Homan, seconded by Councilman Rich, it -was RESOLVED that -the Superintendent of Highways of the Town of Southold be and he hereby is .authorized to advertise for bids and to purchase from the lowest responsible bidder, as much as needed, Cationic Slurry Seal Type II. . Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Mrs. Gladys Csajko and Mrs. Sherley Katz asked for a definition of Cationic Slurry Seal Type II. Highway Superintendent Raymond Dean explained that. it is' a road sealer and is skid resistant, much the same as blacktop, but is less expensive and has proven highly satisfactory in areas of the town where it has been used as an experiment. Mr. David Driscoll asked what the limitation of amount ordered would be, since the bid states "as much as needed" . Superintendent Dean explained that it is difficult to set a specific amount as the product is ordered by the square yard. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Southold Town Board accept a savings account bank book in the name of Lefferts P. Edson, account no. 010-15542 2, in the amount of $90,000.00 as a performance bond for roads and improvements in the subdivision. of "Crown Land Lane" , Cutchogue, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared. duly adopted.. On motion of Justice Suter, seconded by Councilman Rich, WHEREAS W. Edgar Worthington has applied to the Town Board for a single-trailer renewal permit .dated August 5, 1975, NOW, THEREFORE, BE IT RESOLVED that the application of W. Edgar Worthington to locate a single trailer on his property on the south side Sound -Avenue, Mattituck, New York, be renewed for six (6) .months. : Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Homan,. WHEREAS Edmond Bokina has applied to the Town Board for a single trailer renewal permit dated August 5, 1975, Ali G'1'21:197.5- t �d NOW, THEREFORE, BE IT RESOLVED that the application of Edmond Bokina to locate a single trailer on the property of Aldrich Lane Realty, on a right-of-way off the north side Main Road, Laurel for-use by seasonal farm help be renewed for- the period of June 1, 1975 through November 30 ,- 1975. Vote of the Town Board: Ayes: Supervisor- Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, WHEREAS Isidore P. Krupski has applied to the Town Board for a single trailer renewal permit dated- July 29, 1975, NOW, THEREFORE, BE IT RESOLVED that the application of Isidore P-. Krupski to locate- a. single trailer on the north side Main Road approximately 1,000 feet east of Bay -Avenue,' Peconic, New York for the purpose of housing farm help be renewed for six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly- adopted. Moved by Councilman Rich, seconded by Councilman Homan, WHEREAS Herbert 0. Cassidy has by written application applied to this board for a renewal of his permit to excavate sand, gravel, stone or other materials from premises located south of Soundview Avenue, Southold, New York, bounded generally northerly by lands of Edwin A. Smith and Long Island Produce Co. , easterly by lands of Case and Kaplan, southerly by lands of' Newell Estate and Sepenoski, and westerly by lands of Tisdale and Edwin A. Smith, and WHEREAS a public hearing was held on the original application of Angelo G. Petrucci (property now owned by Herbert 0. Cassidy) on July 13, 1971 at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that this Board does in accord- ance with Section V of the Excavation Ordinance of the Town of Southold, find that (a) The proposed operations will not interfere with the surface water drainage plan of the area nor endanger any street, road or highway, (b) The circumstances of the location and terrain are reasonably adapted to rehabilitation to the end that the premises will not become desert or waste - land following completion of operations. (c) The circumstances of the location and the terrain are such that conditions and safeguards may feasibly be imposed to assure that :the premises will not constitute ari attractive nuisance or endanger the safety of children. (d) The use .-will not cause undue traffic hazards. (e) , ,The use will not cause undue noise or wind-blown dust or. sand. (f); .';The use will not change the established character of the neighborhood or depress the value of other lands in such neighborhood. (g) The proposed -operations are set back at least 20 feet from any road, street, avenue or highway and that the excavation operations were in existence at the effective date of the ' - aforesaid excavation ordinance and that such proposed operations will not be extended beyond the present front, side or rear setback lines, and it is further RESOLVED that the Town Clerk be and she hereby is authorized and directed to issue a renewal permit to Herbert 0. Cassidy for the -excavation of sand, gravel, stone or other materials from-the above described premises fora term of one year, subject, however, to the following terms and conditions: 1. The removal of materials shall be confined to the shaded areas outlined in red on- the map accompanying said original--application, a copy of which has been signed by the Supervisor -and the applicant and filed with the Town Clerk. 2-. The removal of materials from said areas shall not extend below fifteen (15) feet above sea level. 3._ .All removal operations shall be- set back at least 10 feet from all property lines. All slopes .shall be maintained during- and -after opera- tions- at one foot vertical on one. foot horizontal. 5. - After operations have been -completed, the excavated areas, as well as all other areas where prior excavation operations have been conducted on the premises, shall be leveled, regraded, all_ stumps, rocks and other debris removed and the entire premises seeded with grass. : Vote of the Town Board: Ayes: Supervisor Martocchia, . This resolution was declared duly adopted, On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that Carolyn Gro.ssenbacher, Mattituck, New York, be and she hereby is, appointed Attendance Officer, subject to .the written approval of the District Superintendent of Schools, throughout the Town of Southold, except such schools as are otherwise provided for by Section 3113 of the Education Law, and be it further RESOLVED that the compensation of such Attendance Officer be fixed at $1,200.00 per year payable in regular semi-monthly installments, she to pay her own expenses, and be it further RESOLVED that the Town Clerk be and she hereby is instructed to notify Carolyn Grossenbacher and . the. .District Superintendent of Schools of the appointment. Vote _of the Town Board: Ayes:. Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, . Justice Doyen. This resolution was declared duly. adopted. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that Elizabeth Ann Neville be and she hereby is appointed provisionally as Clerk-Stenographer in the office of the Town, Clerk, effective August 1, 1975, at an annual salary of $5,500.00 Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Town Clerk Judith T. Boken appointed Elizabeth Ann Neville Deputy Registrar of Vital Statistics, effective August 12, 1975. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the following individuals be appointed Dog Enumerators for the 1976 dog licensing year: Marie Doyen, Fishers Island; Frank Berry,, Southold; Edward Curran, Mattituck. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, -Justice Demarest, Justice Doyen. . This resolution was declared duly adopted. Supervisor Martocchia stated that there is an opening for a dog enumerator for the 'Orient through Greenport area. On motion of Justice Demarest, seconded by Councilman Homan, . WHEREAS the Cutchogue-New Suffolk Park District and the Nassau Point Causeway Association has made application to the Town Board to change the location of a portion of a certain town highway known as Nassau Point Road at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, by extending from a point in the southerly line of Bay Avenue in a southerly direction approximately 1700 feet, more -fully described in the application, and WHEREAS the Highway Superintendent has inspected the said high- way and has advised the Town Board that said proposed relocation complies in all respects with the specifications for the dedi- cation of highways in the Town of Southold, and WHEREAS the said Cutchogue-New Suffolk Park District and Nassau Point Causeway Association simultaneously with the filing of said application have filed a dedication and release instrumental wherein they consent to such relocation; dedicate and convey to the Town of Southold the necessary lands therefor, and release the Town of Southold from all damages by reason of such relocation, NOW, THEREFORE, BE IT RESOLVED that consent be and the same is hereby given that the Superintendent of Highways make an order relocating that portion of Nassau Point Road in the manner described in the aforementioned application and dedication and release. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Upon request of Mrs. Sherley Katz an .explanation of the -road relocation was explained. There is no physical change, simply a. boundary discrepancy in a prior survey of the road. On motion of Councilman Rich, seconded by- Justice Suter, it was RESOLVED that there being no further business to come before this Town Board meeting, the meeting be adjourned at 3:30 p.m. Vote of the Town Board: Ayes: Sppervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen.
