SOUTHOLD TOWN BOARD MINUTES
Meeting of July 29, 1975
A regular meeting of the : Southold Town Board was held at 3:00 p.m.
Tuesday, July 29, 1975 at the Town Board meeting room, 16 South
Street, _ Greenport, New York, Supervisor Albert M. Martocchia
called the meeting to order with the following present:

On motion of Justice. Suter, seconded by Justice Demarest, it was
RESOLVED that the July 8, 1975 minutes of the Southold Town Board
meeting be approved and accepted as submitted by the Town Clerk.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 p.m. , Tuesday, August 12, 1975 at the
Town Board meeting room, 16 South Street, Greenport, New York.
Vote of the Town Board.: 'Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
Supervisor Martocchia reported the following:
1. The. Town Board is in- receipt--of a letter and petition
from Mrs. Martin Ztulo of Pelham, New York, requesting a four-
way stop sign. at Peconic .Bay Boulevard and_ Sigsbee Road, Mattituck
and a 20 mile per hour speed limit .on. Sigsbee Road.- The request
has been referred to the police department for study.
2. A letter from Richard Cron stating he is now the
attorney for Valentine .Ruch in the matter .of the subdivision of
"Shorecrest" on Route 27, Southold.
3. Letter from .Department .of Transportation relative to
a meeting to be held at 9:30 a.m. on. August 5, 1975 at the State
Building, Hauppauge, . relative to a Long Island Sound Ferry
study. The Southold Town Board will be represented 'at-this
meeting.
On motion of Councilman Homan, - seconded by Councilman Rich, it was
RESOLVED that the Southold Town Board authorizes the Southold
Senior Citizens to hire two buses for a trip to Sterling Forest,
Pomona, New .Jersey on ..September - 4,_ 1975.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, _Justice . Suter, Justice Demarest.
This resolution was declared duly adopted..
Supervisor Martocchia reported the following:
1. Receipt of a letter from the Reydon Shores Property
Owners Association relative to a__complaint against a .neighbor
for the collection of junk on his property.. . The matter was
referred-to the Chief of Police .and the situation-has .been
resolved.
2. Request from the Building Department, supported by.-the
Board of Appeals, for stronger -controls of signs -.on parked
vehicles. ' .A study .will be made to amend .the Zoning Ordinance.
3. Request for the roads in Eastern Shores, Section 5, to
be dedicated to the town. Certain conditions must be resolved
before the roads can be dedicated, and the Town Board and

Highway Superintendent are studying the situation.
4. Letter from the Cutchogue-New Suffolk Chamber of Commerce
urging that the Town Board support proposed condominiums in .
Cutchogue, (public hearing has been held for an�I'M" zone) , and
stating a vote at. their .July 9 meeting howed 64% in support,
26% not in support, and 10% abstained.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board approves payment by the
Fishers Island Ferry District of $1,552.00 to Alfred S. Bicknell
for operation of eight extra trips of the Mystic Isle. during
the .month of June 1975.
Vote of the Town Board: Ayes:. Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Southold Town Board accepts the report of
Catherine A. Perrin, Community Aide, relative to the now -defunct
Narcotic Guidance Council.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
On motion of Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that the Southold Little League Association be allocated
$1,000.00 toward expenses incurred by establishing four regular
baseball diamonds at their new baseball field on Peconic Lane ,
Peconic.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest. .
This resolution was declared duly adopted.
Supervisor Martocchia reported the following:
1. Receipt of a letter from the State of New York, Depart-
ment of Public Service relative to extended hearings on the
proposed L.I.L.Co. - Jamesport nuclear`plant. Dates submitted
are : .July .28 - August 1, August, 4 - August 8, September 8 -
September 12.
2. - Copy of a letter from the Southold Town Building
Department to the New York State Department of Transportation
citing a blind site problem at South Harbor Road and Route 25
in Southold, and asking for a study. of same.
3. Receipt of a resolution by the Suffolk County Legis-
lature whereby they are deeding a' parcel of excess county land
situate on Wickham Avenue near Wolf Pit Lake, Mattituck, to
the Mattituck Park District for' $850.00.
4. Receipt of a resolution by the Suffolk County Legis-
lature stating that the Suffolk County Commissioner of Public
Works has received permits for dredging the entrance to the
following creeks in .Southold Town: Mill Creek, Little Creek,
Deep Hole Creek, Schoolhouse Creek, and Mud Creek.
5. Copy of. a resolution whereby the Suffolk County Legis-
lature is accepting a grant from the federal government for
urban development - meeting to be held August 26. Southold
Town' s share is $23,760.00 for the first year.
6. . Through the cooperation of the Town of Southold and
funding by the Suffolk County Department .of Labor, au.thoriza-
tion has' been received .for 44 disadvantaged youths in Southold
Town to take--a bus trip to Great Adventure in' Jackson, New York.
Mrs. Bea Zegzula has volunteered her services to select the
youths for the trip.
7. Letter from the Deep Hole Drive Property Owners .
Association for aid in opening the mouth of Deep Hole Creek.
The matter has been referred to Carl Eisenschmied, Principal
Civil Engineer, Division of Waterways, Department of Public
Works, Suffolk County.
8. Notice from Department .of Environmental Conservation
re : application of Frederick A. Cantrell, Antler Lane, Cutchogue
for permission to construct a bulkhead, dredge and backfill at
East Creek, south of Eugene' s Road, Cutchogue. Objections to
be filed on or before August .18, 1975.
9. Application of Pierce,.Yacht Basin for a wetland permit
has been'.amended and is being referred to the necessary depart-
ments for reports and recommendations.

10. Application of Kenneth C. Ramsauer to the Department
of Encironmental Conservation to build an open dock on piles
and floating dock at Mattituck Creek. Last day to file object-
ions is August 15, 1975.
Moved by Justice Demarest, seconded by Councilman Rich,
WHEREAS the Town of Southold has requested the County of Suffolk
to dredge the mouth of Sterling Basin, Greenport, and
WHEREAS. the County of' Suffolk proposes to do said dredging. of
the mouth of Sterling Basin, in the Town of Southold, atla

WHEREAS, in order to accomplish said dredging, plans, specifi--
cations, agreements - and other documents must be executed on
behalf of the Town of Southold, now, therefore, be it
RESOLVED that Supervisor Albert M. Martocchia be and he hereby
is authorized to execute, on behalf of the Town of Southold,
-all necessary plans and specifications, spoil area agreements,
assurances to the County of Suffolk, license and/or dredging
permit. applications to Federal and State agencies and all other
documents that may be required to accomplish said dreding work.

Moved by Councilman Homan, seconded by Councilman Rich,
WHEREAS the Town of Southold has requested the County of Suffolk
to dredge the mouth of West Creek, New Suffolk, Town of
Southold, and
WHEREAS the County of Suffolk proposes to do said dredging of
West Creek, in the Town of Southold at a nominal cost to the
Town of Southold, and
WHEREAS in order to accomplish said db-edging, plans, specifi-
cations, agreements and other documents must be executed on
behalf of the Town- of Southold, now, . ther.efore, be it
RESOLVED that Supervisor Albert M. Martocchia be and he hereby
is authorized to execute, -on behalf of the Town of Southold,
all necessary plans..and specifications, spoil area agreements,
assurances to the County of Suffolk, license and/or dredgg
permit applications .to federal andstttte agencies and all
other documents that 'may be required to accomplish said drredging
work.

On motion of Justice Demarest, seconded by Justice . Suter,
WHEREAS the Town of Southold. has requested the County of Suffolk
to dredge the mouth of Peters Neck Point, Orient, Town of
Southold, and
WHEREAS the County of Suffolk proposes to do said dredging of
Peters Neck Point, in the Town of Southold, at a nominal cost
to the Townoof Southold anda .no- i-
WHEREAS in.-order to accomplish said dredging, plans, specifi-
cations, agreements and other documents must be executed. on
behalf of the Town of Southold, now, therefore, be it
RESOLVED-that the _Supervisor be. and- he hereby is authorized
to execute, on behalf of the Town of Southold, all necessary
plans and specifications, spoil area -agreements.,....assurances to
the .County of Suffolk, license and/or dredging permit appli-
cations to Federal and State agencies and- all other documents
that may be required to accomplish said dredging work, and be
it further
RESOLVED that the Town of Southold strongly recommends that
the surplus material be placed on the New York State public
property, rather than on private property as indicated in the
dredging proposal.

WHEREAS the Town of Southold has requested the County of Suffolk
to dredge the mouth of Downs Creek, New Suffolk, and the entrance
to Cedar Beach Inlet, Southold, Town of Southold, and

WHEREAS, the County of Suffolk proposes to do said dredging of
Downs Creek and Cedar Beach . Inlet, in the Town of Southold, at
a nominal cost to the Town of Southold, and
WHEREAS, in order to accomplish said dredging, plans, specifi-
cations, agreements and other documents must be executed on
behalf of the Town of Southold, now, therefore, be it
RESOLVED that Supervisor Albert M. Martocchia be and he hereby
is authorized to execute, on behalf of the Town of Southold,
all necessary plans and specifications, spoil area agreements,
assurances to the County of Suffolk, license and/or dredging
permit applications to Federal and State agencies and all other
documents that may be required to accomplish said dredging work,

On motion of Councilman Rich, seconded by Councilman Homan,
it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby
is authorized to enter into a lease agreement on behalf of the
Town of Southold with Margery D,. Burns, Main Road, Southold,
for a plot of land situate, lying and being at Southold, Town
of Southold, Suffolk County, New York, bounded and described
as follows: BEGINNING at a point on the division line between
land of the party of the first part (Margery D. Burns) and
land of the ,party of the second part (Town of Southold) , which
point is 45 feet southerly along said division line from the
southerly line of Main Road; running thence along said division
line South 290 23' 30" East 55 feet to the southeasterly corner
of land of the party of the first part; running thence South
600 00' West 15.0 feet to a right of way; running thence in a
northerly direction along said right of way North 2902312011
West 55 feet; running thence in a northeasterly direction a
distance of 15 feet, more or less, to the point or place of
beginning. Being and intended to be the southerly55 feet of
the premises of the party of the first part.
BE IT FURTHER RESOLVED that said parcel is to be used by the
Town of Southold for public parking purposes for one year, from
August 1, 1975 through July 31, 1976, at an annual rent of One
(1.00) Dollar per annum with an automatic renewal clause.

On motion of Justice Suter, seconded by Justice Demarest,
WHEREAS William P. Ruland applied to the Town Board for a single
trailer permit dated July 16, 1975,
NOW, THEREFORE, BE IT RESOLVED that the application of William
P. Ruland to locate a single trailer on the corner of Route 25
and Mill Lane, Mattituck as living quarters for one farm helper,
be and hereby is approved for six months, from August 5, 1975
through February 5, 1976.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.

On motion of Councilman Homan, seconded by Justice Suter,.
WHEREAS the Burton Potter Post #185, American Legion, Greenport,
New York has applied to the Town Board for a Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, .THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby is authorized and directed to execute on behalf of the
Town Board the findings and determinations as required by law,
and it is further
RESOLVED that the Town Clerk be and she hereby is directed to
issue a Bingo License to the Burton Potter' Post #185, American
Legion, Greenport, New York.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.

On motion of Councilman Homan, seconded by Councilman Rich,
WHEREAS the Sacred Heart R. C. Church, Cutchogue, New York has
applied to the ,Town Board for a Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby is authorized and directed to execute on behalf of the
Town Board the findings and determinations as required by law,
and it is further
RESOLVED that the Town Clerk be and she hereby is directed to
issue a Bingo License to the Sacred Heart R. C. Church, Cutchogue,
New York.

On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that Supervisor AlbBrttM. Martocchia be and he hereby
is authorized to sign a contract on behalf of the Town of
Southold with Kenneth Edwards, Fishers Island, New York, as a
part-time bay constable, for the purpose of. patrolling the.
waterways in and about the Town of Southold from May 25, 1975
and ending September 2, 1975 for the total sum of $900.00;
said Kenneth ,Edwards agreeing to supply a suitable boat, equip-
ment, . fuel, and be responsible for the .repair, and maintenance
of said equipment.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
Supervisor Martocchia reported the receipt of an application to
the Corps of Army Engineers by Richard Manfredi for construction
of a pier and dolphins at Orient Harbor. Last. date for filing
objections is August 25, 1975.
On motion of Justice Demarest,. seconded by Councilman Homan, it was
RESOLVED that the Southold Town ,.Board appropriate $7,775.00
from the Federal Revenue Sharing Fund for the purchase of the
new ,police boat and .equipment.

RESOLVED that $400.00 be transferred from Historical Account

On motion -of- Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the Chief of Police is hereby authorized to order
twp plexiglass separators, with adaptor kits, for two police
cars, at a cost of approximately $1.79.00 each, plus delivery
charges.

On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that the resolution km adopted on June 24, 1975 whereby
Albert W. Richmond was hired to supervise the preparation and
microfilming of the Town Clerk records at a salary not to exceed
$1,200.00 be amended to -read: "at a salary not to exceed
$1,500.00.

Mr. David- Driscoll, Southold,: asked for clarification of Super-
visor Martoc.chia' s previous remarks relative to roads in Eastern
Shores., Supervisor Martocchia explained the procedure for
dedication of private subdivision roads to. the Town.

Mr. Driscoll also inquired about the proposed County launching
ramp in the Eastern Shores area, indicating he- understood that
land had been turned:-over to '-the Town of Southold. - Supervisor
Martocchia stated- that= the land iri' question .is county -property
and construction- of a ramp is provided for in the Suffolk County
Capital Budget, should the project be instituted.
Mr: -Driscoll further commented on the question of- a survey of-
County Route 27A.
Ms. Sherley Katz,- Greenport, asked if the Board would comment
on. a newspaper article stating- the Town-Board will wait six
months to make a decision on the KOA change of zone application.
Supervisor Martocchia explained that no tune- limit has been
set, the Town Board must study the proposal in depth., and after
that has been accomplished a decision will be made.
Ms. Katz inquired as to whether the Town- has made a recommenda-
tion. to the County for- bike paths in the Town 'of Southold. -
Supervisor Martocchia stated that they have sent- a map to the
County, and he understands--it-'has been -approved, but has not
received formal approval '.from the County- itself.
Mrs. Gladys Csajko'; Greenport; asked about the -status of -the
dog pound. Supervisor Martocchia advised -that he understands
the -third and last section will be delivered on Wednesday,
July 30th2 but a final date cannotDbe set for completion, as
the. cages must be 'put in place, equipment purchased, personnel
hired to staff the pound, and technical advice sought from Dr.
Zitek.
Mr. David Driscoll read a prepared statement criticizing
renaming the "Master Plan"-- to "New Development Plan" by-John
Wickham, and objecting to statements made by John Wickham and
the authority he exerts. Mr. Driscoll asked- for Mr. Wickham' s
removal, and removal of the present members of the Planning
Board, -and the appointment of -a new Planning Board to start over
again. Mr. Driscoll also referred to the rising costs of ,public
services in-the--Town of-Southold and the influx of-visitors 'to
the area who do not pay taxes.
Supervisor Martocchia replied to Mr. Driscoll' s statement,
citing -Southold Town' s hstory';of competent and dedicated'
appointments of elected officials, and the Town' s record of
honest and economical government. Supervisor Martocchia praised
John Wickham-as a highly educated, knowledgable person who has
given Southold Town dedicated service far surpassing the pay
he receives as Chairman of 'the Planning Board. The Southold
Town Board is happy to have John Wickham and all the members
of the Planning Board in the service of Southold T6wn.
Mrs. Csajko .questioned the Town Board' s method of recessing to
audit the bills. Supervisor Martocchia explained that there is
an enormous amount of bills - in each audit. The Town Board
examines each one of them closely, double checking, and
often disapproving those that are not in order, however, each
bill,sis -supported by a signed-voucher. To audit the bills
before the public would be a very lengthy-procedure.
Ms. Katz questioned whether the police boat went out for bid,
and was -advised it did.
Moved by Justice .Suter, seconded by Justice Demarest,
WHEREAS,- our friend and fellow official, Willard Lawrence,
Southold Town Historian, has been lost to us through death, - and
WHEREAS, by his passing the Town has lost an esteemed and
efficient officer, and the people of the Town of Southold have
been deprived of his wise counsel- -and -judgment, and the Town
Board has lost a faithful -friend and associate,
NOW, THEREFORE, BE IT RESOLVED that this Board express its
sense of loss and its sympathy to the family of Willard Lawrence,
and that 'a copy of this resolution be entered in our minutes and
a copy be sent to his family.

of silence in memory of the late Willard Lawrence, Southold Town
Historian,/
On motion of Justice Suter, seconded by-Councilman Homan, it was
RESOLVED that there being no further business to come before
this Town Board meeting, the meeting be adjourned at 4:10 p.m.
