Meeting.-of-June 10, 1975
The Southold Town Board met at the office of Supervisor Albert
t Martocchia, 16 South Street, Greenport, New York-, at 3:00
P.M. , Tuesday, June 10, 1975, with .the following present:

On motion of Councilman Rich, seconded by Councilman Homan, it-was
RESOLVED that the minutes of the Southold Town Board meeting of°
May 27, 1975 be approved as submitted.

Moved by Justice Demarest, seconded by Justice Suter, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M. , Tuesday, June 24, 1975 at the office
of Supervisor Albert M. Martocchia; - 16 South Street, Greenport,
New York.

Rich; Councilman Homan; Justice Suter; Justice Demarest.
This resolution was declared duly adopted.
Moved by Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the reports for the month of May 1975 of the ,-:Building
Department, Police Department, Supervisor, Town Clerk, and Justice
Suter, be accepted and placed on file.

This resolution was declared duly adopted.
Supervisor Martocchia reported that he had received the fully
executed copy of the Consortium Agreement entered into for
purposes of the Housing and Community Development Act of 1974.
The Town of Southold anticipates the construction of a Senior
Citizen-Teen Center, and is presently in negotiations with the
attorney for a property owner on Peconic Lane for a vacant
parcel of land. The Town' s allotment for the current year is
$23,76o.00.
Supervisor Martb.cchia reported he has written to Dr. Mary
McLaughlin, Suffolk County Commissioner of Health, requesting
a variance for the use of McCabes Beach, Goose Creek Beach, and
Goldsmith' s Inlet Beach, due 'to the lack of sanitary facilities.
The town is able to meet the County requirements by adding
sanitary facilities at the Southold Town Beach, and at New
Suffolk Beach. The Norman E, Klipp Marine Park and Kenney' s
Beach have new facilties that are acceptable to the County.
Supervisor Martocchia reported that the Suffolk County Department
of Public Works has developed a third or relief lane for the
intersection of Route 27A and Kenney' s Road, Southold.

On motion of Justice Suter,. seconded by Justice Demarest, it was
RESOLVED that Supervisor Martocchia be and he hereby is authorized
to sign the necessary papers for AN ACT, Senate Bill S.5814, Assembly
Bill A.8189, in relation to eztablishing Sound Avenue, a scenic and
historic corridor in Suffolk County, in honor and celebration of the
American bicentennial and the role of Long Island in the American
Revolution (Sound Avenue from its junction with State Route twenty-
five A in the town of Riverhead to its junction with County Road
twenty-seven in the town of Southold, County of Suffolk is declared
to be a scenic and historic route in Suffolk County, and its historic,
scenic, and cultural resources ',and its naturalbeauty shall be
preserved and protected for the benefit and enjoyment of the people
of the state. )

Supervisor Martocchia announced the resignation of Willard Lawrence,
to be effective July 31 , 1975. He invited anyone interestedito
apply for the position iahic'hi will pay between $1 ,800.00 and $2,000.00
The Supervisor advised those present that there are applications
pending before the New York State Department of Environmentall
Conservation by William H. Link, Bayview Avenue, Southold., -,for
100ft. of timber bulkhead, notification before July,7th; ,and
George Burrell, Bridge Road, Cutchogue, for an open dock to a
floating dock, notification date July 14th,
Moved by Justice Demarest, seconded by Justice Suter, it was
RESOLVED that Chief Cataldo be and he hereby is authorized to
attend the 1975 Pedestrian Safety Awards Program at the Statler
Hilton Hotel, New York on Wednesday, June 18, 1975 and accept
the Southold Town Safety Award on behalf of the Town of Southold
from the Board of Judges of thenerican Automobile Association.

A request from the Southold Town Planning Board for the Southold
Town Board to consider the subdivision of land owned by William
Schriever at Orient as a cluster concept subidivison was tabled
for study.
Proposed Local Law No.4 - 1975 - entitled "A Local Law providing
for licensingoof home improvement contraettvs in the Town of
Southold" was tabled for two additional weeks, to give the Town
Board an opportunity to. consult ;with East Hampton Town and.
Southampton Town..
Application of Rev. Donald Brickley for a wetland permit, hearing
held May 27, 1975 was tabled until June 24th to allow the .Town
Board additional time to study the proposal.
Moved by Justice Demarest, seconded by Councilman Homan, it was
RESOLVED. that approval be and hereby is given for payment of Mobil
Oil Co. gas bills, upon receipt of proper voucher and supporting
tickets.

RESOLVED that Judith T. Boken be and hereby is granted a one year
leave-of-absence from her civil . service position of Clerk=Stenographer
in the office of the Town Clerk, effective June 1 ; 1975•

authorized to prepare speci'fications 'and advertise for- bids for a.
50 ft. office trailer to be attached, to the rear of the Town Clerk
building at Main Road, Southold, . at a . cost of approximately $5,000.00

tive at the Long Island Lighting Company nuclear- plant hearings be
extended an additional q weeks, at an expense not ,to . exceed .$500.00

RESOLVED that Highway Superintendent Raymond C.1 Dean be and he hereby
is authorized to repair the eroded conduits to the light on the
Jockey Creek bridge, Southold.

RESOLVED that Supervisor Albert M. Martocchia be and.he hereby is
authorized to advertise for bids, and purchase from the lowest
responsible bidder, an auxiliary police boat under the specifications
to be drawn by the Southold Town Board.

RESOLVED that the Southold Town Board accepts the $100,000.00 bond
of Greenfields at Southold" , owned and developed by Gorwitz & Barnett.

RESOLVED that the Southold Town Board approves the amount of
$90,000.00 bond as recommended by the Southold Town Planning Board
for roads and improvements, in the .subd Itat ion of "Crown Land Lane"
located at Cutchogue, New York, and owned by Crown Land Lane, Inc.

Moved by Justice Suter, seconded by Councilman Rich, it' was
RESOLVED that the Southold Town Board approves the .amount of
$235,000.00 bond as recommended by the Southold Town Planning Board
for roads and improvements in. the subdivision of "August. Acres" ,
located at Arshamomaque, New York, and owned by Posillico Const.
Co. , Inc.

RESOLVED that the Southold Town Board hereby authorizes the purchase
of a Lanier transcriber for the Southold Town Planning Board at- a
cost of $444.00 including service.

Moved by Justice Suter, seconded by Councilman Rich;:
WHEREAS Maddie Miles has applied to the Town Board for a single
`.trailer renewal permit dated May 15, 1975,
NOW, THEREFORE, BE IT RESOLVED that the application of Maddie Miles
to locate- a single trailer on her property on private road, off
north side Main Road, Mattituck, New York be and hereby is granted
for a period of six (6) monthR.

On motion of Councilman Homan, seconded by Councilman Rich, it .was
RESOLVED that -the Superintendent of Highways of the Town of Southold
be authorized to advertise for bids and� to purchase from the lowest
responsible bidder, the following: .
(2) Two D - 100 Dodge Pickup trucks - (OR EQUAL) with
trade-in allowances on (11 one 1966 International pickup
truck and (1) one 1970 International pickup truck.

On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the Superintendent of Highways
of the Town of Southold be authorized to advertise for bids and
to purchase from the lowest responsible bidder the following, more
or less, as needed:
300 tons of Grade No. 1 Cayuga (or equal) rock salt,
delivered in 100 lb. bags to the Highway Department,
Peconic, New York, by truck.
300 tons of Grade No. 1 Cayuga (or equal) rock salt,
delivered in bulk to the Highway Department, -Peconic,
New York, by. truck.

On motion of Councilman Homan, seconded by Councilman_ Rich, it was
RESOLVED that the Superintendent of Highways of the Town- of Southold
be authorized to advertise for bids and to purchase from the lowest
responsible bidder, the following, more or less, as needed:
Item No. 1 - 15,000 lin. feet of Snow Fence with
pickets ' 12 x 2 inches, spaced 2 inches apart, 4
feet high. stained, red, with five (5) double strands
of 122 gauge galvanized wire in 100 lin. foot rolls.
Item No. 2 - 19000 - 6 ft. studded steel T posts with
flanges or anchor plates on- posts, posts shall not be
1 less than 8.65 lbs. each.

On motion of Councilman Homan, seconded by Justice Demarest,
WHEREAS Saint Peter' s Lutheran Church, by application dated September
169 1974 petitioned the Town Board of- the Town of Southold for a
change of zone on certain prDppbty situated at Greenport from "A"
Residential and Agricultural District to "M-1" General Multiple
Residence District, and
WHEREAS the said petition was referred to the Southold Town Planning
Board and Suffolk County Department of Planning for official
recommendation and report, and
WHEREAS, the Town Board, pursuant to due notice, held a public
hearing thereon on the 25th day of February 1975 at 7,:30 P.-M. , at
which time all interested persons were given an opportunity' to be heard,
NOW, THEREFORE, BE IT- RESOLVED that Saint Peter' s Lutheran Church
be granted a change of zone from "A" Residential and Agricultural
District to "M-1" General Multiple Residence District on property
situate at Greenport, New York, and more particularly bounded and
described as follows:

This resolution was declared duly adopted.
Mr. Benson Telsey, Greenport, addressed the Town Board in an attempt
to make a formal protest regarding the K.O.A. proposed change of zone,
and handed the Town Clerk a.pettion- in opposition pursuant to Town
Law, Section 265, containing 11 signatures. Town Attorney Tasker
ruled the petition to have no legal significance.
Supervisor Martocchia stated that the Town Board, as a body, cannot
accept any further evidence or information on the K.O.A. petition; .
as, the public hearing was held on May. 27, 1975, after due .notice, and
any objection should have been made at that time. Any information
presented at this tmm would have no bearing on the final decision.
Supervisor Martocchia encouraged residents to talk to the Town Board
members individually on the outside.
Mrs. Mabel Lytle, Peconic, questioned the -fairness of the public
hearing on the K.O.S. as to the time limit set. Supervisor Martocchia
explained that the petitioner has - the right to make a proper
presentation, as those are the facts the Town Board must be guided
by inimnaking their decision. Every individual present at the public
hearing, which lasted over three hours, had every opportunity to be
heard for and against.
Mrs. Lytle also asked why it took the Town Board and Town Attorney
three years to come to a decision to notify adjacent property owners.
Town Attorney Tasker and Supervisor Martocchia explained that when
changes are proposed for the Zoning Ordinance, they attempt to
incorporate all proposed changes which entails lengthly study by the
Town Board, Planning Board, Board of" Appeals and Town Attorney.
Mr. David Driscoll, Southold, attempted to read a letter in.tb the
minutes which'he stated would present an alternate proposal for the
K.O.A. project. Supervisor Martocchia ruled Mr. Driscoll out of
order. Mr. Driscoll then called for a public referendum, which
Supervisor Martocchia stated is illegal, Mr. Driscoll handed his
prepared statement to the Town Clerk, then withdrew it. Justice
Demarest examined the statement; and on advice of Town .Attorney
Tasker, gave Mr. Driscoll -permission to read it. He refused and
invited those present to step outside the building and he would
read it to those interested.
Mrs. Gladys Csajko, Greenport, presented a letter to the Town Clerk
which she stated was relative to K.O.A. , on behalf of the Council of
Allied Associations of the North Fork Taxpayers Association, Inc.
Mrs. Csajko also questioned the amendment to the Zoning Ordinance.
relating to horses, asking if it is retroactive. She was advised
it is not.

Mr. Samuel Markel, Southold, questioned the Highway Superintendent
and Town Board relative to the wording of the bid for Cayuga rock
salt; the bid for snow fence (most of which is about seven years
old, and some of which was merely loaned temporarily to the Town
of Riverhead. ) Mr. Markel then asked' if it is the policy of the
Planning Board and Town Board to grant changes of zone for financial
benefit of people, rather than the good of the community7L and how
can the public learn how each Town Board member votes?
Supervisor Martocchia stressed that it is the creed of the Southold
Town Board to consider each petition for a change of zone strictly
on the basis of the location, and whether it is a proper location for
a particular zone. The vote is taken by individual poll of the
Board at a regular Town Board meeting, as he witnessed earlier in
the meeting when the Board approved the change of zone for Saint
Peter' s Lutheran Church.
Mr. Henry Steinbrecher, Cutchogue, representing the Mattituck Senior
Citizens, and Mr. John Brolles, Greenport, stated their opposition
to K.O.A. and were ruled out of order.
On motion of Councilman Homan, seconded fby Councilman Rich, it was
RESOLVED that this Town Board meeting be recessed. for thirty minutes
to give the Town Board an opportunity to audit the bills.

On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the following audited bills be approved for payment:
General Fund bills in the amount of $218,942.86; Highway bills in
the amount of .$68,699.06; Fishers -Island Ferry District bills in the
amount of $43., 304.45; and Special Districts bills in the amount of
$199655.94.

On motion of Councilman -Rich, seconded by Councilman Homan, it was
RESOLVED that this Town Board meeting be adjourned at 5: 30 P.M.
