SOUTHOLD TOWN BOARD MINUTES
Meeting of January 7, 1975
The Southold Town Board met at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, at 3 :00 P.M. ,
Tuesday, January 7 , 1975, with the following present:
Supervisor Albert M. Martocchia
Councilman James H. Rich, Jr.-
Councilman James Homan
Justice Martin Suter
Justice Louis M.' Demarest
'Town Attorney Robert W. Tasker
Highway- Superintendent Raymond C. Dean

Absent: Justice Francis T. Doyen
On motion of Councilman Rich, seconded by Justice Suter, it was
RESOLVED that the next meeting of the Southold Town Board will be
held at 3 :00 P.M. , Tuesday, January 28, 1975 at the • office of
Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the reports of 'the High-way Department, Board of Appeals,
Building Department, Town Clerk and Justice Suter be accepted and
placed on file. -

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Rich, it'- was ' l
RESOLVED that General bills in the amount of $12, 334. 07 ; Fishers
Island Ferry District bills in -the amount of $37 ;33,0. 25; Highway
Department bills in the amount •of $3 ;782 .25; Special Districts
bills in the amount of $901.40 and Federal Revenue Sharing bills
in theamount of $2, 627.00 be -and- the same are hereby' ordered paid.

On motion of Councilman Rich,- seconded by Councilman Homan,
WHEREAS the Southold' Fire Department has requested the use of
part of Bayview Road; Lower, Road, Ackerly Pond Lane, Jockey Creek
Drive to form a parade along the Main Road to the Southold Fire
House, and -part of Boisseau Avenue near the railroad tracks to
disband the parade on July 5, 1975 at 6 P.M. , or July 6, 1975 at
4:00 P.M. , in the event of -rain, •and the use of the driveways -and
parking area with the grounds of the Southold Fire House to conduct
a tournament; now, theref-ore, -be -it '
RESOLVED that the aforesaid rgquest be 'granted to -the Southold
Fire Department.

On motion of Councilman"Rich, seconded by Justice Demarest, it' was
RESOLVED that the Town Clerk be and lie -hereby is instructed to -
request the • Long Island Lighting Company to install a 175 MV light
cn� the' 6orner of the new road to the Town Disposal area, north side
County Route 27A, Cutchogue, New York -- first unnumbered pole,
east of LILCO Pole No. 151.

On motion of Justice Suter,, seconded by Councilman Homan, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to arrange for transportation and lodging for all town
officials who wish to attend the Association of Towns meetings in
New York City on February 9th through 12th.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by Justice. Suter , it was
RESOLVED that the Southold Town Board accept Assessors Certificates
of Erroneous Assessments for property assessed to Nicholas Sawka
and wf. , Lot 6, Saltaire Estates, Mattituck (veterans exemption
left off in error) ; and three parcels assessed. to County of Suffolk
c/o Jean Tuthill, Treasurer, at Orient (omitted entry- went on the
exept to the County of Suffolk instead of the final tax roll for
extension. )

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Supervisor Martocchia set 7 :45 P .M. , Tuesday, January 28, 1975
for a joint meeting with the Town Board, Board of Appeals, Planning
Board and Town Trustees.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Southold Town Board authorizes the Beach Committee
to solicit prices for a comfort station for the Town beaches.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that the Police Committee be and it hereby is given the
authority to make, adopt, and enforce rules and orders for the
government and .administration of the Police Department and the
members thereof.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion .of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to sign-,a contra,ct for the lease of a Zerox machine
for $13.5.00 per month, plus necessary installation charges.
Vote ,of the, Town Board: Ayes; Supervisor Martocchia , Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest. .
On motion of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that Howard, M. Terry, Building Inspector, Town of. Southold
be and he hereby is authorized to attend the Eastern. States Building
Inspectors School at New York City on March 5 through March. 7 , 1975 ,
and it is.
RESOLVED that the actual and necessary expenses to travel, meals
and lodging incurred while attending said school be a legal charge
against the Town of Southold.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that Howard M. Terry, Building Inspector, Town .of Southold
be and he hereby is authorized to attend the New York State Building
-Inspector ' s School at Babylon, New York each Wednesday afternoon
during late January and February, and be it further
RESOLVED that the actual and necessary expenses to travel, meals
and lodging incurred while attending said school be a legal charge
against the Town of Southold.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Coutcilman Rich, seconded by Councilman Homan, it was
RESOLVED that Howard M. Terry, Building Inspector, Town of Southold

be and he hereby is authorized to attend the New York State Building
Officials Conference at Spring Valley, New York for two days in
September, and be it further
RESOLVED that the actual and necessary expenses to travel, meals
and lodging incurred irhile attending said conference be a legal charge
against the Town of Southold.

On motion of Justice Demarest, seconded by Councilman Rich,
WHEREAS the Southold Town Planning Board and Suffolk County
Department of Planning have prepared official reports and
recommendations on the application of Saint .Peter ' s Lutheran
Church for a change of zone from "A" Residential and Agricultural
District to "M-1" General Mutliple Residenb6 District,
NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held
by the Southold Town Board at 7 :30 P.M. , Tuesday, February 25, 1975
at 16 South Street, Greenport, New York, on the abovementioned
petition, and that the Town Clerk be and he hereby is authorized
and directed to cause notice of said hearing to be published in
the official newspaper pursuant to the requirements of law.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Demarest, seconded by .Justice Suter, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to sign an agreement with Honeycomb Fabricators, Inc. ,
41 Degnon Boulevard, Bay Shore, New York, Contractor of a dog
pound for the Town of Southold, under the following agreement:
1. - The Contractor will, at the Contractor ' s sole cost and
expense, furnish all labor and materials for the construction of a
dog pound on premises of the Town in strict accordance with the
Notice to Bidders, Proposal and Specifications hereunto annexed
and are hereby made a part of this contract as fully as if the
same were repeated at length hereti.
2. In the performance of the work provided for herein, the
Contractor agrees to comply with all laws applicable to such work
including the applicable provisions of the Labor Law of the State
of New York which said provisions of law are deemed to be- incorporated
herein by reference'.
3. In consideration• of the performance of the work as herein
provided, the Town Agrees to pay and the Contractor agrees to
receive as full satisfaction for such work the' sum of TWENTY-FIVE
THOUSAND and no/100 DOLLARS ($25, 000.00)' which said sum is to be
paid by the Town within thirty (30) days after completion of the
work by the Contractor and the acceptance thereof by the Town.

On motion of Justice Demarest, seconded by Justice Suter, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to sign proclamations of thanks and appreciation to
Dr. William Gerdes for his service to the community and Eastern Long
Island Hospital from 1962 through 1971; Dr. Claus Robohm; and Dr.
Charles Seelig from 1965 through the present day.

On motion of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that this meetingo6f the Southold Town Board be- adjourned
at 3 :55 P.M.
