Item 4 in that policy states the following: 4. Other situations where the Planning Board finds the amount of land being transferred is negligible, will result in no additional residential units being developed, and that there will be no impact to wetlands or other sensitive environmental features. Waivers Pursuant to Town Code §240-56 Waivers of Certain Provisions, the Planning Board may waive certain elements of the subdivision review §240-56 Waivers of certain provisions. "The Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law." SEQRA Pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5(c)(16), the proposed action is a Type 11 Action under SEQRA. IX. LWRP The application is EXEMPT from review by the LWRP X. Zoning Board of Appeals The ZBA has held a hearing on this application to review the proposed Lot 1, which is proposed to remain at less than the required lot size of 80,000 sq. ft. in the A-C zoning district. The lot size is proposed to remain the same at 0.57 acres or 24,888 sq. ft., however the Town Code currently requires a variance when the lot lines are changing on anon-conforming lot, even if the size isn't changing. The ZBA hearing was adjourned pending Planning Board comments. X1. Application Review. Lot Design. The proposed design, while attempting to preserve the existing lot sizes, ultimately does not present a functional lot layout for proposed Lot 1. We appreciate the intention to maintain the current dimensions; however, the Page 5 resulting flag-shaped configuration creates an awkward and impractical yard layout that fails to function well for future use. It is recommended that Proposed Lot 1 is reconfigured to remove the flag and add that area to the rear of the proposed lot so that it is rectangular in shape. XII. Items to consider A. Consider finding the application complete. Several items typically required are still missing, however they can wait and be handled as conditions if the Planning Board intends to require a change in the design of the lots. B. Consider waiving the requirement for Health Department approval prior to Planning Board approval as per the Planning Board's policy outlined above. C. Consider waiving the public hearing, as well as the usual other items in the subdivision review process listed above. D. ZBA Comments Recommend supporting the variance if the parcel labeled Proposed Lot 1 is redrawn to exclude the flag. That land can be added instead to the rear of Proposed Lot 1 and would extend the lot by an additional 407. E.
