BEGINNING at a point on the southeasterly line of a 50 foot private road hereinafter described at the
northeasterly carrier of land now or formerly of Elfers;
RUNNING THENCE along said southeasterly line of said 50 foot right of way North 52 degrees 22 minutes 50
seconds East,a distance of 125 feet;
THENCE along other land now or formerly of Bertsc South 43 degrees 49 minutes 30 seconds East,a
distance of 233.24 feet to mean high water mark of Peconic Bay;
THENCE along said mean high water mark of Little Peconic Bay on a tie line bearing South 44 degrees 13
minutes 50 seconds West a tie line distance of 125.02 feet to land now or formerly of Elfers;
THENCE along said land North 43 degrees 40 minutes 11 seconds West a distance of 250.99 feet to the point
or place of BEGINNING.
TOGETHER with a non-exclusive right of way over said 50 foot private road from the northerly corner of the
premises herein above described in a general southwesterly of southerly direction about 1575 feet to the

first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
