at Southold,in the County of Suffolk and State of New York,being more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of a certain twenty foot wide right of way,which point or place of beginning is
distant the following three courses and distances from the corner formed by the intersection of the northwesterly side of
Sound View Avenue with the northeasterly side of Hortons Lane-
(1) Westerly along the northeasterly side of Hortons Lane,564.49 feet to the intersection of the southwesterly side of
said twenty foot wide right of way with the northeasterly side of Hortons Lane;
(2) Westerly along the southwesterly and southerly side-of said 20 foot wide right of way, 112.73 feet to the westerly
side of said 20 foot wide right of way;
(3) Northerly along the westerly side of said 20 foot wide right of way, 34.08 feet to the true point or place of
BEGINNING.
THENCE North 64 degrees 50 minutes 00 seconds West along land now or formerly of Offenheimer,371.00 feet to
the average high water line of Long Island'Sound;
THENCE northerly along the average high water line of Long Island Sound along a tie line bearing of North 32 degrees 15
minutes 00 seconds East,171.31 feet to land now or formerly of Bums;
THENCE South 64 degrees 50 minutes 00 seconds East along last mentioned land,310.00 feet to the westerly side of the
aforesaid 20 foot wide right of way;
THENCE South 22 degrees 30 minutes 00 seconds East along the westerly side of said 20 foot wide right of way,15.16 feet;

BEING AND INTENDED to be the same premises conveyed to EWALD M.KARBINER and MARY ANN KARBINER,
husband and wife,and JOSEPH A.TOMITZ and JOAN H.TOMITZ,husband and wife,by a deed dated December 9,2010
and recorded in the Office of the Clerk of the County of Suffolk,on January 27,2011 in Liber 12649 at Page 606,which 50%

SAID PREMISES being known as 155 Sunset Path,Southold,New York 11971.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting the
above-described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the parry of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns
of the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
AND the party of the first part covenants as follows: that said party. of the first part is seized of the said
premises in fee simple,and has good right to convey the same,that the party of the second part shall quietly enjoy the said
premises;that the.said premises are free from incumbrances,except as aforesaid;that the party of the first part will execute or
procure any further necessary assurance of the title to said premises;and that said party of the first part will forever warrant
the title to said premises.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
