Prior Zoning Board of Appeals relief was granted on this parcel in file 92158 dated July" 22, 1976 pennitting an off -premises directional sign for"Old Oyster Factory Ltd.". This sign no longer exists and it is presurned that the relief granted in this decision is now extinguished. Improvements on the subject parcel are covered by the following Certificates of Occupancy: #Z-6002 dated July 15, 1974 covering an accessory storage building #Z-11297 dated November 16, 1982 covering a seasonal one-family dwelling #Z-17026 dated June 24, 1988 covering the addition of a deck The applicant provided, as part of their application, a copy of the Town of Southold Board of Trustees permit No, 10508 dated December 13, 2023, which includes the following, conditions: installation and perpetual maintenance of a 15 feet wide vegetated, non-turf buffer/rain garden to be placed landward of the split rail fence and the removal of the two sheds, among other things. Additionally, a stop work order, dated August 30, 2022 was included in the application. During the site visit it was observed that a hose extended from the cellar, below grade,to a distance of approximately 20 feet from the residence. The applicant's agent offered testimony that this hose is used to drain the sump-pump located in the cellar/crawl space. Furthermore,the applicant's agent indicated that while the subject lot is located in the LI Zoning District(which extends along Main Road from the west side of Kerwin Boulevard, east to Pipes Neck Road), the parcel is more closely associated with Peconic Bay Estates, and the residential lots to the east of the subject, beyond vast preserved wetlands, which are all located in the adjacent residential zoning districts: R80 and R40. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/J3JF AS( NS DRAOAR � CTIONm The Zoning Board of Appeals held a public hearing on this application on August 7, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law ` 67'-b b' 1 . Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel has continuously been used as a seasonal residence as supported by the issuance of Certificate of Occupancy #Z-11297, dated November 16, 1982. While located in the LI Zoning District, the residence, was built prior to zoning, and is more in keeping with the character of other residences along Pipes Neck Road and the homes located to the east in Peconic Bay Estates. The modest addition of living space`and decking is in keeping with the residential nature of other homes along Main Road. The subject dwelling is screened from view from Main Road by a mature hedgerow and on the opposite side of the other street frontage, Pipes Neck Road, there is a buffer of heavy mature natural vegetation. No adverse visual or other impact will occur as a result of the proposed additions and alterations.Given vast wetlands to the northeast and south, and other residences in the immediate area, a more intensive industrial use of this, small, corner property(leading to a residential, waterfront, neighborhood) would produce an undesirable change in the character of the neighborhood and a detriment to nearby properties. 14 Page 3, August 21,2025 #8025, Pittorino SCTM No. 1000-53-2-1 Town Law 267-bQ(b)(2). Flowever, the structure is covered by an existing(,ertificate of Occupancy as a seasonal residence and the alterations and additions to the structure are minimal when compared to other residences within the area. If the applicant's parcel was located in a residential zone or the property was re-zoned to allow residences within the IA Zoning District,the applicant would not be before the Zoning Board of Appeals seeking,relief 4. The applicant must comply with Chapter 236 of theTown's Storm. Water Management Code, The applicant has obtained a Wetlands Permit from the Town of Southold Board of'Frustees and proposes to establish a 15-foot-wide non-turf buffer or raingarden along the property line adjacent to the wetlands. 5. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was inl effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or-at the time of purchase. 6. lown Law§267-b.
