The parcel is undeveloped with the exception of the remains of a wire fence surrounding a former garden as shown on a survey prepared by Nathan Taft Corwin,III, L.S.,dated May 16,2025.The adjacent Lot No. 5 is an-improved parcel as shown on a survey prepared by Ward Brooks,L.S., dated December 20, 2023. Hugh Benjamin& Venie Benjamin to John and Edna Polyn: 07/08/1963 2. John Polyn and Edna Polyn to Randolph Poylyn: subject to life estate: 12/05/1996 3. John Polyn died a resident of Suffolk County on 06/04/2000 4. Edna Polyn died a resident of Suffolk County on 11/5/2000 As such,the subject parcel has not changed ownership out of the family to the current date. The adjacent parcel, SCTM#1000-107-2-5,was also held by the Polyn family,but has since.been sold to Andrea& Angelo Provvisiero on January 23,2024, recorded on February 15, 2024. The applicant's representative, requested that the Board AMEND the decision rendered on November 6, 2025 by removing Condition #1, since the applicant has already recorded the subject deed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The standards for the granting of a waiver of merger are contained in Section 280-11 of the Town Code. Sections 280-11(A)and(B) require that the Board engage in a two-prong test before granting a waiver of merger. Pursuant to Section 280-11(A)the Board must determine whether the lot proposed to be recognized has been transferred to an unrelated person or entity since the time the merger was effected. If the lot has been transferred to an unrelated person, the lot is not eligible for a waiver of merger. Pursuant to Section 280-11(B), if the lot has not been transferred to an unrelated person, the Board must engage in a balancing test of 3 factors to determine whether the lot is eligible for a waiver of merger, namely, whether(1)the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood, (2)the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation, and (3)the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district. The Zoning Board of Appeals held a public hearing on this application on October 2, 2025, at which time written and oral evidence were presented. Pursuant to § 280-11(A)the Applicant has submitted documentation to the satisfaction of the Board that there have been no transfers of ownership of the lot outside the family since the time merger was effected. Consequently,the lot is eligible for a waiver of merger. Pursuant to §280-11(B),the Zoning Board finds that: (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because: The surrounding neighborhood is characterized by lots of varying dimensions, with the majority being comparable in size to the subject parcel. Lot No. 6 is similar in area to numerous parcels located along Knollwood Lane. Many of the lots within the surrounding neighborhood are substandard in size, a condition commonly found within the R-40 Zoning District. Accordingly, Lot No. 6 is consistent in both size and character with other improved properties in the immediate vicinity. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because: There will be no discernible adverse impacts upon the physical or environmental conditions within the surrounding neighborhood. The unmerging of Lot No. 6 from Lot No. 5 will result in the creation of one additional building lot that is comparable in size and character to other lots in the vicinity. In accordance with current Suffolk County Department of Health Services regulations, the construction of any single- family dwelling on the subject lot will require the installation of an Innovative/Alternative (I/A) wastewater treatment system,thereby ensuring that minimal potential adverse environmental impacts will occur. Polyn ("the Applicant") is seeking a Waiver of Merger of the vacant parcel located at-3000-Grand Avenue, Mattituck (SCTM# 1000-107-2-6)("Lot 6") from the adjacent improved parcel located at 2900 Grand Avenue, Mattituck (SCTM # 1000-107-2-5) ("Lot 5"). Lots 5 and 6 were originally created in 1948 by a deed from Cora D. Newton and Venie B. Benjamin to Hugh and Venie Benjamin (1,2908 P154). In 1960, Lot 5 was conveyed to the Applicant's parents, John and Edna Polyn, who held title to it until 1996 when it was conveyed to the Applicant and his brother, Denis Polyn. That improved parcel was sold to its current owners, Andrea and Angelo Provvisiero in 2024. The vacant parcel, Lot 6, for which recognition is sought, was conveyed to the Applicant's parents in 1963 (L5374 P518) and subsequently conveyed to the Applicant in 1996 (L11804 P 968). Unbeknownst to the Applicant or his parents, these parcels became merged when the merger law was adopted in November 1995. The parcel has never been transferred to an unrelated person or-entity since that time. Lots 5 and 6 have always been treated and maintained as separate lots evidencing the family's intent to keep them as single and separate lots. In 2008,.the Town Board amended Section 280-11 of the Town Code to remove the=hardship criteria and add the current criteria for assessing a waiver 74. of-merger.._A review of the legislative history of the amendment demonstrates 2 that the Town Board had the express intent of making waiver of merger available_to families under the very circumstances presented here. During the public hearing on amendments to the waiver provisions on September 9, 2008, Supervisor Scott-Russell said of people who inherited properties which have -- - unintentionally-:merged "They are excluded. They are part of the group we are trying to offer relief to... related parties." The situation in which the Polyn family finds itself is a prime example of the very issue this code revision sought to remedy. The two lots owned by the Polyn family were treated as single and separate and were then passed on to their children who did not know the lots were considered merged. For the reasons explained in more detail below, the Applicant submits that a Waiver of Merger under §280-11 of the Town Code is warranted. ARGUMENT THE APPLICANT HAS SATISFIED THE CRITERIA FOR THE GRANTING OF A WAIVER OF MERGER UNDER §280-11 OF THE SOUTHOLD TOWN CODE With respect to a waiver of merger, §280-11 of the Town Code provides that: If a lot has merged pursuant to the provisions of§280- _ _ 10, the Zoning Board of Appeals may waive the merger and recognize the original lot lines upon public hearing and finding that: A. The lot proposed to be recognized has not been _. --- _- - - -transferred to an unrelated person or entity since the time the merger was effected. _ Here, as explained above, Lot 6 which is proposed to be recognized has = 3 -_not been transferred to an unrelated person or entity since it was unknowingly merged with Lot 5 by operation of law in 1995. The most recent conveyance of the lot in 1996 was to the Applicant from his parents who had owned the lot since 1963. As such, the Board can properly find that the lot remains in the Polyn Family. - Section 280-11(B) requires the Zoning Board of Appeals to balance the following factors: 1. Whether the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. Although the surrounding area is characterized by lots of varying shapes and sizes, a simple review of aerial photos on the Town's Tax Map Inquiry page confirms that Lot 6 is comparable in size to the adjacent lot and many of the nearby parcels on Knollwood Lane, with many lots being substandard in the R- 40 zoning district. Lot 6 is therefore comparable in size with other improved lots in the vicinity. 2. Whether the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. It is evident that Lot 6 is and always has been treated and maintained as - a-separate-and--independent lot from Lot 5 since the date is was created. The lot remains totally unimproved and Lots 5 and 6 have always been separate tax parcels with separate tax bills. 4 Whether-the proposed waiver and recognition will not create - _ an adverse impact on the physical or environmental conditions in the neighborhood or District. - - There will-be no perceivable adverse impacts on the physical and - environmental conditions in the neighborhood or District. Unmerging Lot 6 _-- ---from_Lot 5-will create one-more building lot that will be comparable in size with the lots in.the surrounding neighborhood and under current Health Department regulations, the construction of a single family dwelling on the subject lot must include the installation of an I/A wastewater treatment system to avoid any potential adverse environmental impacts.
