That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion.of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board prior to expiration. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. A permit issued for work not including a demolition as per the definition in the Town Code, but subsequent to issuance,the work results in a demolition,the permit is,voided and a new application must be submitted. 6. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 7. That there shall-be no interference with the right of the public to pass and repass along the beach between high and low water marks. 8. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 9. Specifically, our concern stems from the portion of the definition emphasized, "[a] vegetated area, as designated by the Board of Trustees, immediately landward of the wetland boundary, shoreline structure, or other line designated by the Trustees where no operations, maintenance,placement of signs or other activities may take place, except that man-made debris may be removed from such area by hand without the permission of the Board of Trustees." We are thus writing to respectfully ask that if we are to change the designation,the Board will stipulate to a permit condition that the Non-Disturbance Buffer would"allow for pedestrian access through the Non-Disturbance Buffer for recreation purposes, such as launching non-motorized watercraft; and maintaining and/or replacing the existing dock and split-rail fence, as needed; provided that all permits are obtained, if required by law."The recorded deed covenant can then memorialize this permit condition to preserve our rights to undertake these minimal activities within the Non-Disturbance Buffer. SWEENEY, SCTM# 1000-70-5-31.2 This application is for a Wetland Permit to raise by 1'8" an approximately 450sq.ft. portion of roof over existing, approximately 1,488sq.ft. one-story, single-family dwelling, and construct a 4'x5.75' concrete entry stair in place of existing; construct a 9.9'x14.7' screened porch addition with 3.6'x4' concrete entry stair, and a 19'x35' uncovered masonry patio (raised 16" max. above existing grade) with steps and adjacent trench drain piped to a proposed stormwater containment system consisting of roof leaders, gutters and two (2) 10' diameter drywells; truck in approximately 15 cubic yards of clean sand fill from an approved upland source to be placed and compacted beneath footprint of porch addition; and to establish and perpetually maintain an approximately 1,010sq.ft. vegetated non-turf buffer between the tidal wetland boundary and existing fence, and a maximum 13-foot wide, approximately 1,129sq.ft. non-turf buffer between existing fence and 6-foot elevation contour. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: 5.1 Prohibit direct or indirect discharge that would cause or contribute to contravention of water quality standards. 6. 1. Protect and restore the quality and function of Town of Southold's ecosystem. B. Protect and restore ecological quality by adhering to the following measures. 2. Retain and add indigenous plants to maintain and restore values of natural ecological communities. b. Include the use of suitable indigenous plants in the landscaping plans for new development and in redevelopment projects where loss or disturbance of existing indigenous plants could not be prevented during construction. 3. Avoid fragmentation of ecological communities and maintain corridors to facilitate the free exchange of biological resources with and among communities. b. Where fragmentation of ecological communities has already occurred, the adverse effects of fragmentation can be mitigated by maintaining or providing connecting corridors to allow exchange of biological resources. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. C. Prevent the net loss of vegetated wetlands according to the following measures. Use the measure resulting in the least environmentally damaging practicable alternative. 3. Provide compensatory mitigation for adverse impacts with may result from the unavoidable fill, excavation or other activities remaining after all appropriate and practicable minimization has been accomplished. 2 While pre-existing nonconforming wetlands setback of the existing dwelling means that the proposed patio addition will unavoidably encroach further on the wetland setback, the applicant has kept the addition within the "square off' footprint of the building and proposed several actions that will mitigate for this minor encroachment. These actions include improving rainwater catchment and recharge through installation of a stormwater containment system designed for a 4-inch rainfall event and establishment of 2,139 sf of vegetated non-turf buffer area between the existing home and the wetland boundary. SWEENEY 647 PINE NECK ROAD SOUTHOLD,NY SCTM#1000-70-5-31.2 STATEMENT OF EFFECT The proposed project is designed to enhance the use and recreational enjoyment of the waterside of the existing dwelling on this waterfront property in the least environmentally impactful way possible, namely through the addition of a screened-in porch and uncovered patio addition,rather than through the addition of enclosed, conditioned space, for example. All of the proposed construction is located within a FENIA Zone X flood zone adjacent to Jockey Creek, and thus well protected from potential flood and erosion damage, and project limiting fencing will be installed during construction to contain potential runoff and sedimentation during construction. With respect to the proposed design,the 9.9' x 14.7' porch is limited in size to that which will "square off'the existing void on the waterside of the house and will thus not create any diminishment of the existing wetlands setback to the existing dwelling footprint. Due to the preexisting location and nonconforming wetlands setback to the dwelling, the proposed waterside patio would unavoidably encroach further upon the wetland setback, but the patio has been painstakingly designed to be raised only minimally above the downward sloping grade, a maximum of 16 inches above existing grade; it will remain entirely unroofed and uncovered; and it will be equipped with a trench drain at its waterside base,piped to a proposed stormwater containment system, which to maximize stormwater capacity has been designed for a 4-inch rather than 2-inch rainfall. Specifically,the system consists of two (2) 10-ft diameter drywells, also connected to gutters and leaders to capture and recharge roof runoff from the renovated dwelling and porch addition. Both additions would remain set back well landward of the pier line formed by the neighboring dwellings, and together would increase Town-defined lot coverage only to 6%where 20% is permissible. And to mitigate the additional structural footprint within the required wetlands setback, an approximately 1,010 sf vegetated non-turf buffer is proposed to be established and perpetually maintained between the tidal wetland boundary and existing fence; and an up to 13-ft wide, approximately 1,129 sf non-turf buffer is proposed between the existing fence and 6-ft elevation contour. Together,this combined 2,139 sf buffer area, an area more than 2.5 times larger than the total proposed construction footprint, will serve to protect and restore the quality and function of the adjacent wetland by reducing the area of maintained and potentially treated turf lawn adjacent to wetlands; increasing the separation distance between wetlands and any such areas; and enhancing the upland area's capacity to absorb, recharge, and filter excess nutrients and potential contaminants from runoff before reaching the surface waters of Jockey Creek. SWEENEY 647 PINE NECK ROAD SOUTHOLD,NY SCTM#1000-70-5-31.2 POLICIES 5 & 6 The proposed project is designed to enhance the use and recreational enjoyment of the waterside of the existing dwelling on this waterfront property in the least environmentally impactful way possible, namely through the addition of a screened-in porch and uncovered patio addition, rather than through the addition of enclosed, conditioned space, for example. All of the proposed construction is located within a FEMA Zone X flood zone adjacent to Jockey Creek, and thus well protected from potential flood and erosion damage, and project limiting fencing will be installed during construction to contain potential runoff and sedimentation during construction. With respect to the proposed design,the 9.9' x 14.7' porch is limited in size to that which will "square off'the existing void on the waterside of the house and will thus not create any diminishment of the existing wetlands setback to the existing dwelling footprint. Due to the preexisting location and nonconforming wetlands setback to the dwelling,the proposed waterside patio would unavoidably encroach further upon the wetland setback, but the patio has been painstakingly designed to be raised only minimally above the downward sloping grade, a maximum of 16 inches above existing grade; it will remain entirely unroofed and uncovered; and it will be equipped with a trench drain at its waterside base,piped to a proposed stormwater containment system, which to maximize stormwater capacity has been designed for a 4-inch rather than 2-inch rainfall. Specifically,the system consists of two (2) 10-ft diameter drywells, also connected to gutters and leaders to capture and recharge roof runoff from the renovated dwelling and porch addition. Both additions would remain set back well landward of the pier line formed by the neighboring dwellings, and together would increase Town-defined lot coverage only to 6%where 20% is permissible. And to mitigate the additional structural footprint within the required wetlands setback, an approximately 1,010 sf vegetated non-turf buffer is proposed to be established and perpetually maintained between the tidal wetland boundary and existing fence; and an up to 13-ft wide, approximately 1,129 sf non-turf buffer is proposed between the existing fence and 6-ft elevation contour. Together,this combined 2,139 sf buffer area, an area more than 2.5 times larger than the total proposed construction footprint, will serve to protect and restore the quality and function of the adjacent wetland by reducing the area of maintained and potentially treated turf lawn adjacent to wetlands; increasing the separation distance between wetlands and any such areas; and enhancing the upland area's capacity to absorb,recharge, and filter excess nutrients and potential contaminants from runoff before reaching the surface waters of Jockey Creek.
