Dear Mr. Finnegan;
We are in receipt of your letter, dated September 25, 2025, requesting a de minimus approval related to
ZBA determination#7854, dated December 21, 2023, in which variance relief was granted to construct a
single family dwelling and an accessory garage upon the above referenced premises.
In your letter, you explain that the proposed construction has been amended by moving the dwelling into
the widest portion of the building envelope and pivoting the house slightly in order to become more
code conforming. As a result, the front yard setback is 41 feet and 10 '/2 inches instead of 40.3 feet and
the top of bluff setback is 89 feet and 10-1/8 inches instead of 89.8 feet. In addition, the exterior fagade
of the proposed garage was enhanced to be more consistent in design with the house and remains in the
same location. The site plan and architectural plans were revised accordingly by Alexander Ridgway,
Architect, dated August 15, 2025.
I have reviewed your request, your revised plans along with the Zoning Board of Appeals records, and
have determined that the changes proposed are less non-conforming and de minimus in nature.
Please note all conditions of approval shall remain. Submit two (2) dated, signed and sealed site plans
and architectural plans depicting-the changes, and contact our office if you have any further questions.

NAME OF APPLICANT: Fishers Island School District/Ferry View LLC
PROPERTY LOCATION: Reservoir Road, Fishers Island,NY SCTM#1000-9-8-1.
S'E RA DETERMINATtQLN: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA.
SUFFOLK COUNTY AD11a'LINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning
issued its reply dated October 26,2023 stating that this application is considered a matter for local determination
as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront
Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP)Policy Standards. The LWRP Coordinator issued a recommendation dated December 1,2023. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy
standards and therefore is CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTIO The subject property is a conforming 2.4-acre parcel located in an R-
40 Zoning District. The parcel is runs+/-348.00(Deed)feet along Fishers Island Sound,runs 249.95 feet along
Reservoir Road, runs 186.45 feet on a radius on the North East side, runs+/-232.7 feet on the North side and
then parcel runs +/- 363.10 feet on the South side. The property is currently vacant as shown on a survey by
Craig P. Bigger L.L.S., dated May 18,2023.
BASIS APPLICATION: Request for Variances from Article III, Section 280-14; Article XXII, Section
280-116A(1);and the Building Inspector's August 11,2023,Notice of Disapproval based on an application for
a pen-nit to construct a single family dwelling and an accessory garage, at; 1) dwelling is located less than the
code required minimum front yard setback of 60 feet;2)dwelling is located less than the code required 100 feet
from the top of the bluff; 3) garage is located in other than the code permitted rear yard; located at Reservoir
Road,(Adj.to Fishers Island Sound)Fishers Island,NY. SCTM#1000-9-8-1.
RELIEF REQUESTED: The applicant requests variances to construct a two-and one-half story residence with
a front yard setback of 40.3 feet where town code requires a minimum 60-foot front yard setback. The proposed
new dwelling is located 89.8 feet from the top of the bluff where town code requires a minimum of 100 feet
setback from the top of the bluff. The applicant also proposes to build an accessory garage in a side yard

location where town code requires accessory garages to be located in a rear yard location or in the case of
waterfront parcels accessory garages may also be located in a front yard location.
FINDNGS OF ACT/ISI.ASONS FOR BOARD ACTION.-
The Zoning Board of Appeals held a public hearing on this application on December 7,2023 at which time
written and oral evidence were presented. Based upon all testimony„ documentation,personal inspection of
the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to
be true and relevant and makes the following findings:
1. Town Law§267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. The neighborhood is a waterfront neighborhood
consisting of single-family waterfront homes. The proposed dwelling with accessory garage is similar to the
architectural style,size,and scale of other homes in the neighborhood.
2. own-,Law aw 267-b(1J(b 2 . The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance. The lot is a narrow lot and is oddly shaped
with two curved areas. The applicant is proposing to locate the house and garage as far away from the bluff as
practically possible. The property is wide with little depth so a code conforming building envelope is too narrow
to build an appropriately sized dwelling similar to others in the neighborhood without variance relief. There is
no code conforming location on the subject lot to locate an accessory garage.
3. Town Lawv§267-bQ)(b)Q), The variances granted herein are mathematically substantial. The variance
granted herein for the non-conformin.g, 0.3-foot front yard setback represents 33% relief from the code. The
variance granted herein for the non-conforming bluff setback represents 10.2% relief from the code. The
variance granted herein for the non-confirming garage location represents 100% relief from the code.
However,the applicant designed the house to conform to the character of the neighborhood while achieving the
greatest bluff setback that is possible. The applicant's proposed design protects the environment to the greatest
extent that is practicable by achieving the proposed bluff setback.
4. Town Law 267-b(, )(b)(4). No evidence has been submitted to suggest that,a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood.The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. 'Town Lave 267-b 'b 5 . The difficulty has been self-created. The applicant purchased the parcel after
the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6.Town-Law 4267-b. Grant of the relief as requested is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of a residence with accessory garage while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.
IESOLUJ ION"OF THE BOARD:In considering all of the above factors and applying the balancing test under
New York Town Law 267-B,, motion was offered by Member Dantes, seconded by Member Acampora, and
duly carried,to
GRANT the variances as applied for, and shown on the Architectural Plans, labeled lower-level floor plan,
upper-level floor plan, attic level plan,, conceptual West elevation, conceptual North elevation, and garage
elevations, prepared by Alexander Ridgeway, R.A. last dated October 10, 2023; and the survey prepared by
Craig P. Bigger L.L.S. dated May 18, 2023.

exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the
Building Department of a building permit and/or the issuance of a Stop Work Order,and may require a
new application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or
survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the
relief granted herein, are net authorized under this application when involving nonconformities under the
Zoning code. This action does not authorize or condone any current or future use,setback or other feature
of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features
as are expressly addressed in this action.
TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the
Town of Southold any variance granted by the Board of Appeals shall become null and void
where a Certificate of Occupancy has not been procured, and/or a subdivision map has not
been filed with the Suffolk County Clerk,within three(3)years from the date such variance
was granted. The Board of Appeals may,upon written request prior to the date of expiration,
grant an extension not to exceed three (3) consecutive one(1)year terms.IT IS THE
PROPERTY OWNER'S RESPONSIBILITY TO ENSURE CO PLIANCE'VVITH THE
CODE REQUIRED TEME FRAME DESCRIBED HEREIN. Failure to comply in a timely
manner may result in the denial by the Building;Department of a Certificate of Occupancy,
nullify the approved variance relief,and require a new variance application with public
hearing before the Board of Appeals
