The proposed lot line change to merge tax snap# 1000-13-8-10 to the western adjacent lot tax map# 1000-123-8-09 is not permitted pursuant to Section 280 Attachment 3 Bulk Schedule for Residential Districts R-40,which required a newly created lot to have a lot width of 150 linear feet. The proposed merger will create a lot width of 100.54 linear feet. The proposed merger will create a lot that requires approval from the Southold Town Planning Board. Additionally,the proposed new construction, on the potentially created lot having a buildable lot area of 58,885.80 square foot in the Residential R-40 Zoning District, is not permitted pursuant to Article IV, Section 289-17A(1), reference Article III 280-13A(l) which states: One-family detached dwelling;, not to exceed one dwelling on each lot. PLANNING BOARD MEMORANDUM: On May 24, 2024, the Zoning Board of Appeals received a Notice of Memorandum from the Southold Town Planning Board in reference to this application. The'Planning Board supports the substandard and nonconforming width of 100.54, where 1.50 feet is required. The merger would result in the elimination of a nonconforming lot. If the lots are merged,the resulting parcel would be made less nonconforming in the R-40 District. The proposal will eliminate the nonconformity,of the two dwellings on one of the parcels. The buildable area of the lot and new dwelling are not located within a mapped. FBMA Flood Zone. While the Planning Board agrees with the merger it had pause to approve the allowance of the one existing single-family dwelling being allowed and the code does not allow for more than one dwelling per lot. However,,the Board reconsidered'the request to allow the existing dwelling if it were to be put on the'Town Affordable Housing Registry and rented year-round. There is no basis for the ZBA to impose covenants and restrictions on the second existing dwelling for use as a year- round affordable rental as suggested by the Planning Board ADDITIONAL, INFORMATION: The proposed remaining dwelling on parcel 123-8-10 is a legal pre-existing nonconforming residence. Prior ZBA. decision#7589 in 2022 variance relief was granted for the construction of a new single-family residence on a neighboring property with an existing second dwelling,. The applicant will be installing a new (I/A) Innovative Alternative Onsite Wastewater Treatment System for both existing and proposed dwellings. The Site flan for the new dwelling along with the in-ground swimming pool and the one and one-half story garage was prepared by Jonathan Karl Paetzel,Landscape Architect, and dated March 25,2024. Page 3,June 20,2024 #7913,JSK Park Avenue SCTM No. 1000-123-8-9& 123-8-10 FfNDINGS OF-1~ACT/1-EASONS FOR-BOARD ACTION' The Zoning Board of Appeals held a public hearing on this application on June 6,2024 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board rinds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-bL3)Jb)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is mixed with,parcels meeting the 150-foot width requirement while there are others that do not. Also,there are:other improved properties in the neighborhood that have two single-family dwellings on one lot. If the merger is approved, it will not change the character of the neighborhood. 2. Town Law§267-b(3)( )(2)._The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue,,other than an area variance. Without approval to merge the two lots and demolish three of the existing dwellings,the applicant cannot achieve the benefit of combining these substandard parcels to create a single parcel with a conforming lot in the absence of variance relief, as there is no way that the code required lot width can be achieved. 3. Town Law &267-!!(1gb 31. The variances granted herein for the lot width is mathematically substantial, , _.)L representing 33% relief from the code. However, the merger will reduce the nonconformity of the lot and the lot width is consistent with other parcels in the neighborhood. 4. Town Law .§267-bQ(b)ffi. No evidence has been submitted to suggest that a variance in this residential conimunity will have an adverse impact on the physical or environmental conditions in the neighborhood. The: applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-bQ)(b)M. The:difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in elfect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the:Zoning Code in effect prior to or at the time of the purchase. 6. Irown Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single merged lot with a new single-family residence with a new in-ground swimming pool and a new 11/2 story garage and keeping the existing single-family dwelling while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RELSOLUTION_OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora,seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the Site Plan prepared by Jonathan Karl Paetzel, Landscape Architect and last revised March 25,2024 SUBJECT TO THE FOLLOWING CONDMONS: I The septic system on the subject property must be approved by the Suffolk County Department of Health Services for a new I/A OWTS Innovative Wastewater Treatment System for both the existing and proposed dwellings. 2. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined to the upland area landward of the top of bluff. 5. Equipment,Material Stored Away from Crest of Bluff The storage of construction equipment and materials shall be confined to upland areas landward of the crest of the bluff or hill. 6. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional condition until the project has been completed and the area has been stabilized. 7. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 8. No Alteration of Bluff for Stairway Alteration of the existing grade of the bluff or hill during construction of the stairway is prohibited. 9. Stairway Design The stairway must be elevated a minimum of 3 feet over grade to minimize disturbance or loss of the natural vegetation and reduce the potential for causing or accelerating erosion of the bluff or hill. Disturbance to the natural vegetation or topography seaward of the crest (top') of the bluff or hill must be restricted to an 8-foot wide area,including the width of the stairway, as shown on the approved plans. lo. Wood Preservatives a. Pressure treated wood used for construction of in-water structures must have undergone a treatment process approved(stamped or otherwise marked as certified) by the American Wood Preservative Association. b. Wood treated with Pentachlorophenol (PCP) must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three months prior to in-water use. c. The use of creosote treated wood is prohibited both in the water and upland areas. d. Chromated Copper Arsenate (CCA)pressure treated wood must be clean and free of CCA surface deposits. Wood with surface deposits must be washed for at least 5 minutes under running water prior to use. The washing must occur greater than 100 feet landward of any regulated wetland and/or water body. (Note "E." below for handling wash water.) e. Any wood debris such as sawdust or wash water must not enter any water body, including wetlands or protected buffer areas. 11. Clean Fill Only All fill shall consist of clean sand, gravel, or soil(not asphalt, slag, flyash,broken concrete or demolition debris). 12. Department Jurisdiction The department retains jurisdiction of all regulated lands where fill has been permitted. Placement of fill shall not be used to alter the department's Tidal Wetland jurisdictional area at the project site. The area remains a regulated area subject to Tidal Wetland Land Use restrictions of 6 NYCRR Part 661. 13. Vegetate All Disturbed.Areas The perrnittee shall revegetate all exposed faces and disturbed areas to prevent soil erosion prior to the project completion or expiration date of this permit,whichever cones first. Seeding Disturbed Areas Aft areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses,etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then,the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. is. Temporary Mulch,Final Seeding If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather conditions favor germination and growth but not more than six months after project completion. j6. Plant Beach Grass The area of fill placement shall be planted with American Beach Grass planted 12 inches on center during the first growing season following placement, but not more than,6 months following the placement of fill. The permittee shall maintain a beach grass survival rate of at least 85% after 3 years. Any grass planted after April 15 of any calendar year shall be irrigated. 17. Long-term Plant Survival The bluff shall be planted with American Beach Grass and the permittee shall ensure a minimum of 85% survival of plantings by the end of five growing seasons. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/ silt curtains (or other NYSDEC approved devices)placed on the seaward side between the rill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 19. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately mid completely disposed of in an authorized solid waste management facility. These materials shall be suitably stabilized as not to re-enter any water body, wetland or wetland adjacent area. 20. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 21. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 22. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants,epoxy coatings,paints, concrete, leachate or any other environmentally deleterious materials associated with the project. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 24. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood Rows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if,upon the expiration or revocation of this permit, the structure, fill,excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. GENERAL CONDITIONS - Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department)to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this pen-nit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. 2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. Applications For Permit Renewals,, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any fanns or supplemental inforinationthe Department requires. Any renewal, modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before pen-nit expiration for the following permit authorizations: Tidal Wetlands. 5. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership.
