A regular.. meeting of the Southold Town Board was held at 1.:00 P.M. ,
Thursday, August 12, 1976 at- the Fishers Island School, Fishers
Island, New York. Supervisor Martocchia opened the meeting- and
introduced 'the following indiv.iduals' present:

Moved by Justice Demarest, seconded by. Councilman Homan,
WHEREAS, ' Eastern Long -Island Kampgrounds, - Inc. has' filed an
application and plan with the Town Clerk for a permit to operate
a.. tourist camp to be located at the southwest corner of Queen
Street and County Route 27 near the Village of Greenport, pursuant
to the provisions of .Chapter 88 of the Code of the Town of Southold,
and
WHEREAS, a public' hear.ing was held by the Board with respect
to said application on the- 10th day of August, 1976, at which time
all interested persons were given an opportunity_ to be heard with
respect to said application, .arid
WHEREAS, the applicant has obtained the approval of the Southold
Town Planning. Board. of the -site plan, . and special exception approval
of. the Southold Town Board. of Appeals, all in accordance with Chapter
100 of the Code of the Town of Southold, and-
WHEREAS, this Board, Yas- examined said plan of the proposed
tourist camp' which consists of 73. units; an administration building
with a swimming pool adjacent thereto and a parking field comprising
20, 000 square feet likewise adjacent to said administration building
and two satellite buildings which said plan appears to be in compli-
ance with the provisions of the Code of the Town of Southold,
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS :
A tourist camp permit is hereby granted to Eastern Long Island
Kampgrounds, Inc. for the" establishment, maintenance and operation
of a tourist camp to contain not more than 73 units on premises
located on the south side of County Route 27 and generally bounded
northerly by County Route 27 ; easterly by Queen Street and land of
Bolling; southerly by land of the Village of Greenport; and westerly
by lands of Fenno, Francisco and Sledjeski, and the Town Clerk is
hereby directed to issue such permit, subject, however, to the
followingiterms and conditions, to wit:
a. That the public water supply and sanitary sewage disposal
to the premises for which said permit is issued shall be supplied
by the Incorporated Village of Greenport at the sole cost and expense
of the applicant which said water supply and sewage disposal systems
shall comply with all of the requirements of all agencies having

jurisdiction thereof, and said water supply and sewage disposal systems
shall be installed and in operation prior to the occupancy of the
premises -for' any purposes whatsoever.
b. That in the event that- any portion of the premises located
within 100 feet of the land owned by the Village of Greenport is
utilized for campgrounds or trailer sites, a six foot chain link or
equivalent type fence shall be'- erected and maintained along the
boundary line of said land of 'the Village of Greenport. That prior
to April 1, 1977 the applicant shall e.rect -and maintain a similar
type fence- along the entire boundary line of applicant's premises
abutting the lands of Fenno, Francisco and Sledjeski.
c. That the portion of applicant's premises adjacent to County
Route 27 to a distance of 100 feet therefrom shall at' all times be
maint*ined-_' s a' landscaped buffer zone and no buildings or structures
of any -type whatsoever except an' id.ehtification sign shall be erected
or mairitaiiied 'therein. 'Thact the type and location of landscaping
within ,said buffer zone shall be of the type 'heretofore -approved by
the Planning Board of -the Town of Southold- that in the event that
County Route 27 shall be widened, altered or 'relocated said buffer
zone shall be extended so that said buffer zone shall at all times
extend '100 -feet from said highway.
"-d. That 'to minimize traffic hazards that may occur- by "reason
of trailer vehicles entering and leaving said premises, suitable ,
turnoff or deceleration lanes or such other highway facilities as the
agency 'having jurisdiction of County Route 27 shall prescribe shall--be
provided and constructed prior to -the use of any portion of the premises
for tourist camp -uses.
e ` That in order to provide suitable access to the premises 'over
Queen Street, a 33 foot wide town highway, the same will' be required to
be widened to 50 feet along its entire length. Prior to the occupancy
of the premise's for tourist camp purposes, 'th-e applicant shall at its
own expense •improve and pave a. 17 foot strip along the entire westerly
boundary of Queen Street in accordance with the present town highway
requirements aEd when so improved and paved, dedicate the same to the
Town of Southold.
f. That .the portion of the premises extending from a point 100
feet south of County Route 27 to a point 600 feet south of County
Route 27 shall be restricted to open recreational uses with no
structures erected'-thereon. -The -term "structures" when used herein
is intended -and -construed 'as not •to -prohibit the erection rand
maintenance in said open recreational area of suitable fences,
facilities -and -equipment -necessary and -incidental to--the 'open -
recreational -activities.- -to be -conducted thereon: -
g:- -That -the=-premises -for which-a permit is :hereby' authorized
shall be used oiily-•for -the* purpose- bf operating thereon -campgrounds
fra-nehised- by -Kampgrounds of` America;- -Ihd.'; -in accordance with a11,"of
the ordinances,- laws, _and regulations -of the -Town of Southold 'and -other
governmental agericies- having ,jur-isdiction thereof -and -no• building-s or
structures shall be 'erected or maintained bft� the premises nor shall the
premises .be used for 'any- user-except the Aisbs specified herein and uses
accessory and - ncidental thereto.-
h. That a parking -lot of at least 20, 000 square feet in area to be
-constructed in accordance with the Southold Town highway specifications
located-.adjacent to -the main administr-a•tion building shall be completed
prior' to the u-se of• the ''premises for•-tourist camp purposes.
That except as otherwise provided herein, said tourist camp shall
be constructed, - maintained and• operated -in comp liance'with• the-•site plan
approval granted by-the Southold -Town' Planning Board on June 2-1,. 1976 :
the special--exception -use granted' by--the •-Southold--Town--Boa-rd of -Appeals on
July 22,_ 1976- -and-- the terms and conditions of- Chapter• 88 -of' the,Code of
the Town- of Southold. -
3." That- the fee -for such- license authorized~ hereby- shall be- $730.00
and any a•nd all- sums--in• excess--thereof--he-retofore -pa-id,by the applicant
paid to the Town Clerk are - hereby directed to- be refunded to the applicant.

This resolution,.was..declared. duly adopted.
Mr. John P. Gaillard, President of the Fishers Island Civic Association
asked why the KOA.,.resolution was adopted on Fishers Island, since it
does not affect Fishers Island, and might be restrictive to the _people
on the Long Island side, not being .present when such a permit is
granted.--Supervisor, Martocchia stated _a public- hearing was -held on
August loth at which time, everyone, was..given an opportunity . to be
heard, the hearing date was .advertised in the two local newspapers,
thereby notifying -the public of such .a. hearing. All that ,is,.remains
is for the Board to take action on the application for a tourist
camp .,which they are doing at this meeting rather than holdup their
action .until. the. next board .meeting ,on August 24th.--One indi;v_idual
asked if e ther :is any tax. money. involved?-}Supervisor, Martocchia -
stated.-it, is: a private franchise. business.. _r,;.
Supervisor opened the meeting to the public, stating they are here on
their annual visit to hear some of their problems and possibly resolve
them.
The question was asked if Superintendent of Highways Dean is on the
island today?--Supervisor _Martocchia ,stated. he is not, he is in .the .
process of seeing to the removal of 700 loads of debris left by the
.hurricane on Monday night. He will be over soon with a representative
of. a road construction company and his deputy superintendent.
Mr. Gordon Ahman :asked if the board knew why the Coast Guard evacuated
Fishers Island at -2 :00 P..M. on the day of the hurricane, leaving the

residents .virtually abandoned? They asked if the board had any
authority to speak .to someone,. such_. as„a senator,_, to prevent. this
from happening again.---Supervisor Martocchia said he would .try .to
find out what the reason was for this evacuation of the Coast Guard
and have a reply for the residents.---Justice Suter stated there was
a federal notice put out in the middle of -the afternoon on Monday
that all federal agencies were to secure their own property; , they
were just following orders. They .were to go to a secure .place .so
they could .return ,as, soon as -the storm was ,over .to, aid the residents.

Mr. John P. Gaillard, President of the Fishers Island Civic Association
referred to a letter he wrote to the, supervisor .raisi.ng a number of
questions. He also thanked- him for his :help., last ,year ,in aiding the
fire. department, in getting the county, police boat which was used for
evacuation- of emergency cases when...private boats and the coast guard
were unavailable last winter. He has been informed that after- a haul-
out the boat was found to be not .seaworthy.---Ariother individual .stated
that the boat was hauled-out at Pirates .Cove Marina and examined by .
Chief Wall- and Peter Sanger, and it was Mr. , Sanger`s recommendation.
that the boat be given back to the county as the hull is not a.s- ;good
as it .shou•ld be, the, engines are not fresh water cooled and might go
at any minute, and in anything over 25 mph winds the boat- might -go.---
Supervisor Martocchia stated that the- boat came from the office of
Emergency Preparedness and wa.s viewed by him when it arrived- in Orient
pnior . to being sent over. to Fishers Island and it seemed like a, very
good boat, he rode- on it himself. He cannot understand how it went
down hill so fast; .and hates to think what the county will :say when
they, get, th,is boat .back in the condition it is purported to be in.
the original plan ,was to return the ,boat-, after the winter, but he was,.,
able to keep it at Fishers Island for as long as they needed it. He
did see a report of the study of the boat by Pirates Cove Marina,, and
would have to accept their assessment .as they undoubtedly know more
about boats; than- he does. He sta-ted -he _might be able to get- them a%
4.5 ft. picket boat very shortly. It is not as fast as the present
boat, but is very heavy and comfortable.

Mr:. -Gaillard stated the islanders are concerned that -they have *not
been able:.to. obtain- the $100, 000.00 for the replacement of the dolphins
which,:have deteriorated at Silver .:Eel...Pond. The entry is dangerous in
.winter weather. Mr.' Gaillard wished 'to remind the board that ,is is a
real problem to the island and .still dragging three years after the
appropriation was originally made. He :asked whether, 'the Orient Point
discussion: a•s to whether or .not it was advisable to increase the •ferr.y
service and for that purpose-remove the ferry landing at Orient have
anything to -do with the delay in the appropriation for them?-.---
Supervisor .Martoc'chia' had a letter hand-delivered from Austin Emery
who could not answer because• he was not invited to this meeting, giving
details of everything he has done up to this point. An* hour ago a
message 'was received from Assemblyman Duryea 's officer The project
has been approved by three different govenors, four different sets
of legislative sessions, but the Department of the 'Budget operated by
civil service employees has refused 'to let the money go. These --
employees have. not let the money .go becuase they feel, _the money would
be used to . "make a few wealthly people happy Supervisor Martocchia
stated' it has been approved, ' and it will be released as soon as it
can be- worked out. with. the, Department of Budget people.---Mr:. Gaillard
asked if Senator• Guiffreda has joined• with, Assemblyman -.Duryea in this
action?-=-Superviso-r Marto'cchia stated he* has ,.not- talked with 'Senator
Guiffreda:,about- it-:- • Assemblyman Duryea-.=h,ad paanned. to be•.on. Fishers
Island toady, but could .not fly over due :to the fog.---Mr-.- Ga'illard
asked •that the Board indicate to Senator Guiffreda and Assemblyman
Duryea that the islanders have long needed this project, have long
been promised it.-=-Supervisor: Martocchia stated; they would- -be happy
to do it.
Mr. Gaillard -asked for a. speedy review of Fishers. Island roads: so they
may have a-- copy ._ of the road .Map••:for ,the island. When- the -taxpayers . see
their -taxes- of $54; 000.00 for Fishers Island alone assigned to. maintenance
of Highway 1:; 2., 3,4. in- the tax notice,= roads. which they- do not use at all,
and 'ask what '.the total salaries of. the. 2 2 maintenance men. and .the supplies
used on- Y..I.:,. no major :ma.in.tenance or surfacing of. -dirt roads. have .been
done.----Supervisor-:Martocchia, :presented Mr. Gaillard 'with a: 'Ii-st of town
roads on F.I.---Town Attorney Tasker stated that about ten years- '.ago it
appeared• there. -were many roads on F.I. that were maintained -by the.
highway 'department although our records, indtica-ted -they were never officially
taken as town roads. At that time the then superintendent of:.highways and
the town justice on F.I.. reviewed the roads to determine which roads which
had been worked -and, used- and -maintained by the town: for. :•a.• period:-of_ ten
years, because under statute law., if a highway department works and
maintains a road for a period of ten year:s, .the statute- requires that the
superintendent of highways may make an order o.fficia,lly laying,-this out
as a town highway and putting it on the records. He is now trying to
cover the •remaining 'are.as of F.I. and -then reviewing--with -the. local.
maintenance men here how many years- ,those roads. which are. not officially
on the town, records, have been worked and if -they= qualify .to be .turned
over as, town roads, ' and then from that .a map :will be-prepared showing
those roads:-_=-Mr:: -Ga-i-llard -•feels- that: any% draft, of these town-.'roads
should be the subject of a meeting between Mr. Dean and member.s.,of the
community, so the map can be checked before being confronted with roads
which might be subjected to, maintenance by :the . town._-Mr. Tasker:.further
explained. the ••procedure• of dedication• of 'town .roads and of taking- roads
by user.---Mr. A.. John. Gada -stated- he ,_thinks th-e,. Fishersi Island Utility
Company has a series of master maps giving' a complete list of the roads
on the, island.

received a generally neutral reply because it has become a political

EPA the .Navy: and Army Corps .of Engineers are a strong combination.
They hope- .to. arrange .a. meeting with . the- Corps, of Engineers_ and EPA,

Supervisor made by way of resolution to endorse the East Hole and join
the States, -of Connecticut and New York in urging the closing of the

Mr. Gaillard asked about the tidal wetlands act,,_:and -requested a short
briefing on how the town system works with respect to issuing builidng
permits, :particular.ly -where houses may;:encroach on wetland areas -and
liason -in, that connection '•is maintained by- the Planning -Board, .town
and county- conservation and. public health -.officials-? It would help - . -.
home builders know . in advance what requirements they must meet for a
building permit and certificate of occupancy.---Supervisor-. Mar-t'occh•ia-
stated the town has its own wetland ordinance. Most people that wish
to build start off- with -a-ft..application to the town building -depa-rtment,
and they .-ma-y .have to,.go :to, Stonybrook' where they: have to apply; they.-.
then send of inspector -o,u't. ---Building: Inspector Terry statedr.an application
must be made, to the,. DEC.; they give a- letter of approval ;or, disapproval.
If approved, .the' next move is to the--health ,department, they also review
the survey and application; if- they- approve-•it.,'a serial ,number-. .is -
assigned to it and it is then presented to the building department.
A certificate of occupancy is not given by the town until approval of
the health department for water and sewage disposal and the underwriters
approval for electrical...
The question was asked if the board could forsee three of four years in
the future, as to how taxes in the town will increase?---Supervisor
Martocchia indicated that the tax bull is broken down, and better than
50/ 50 60/ is for school. As far as county tax is concerned, they see
a problem where the town might be included in taxes covering the Suffolk
County sewer, which does not affect Southold Town. In another area the
town is concerned with the CSEA and PBA demands for their contracts which
become effective January 1st. Many areas of revenue in the town is fall-
ing off, sand and gravel is not what it once was, there is less building,
mortgage tax from the county is not as much as it was, assessment, due
to lack of new construction is not climbing as high percentage-wise.
However, the. town is very dollar concious and careful of the tax-
payers money; therefore he does not see a very great increase in the
town tax; but there are about nine other items on the tax bill, such
as special, districts, -schools, light, ,water, fire, library, the town
is only the collection agency for them. Over the past ten- or twelve.
years the .rate on the town level has changed very little, but the over-
all tax has risen.---T1he., question was asked if the town didn't
have to send notice by mail to all the taxpayers of a budget vote?--- .
Supervisor Martocchia stated it is advertised in both of the local
papers, and two hearings are held, one in the afternoon, and one in
the evening. However, the budget is not voted on by the public, a
public hearing is held. The school budget is voted on.
Mrs. James Wall asked questions relative to the health department.
She asked how the health department can make a ruling and them come
and inspect and make the property owner change the location of the
septic system. Supervisor Martocchia stated he would look into the
situation. Building Inspector Terry explained his knowledge of the
situation.
Supervisor Martocchia stated that if the people on the island wanted
any one of. the particular heads of departments to come to the island
he would arrange it.
The question was asked if there is provision for absentee ballots for
school board or ferry budget votes?---Town Attorney Tasker
stated he does not think so:
The question was asked what other meetings the board had with individuals
prior to this meeting?---Supervisor Martocchia stated he met with
representatives of the Island People ' s Project and another meeting
with contractors on the island. Supervisor Martocchia stated ,these
meetings were merely discussion and held at the request of those
