This resolution was declared duly adopted. Before voting on' the foregoing resolution .Justice Demarest pointed' out that ,$60,448.00' in interest was, earned by the Town ' through th6 "Supe'rintendent of 'Highways account and. other funds. Sherley Katz questioned -if 'this was through Federal Revenue Sharing funds?`''-Justice Demarest' stated that it. was not. Federal Revenue Sharing Funds. This was from money in this years,_,.budget that was kept in 'interest bearing accounts. _ Supervisor Martocchia reported: 1: Receipt of only one bid for..the furniture•, for the, Town Hall at Southold. The bid. was received from McCabes at Riverhead. Super- visor Martocchia -stated that it was brought to his attention that the figure stated in the newspaper seemed like, a large figure for what were are getting: But he said that' the newspaper did not state all of the furniture we -are actually receiving. ; , There are quite a few pieces we are getting that, they .did not mention. . He stated that he reviewed this with an interested, party and they were quite satisfied because th6re, was 'more' .furniture involved„than what"the newspaper indicated-. 'Sherley Katz' stated- that .the L. . I,.- Traveler did elaborate on th.e number of pieces.,,-Supervisor Martocchia =sa'id that it must have been the' Suffolk Times that- didn't. The bidfigure. is $5,682.00. ' 13.0 DEC` 7.197=� On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to enter into a contract with McCabes, the lowest and only responsible bidder for furniture at the Southold Town Hall addition at Southold, New York, in the amount of $5,682.00. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia reported: . 2. Receipt of letter from the Suffolk County Community College, Richard Minisce, Associate Professor of Sociology. He was one of the men we employed this past summer with the police department at no salary. He was able- to spend the summer and a little beyond with us learning police procedures., office work, etc. He participated in everything involved. as a policeman.- It. did give- him a tremendous amount .of wealth to ,be able -to go back into his classroom . and lecture on things after being on the scene and . actually participating. He ,sends his appreciation to the elected officials of the Town of Southold and.'.the -police department for this opportunity. 3. Southold Public. School" s requesting -some funding which the town has money set aside . for..`the school to extend recreation programs for their youth, whether it—be into the summer further or into the winter further.. Due to the fact that Southold School was on austerity for quite a while they could not participate in the summer program. The money was held in custody of Southold Town accounts. The school has come- up with a "matching dollar involvement program" in which they will participate to the -tune of $2,500.00 and there is a. little outside money also. - They ask if :the -Town will participate with the money that was normally set aside- for Southold. They are asking. that we match their $2,500.,00 plus $300.001 for CYO_ program. This was .sent. to the.:Town Attorney for clearance' to besure'.that` everything ,was' in proper order. We find that the money was set aside. ' ' On motion of Councilman Rich., . seconde'd by Justice Suter, it was RESOLVED that the Southold Towh Board approves . a. recreation expenditure to..the .Southold 'Public .Scho-ols' in the amount of $2,800.00- to extend .recreation programs. Vote of the- Town Board: . Ayes: 'Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice_ Suter,' Justice Dema rest. This resolution was declared duly adopted. Sherle Katz y questioned .if ,this can be done though it is only, a summer funding.---Supervisor .Martocchia answered that they have an entire breakdown of the programs which has been examined and they are very careful using the money as intened, they feel that the spirit is being followed. Supervisor Martocchia: 4. _ Supervisor Martocchia -reported that certain towns ,and, villages were entitled to 'put 'in for some of -their expenses that were incurred ,during- "Hurricane ;Belle" . `The. .Southold Town Highway Department' and' Police 'Department did occur expenses above anal beyond the norm... The Town of -Southold--will be receiving about - $70,000.00' `eventually from the .New York State Office of Disaster Preparedness. 'At this point, .we have received a ,check -for $3,79300.00 to be- divided between the Public Works . program,at the dis,posal. area, which the Town Board controls, the Highway Department, and the Police Department for some overtime ,to . personn.el-.and some. ,off' the _ damage to our generator. So we will 'be getting part -of this $37,300.00 in our Town Board account. Mr. Dean is holding the check. The- Police Department allowed .$1 244.00. . put in .for: 1;386.20; they were , 5. Supervisor Martocchia' reported on"the outcome of the, meeting'.at7'the' Mattitu.ck High'..School in reference to problems. in the Mattituck-West Cutchogue :.area of poor tel-evision reception.. There was a meeting set up by :Peter Jones, ' Manager. of the Riverhead branch of CATV. There was a turn-out of about 100 people. It- was quite an open meeting.. 8ome .of'them- were quite unhappy with the service for which they were paying and not getting a good picture. Mr: Jones indicated .that he was trying to remedy it- as best as possible and review the- reports of the people who gave their names and complaints at the meeting. He sent a report of the ones his repair and engineering staff have visited. They corrected many of the problems. There was no one single type of problem. They were different types of problems. There is still more to do, some people were not at home when they came. They left door knockers but they never received a follow-up on them. Supervisor Martocchia reported- that •he received a letter from the North Fork Lions Club!'informing us that '-U�py are ' organizing , a group from the North Fork Lions, Rotary, & Kwianis. They are willing to be more aware of what is going on and what they see and reporting it to the police. Whether it be 'a strange car in a strange place or person acting strangely. They could be another set of. eyes- for the police department'. ' It was endorsed by the' Chief of Police and Supervisor Martocchia. It is called a' " "community awareness program" . 7. :.Supervisor Martocchia -reported receiving request from the attorney for- the owners of "Oregon View Estates" asking for a reduction . of their subdivision bond. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Southold Town Board hereby denies request for reduction of performance bond of Oregon View Estates, subdivision located at Cutchogue, owned and developed by Louis - Hodor. Bond to remain as is until work is completed in accordance with the highway specifications for this particular subdivision. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich; Councilman Homan, Justice Suter; Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 8. Supervisor Martocchia reported- receiving-,notice of hearing .to .amend the Code of the Town of Riverhead in relation to zoning. 9: - Supervisor Martocchia reported receipt of' letter from Ethel ..Wortis, .South Harbor Road; Southold, concerning th.e property directly in front -.of the end of South Harbor Road and property immediately west - the Southold Park District owns the property to the east— Over the years the town has been leasing this property from Mrs,. Wortis. She indicates-- she-would like to talk about ,aelling this to the Town of Southold and/or to the Southold .Park District. The Park District .has indicated to the Town that they are not interested. Supervi-so' Martocchia researched this -with former Supervisor Lester-M. Albertson and found that some dredging and filling had been done there and arrangements had been made with the family that a given point in time:the property would be deeded to the Towri of Southold for $1.00, but it seems that Mrs. Wortis does not remember this. Supervisor Martocchia and board members will meet with her to see what can be worked out.--Gladys Csajko questioned if there was anything in: writing?---Supervisor Martocchia said that there was not. However, Mr. Albertson did go with him to talk to , her and the .point was brought out very strongly regarding the arrangement:.---Sherley.,Katz questioned how much property was involved?---Supervisor Martocchia answe,red that it was the ' property at the end of the road and immediately west, less than an acre. :.10.. . Supervisor .Martocchia .reported receipt of -letter -from Mrs.! Edward :Adams,;. Orient, in reference to the -League of Women Voters to head a drive to make. citizens .aware of and interested in participation and planning of the Coastal Zone Management Boards.. :. Mr.. Rhodes Trautman is the committee chairman for the Riverhead--Southold- League of Women Voters. This has, to do with the -200 mile.•zone;---Councilman 'Homan stated' that the various fishery groups have .just voted to stay. in'-the International Conference of North American Fisheries which will give the state.. department, control of the area. 11. Receipt of letter from Elaine F. Caldor, CPA 'offering to audit books :for. _the-year -of. 1976 for .fee 'of ,$1,600.00. She has :done them_, annually _over the. years. : On motion of, Councilman Homan, seconded by Counci.lmah •Rich, WHEREAS, Section 12.3, of the: Town Law provides that town officials and employees .who .rec-eive 'and-. disburse monies 'of the town shall account: to -the .town :board for :all' monies .received and disbursed by them by the 20th day of January, and WHEREAS, the. Town Board deems -.it necessary to .erigage a public accountant .to,-prepare: the:--aforesaid annual account for all; town officers and employees, NOW, THEREFORE, BE IT RESOLVED that the Town Board engage the services of Elaine F. Kaldor, Certified PublicAccountant, to`' make, the annual audit of the books and records of officers -and employees of the Town of Southold for the fiscal year 1976`at 132 a. contract fee of $1,,600.00. This matter to be investigated more thoroughly by' the board. On motion. of Councilman Homan�, ..seconded by Councilman Rich,. WHEREAS a proposed ,Local Law,No. -1976 was introduced at . a meeting of this board held on the 26th ,day, of. October, 1976; and ' WHEREAS a public hearing was held thereon by the board on the 23rd day of November, 1976, at which time all interested persons were: given,.an-. opportunity to be heard- thereon, NOW, THEREFORE, BE -IT -RESOLVED.-that- Local Law :-'No: 6-1976 be enacted as follows: LOCAL -LAW N0. 7 - 1976 A Local Law to amend Chapter 69 of the Code of the Town of Southold in relation to -Peddling and Soliciting. Be it enacted by the Town Board of the Town of Southold as follows: - I.' Section 69-102, Article I, Chapter 69 of the Code of the Town of Southold is hereby amended to read as follows: 697,102,License required. ' It shall be unlawful for a person to act as a hawker; peddler or solicitor within the limits of the Town :of . Southold,. except .in' conformity:,with the provisions of this.;Article, and without first having obtained:and ' paid for and having •in force and effect a license; '-as , -provided herein. . Notwithstanding the foregoing) :prov-;slons of this Section.; a merchant .having an established.,place of-, 'business within the Town of, -Southold, or his employees shall not be . required to obtain a license •issued pursuant to the provisions of this Article. II. .-The first sentence of Section 69-109, Article I, Chapter 69 of the Code.-of-the -Town of Southold is hereby-amended-"by' deleting therefrom the word I'licensed" . III... ! Subsection C of Section 69-111 of Article I, Chapter 65 of the Code of the Town -of-Southold is -amended by deleting para- graph (3) thereof and renumbering paragraphs (4) , (5) , and (6) accordingly: IV. Suter, Justice Demarest. This resolution was declared duly adapted. Supervisor Martocchia: 13. ,Reported- on hearing for . disciplinary action of police officer Salvatore M. Cr.imi�. Charges preferred by Chief of Police Cataldo were read by Supervisor Martoochia. On motion- of -Justice Demarest, seconded by Councilman Homan, WHEREAS, on te 26th day .of October, 1976 Carl Cataldo filed written charges with this-Board. against Poli.ce .Officer -Salvatore 'M. Crimi_ , and WHEREAS, .a .hearing-with- res.pect to said charges was held by this Board on November 22, 1976, and WHEREAS, this Board has reviewed .all of the evidence adduced' at said hearing- NOW,. -THEREFORE, IT IS RESOLVED AND DETERMINED, as follows: 1. That this Board finds Police Officer.Salvatore M. Crimi Guilty of all of the charges preferred against him. 2. That Police -Officer -Salvatore M. Crimi is hereby punished by the forfeiture and withholding of. 5 .d.ays salary or compensation to be- withheld -as follows: ! Deductions to -begin January 1; 1977, one day shall be decuted from each pay period thereafter until entire forfeiture has been completed. Vote of the Town Board: Ayes: Supervisor. Supervisor Martocchia reported that wetlands violation of Valentine' Ruch IV needs. .further study by the board. OTC 11976 13: 15. Notice from the New York State Department of Environmental Conservation that a hearing will be held upon -the application of Charles A. Gagen, 2400 Pine Neck Road, Southold, N.Y. , for construction of a one-family dwelling, on- January 10, 1977 at 2:00' P.M ;' objections by January 4, 1977. 16. The Town Board is still looking for names of people who might like to serve on the Conservation Advisory Council; must have the names by the,.next: me.eting on. December 21st. 17. Correspondence. was �received at the last meeting from Holzmacher, McLeondon, & Murrell, P.C. in reference to the waste water study. Supervisor Martocchia met with Jim Monsell from the Village of Greenport this morning. The Town Board and the Village of' Greenport are requesting a meeting with a representative of the firm to find out more about it.---Sherley Katz questioned what -the study was, all' about, and where the waste water was from. ---Supervisor Martocchia answered that it was a waste water -study on waste from sewage plants. -The' 'Village of Greenport serves many areas outside the village limits.---Justice Demarest stated that it is a study to' see how much waste water we can put back into the ground without fouling up the water supply. . Although the Village has its own sewage and disposal system, they are also interested in the areas outside of the village because all of their working wells, except the one on Moores L e, are in the Town. So they certain ly, ar'e interested in the waste outside the Village because it could foul up the. wells' that supply everyone.---Supervisor Martocchia stated that jointly between the Town and the Village, it will cost the Town $700.00-$800.00, to prepare the necessary papers to apply for the grant to do the study. Then if the grant is approved, it will cost us $99000:00-$10;000.00 as our share to make the study. The Town and Village will have to pick up 12/ of, the cost: A formula is being worked out, bit it will cost us approximately $9,000.00-$109-000.00. 18. Supervisor Martocchia announced that a parade and Christmas Party will .be. held on'.De,cember 19th at 1:'00 P.M.' at • the..Gr.eenport Fire House. ..He has :secured ,the. Suffolk-County Police Helicopter to bring Santa in and everyone in the Town is welcome to attend: On motion of Councilman Rich, seconded by Councilman Homah,"it was RESOLVED-,that $2.,400.00 be and.hereby :is transferred- from Highway Item .I, Social- S:ecuri.ty to Highway Item'1,' Contractual. On motion of Councilman Rich, seconded. by Councilman Homan, it was RESOLVED that 3:30 P.M.-, Tuesday, January 11' 1977, office -of the Supervisor, 16 South Street, Greenport, 'New'York, . be set as- date, time .and place for hearing upon the application of Leo Kwasneski for a permit under the provisions of the Wetland Ordinance of the Town of Southold for permission to construct a turn-around at Sleepy Hollow Lane in the subdivision known as "Sleepy Hollow" at Southold, New York. Vote of- the Town Board: Ayes: Supervisor .Martocchia, Councilman Rich, Councilman Homan, Justice Suter, 'Justice' Demarest. This resolution was declared duly adopted'. Supervisor Martocchia: lg: - Receipt of request fRr:,cluster' concept 1` subdivision "Southold Gardens" , owned by Babcock-& Rimmler, located at Southold.. Consists of ,12:056. acres. This. matter needs further study. and will be examined by' the 'Town 'Board. Supervisor Martocchia`opened 'the floor 'to the public. Mr. Charles.,Hickey questioned if any. decision'has been reached on the telephone system for the : town hall.---Supervisor Martocchia answered that the Town has gone into. contract with Progressive Phone- Systems, ,the -same as Greenport Hospital. ' 'We also considered Executone and the' New York Telephone Co. :Bas-ed on 'the findings of our ,study, -we. can save at least $24,000.00 over the next ten years with the Progressive System verses the others.-'--Mr.' Hickey stated that the County is being criticized in todays ' paper for doting the same thing. The Telephone Co. 'gave them some new- figures, now -they are showing a saving of 16009000.0O+.---Supervisor Martocchia stated that they; met with the representatives of N.Y. Telephone: Co. many times. - They all have to work with guidelines,, fixed tariffs, whereas 'the 'other companies do not. The proposals. -were taken apart by our town attorney. The N.Y. Telephone Co-. proposal was not very clear. The figures that they quoted us. were not accurate figures. We found .that they were not really fixed figures, but- subject -to rate increases.---Mr.. Hickey stated that he hand-led a' -similar matter for his company in New York six years ago.—He found that the private companies are lower initially, but they ran into trouble on repairs -and service. N. Y. Telephone Co. ' s response time is 15 minutes.---Supervisor Martocchia stated that we have a service contract to go with the package. The, first year is free, then there is a $2.00 charge per telephone for the next nine years. The response time. is up to 4' hours for apy major problems..and,-2-4' hours for minor ones. Supervisor Martocchia agreed that you do -have a. different. fe ing of security with, the Telephone Co. , but -how- much of a price9bu have to pay for it. We had to consider this into our evaluation. This Board did- pass a -resolution to go wi-th the N:Y. Telephone Co. proposal, but 'it- contained.;a clause- to cancel.:if.: we saw, fit or could do better with someone else. We were -willing to go ahead with them knowing that they were. a little- higher, but •at_.the time we didn't realize how much higher it was: After everything was brought out, we found , that they were considerably higher. Gladys Csajko questioned if the Town Board is going to ' open their working sessions to the public on January-1st.--Supervisor Martocchia stated that this really has not been discussed yet. He asked Town Attorney Tasker if this was. `mandatory or optional. Mr. Tasker_ stated that- an executive session., under the new law,- is a session where you take legal action. `. The Town Board does not have those. If you were to recess now and go into executive session. n .the only. way. you can.'go .into' executive session under the -new law is to recess a 'public session 'forr specific purposes set down in the law and you take action in those executive sessions. We don't -have. those. .. What we do in the morning up until the meeting is not really an executive session.---Supervisor Martocchia asked if the Town Board would be covered by the new ruling?--Mr. Tasker stated EC 711976 that the ' Town Board would not be covered by it; our working session is 'not 'an executive session. Mr. Tasker said that the new law defines-' two types of meetings: (1) a public meeting; (2) an executive session: They define exactly what each one is . An executive session is where if this Board wished to recess and go into an executive session to take legal official action on a vote or a specific thing. ---Gladys Csajko questioned if you would have to have minutes of it?--- Mr: Tasker answered yes, that you would have to have minutes. It is a regular official meeting but held -in secret and of which minutes must be maintained. It is not the working session that we have.--- Gladys -Csajko stated that according to the newspapers it covered working sessions."-"Mr. Tasker answered that the newspapers may have said that, but the law does not.---Sherley Katz stated that Southampton does open their working sessions, but the public is not allowed to ask questions during this session. ---Justice Demarest stated that if they were to open their working sessions, thenthey might have to have other sessions for certain necessary discussions; not that anything they do is a secret, everything comes out, but there might be certain advantages to a private discussion at' a particular time. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that this meeting be recessed at 4:05 P.M. , for the purpose of auditing the bills, to be reconvened at 5:00 P.M. Meeting reconvened at 5 :00 P.M: On motion of Justice ,Suter, seconded by Councilman Rich, it was RESOLVED 'that the following audited bills be authorized to be paid: General Fund bills in the amount of $48,989.63; Highway Department �1 bills in -the amount of $31,034.53; Fishers Island Ferry District bills- in the amount of $25;955.78; , Federal Revenue Sharing bills in, the amount of $25,075.84; and Lighting Installation bills in the amount of $3,441.89. On motion of Justice Demarest, seconded by Councilman Homan; WHEREAS, •the Building Inspector, heretofore served a notice of violation •upon the Estate of Valentine Ruch IV, pursuant to Section 96-31 of the Wetlands Ordinance of the Town of Southold, and WHEREAS, this Board held a hearing with respect thereto, pursuant to Section 97-32 of said -Ordinance, and WHEREAS, it appears that the- New York 'State Department of Environ- mental Conservation, in its consideration of a permit application with respect to said presmies, found that wetlands -did exist in the area to be filled, but determined that .the filling thereof would not cause irreparable damage to the water; And it further appearing, upon a personal inspection caused to be made by this board that wetlands were present in the area to be filled and therefor a wetland permit should be applied for, NOW, THEREFORE, BE IT RESOLVED that the Notice of Violation of the Building Inspector is being sustained and it is further RESOLVED that the Estate of Valentine Ruch IV apply for and obtain a wetland permit before conducting any further filling and/or construction work to- be conducted on the premises in question. On motion of Councilman Homan, seconded by Justice Suter, WHEREAS, the Board of Commissioners of the Fishers Island Ferry District, in the Town of Southold, Suffolk County, New York, has recommended that the facilities of said Ferry District be increased and improved by the acquisition of an additional ferryboat at an estimated maximum cost of $730,000.00 to replace the ferryboat "Mystic Isle" , presently operated by the Fishers Island Ferry District and to apply the $141,000.00 expected to be received as trade-in on the "Mystic Islane" , to the purchase price of said new ferryboat, bringing the actual total purchase price to $589,000.009 said new ferryboat to be used on the authorized routes of said Ferry District, and has caused preliminary plans and specifications for the construction thereof to be prepared by Blount Marine Corporation, Warren, Rhode Island, shipbuilders and licensed naval architects, and 13 6 that said Town hold . a public hearing to consider said increase and improvement of the facilities of said .Ferry District and to make funds available pursuant to Chapter. 699 of the Laws of 1947, as amended, and the Local; Finance Law; to finance said increase and improvement of the facilities and-to -take other. action in connection therewith: WHEREAS, the maximum amount proposed -to be expended for said proposed increase and improvement of- the facilities by the Fishers Island Ferry District is $73.0,000.00, which is planned to be . financed by the issuance of serial bonds of the Town -of .Southold, the levy and collection of a tax -on all the taxable real property within said .Town' to pay the principal of and interest thereon as the, 'same shall become. due and :payable and the application of $141,000.00 expected .to. be received, as the trade-in on the ferry- boat "Mystic Isle" , now oened by !the District. The cost of acquiring said new ferryboat shall' be raised by a tax upon all . .the taxable real property. f the;District, at, the same time, in the .same manner and by the same officers as, Town charges are raised by .a tax therein and when :collected shall be paid by the tax therein and the amount of such-special assessments will be budgeted -us an offset to the taxes thus to be levied; now, therefore, be it QRDERED, that the Town Board of the Town meet and hold a public_ hearing at the. Fishers Island Firehouse, at Fishers -Island; in the Town of Southold, New York, on January ,8,. 1977, :at. 1:00 ,o'clock P.M.
