SOUTHOLD 'TOWN BOARD
November 9, 1976
A regular meeting of the Southold Town 'Board was held on Tuesday,
November 9, ' 1976 at the office of the Supervisor, 16 South Street,
Greenport., New.,York. Supervisor. Martocchia opened the meeting at
3:00 'P.M. with the following present:
Supervisor Albert. M: Martocchia
Justice Martin Suter
Justice Louis- M. Demarest
Justice Francis T. Doyen
Town -Attorney Robert W. Tasker
Highway. Superintendent Raymond C. Dean '
Town Clerk Judith T. Terry
Absent: Councilman James H. Rich, Jr.'

On -motion -of Justice Suter-, seconded by Justice Demarest, it was
RESOLVED that the South6ld' Town Board minutes of October 26, 1976
beand hereby are approved as submitted:

This resolution was declared duly adopted.
On motion *of Justice-Demarest, seconded- by Justice Doyen, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00- P.M., Tuesday, November 23, 1976 at the office
of the Supervisor; 16 South Street, Greenport, New York.

Suter, Justice Demarest,- Justice Doyen.

Supervisor Martocchia:
1. Receipt of the October- 1976 reports of Justice Suter,
Dog Wardens, Supervisor Martocchia, Town Clerk Terry, Town Trustees,
and Building"'Dep:artment
2. The Board' will " recess to-hold their audit of the bills
following the general meeting.
3'. There has been .the closing on-the senior-citizen-youth
center proposed to be built.. on the former Gozelski property, -Peconic.
4. Receipt of a report made at the Town Disposal Area as
suggested by the Suffolk .Gounty Department of Environmental Contras
by Holzmacher, McLeondon..an.d Murrell, Consulting Engineers. An
excellent report was received.
5. Receipt of a letter from Parity Systems, the company that
processes the tax bills. Their contract ends in December and the
town will again go out to bid for this service.
6.. There will come before the Suffolk County Legislature an
item under capital budget and program for $6,315.66 to pay for
a drredging 'project at the ramp site in New Suffolk.---Also there
is'.an- item- in the 1977 capital operating budget for• $l,620,600
for., dredging. waters in;.the- five e' astern..towns of. Suffolk County.
On motion of Justice Suter, .seconded. by••Justice Doyen,; it was
RESOLVED that dues in' the amount of $400.00 for the Association of
Towns of the State -of-New York be and hereby is ordered paid.

On motion of Justice Suter,-. seconded .by Justice Doyen,. -it was
RESOLVED that a recess be called at this time (3:30 P.M. ) for the
purpose of holding a public hearing upon the application of Eastern
Long Island Kampgrounds, Inc. for permission to establish and operate
a tourist camp (second 2) on the westerly side of Queen Street,
Greenport, New York.

Suter, Justice Demarest, Justice Doyen.

Supervisor Martocchia:
7. Receipt of a thank-you letter from Stanley V. Becker a
summer patrolman with the Southold Town Police Department, thank-
ing the board for .the opportunity to with with the Town of Southold
and stating that if the program is to be continued next year, he
will be available. Justice Suter advised Mr. Becker volunteered
,his services for the winter, months also.

RESOLVED, that"Supervisor' Albert M. Martocchia' be and he hereby is
authorized to sign a loan agreement 'witYi the' Suffolk `County' Depart-
ment of Emergency -Pre} are'dness -fbr' the u:se of+'a Mark V 45 ft:
Picket Boat, U.S.N. Serial #C-43-44 for use �by' the Southold Marine
:Rescue Unit; adequate liability and property' damage insurance to
be carried by the Southol-d` Unit -of' th.e Office .-of Emergency Prepared-
ness and to include the Town--,'off• S.outh.ohd in' the name insured.

(Supervisor Martocchia explained that under clam transplant program
with the State of New York, the State, will reimburse us 50%.
We have budgeted $2,000.00 but have spent $2943.67, 'therefore the
transfer of $943.67 will cover the account. )

RESOLVED that $312.69 be, trans-ferred from Part Town Surplus to'

WHEREAS the Town Board bf- the Town of Southold, New York has met
at the time and place specified in - the notice- of public hearings
on th.e' preliminary budget and heard all persons desiring to be
heard thereon; now, therefore, be it
RESOLVED that the Town Board oflthe Town of Southold does hereby
adopt such preliminary budget as originally compiled, as the
annual budget of this Town for the fiscal year beginning on the
lst day of January 19779 . and. that such b-adget as so adopted .by
this Board be entered in detail in the minutes of the proceedings
of this .Town. Board, and ,be it further
RESOLVED that the Town 'Clerk of the Town of Southold shall .prepare
and certify:,, in duplicate, copies of said annual budget as adopted
by the Town Board of the Town of Southold, together with the estimates
if any, . adopted pursuant to Section 202a, subdivision 4 of the Town
Law, and deliver two copie"s .thereof to the Supervisor of this Town
to be presented by him to the County Legislature of the County of
Suffolk.

9,. ,„ Starting November 15th the town lighting crew will be working
with LILCO', to make the street lighting change over. Some months- ago since
we went into the rental agreement .to do our own maintenance, we have received
credit up to 1.October .3lst from the: LILC.O of• $8,351-.86. This will point out
our statements in the past that we: will be saving' about $39,000.00 a year,
and this is just a -maintenance savings in the amount of $8',351.86.--=Mrs.
Sherley Katz asked what area of the town will they. be working in on Mondayl
Supervisor Martocchia stated they. .will be- working on all the' big 400 mercury
vapor in the commercial areas, and will replace them with 251 lights with
lower candle power which will produce an energy savings of 50/ what it is
now. On the, mercury. , apors alone the savings a year is about $19,000.00.

RESOLVED that the Town Attorney be and hereby is authorized to prepare
a 10 year lease at $1.00 per year between the Mattituck; Park District

and the Town of Southold- for .the lease of a parking lot owned by
the Mattituck Park District on the south. side of Pike Street, Mattituck,
New York; said lease to be effective November 10, 1976, and it is to
be insured by the town.

RESOLVED that the following suggested amendments to the Southold
Town Code, suggested by the Southold Town Baymen' s Association,
Inc. , be referred to the Southold Town Planning Board for their
recommendations and report:
Chapter 100, Article III, Section 100-30, add a sub-section
(4) to paragraph A as follows:
(4) The following commercial aquicultural and fishing operations
and n.e.ces.sary uses thereto, , provided: that. there- shall be no storage
of dead fish or bait within. 15O feet of any. lot line except in closed
iced containers.
(a) The storage, use and maintenance of fishing and aquicultural
gear, including lobster pots,. . nets, .stakes, dredges,
provided such gear does not exceed the height of five (5)
feet; and
(b) The storage, use and maintenance of holding and other,
tanks, including related accessories, for live sea life
provided such tanks -do not exceed the height of five (5�
feet; and
(c) Storage buildings and other related structures., . pr.ovided
that such buildings. shall conform to- the yard requirements
for principal buildings.

RESOLVED that Superintendent of Highways Dean be and he hereby is
authorized to •pay for one (1) D7 Caterpillar bulldozer to be a
loan purchase from the Suffolk County Department of Emergency
Preparedness. This bulldozer billing will be received momentarily
and has to be paid on receipt.

RESOLVED that pursuant to the .provisions of Section 284 of the
Highway Law, the Southold Town Board agrees that moneys levied and
collected for the repair and improvement of highways; and received
from the- State for the. 'repair and improvement of highways, shall be
expended. as follows: . General Repairs - The sum of $540,500.00 inay
be expended for general repairs upon 177.06 miles of town highways,
including-sluices, culverts and bridges having a span of 'less' than
..five- feet and boardwalks or: the renewals thereof.

10. Receipt..of a letter. from the Matttuck ,Free Library,
Ed Luridstedt, ;President of the Board of.,Trustees,- stating that
Mrs. Katie' Dexter has reported to the -trustees on ,the meeting she
had .'with .the' Town Board on. September 7th at which time. she requested
funds 'forr the library, requesting that the Town .Board. consider such
a request so' their library expansion -needs may be met,.---The Board
has allocated an additional .$5,000.00 from revenue,,sharing funds
from the 1977 budget for libraries,, which. is in addition to the
$35,000.00 they will receive .from the regular budget.

Town Police Department be and hereby are adopted:
RULES AND REGULATIONS #RR 76-1 - COURT APPEARANCES
I. , PURPOSE
To provide a rule and regulation to govern the appearance of
police officers, in court.
II. METHOD
A. ' ,Members of the Department will appear in court promptly at
the time directed in their subpoena or notice of trial.
B. Members who are on duty will advise their supervising
sergeant or supervising officer at the beginning of their
tour of duty that they have to make a court appearance.
The supervising sergeant or officer will so -advise the
department court liaison ,officer, or, in :his :abs.ence, the
court clerk of the fact that the subpoenaed .officer is on
duty and request that .he be kept. on patrol if possible
and subject. to call when needed. . Compliance with this
request is at the option- of the. court.
C. One of the major : uxctions'_ of. the court liaison officer
is to . coordinate the appearance of police officers. so that
minimum duty time is spent waiting in court. He shall
coordinate as necessary with both the court and the supervisor
of .the-duty squad. The .supervisor .shall take steps toassure
the , appearanc.e of the needed officer .as- quickly--as possible
after being notified the officer' s presence.-is needed in
court. :.
;_D. . Officers will leave the.. court immediately....upon • completion
of their testimony after determining that -their further
presence is...no-longer: necessary.. - Officer.s.,not- on duty
Will- fill_.out 'a form PDTS-,105: (Report of-.,Overtime) and
eve-At 'signed_.by either the: judge -or the court clerk.
The court liaison officer will, iri addition .to his other
duties, see that,_officers..do..no.t. remain.•in the court any
longer than is necessary.
E. Officers will wear-,...either the appropriate uniform of the
day, or, if off-duty appropriate civilian clothes. Appropriate
civilian clothing must be clean. and neat'. and shall mean a
shirt with tie, and a---suit -or 'slacks_ and "sport ;coat. Clothing
should not .be. ,.excessive.ly loud in design or color.. Liesure
attire or workclothes are no't. considered, appropriate. .attire
for court. Court liaison officer shall report non-compliance
with- this regulation to the Chief of Police in writing.
RULES AND. REGULATIONS: #RR 76-2 - ,SI,CK TIME-'
I. PURPOSE
To provide regulations„governing the use of sick time.
II. PROCEDURE
A. . Employees of the department,.who are ill or injured .and unable
to appear for. duty --shoul-d notify .headquarters as soon as
possible upon . aking. such ,a determination so that a replace-
ment .may be obtained if 'necessary.
B. Any sickness or injury which causes absence over three working
... days .in, duration- shall necssitate a certificate- from a
physician attesting to the .i-ll-ness: or injury and the nature
thereof and that the physician does not recommend that the
employee return to duty.
C.. _ A member_ of_the department, who is. zick�..isi• assued to, -be either
at home .or in the, hospital .or .a doctor' s offi:ce receiving
' treatment. Since- the-: municipality pays the- member,.for. such
sick-time it has .the right.:to, determine if such sick time is
justified._ Accordingly., .the, department reserves the- right to
call or have its .xepr-esentatives visit .the - residence of the
-.of the member,when.. such..member...-is on,:s. ck call.. Any member

who reports sick for a tour of duty and due to circumstances
beyond his' control ' is• not' at his residence shall so advise
the radio operator •when reporting and advise the_ radio '.
operator 'the' location and phone' number` at which' he.-'.can be
reached. If it is• necessary to leave` theres'idence to"go
to- a physician' s office for treatment,` headquarters should
be advised in' advance''giving' pertinent details.
D. Any member who is .absent from. ,duty *:for 'anytime shall complete
a' form PDTS-109 (Affirmation' 'relative to illness 'or: injury)
and submit such form upon' his return to duty.
E. The failure of a member to comply-- with the above conditions
could lead to a forfieture of pay for such sick days..
RULES AND REGULATIONS #RR .76-3 - .HAIR GROOMING REGULATIONS
I. PURPOSE
To provide regulations to govern the appearance of the hair
styles and facial growth of police officers so that there may
be a degree of uniformity in' the appearance of the members of
the depirtment 'while permitting the 'members 'to conform to
reasonable 'current styles in ha.ir 'grooming.
II. METHOD
A: Regulations are applicable to. male employees of the depart-
ment and waivers may be granted by the.. Chief of Police to
meet individual- needs of sp`ecial. assignments.
B. Hair will be neat,, clean,--trimmed and present a well groomed
appearance: Hair will not .exceed' 1 1/2 inches in thickness
as measured`'from• the scalp.; it' will not. extend below the
collar, but may extend to. mid-ear.
C'. If a member' chooses to wear ' sideburris, they will be neatly
trimmed. Sideburns will measure not more than 3/4 of an
inch in width and riot flare ,to..more than 1 1/2 inches or
extend' belbw the ear. '
D.- If a member chooses to wear a. mustache it may be neatly
trimmed and may. extend ' one-half inch beyond and/or below
the mouth.
E. Beards, goatees and. ponytails or similar configurations
will not be allowed. . A waiver 'for. medical' reasons' may be
granted by, the Chief of Police'.-
F. , Wigs or hairpieces wll •not be worn. while on -duty in uniform
except for cosmetic 'reasons to `cover"natural baldness or
physical 'dis'figurement. If, under. these conditions, a hair-
piece or= wig is worn,. it will 'conform to the standards as set
forth herein 'for-'natural hairgrowth.
RULES AND REGULATIONS #RR 76-4 — SENIORITY
I. PURPO E
To provide a rule governing the determination of seniority among
the members of the police department. .
II. METHOD
Seniority in the police department is determined as follows:
A. by rank
B. by continuous service in rank
C. by date of appointment to previous rank or ranks
D. by date of appointment. to the department
E. by highest score on the civil service list from which
appointments were made at time of initial appointment
examination
F. by age (older employee is senior)
G. alphabetically by surname
The method 'above shall be utilized by starting with subdivision
A. If that does riot determine seniority,. the next subdivision shall
be used, etc. until the seniority is determined.

RESOLVED, that this Board, ,on behalf .of the people of the Town
of Southold, request the County Legislature to appropriate
sufficient funds for the maintenance and operation of the County
dredge in the year 1977, and thereafter.

WHEREAS . Eastern Long ,Island Kampgrounds, •Inc'., has filed an
application and plan with the Town Clerk for a permit tooperate a
tourist camp to be 'located at the "southwest corner of Queen Street
and County Route 27 near the Village of Greenport, pursuant to the
provisions of Chapter 88 of the Code of the Town of Southold, and
WHEREAS, a public hearing-was held by- this -Board with respect
to said application on the 9th day of• November, 1976, at. which
time-all interested persons were given -an opportunity to be heard
with respect to said application, and
WHEREAS the applicant has obtained the. approval of the Southold
Town Planning Board of the site- plan, and special exception .
approval of the Southold Town Board of Appeals, all in accordance
with Chapter 100 of the Code of the Town of Southold, and
WHEREAS, this- Board has -examined 'said plan of the proposed tourist
camp which consists of 51 units -(Secti6`n--II) and ''73 units (Section
I) ; an administration building with ' a swimming pool adjacent thereto
and a parking field comprising 20,000• square feet likewise adjacent
to said administration building and two satellite buildings which
said,.plan appears to be in compliance with the provisions of the
Code of the Town'- of Southold,
NOW; THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:
A tourist camp permit is hereby granted to Eastern Long Islanid
Kampgrounds, Inc. for the establishment, maintenance and operation-
of a tourist camp to contain not more- than• 124 units on premises .
located on the south side of County Route 27 and generally bounded
northerly by County Route 27; easterly by Queen Sheet, and land of
Bolling; southerly by land of the Village of Greenport; and westerly
by lands of -Fenno, Francisco and Sledjeski; and the Town Clerk is
hereby directed-to issue 'such .permit', , subject, however, to 'the ,
following terms .and conditions, t&-,_%nit:
. a. That the public water- supply ,and sanitary ,sewage disposal
to the premises for which said permit -is issued shall .be supplied
by the Incorporated Village of Greenport at the -sole cost and
expense of the applicant which said water supply and sewage .disposal
systems shall comply with all of ,the requirements of said agencies
having jurisdiction thereof, and said water supply and sewage
disposal systems shall be installed and in operation prior to the
occupancy of the -premises for any purposes -whatsoever.
b. That in the event that any portion of the premises located
within 100 feet of the land owned by the Village. of Greenport is.
utilized ,for campgrounds or trailer sites, a six foot chain link
or equivalent type fence shall be erected and maintained along the
boundary line of said land of the Village of Greenport. That
prior to April 1, 1977 the applicant shall erect and maintain a
similar type fence along the entire boundary line of applicant's
premises abutting the lands of Fenno, Francisco and Sledjeski.
c. That the portion of applicant' s premises adjacent to
County Route 27 to a distance` 'of 100 'feet therefrom shall' at all
times be- maintained as a landscaped buffer zone and no buildings
or structures of any type whatsoever except an ,identification sign
shall be erected or. maintained therein. That the type and location
of landscapin& within said buffer zone= shall be of the type hereto-
fore approved by the Planning Board of the -Town .of Southold; that
in the event that County .Route 27 shall be widened, altered or
relocated said buffer zone shall be extended so that said buffer
zone shall at all times extend 100 feet from said highway.
d. That to minimize traffic hazards that may occur by .reason
of trailer vehicles entering and leaving said, premises,. suitable
turnoff-.or deceleration lanes or such other highway -facilities .as -
the agency having jurisdiction of County Route 27 shall prescribe
shall be provided and constructed prior to the use of any .portion
of the premises for tourist camp uses.
e. That in order to provide suitable access to the premises ;
over Queen Street, a 33 foot wide town highway; the same will be
required to be widened to 50 feet along its entire length. Prior
to the occupancy of the premises for tourist camp purposes, the

applicant shall at its own expense improve and pave a 17 foot
strip along the entire westerly boundary of Queen Street in accord-
ance with the present town highway requirements and when so ,
improved and paved, dedicate the same to the Town of Southold.
f. That the portion of the premises. extending from a point
100 feet south of County Route 27 to a point 600 feet south of
County Route 27 shall be restricted to open recreational uses with
no structures erected thereon.- The term "structures" when used
herein is intended and constructed as not to prohibit the erection
and maintenance in said open recreational area of suitable fences,
facilities and equipment necessary and incidental to the open
recreational .activities to be conducted thereon.
g. That the premises for. which- a, permit is. hereby authorized
shall b.e. used only for the purpose of. op:erating :thereon camp-
ground franchised by Kampgrounds of America, .Inc. ,, in ;accordance
with all of the ordinances, laws and regulations of the Town of
Southold and other governmental agencies having jurisdiction there-
of and no buildings or structures, shall be erected or maintained on
the premises nor shall the premises be .used' for any use except the
uses specified herein and uses accessory and incidental thereto.
h. That a parking lot of at least 20,000 square feet . in area
to be constructed in accordance with.;the Southold-Town highway
specifications located ajdacent ,to the main administration build-
ing shall be completed prior ,to the. use of the: premises for tourist
camp purposes.
i. That except as otherwise- provided herein, said tourist
camp shall be constructed, maintained and operated in compliance
with the site plan approval granted by the Southold Town Planning
Board on June 21, 1976; the special exception ,use -granted by the
Southold Town .Board of Appeals on July 22, 1976; and the terms
and conditions ' of Chapter 88 of the Code of the, Town of Southold.
j That the fee for such license authorized h.erebyy .shall be
$510.06 for, Section II., and any and all- sums in excess thereof
heretofore paid by the applicant ,to the Town Clerk are hereby
directed to be refunded to the applicant.
