Woychuck Land Surveying, PLLC, last dated October 5, 2025 and determined that the proposed installation of anew septic system is out of the 100 foot Wetland jurisdictional area under Chapter 275 of the Town Wetland Cade and Chapter 111 of the Town Code. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary, or within 100' landward from the edge of vegetated wetlands, without farther authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111' of the Towle Code. Therefore,in accordance with the current Tidal Wetlands Land Use Regulations(6NYCRR Part 661)no permit is required under the Tidal Wetlands Act.Please be advised, however, that no construction, sedimentation,or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary,as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional, boundary and your project(i.e.,a I Y to 20'wide construction area)or erecting a temporary fence, barrier,or hay bale berm. In addition, since the survey/site plan noted a wetland area in the southwest corner of the parcel, the project was sent to our Central Office to determine whether this was a DEC regulated freshwater wetland. They have determined that there are no DEC regulated freshwater wetlands and/or adjacent areas identified on this parcel referenced above. Therefore,in accordance with the current Article 24 of the Environmental Conservation Law(ECL)and 6 NYCRR Part 663,no freshwater wetlands permit is required at this time. Please note, pursuant to ECL section 24-0703,this freshwater determination shall remain valid for a period of five years from the date it is issued(through 4/22/2030).
