The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 11, 2025 regarding the above matter:
WHEREAS, AMP Architecture on behalf of AMBER MORIARTY& PATRICK COURTNEY
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March
28, 2025, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
June 11, 2025, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of AMBER MORIART'Y&
PATRICK COURTNEY for the existing 1„g45sq.ft, one-story dwelling with 32sq.ft. front covered
porch and attached garage„ remove existing 610sq.ft. rear wood deck, 1,134sq.ft. rear at-grade
patio and traditional sanitary system in rear yard; construct a 511sq.ft. rear deck with 436sq.ft.
raised pool with 10" coping; pool enclosure fencing with locking gates to be installed around
pool and deck; construct a rear 10.3'x10.2', 20'x20' (505sq.ft.) screened-in porch; construct a
10'x43' rear wood deck (at first floor level); install a 350sq.ft. at-grade stone patio under rear
wood deck; construct a 6'x11.1' half bath and shower against seaward sine of dwelling; install a
t16' long by 2' high retaining wall along west side of dwelling; remove existing east side
retaining wall and construct new t14.6' long by 2' high retaining wall in-place; install an I/A
OWTS on landward side of dwelling; install drywells in rear yard for new structures;
approximately 84 cubic yards of fill to be excavated for proposed work, backfll pool/deck area
and t4 cubic yards used for grade fill with all excess fill to be removed from site; all as depicted
on the site plan prepared by AMP Architecture, received on June 18, 2025, and stamped
approved on June 20, 2025.
Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid', if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

4. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or
excess excavated materials shall be immediately and completely disposed of in an authorized solid waste
management facility. These materials shall be suitably stabilized as not to re-enter any water body,
wetland or wetland adjacent area.
-5. Prohibition Period for Nesting Birds To protect nesting shorebirds, including threatened and/or
endangered species, no regulated activities may OCCUr between April I and ALIgLISt 31,1, inclusive, of any
calendar year.
6. Authorized Systems This permit authorizes the installation ofany models of Innovative/Alternative
Onsite Wastewater Treatment Systems (I/A OWTS) which have received the approval of the Suffolk
County Department of Flealth Services (SCDFIS). If SCDFIS rescinds its approval of one or more of
these models during the term of this permit, DEC will no longer approve new installations of that model.

7. Installed System Must Be Properly Maintained The permittee MLISt maintain. service and repair
the installed I/A OWTS in accordance with the maintenance schedule set forth in the SCDFIS permit
issued for the system.
8. Install and Maintain Erosion Controls Staked hay or stra-vv bales or other DEC-approved erosion
control measures are to be installed on the downslope edge of any disturbed areas. This barrier to
sediments is to be PLIL in place before any disturbance of the ground OCCLirs and is to be maintained in a
I'Linctional condition Until all disturbed land is heavily vegetated.
9. Contain Stockpile and Disturbed Areas All disturbed areas ",here soil will be temporarily
exposed or stockpiled for longer than one week shall be contained by a continuous line of staked hay
bales/silt curtain (or other department-approved method) placed on the seaward side between the fill and
wetland or protected buffer area. Tarps are aLithorized to supplement these approved methods.

trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be Used. Wet concrete shall not be poured to displace water within the forms.
12. Prohibited Toxic Materials The introduction of materials toxic to aquatic life. such as pesticides,
cleaning flUids, oils and chlorinated liquids Is strictly prohibited in the absence of permit authorization.
13. No Equipment in Wetland Fleavy equipment, including bulldozers, backhoes, payloaders, etc.,
shall not be operated in the wetland.

14. Equipment Storage 100' from Wetland, Water Body All equipment and machinery shall be
stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the
end of each work day. This will serve to avoid the inadvertent leakage of deleterious SUbstances into the
regulated area.
15. Storage of Equipment, Materials The storage
ye of construction equipment and materials shall be
conFined. within the project work area and/or Upland areas greater than 100 linear feet from the wetland
boundary.
16. Clean Fill Only All fill shall consist of clean soil, sand and/or gravel that Is free of the following
substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, hOLIsehold refuse, tires,
woody materials including tree or landscape debris, and metal objects. The introduction of- materials
toxic to aquatic life is expressly prohibited.
17. Seed, Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be
seeded with an appropriate perennial grass, and mulched with straw immediately Upon completion of the.
project, within two days of final grading, or by the expiration of the permit, whichever is first.
18. Temporary Mulch, Final Seeding If seeding is impracticable due to the time of year, a temporary
I-111,11CII shall be applied and Final seeding shall be performed at the earliest opportunity when weather
conditions favor germination and growth but not more than six months after project completion.
I(). Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
ILibricants, epoxy coatings. paints, concrete, leachate or any other environmentally deletei-IOLls materials
associated with the project.
20. State May Order Removal or Alteration of Work If future operations by the State of Nekv York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Department or Environmental Conservation it shall caLISC Unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of"the State, or cause
loss or destruction of the natUral resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, Upon the expiration or revocation or this permit, the strL[CtLIre, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners., shall, without
expense to the State, and to SLICII extent and. in such time and manner as the Department or
Environmental Conservation may require, remove all or any portion of the Uncompleted structure or Fill
and restore to its former condition the navigable and flood capacity or the watercourse. No claim shall
be made auainst the State of New York on account of any such removal or alteration.
21. State May Require Site Restoration If Upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, withOLIt expense to the State, and
to SLICII extent and in SLICII time and manner as the Department of Environmental Conservation may
[awfully require, remove all or any portion of the Uncompleted Sti-LICture or fill and restore the site to its
former condition. No claim shall be made against the State or New York on account of any such
removal or alteration.

22. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
Undertaken by the State for the conservation or improvement of navigation, or For other purposes, and no
claim or right to compensation shall accrue from any such damage.

I. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable 1101-irs and intervals by an authorized representative of the Department
of Environmental Conservation (.the Department) to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 03)0 1
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.

all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the pro,ject site or facility. Failure to produce a copy of
the permit Upon. request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided f-or by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously ISSUed by the Department or any of the terms, conditions or requirements
contained In such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee n1LISt submit a
separate written application to the Department for permit renewal, modification or transfer of"this
permit. SUCK application MUSt in.ClUde any forms or SUpplernerital information the Department reqUires.
Any renewal, modification or transfer granted by the Department Mist be in writing. Submission of

5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
