A special meeting of the Southold Town Board was held on -Friday,
October 1, 1976, upon proper written notice of the Supervisor, at
the office of the Supervisor, 16 South Street, Greenport, New York.
Supervisor Martocchia opened the meeting at 1:00 P..M. with the
following present:
Supervisor Albert M. Martocchia
Councilman James H. Rich, Jr.
Councilman James Homan
Justice Martin Suter
Justice Louis. Mr. Demarest
Town Attorney Robert W. Tasker
Highway Superintendent Raymond C. Dean
Town Clerk Judith T. Terry
Absent: Justice Francais T. Doyen
Town Clerk Terry presented the Town Board with the Tentative Budget
for the year 1977 as required by law. .
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the Town Board accept the Tentative Budget for 1977
as presented by the Town Clerk.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
This resolution was declared duly adopted.
The Supervisor explained that this tentative budget will be studied
by the Town Board, and after any revisions, it will then become the
preliminary budget, and copies will be printed for the public to
examine. A hearing will be held on the preliminary budget the first
week of November, a date to be set in the future.---The summary page
was made available to those present, and explained by the Supervisor
in comparison to the 1976 budget. At the moment the proposed rate
for the town, outside the village, will be 3. 531; and the village
1.297. The 1976 rate was 3. 023, village 1. 151. The unexpended
balance for 1976 in the general fund wa(s $107, 111.00, general
outside village was $120, 000. 00, This year the unexpended balance
proposed is $50, 000.00 general; outside village $15, 000. 00 Highway
comparisons for 1976 and 1977 were explained. In revenue sharing
it is projected $36, 000. 00 will be left from 1976, and $136, 000.00
projected to be received in 1977 . $60, 000. 00 is earmarked for the
two policemen to be put back on duty, $30, 000.00 for police cars,
$5 , 000. 00 for libraries. Whatever remains will be earmarked for
further expenditures for the town hall.
Mrs. Sherley Katz asked if there are any salary raises for the
elected officials?---Supervisor Martocchia stated there are no
raises for the elected officials projected in the tentative
budget. None for the planning board, appeals board, tax receiver,
assessors, trustees,, town board members. There is a provision in
the law which allows the registrar and superintendent of public
works to receive $3, 000.00 per year, an increase of $500.00 for
each catagory; those $500. 00 increases have been included in the
tentative budget.
The police-.budge,t -was discussed._ by, the board and. the- newspaper
reporters, present.--Will . there.. be. the same number ;of- employee's
on the--.payroll1' next year?=Supervisor-'.Martocchia,-stated he does
not anticipate any . new employees, nor •any. -layoffs anticipated,
based on negotiations, however.--Supervisor Martocchia cited
anticipated increases in hospitalization and insurance fees for
town vehicles... Further general discussion -.onthe.:tentative 1977

amended..by adding a new Article thereto, to .b,e Article II to read
as follows :
GAMES OF CHANCE

purpose of this Article have the meanings respectively ascribed

obtaining the required license therefor, to. condu.ct.games; of chance
within the territotial limits of " the Town of Southold, subject to
the provisions of this ar.t.ic_le- and Article .9-A. of the,;General
Municipal Law.
Section 30-22 ;.;Restrictions}"
The conduct of games oc . chance authorized by this Article shall

C. No authorized organization licensed under the
provisions of Article 9-A of the General Municipal
8: ACT 11976
Law .shall purchase or .rece'ive ra.ny supplies or
equipment specifically designed--or--adapted' for' -tise
in:-.the conduct,.of.•games of chance ,from other .than a
-.:supplier 2licensed--by the,-board or from another -
authorized organizaton.
D:. The entire net proceeds of any game of -chance
and of--any rental shall be exclusively-devoted`! to .•. .
the lawful purposes of the organization permitted
to-conduct-the• same.
- E. No prize''sY all exceed-'the -sum 'or value- of one
huizdred dollars in any operation or conducting of'--'asingle
.game of- chance..as providedyin section one hundred
eighty-six of• Article 9-A 'of the' General Municipal
Law. No single wager sha11 exceed ten dollars.
F. No series of—prizes on any one-- occasion of games
of chance shall aggregate more than one thousand
dollars as provided in- section one hundred eight—
six of Article 9-A of the General Municipal Law.
No person except a bona fide 'member= of',any such
organization, its auxiliary or affiliated* organization,
shall participate in the management or operation of
such 'game; as 'set forth in section one hundr 'd '�ninety-
five of Article -9-A 'of the' General Municipal':Law:
H. No person shall receive any renumeration for
participating in the management or operation of any
such game.
I. The unauthorized conduct 'of a game of chance 'shall
constitute `a 4 be- puni ishab•le` as' a misdemeanor' .
Section 30-23 Approval' by Electors. `
This Local Law shallnot become operative• 'or effective unles-s
and until it shall have been approved by a majority of the
electors voting' on' a- propositiori submitted at a general' or-special
election held within the Town ;of Southold who 'a-re ' qualified '•to•"
vote for officers 'of the Town of Southold.
II. 'This ' local iaw shall take effect immediately-

RESOLVED that the Fishers Island Ferry District be and they hereby
are authorized "to advertise•- for-bids 'for the replacement of a clutch
on the' Mystic' Isle at 'an amount not` to exceed: $4; 000:00,[

1976 for the renewal of a single trailer on his property on the
east side of ' E-lijah's Lane, Mattituck', New'York, be and hereby is
renewed; for a period of 'six (6) "'months.

On motion of Justice Suter, .eeconded. by Councilman Homan,
WHEREAS the Sacred Heart R.C. Church, Cutchogue, New York, has
applied to the Town Clerk• for .an amended bingo license, and
WHEREAS the Town Board has ecamined the application, and after
inestigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he
hereby is authorized and directed to execute on behalf of the
Town Board the findings and determinations as required bylaw, and
it is furthier
RE$OLVED( that `the Town Clerk be and she hereby is directed is issue
an amerided'*Bingo License �to� th-e Sacred Heart R.C. Church,, Cutchogue,
New York.

RESOLVED that Supervisor •Albert'M. Martocchia be and hereby is
authorized to make arrangements with the New York Telephone Company for
the installation' of a telephone system in the,• town hall, Southold,
at such terms and conditions as 'he may deem proper.

On motion_ of Councilman Rich, s.econded by Councilman Homan, it was
RESOLVED that the retirement resignation of Edna A. Ashworth,
secretary to the Superv'i'sor, be and hereby is accepted effective
October 31, ' 1976.

The Board discussed the proposed "Richmond Shores at Peconic" cluster
concept development, ' but no 'action was taken". The board will arrange
a possible .meetingwith the Planning Board to discuss cluster concepts.
On motion of Justice Demarest; seconded by Justice Suter, it was
RESOLVED that adjournment- be called at 4 :30 P.M.
