SOUTHOLD TOWN BOARD
August 26, 1976
A regular meeting of the Southold Town. Board was held on Thursday,
August 26, 1976 at the town board meeting room, 16 South Street,
Greenport, New York. Supervisor Martocchia opened the meeting at
8:00 P.M. with the following present:
Supervisor Albert M. Martocchia
, Councilman James H. Rich, Jr.
Councilman James Homan
Justice Martin Suter
Town Attorney Robert W. Tasker
Town Clerk Judith T. Terry
Absent: Justice Louis M. Demarest
Justice Francis T. Doyen
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that a recess be called at 8:01 P.M. for the purpose of
holding a public hearing on proposed Local Law No. - 1976 - "A Local
Law to amend Chapter 97 of the Code of the Town of Southold in relation
to the regulation of Freshwater Wetlands in the Town of Southold. "
Ms. Muriel Brush took the minutes of this public hearing.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich,
Councilman Homan, Justice Suter.
This resolution was declared duly adopted.
.Meeting reconvened at 8: 30 P.M.
On motion of Councilman Homan, seconded by Councilman Rich,
WHEREAS a proposed Local Law No. -1976 was introduced at a meeting
of this board held on the 18th day of August, 1976, and
WHEREAS a public hearing was held thereon by the Board on the 26th
day of August, 1976, at 8:00 P.M. , at which time all interested
persons were given an. opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED that Local Law No. 2 - 1076 be enacted
as follows, to wit:
"A LOCAL LAW TO AMEND CHAPTER 97
OF THE CODE OF THE TOWN OF SOUTHOLD
IN RELATION TO THE REGULATION OF
FRESHWATER WETLANDS IN THE TOWN OF
SOUTHOLD. "
Be it enacted by the Town Board of the Town of Southold as
follows:
I. Section 97-13 of Article I of Chapter 97 of the Code of the Town
of Southold is hereby amended as follows:
The definition of "Wetlands" as contained in
Section 97-13 of said Code is hereby amended by
adding thereto a new paragraph to read as follows:
Freshwater wetlands as defined in Article 24,
Title I, Section 24-0107, Subdivisions 1(a) to 1(d)
inclusive, of the Environmental Conservation Law of
the State of New York.
II. This local law shall take effect immediately.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter.
This resolution was declared duly adopted.

On motionof Justice Suter, seconded by Councilman Homan,
WHEREAS a proposed Local Law No. -1976 was introduced at a meeting
of this board held on the 27th day of July 1976, and
WHEREAS a public hearing was held thereon by the Board on the 24th
day of August 1976 at 4:45 P.M. at which time all interested persons
were given an opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED that Local Law No. 3 -1976 be enacted
as follows, to wit:

A LOCAL LAW TO AMEND THE CODE OF THE TOWN OF
SOUTHOLD IN RELATION TO THE MANNER OF GIVING
NOTICE BY MAIL.
Be it enacted by the Town Board of the Town of Southold as
follows
I. Chapter 32, Article III, Section 32-33, Subdivision A of the Code
of the Town of Southold is hereby amended by deleting the words
"registered mail" and inserting in place thereof the words "certified
mail".
II. Chapter 52, Article IX, Section 52-91 of the Code of the Town of
Southold is hereby amended by deleting the words "registered mail,
return receipt requested" and inserting in place thereof the words
"certified mail".
III. Chapter 81, Section 81-9, Subdivision A of the Code of the Town
of Southold is hereby amended by deleting the words "registered m&il"
and inserting in place thereof the words "certified mail" .
IV. Chapter 97, Article III, Section 97-31, Subdivision C of the Code
of the Town of Southold is hereby amended by deleting the words
"registered mail" and inserting in place thereof the words "certified
mail".
V. Chapter 100, Article XIV, Section 100-143 of the Code of the Town
of Southold is hereby amended by, deleting the words "registered mail"
and inserting in place thereof the words "certified mail" .
VI. This local law shall. take effect immediately as required by law.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, - Justice Suter.
This resolution was declared duly adopted.
On motiori. of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that. the minutes of the August_ 12, .1976 town board meeting be
and hereby are approved as submitted.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman .
Rich; Councilman Homan, Justice Suter.
This resolution was declared duly adopted.
On motion of Councilman Rich, seconded by Justice Suter, it was
RESOLVED that there being no further business to come before this'.
town board meeting, adjournment be 'called at 8:35 P.M.
