SOUTHOLD TOWN. BOARD MINUTES
July 27 , 1976
A regular meeting of the Southold Town Board was held on Tuesday,
July 27., 1976 at the town board meeting room, 16 South Street,
Greenport, New York., Supervisor Martocchia opened the meeting at
3 :00 P.M. with the following present:

On motion of Justice Demarest, seconded by Councilman Homan, ' it was
RESOLVED that the July 13, 1976 minutes of a regular meeting of the
Southold Town Board be and hereby are approved as submitted.

RESOLVED that the next regular meeting of the Southold- Town Board
will be held at 3 :00 P.M. , Tuesday, August 10, 1976 at the town
board meeting room, 16 South Street, Greenport, New York.

RESOLVED that the annual Fishers ' Island meeting of the Southold
Town Board will be held at Fishers Island, New York, on Thursday,
August 12, 1976 at 1 :00 P.M.

Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen.
This resolution was declared duly adopted.
Supervisor Martocchia reported:
1. The sanitation faciltiies at the beaches are nearing
completion; there had been a delay due to lateness of delivery of
interior component parts.
On motion of Justice Demarest, 'seconded by Councilman Rich,, it was
RESOLVED that the Oysterponds Chemical Company, Orient, New York
be granted permission to close a section of Orchard Street, Orient,
between Village Lane and Navy Street from 5 PM to 8PM on August
14, 1976 for their annual barbecue; provided the necessary insurance
coverage is obtained. .

Supervisor Martocchia :
2., . The Department of Environmental Conservation, State of New
York will 'hold a public information meeting at the Greenport School
on.Monday, .August 2, 1976 starting at 6PM to discuss with landowners
the ,effect of the Tidal Wetlands Act on their individual properties.
This meeting was arranged by Supervisor Martocchia due. to ..the fact
some people were not notified of the earlier meeting ,in Riverhead,
some of the :.maps were missing and :so,.many people appeared, many
questions could not be answered.
3. Letter -from The Congress of Senior Citizens of Greater New
York seeking more interested legislative support and asking that the
town appoint a senior citizen advisory committee. Supervisor
Martocchia appointed. the. two presidents of the Southold ` Town senior
citizen groups , Mattituck and Southold, to .meet with him .to discuss
the proposal.
4. 1 The permit -ha.s been received from the New York State Depart-
ment of Environmental Conservation for the dredging work at the ramp
in New Suffolk. The coprs of Army Engineers ' permit has not been
received as yet and work cannot be: started until that permit is
received.
. . 5. notice -has ..been received that the rates for the three Town
Xerox machines has been increased based .on the volume of use.
6. Letter from Southwold, England, which has been turned over
to Councilman Rich for reply, seeking information on several former
residents: of Southold.
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that Supervisor Albert M. Martocchia be and. he hereby is
authorized to enter into a renewal lease fora launching ramp next
to the marina on Narrow River Road, Orient, the only public access
=to Peconic Bay in the area, with H:M. Demarest & Sons, at a rental
fee of $100.00 for the period of September 1, 1976 through August 31,
1977 ; property bounded north by Narrow River Road, east by now or
formerly ,of John .Brown, south by Hallock ' s Bay, and -west by now or
formerly of George L. Edwards.
Vote of the Town -Board: Ayes : Supervisor Martocchia, Councilman Rich,
Councilman Homan, Justice Suter, Justice Doyen. Not Voting: Justice
Demarest.
This resolution was declared duly adopted._.
(Justice Demarest abstained from voting .on. the .former resolution, as
he is a. part-owner of the property; although the town attorney assured
him there is no conflict of interest in renting the aforesaid property
to the Town of Southold. )
Supervisor Martocchia :
7. Receipt of a letter from Mrs. McIntyre, Chairperson of the
Comprehensive Planning Committee of the Suffolk County Youth Board
Coordinating Committee, who will be in Southold Town sometime during
the first two weeks in August, and will meet with Supervisor Martocchia
and Councilman Rich to review some of their projects and discuss what
might be available.
8. Thank-you letter from Dr. Jon Richmond, Chairman of the
Festival. Program of the Bicentennial celebration, thanking the tcw n
board for the part they played in the program, and requesting
additional funds to .cover current bills; much of which money will
be coming back in from items they are selling at the present time.
On- ,motion of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that $1, 500. 00 in additional funds be allocated to the
Southold Town Bicentennial Committee.

RESOLVED that the Town Board of the Town of Southold will hold a
public hearing at the Supervisor' s Office, 16 South Street, Greenport,
New York. on the 24th day of August, 1976 at 4 :45 o'clock P.M. , at
which time and place all interested persons will be given an oppor-
tunity to be heard on the following matter; Proposed Local Law No.
1976, entitled "A Local Law to amend the Code of the Town of Southold
in relation to the manner of giving notice by mail" .
I. Chapter_ 32 , Article III, Section 32733, Subdivision A of the Code of
the Town .of Southold is hereby amended by deleting the words "registered
mail" and inserting in place thereof the words "certified mail. "
II. Chapter 52, Article IX, Section 52-91 of the Code of the Town of
Southold .is hereby amended by deleting . the words "registered mail, return
receipt .requested" and inserting in place thereof the words "certified mail.

RESOLVED that a public hearing will be held by the Town Board of the
Town of Southold at the Supervisor 's Office, 16 South Street,
Greenport, New York, on Tuesday, August 10, 1976 , at 4 :30 P.M. , in
the matter of the application of Eastern Long Island Kampgrounds, Inc.
for permission. to establish .and operate .a tourist camp .on Queen Street,
Greenport, New York. All persons interested in said matter shall
appear at the time and place above specified and will be given. an
opportunity to be heard.

On motion of Justice Suter, seconded by Councilman 'Rich, it was
RESOLVED that the Matti.tuck''Senior Citizens be 'and hereby are
authorized to contract for buses in the amount of' $560'. 00 for a'
trip to Monticelloo, New York;' in November, 'involving a stay of
five days and four nights.'.

This resolution was declared duly adopted.
Katherine Kiernan read a statement to the 'Town Board on behalf of
the Southold Town Community Health 'Council, Inc: which is- working
with "the Community Advisory' Board for the proposed 'health center,"'
and with the' administration of the Eastern 'Long' Island' Hospital,
the towns ' Inter-Agency Council, and with the Suffolk County Health
Serviced Department. The letter requests funding _assistance � in the
amount of '$300. 00 to aid in 'covering expenses for 'the current year.
Mrs. Gladys Csajko suggested that a list of the total membership of
'the senior citizen groups be obtained, and a list of those senior
citizens who have gone on' the 'bus trips, to determine if it' is a
broad spectrum of their group, or a small spectrtim. ''and if just -a
small percentage is going on these trips.,--- Supervisor Martocchia
stated there' has. been a misunderstanding on the use •of' the'' money
allocated to the senior citizens. ' It was never" discussed' in- the '
beginning as to how the money would be used, but when it has been
spent, there would be no further funds available for' the present
year. In 1977 there will be different guide lines set up` for the
program. ---Andrea Aurichio asked if the board''is in 'favor of the
money`, and in favor of one day trips, but opposed to more than one
day trips; what other uses would there be except''transportat'ion?---
Supervisor Martocchia stated those are the things to be discussed
with the two presidents of the local groups.'
Mr. Al Daubert, Mattituck, President of the- Mattituck Senior Citizens
thanked the board for approving the resolution for the buses to
Monticello. He stated when he was elected president he was told
there was so. much money to 'be used but .riot for a'- specific puspose-.---
Marie Johnson asked how much money has been used? Mr'. Daudert stated
out of their $2, 000. 00, they should return about $1, 000.00
Mrs. Sherley Katz asked how' long before the Board would act 'on the
request of the Health Council for the $300. 00?=--Supervisor Martocchia
stated it would be at the next meeting, August loth.
Mr. ' William Graham asked what the town requ"ireiients are for the school
district to be eligible to wine under the recreation program?---'
(Reference made to the Southold School) ---Supervisor Martocchia stated
he had just spoken to Principal Walter Cain this morning, and there is
$3, 200. 00- allocated" to the Southold program to expand on what they
are doing themselves; however, they do ::-not have 'a ''program at all due
to the austerity program. If they initiate a program they would be
eligible to receive town money. It is given to them following the
program..
Mr. Donald Stanton,' Kenney's Beach Civic Associa'tiori spoke to' the"
board relative- to an erosion problem just west of Kenney' s 'Beach.
and requested. the board to assign someone to look into the situation.
Goldsmith ' s Inlet is to the west. The proportions of the problem
is serious and the danger of jokoperty loss is eminent.--Councilman
Rich stated he i,s very familiar with the pr--oblem, .Mt. Stanton had
spoken to him on the phone. - Councilman Rich owned property after
the breakwater and ended up selling it as there is no nourishment
coming along the beach. The problem is so big-, he does not know ,
how the town could go about solving it.---Mr. . Stanton stated they
have contacted the New York State Department of Conservation and. .

they are coming out to look at the situation this Friday morning
at. _:1:0 :00 .o' clock,: and.'they ,request :the ,town also look into the matter. ---
Supervisor .Mar:tocchia stated that he would make some phone.;calls� to see
what other agencies -he could..get .to ..come. out • and...look.. at .it..
Supervisor Martocchia introduced Salvator-e !.Nicosia, . who is running
for Congress, First Congressional District. Mr-.>. Nicosia ..:expressed
his pleasure at being at this town board meeting and seeing local
government in action. He stated there is a severe erosion problem
on the south shore.
Mrs. Csajko asked why.. Supervisor Martocchia skipped item 8 on the
agenda relative to Thomas O'Neill.--Supervisor Martocchia stated
Mr. O'Neill owns property on Smith Drive, Southold, and he is having
problems with clam diggers on what he claims to be his property.
The Town Trustees sent Mr. O'Neill a letter stating they have examined
the maps and deeds to his property, indicating he is indeed the owner
of the property. It is not town land and they therefore do not have
jurisdiction, and suggest he stake out the boundaries of his marshland
so his rights to the property may be known to those concerned.
Mrs. Csajko asked about item ll, relative to the Town of Islip
navigation laws. --Supervisor Martocchia stated they sent a prepared
resolution asking all the towns to sign it so Suffolk and Nassau
Counties will have a uniform navigation law.
Mrs. Csajko asked what the letter from the Congress of Senior
Citizens of Great New York is about?---Councilman Homan gave Mrs.
Csajko his copy of the letter.
-Supervisor Martocchia stated the progress of the town hall is on
schedule and should be completed by Christmas.
On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that a hearing will be held by the Town Board of the Town
of Southold at the Supervisor' s Office, 16 South Street, Greenport,
New York on the 4th day of August, 1976 at 10:OOo'clock A.M. in' the
matter of the revocation of the peddlers license issued to Robert
Allan Beaudoin pursuant to the provisions of Chapter 69 of the Code
,of the Town of Southold. That the grounds for such revocation are
the violation of the provisions of Article I of Chapter 69 of said
Code, to wit: By engaging in the business of selling goods, wares,
or merchandise between the hours of 8:00 R.M. and 9 :00 A.M. in
violation of the provisions of Section 69-109A of said Code; By
standing or permitting the vehicle used by him to stand in one place
in a public place or street for more than ten minutes in violation
of the provisions of Section 69-109F of said Code; By calling
attention to his goods by blowing a horn or ringing a bell -in violation
of the provisions of Section 69-109E of said Code.-

RESOLVED that the Amended petition of the Cutchogue Polish Democratic
Club, Inc. requesting a change of zone from "A" Resildential and
Agricultural District to "B" Light Business District on certain
property at Depot Lane, Cutchogue, New York be and hereby is
transmitted to the Southold Town Planning Board for their official
report defining the conditions described in said petition and to
determine the area so affected with their recommendations.
Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich,
Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen.
This resolution was declared duly adopted.
