Based Upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence, the Zoning Board Finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is characterized by modest dwellings ol"various sizes and styles, many oil non-conforming lots. Many of the homes were developed prior to zoning,and on the north side of Peconic Bay Boulevard it is not uncommon for the homes fronting the street to share rights-of-way to enable access to homes behind those fronting the street. The subject easterly side-yard setback has existed since at least 2017 and likely since the home was built. Further, the neighboring homes on that side are set back trom the light- of-way, such that the distance from the subject dwelling, to the dwelling to the cast: is equal to at least 3.1 feet plus the width of the right-of-way (25 feet). Hence the non-conforming side yard setback continues to have little visual impact. 2. Town Law 6267-b(3)fb)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling was built close to the property line prior to,Zoning and the proposed porch enclosure does not alter that situation. 3. Town-Law V67-W)M(3), The variance granted herein is mathematically Substantial, representing 69% relief' from the code. However, the residence was built prior to Zoning and close to the property line, and a prior Board decision allowing installation of a pitched roof to replace a flat roof sim ilarly granted the identical side yard setback variance. 4. Town Law '267-b(3)(bJJ4). No evidence has been submitted to suggest that a variance in this residential n community will have an adverse irnpact on the physical or environmental conditions in the neighborhood.
