Supervisor Martocchia opened the meeting at 3 :00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Ric h, _Jr. Councilman James Homan Justice Martin Suter ' Justice Louis M. Demarest Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Absent: Justice Francis T. Doyen On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the June 22, 1976 minutes of a regular meeting of the Southold Town Board be and hereby are approved. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Rich, it .was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3 :00 P.M. , Tuesday, June 27, 1976 at the town board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan,Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the June reports of Supervisor Martocchia, Town Clerk Terry, Justice Suter, and Building Department be and hereby are accepted and ordered place on file,' Vote of the Town Board: Ayes: .Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This .resolution was declared duly adopted. Supervisor Martocchia reported: 1 . Item # 4 ' on the agenda - auditing bills - will be completed following a recess of this meeting. 2.Applications for dredging projects: Thomas L. Blankley, Jockey Creek, Southold, objections by August 5th, hearing August 11th. Leopold Stein, East Marion, objections by August 10th, P!earing August 16th. Paul Capron, East Marion, objections by August 4th, hearing August 10th.---All hearings by the Department of Environmental Conservation, State of New York. 3. Applications before the U.S. Army Engineers: Edmund H. Curcuru, Paradise Point, Southold, objections by July 29th. Matt-A- Marr, Inc. , Mattituck, objections by July 29th. William Gardner, Nassau Point, Cutchogue, objections by July 29th. Donald Finnerty, Cutchogu-e Harbor, Cutchogue, objections by July 15th. 4. On Thursday, July 15th, at 2 P.M. and 7: 30 P.M. there will be information meetings on the wetland regulations at the Suffolk County Center, Riverhead, Maps will be available at that time. 20. JUL' 31976 5. At the last meeting the Board approved the figure of $35,000.00 for subdivision known as Peconic Knolls; There will be a waiver on construction of part of that roadway and a new bond estimate will be submitted in the near future. On motion of Councilman Homan_,. seconded by Councilman Rich, it was RESOLVED that upon a submission of a proper voucher, the Town Board authorizes payment to C.S.S. Testing Lab. Inc. the fee of $55.00 per day and $40.00 per half-day for concrete .batch plant inspection, and $60.00 per day and $45.90 per half-day for concrete field inspection in connection with testing and inspection services regarding the controlled concrete at the Southold Town Hall addition site, fees for which the Town of Southold is responsible for payment. .Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: A 6. The Board has received a series of maps and study books on the Flood Insurance Program for the Town of Southold. The Town Board will study them and has submitted a set to the Planning Board for their study and recommendation. 7. A request of the Planning Board fora joint meeting on cumulative zoning will be considered for. the near future. 8. Receipt of a questionnaire relative- to self insurance in conjunction with a county study which is being made. 9. Dredging project at Conklins Point, Greenport - The Town Board is uncertain whether to recommend such a plan or not, as two years ago the town supported the project, but -was •objected to by some people in the area, therefore it was defeated; . however now some people in the area want the project. The Supervisor has asked a county survey team to study the plan.-- Mrs. Gladys Csajko stated that three years ago the taxpayers went on record as opposing the project as it is all private property and would set a precedent. The Department of Environmental Conservation turned the project down completely. Mrs. Csajko recommends that the people involved pay for the project themselves and not expect the town to pay for it. 10. Notice from- the Suffolk County Legislature that Coast Guard approval has been received for the construction of the. Route 25 bridge over Mill Creek, Southold; for the temporary detour _ structure as. part of the construction of said bridge. 11 . Mortlock, Chairman. " , 12 _ Letter from the Consumers- Protection Board requesting a':: list of soft ice cream trucks presently doing business in Southold Town. 13. Notice from the U.S.A. Nuclear Regulatory Commission indicating the pre-hearing conference will be reconvened at 9:OOA.M. July 15, 1976 at the Holiday Inn, Riverhead. 14. Notice relative to new non_profit organization- gambling law. The town attorney will examine the law as it pertains. to the Town of Southold. 15.. ..Letter from the Southold Town Baymen' s Association, Inc. requesting inclusion in the town ordinances putting -them on the same level as an agricultural farmer. They ask that a change or addition to Article III, Section 100-30 : "the right to make and store fish nets, lobster pots, and other necessities of our' work on our own property or the property we lease. We also request that our boats be permitted at our, own docks or docks which we rent. We base this request on the assumption that mariculture and agriculture are, one and the same., - i. e-. ,that farming• of the land and farming of'-the sea are identical in our fishing and agriculture community. " The request will be studied between the Planning -Board and Town Board and should have some sort of determination within a month. 16. Thank you letter !from the Nassau Farms Association relative to dredging of Little Creek, Cutchogue. On motion of Justice Suter, seconded• by Councilman Homan,. it was RESOLVED that the Southold Senior Citizens be granted permission to contract for one �dddition.al bus to go to Shirley on July 14, 1976 at a cost of $90.00. This resolution was. declared duly adopted. , On, motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the resignation _of Marjorie McDermott as secretary to the Board-' of Appeals and Building Inspector of the Town of. , Southold effective August 2, 1976 be accepted with regret, -and it is further RESOLVED that a letter of thanks and appreciation be sent to Mrs. McDermott for her years of dedicated service . to. the town. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan; seconded by Justice Suter, it was RESOLVED that Mary Dawson be and she hereby is appointed to the position `of Clerk-Stenographer for the Board of Appeals and Building .Department, Town of Southold, . effective July 16, 1976,, a salary of $5,500.00 per annum; and subject to the 26 week probationary provisions. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Jus.tice Demarest. This resolution was declared duly adopted. Supervisor Martocchia': 17. Letter from Mattituck Chamber of Commerce ,requesting the town to discontinue draining silt and sand into Wolf Pit Lake. The Mattituck Park Commission has authorized the town to fill the adjacent parcel which should resolve the drainage problem. A letter was also received from Mr. Murphy p'ertaining' to this same -subject. The matter has been referred to the Highway Superintendent to work out a solution to the problem.. 18. Notice from the Department of the Army regarding the implementation of the second phase of a three-phase program to protect the quality of the waters of the United States .against harmful discharges of dredged or filled materials which will be implemented on July 1 , . 1976.. 19. Copy of a notice from the -State of New York, Department of Public Services, Board on Electric Generation Siting and ,the Environment relative to the proposed Long Island Lighting Company Jamesport Generating Station., .Nuclear Units 1 and' 2 whereby the Towns of East Hampton and Southampton wish to become the late - intervenors at the hearings,. 20. Thrusday, July 15, 1976 there will. be a. meeting. at the Southold.. Presbyterian Church, 7:30 P.M, relative .to setting up a town-wide blood program to cover the blood needs of all. r.esidents . . . in. all. villages of the Town of Southold. 21 . Letter from the Suffolk County Department of Transportation requesting information for a study- they a_ re. making of .special transportation services; to identify the level of transportation, existing services, develop and evaluate alternative plans and programs, and recommend specific programs of action_. 22. Acknowledgement letter from the New York State Division of Housing and Community Renewal relative to the" Town of Southold' s adoption. of the State Building Construction Code. 23. . Letter from the' Suffolk County .Department of Civil Service informing the ,town that the time,. period for Veteran' s preference during the Korean conflict has been extended from July 27, . 1953 to January 31 , 1955. On motion of -Justice Demarest, seconded by. Councilman Rich, it was RESOLVED that the Orient.. Fire' Department Ladies Auxiliary .be and hereby. is granted permission to close off the- portion of .Orchard Street, Orierit, between Village Lane and Navy Street on. August 21 , 1976-- between the.._hours of 9:.00 P.M. and 1 :00 A.M. and. provide the necessary insurance coverage to hold the Town of Southold free from damages. Vote of the Town Board: Ayes: Supervisor Marto.cchia, Councilman Rich, Councilman Homan, Justice' Suter, . Justic-e Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 24. Letter from Assemblyman Duryea stating- relative to the exempt status of Nassau and Suffolk County' s''exemption 'from the -1976 Navigation Law. This- year :the Assembly passed legislation .removing this exempt status, however, the Senate did not pass the legislation thereby continuing us -in the exempt classification. 25. Notice from the Long, Island Lighting Company stating Classification # 5-and Classification .# 8 will have an increase in its electric service rates. Classification # 5 pertains .to..traffic signal lighting and Classification #8 pertains- to street lighting. On motion of Councilman Homan, seconded ,by Justice Suter, .it was RESOLVED that Chief Mathew J. :Martin', Assistant Chief Vincent Wieczorek, and Assistant Chief James Fogarty of the Cutchogue Fire Department be and hereby are appointed fire wardens . for Robbins Island. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On .motion of Justice Suter, seconded by .Justice Demarest,-..it was RESOLVED that application of Sophie T. Saunders dated June 24, 1976 for the renewal of a single trailer on her property located on the north side of Main Road, Laurel, New York, be and hereby is renewed for a period of six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was deccared duly adopted. On motion of Justice Suter, seconded .by Councilman Homan,- .it was RESOLVED that application of Maddi'e Miles dated June 24, 1976 for the renewal of a single trailer on her property located on private road, ' off north side Main Road, Mattituck, New York, be and hereby is, r.enewed for a period of six (6) months. On motion of Justice -Suter, seconded by Justice Demarest, '.it was RESOLVED that the Southold Town Board accepts the $50,000.00 bond for roads and improvements in "Greton Estates", .Mattituck, . N.Y. , a subdivision owned by Peconic Homes , Corporation, New Suffolk, New Yorke. . . Vote of. the Town Board: Ayes: Supervisor., Martocchia, Councilman Rich, Councilman Homan, Justice Suter,, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 26. Justice Demarest was . asked to . explain the next proposed resolution: Proposal to abandon Creek Street and South Street., New Suffolk - Creek Street is . at the- bottom of School -House Creek, it was dedicated in 1837, but the roads were never-built. .According to. law if the road is not. built within six years' it must be . abandoned'. On motion of Justice Demarest, seconded by Justice Suter, .' it was RESOLVED that consent is hereby given to- Raymond C. Dean, Superintendent of Highways of the Town of Southold. to abandon South Street,. described on the records of the Southold Town Clerk as commencing on Fifth Street.,near the south end thereof and running thence easterly to the high water mark of Peconic Bay, said highway has not been traveled or used as a highway for;"six. y6a rs prior to the date hereof, and said highway is hereby deElane:d'abandoned as a highway and a public right of way, pursuant to. the provisions of Section 205 of the Highway Law, and it is further RESOLVED that consent is hereby given to . Raymond C. Dean, Superintendent of Highways 'of the Town of Southold to abandon. . Creek Street, described on the records of the South.old. Town Clerk as commencing on Fifth Street about 300 feet to the north of Orchard Street and running thence easterly to high water mark of Peconic Bay, said highway has .not been traveled or used as a highway for six years prior ..to .the date hereof, and said highway is hereby. declared abandoned as a' highway and a public right of ,way, .pursuant to the provisions of 'Section 205 of the Highway Law. This resolution was declared- duly adopted. • - ��u,���:3:�s�6 23 On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder the followin5 more or less, as needed: , 300 tons of Grade No. 1 Cayuga (or equal rock salt, delivered in 100 lb. bags. 'to the Highway Department, Peconic, New York, by truck.--300 tons of Grade No. 1 Cayuga (or equal) , rock salt, delivered in bulk to theHighway Department, Peconic, New York, by trucks. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be' authorized to advertise for bids and to purchase from the lowest respobsible bidder, the following more- or less, as needed: Item No. 1=w 15,000 lin. ' feet of snow fence with pickets 12 x 3/8 inches, spaced 2 inches apart, 4 feet high stained red, with five ,(.5), double starnds of122 gauge galvanized wire in 1'00 lin. 'foot rolls. . Item No. 2- 1 ,000 - 6 ft. studded steel T posts with flanges or anchor plates on posts, posts shall not be less than 8.65 lbs. each. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice, Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 27. Receipt of a letter from the residents of the Rocky. Point Road area East Marion. There has been the problem of the steps to the beach which have been destroyed time after time :by vandals, so the beach has been closed and steps removed.. A chain link fence was installed, but it_was destroyed two days .after it was placed there, including .the no parking and no trespassing signs. The residents of the. area feel they are being penalized, and have offered to police the area on shifts. The board appreciates their interest but feels there would still- be problems in that area, therefore the beach must'-:remain closed for- the present time. 28. At the last- meeting the board tabled a request by the Mattituck Senior Citizens to go to Monticello for four days and five nights, involving .$560.00 for buses. The -board met with the president and representatives of that group this morning and were enlightened by the discussion as to their rules and regulations. the trips taken by the senior citizens are voted on by the membership and,-.is a group decision. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that a decision on the senior citizen trip to Monticello be tabled until- the next meeting of July. 27,' 1976 to 'give the board an opportunity to discuss the proposal,' and to make it possible for Justice Doyen, Fishers Island, . to be' present to vote on� the proposal. Vote .of the Town Board: Ayes: Sup-ervisor Martocchia, Councilman Rich, Councilman -Homan. -Justice Suter, Justice-.-Demarest. This resolution was de6l-ared auly: adopted. Supervisor Martocchia opened the meeting for discussion by the public, explaining first that the board- will -recess to, audit bills and meet with Chief of Police -Cataldo. Mrs. Maria,.•Tejo, Mattituck complimented the board on the dog pound, the. .high Late of adoption, it is well run and very clean.--She has learned, however, of an id:iviidual- in Mattituck who has two dogs in a house without food. A letter was sent to Justice Suter by Raffe and Raffe, attorneys from Riverhead, indicating this situation. Mrs. Tejo is concerned with the case of neglect of the dogs who appear :to•,her to be abandoned; they- were . there from June 23rd through July 9th. The warden was--called, but he did not act, .since the dogs were licensed and being fed by someone who was aksed by the owner to care fro them.---Justice Suter stated he received a copy of a letter from.Raffe and Raffe .representing a Mrs. Naugles in Mattituck_who repossessed certain property upon which th be were two dogs which were •being fed by relatives of thw owner of the property: Mrs. Naugles admits the dogs, were being fed, and Justice Suter contacted Town .Attorney to, ask if the town has any right to go on to private property. to --seize -those dogs since theywere �not technically abandoned at this time since someone was taking care of them according to Mr. Raffe-.Is-..own letter. .It was not a complaint about the. dogs r JUL 11 1976 not being cared for as. being the purpose of the letter; the letter concerned the repossession of the property only. (Mrs. Tejo quoted from the Agriculture and Markets ,law-,pertaining to abandoned animals.-)---Supervisor Martocch:ia. stated it is not- the position of the town board to .take possession of th.e dogs or swear ,a complaint against the owner of .the •dogs since they are licensed. Mrs. Tejo hereself can swear out a- complaint• and. take action herself if she is not satisfied with the manner in which the ,dogs are being cared for. Mrs.' Helen .Pospisil_ a member of _the- Southold Senior Ctizen'.'s `Club stated she app.ear.ed_,.befor.e .the-, board.. over.. two years_ ago requesting funds that were made available from the. fbderal .government, to the state to the county and then to the senior citizens for a senior citizen-teen center. She wished to know what progress,. th:ere is on _the senior-citizen-teen.- c.enter up .to, the present time?--Supervisor Martocchia stated they did enter _into a program for three grants for such :.a center._ $23,76.0.00. was granted., ,it has not been-received yet, as the first.phase. . A. contract has -been entered into for.' 2- 1/3 acr.es: of land upon which a 50ft. by 100ft. building is _to be built to house 425. to 475 people.. _ All of the. paper..work. is:.now in order for phase two of this program.--- Mrs. Pospisil thanked the board for the .informati.on, _since in two and half years' she had not heard of the progress and :they did not want to lose the grant to someone else as a center. .is badly needed in Southold Town. Mr. Charles Hickey, Vice-President of the Kenney's Beach Associ- ation thanked the Board for all the effort their put in- to get the left lane turn. on County,: Route 27. Mrs-. .Sherley.Katz asked .if anything .has been done by the town-board on the KOA change in cutting back .the .buffer strip. from. 600 ft. to 300 ft. ?== Superviso.r Martocchia stated. there was a joint meeting between the attorney -for the applicant, .the. .planning -board, and board of. appeals and it.,will, be on- the agenda for the .27th.' Mr. C.E.- Allen, Mattituck spoke to- the Board relative to dredging of James Creek by. the County of -Suffolk, the application for which was made about: 2- years- ago, and the fill must be .placed to the west, where the Salt Lake Village. property owners will not give permission.---Supervisor ,Martocchia stated the- dredging of James Creek- should be started in the very near future. - A suggestion was directed to the board reltive to one=way- parking on the Main Street in Greenport.---Supervisor Martocchia stated the matter is one for the Village of Greenport, not the Town of Southold. Mr. William Pollert, Southold, read a letter to the Town Board relative to a canoe renting enterprise which has been operating at- the foot of Pine Neck Road, Southold. . The matter was made known to various town officials and police_ and ,building departments. , Action was taken by the -police department, but the canoe business continued.. He urged a review ,of perrtiment town ordinances by the town attorney and town board and: if additional ordinances or' ' regulations are necessary they should' be enacted at the earliest possible time._ He did state the business has not been 'operat ing during the last few days.,---Supervisor Martocchia stated the matter was discussed between the town attorney, building department and town board to try to resolve the situation. This business operator, Austin Burt, could rent a parcel of business property and-then operate his business;however, - he- was directed to- discontinue the business in the former -manner of parking on certain residential streets. Mr. Peter Frumenti of the Southold' Town Marine- Rescue Unit of Civil Defense thanked' Supervisor Martocchia and-the town board for all the' help they have -given them. Supervisor Martocchia thanked •their for their- efforts. Mrs. Gladys Csajko asked for the answer to the KOA question.-,- Supervisor Martocchia stated the Appeals Board will hold a hearing on July 22nd.----Mrs. Csajko spoke about the problem directed .to the Board by Mrs. Tejo; stating the owner of the property if from" out of state; and possibly the wardens could- be� given •better, instructions- in handling matters of this nature. The abandonment case can be covered under three or four different sections of the state' law. Mrs. Csajko did:talk to Dr. Zitek who stated the :J UL 1.3..1976 25 animals are definitely in bad health. It is a serious abandonment* problem.---Justice Demarest stated the wardens cannot be ordered, on the strength of a letter, to go out and pick up those animals. ---Mrs. Csajko asked then why did .they not .go out and observe.--- Justice Suter stated they did go out and observe, and determined the animals were all right, in fact in such good shape, if they were to be picked up,- they would have. to use a ,tranqualizer gun to get near the dogs. If a complaint for a dangerous dog is filed, a hearing will be held, and a determaination can be made. --- Mrs. Csajko stated Mrs. Tejo has a list of people in the neighborhood who are willing to testify the dogs- are abandoned.---Supervisor Martocchia stated the matter will be looked into and if there are any corrections to. be _made on the part of the town, it will be done. Mr. William Pell III' asked what the advantages of purchasing a second-hand 1975 truck topurchasing a new one?---Supervisor Martocchia stated the highway superintendent has probably spotted something at a good price, but he still has to go to bid.- On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that a recess be called at 4:45 P.M. , to reconvene at 5:30 P.M. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Meeting reconvened at 5:30 P.M. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that $53.44 be and hereby is transferred from the Fishers Island Ferry District office to Fishers Island Ferry District property Tax. Vote- of the Town Board: Ayes: Supervisor Mar-tocchia; :.Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of. Justice Suter, seconded by Councilman Homan, it was RESOLVED that the following audited bills be and hereby are approved for payment: General Fund bills in the amount of $39,595.03; Highway Department bills" in the amount of $24,705.38; Fishers Island Ferry District bills in the amount of $23,704.32; Street Lighting Installation bills in the amount of $699.51 ; and Federal Revenue Sharing bills in the amount of $163. 14. Vote of the Town Board.: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked for the board' s permission, and'w s granted same, to write a letter to the Village of Greenport relative. to the renewal of the police radio 's-ervice. Supervisor Martocchia spoke to Mayor Townsend some time back, stating ,the. , cost of service will be $6,000.00 per year, with an escellato .clause of' $1 ,000.00 per year and was.. supposed to have an answer by July 1st. , Mayor Townsend stated thek_ Village does not have the money to pay such an amount for the police radio service, but would take the matter up at a special village meeting on July 12th, and reply immediately. At this time, 6: 15 P.M. , no reply has . been received. The board directed the supervisor to seek a reply before their next. meeting of July 27th, or to send a second letter by registered mail stating that if there is no .contract by August 1st service will be terminated. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that there being no further business be come before this town board meeting, adjournment be called at 6:30 P.M.
