AP R, 2 7_1976 SOUTHOLD•-TOWN -BOARD MINUTES- April 27, 1976 A regular meeting of the Southold Town Board was held at the Town Board meeting room, 16 South Street, Greenport, New York on April 27, 1976. -Supervisor- .Ma-rtocchia opened the meeting at 3 :00 P.M. with the following-pr•esent: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Justice Louis M. Demarest Justice Francis T. Doyen Town Attorney Robert W. Boken On motion of Coulcil.man Homan, seconded by Justice Suter, it was RESOLVED that the minutes of the April 6, 1976 meeting of the Southold Town Board be approved asusubmitted. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVDDthat the next regular meeting of the Southold Town Board will be held at 3 :00 P.M. , Tuesday, May 11, 1976 at the Town Board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia reported: 1. Receipt of a letter from Austin Emery, Regional Director, New-York State Department of Transportation relative to the Town Board' s suggestion that a hearing be held on the Cross Sound Ferry project. Mr. Emery states the matter has been referred to the main office, and a reply will be forthcoming in the near future. 2. There is a problem at the New Suffolk boat ramp where it has shoaled-up and the boatt cannot get out. The Board is trying to obtain a special variance from the New York State Department of Environmental Conservation for immediate relief. 3. Letter from the Suffolk County Civil Service Department stating a recent court decision has ruled that towns cannot draw from local lists for police department employees, but musts-Elect from the entire county list. Supervisor Martocchia has been authorize by the Town Board to speak with the ten supervisors in an attempt to amend the law so towns and villages can draw from their own list.,--- Mr. William Pell asked if all the police who have been hired in the last two ge three years have been from the local area?---Supervisor Martocchia stated only one on the police department camefrom the county list, however, at the time he iw.asshired there were no names on a local list. On motion of Justice Doyen, seconded by Justice Suter, it was RESOLVED that the Fishers Island Ferry District be authorized to enter into an agreement with the firm of Gibbons & Ryland Associates at a fee of $5, 000. 00 for the purpose of making a study of the proposed improvements at Silver Eel Cove, Fishers Island which improvement will be funded by the federal government; said study being a require- ment when applying for a federal grant. Vote of- the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman- Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted.. Supervisor Martocchia : 4. Explained aged exemption study relative to how many people are involved in expanding the exemption to $6 , 500. 00.---Mr. Joseph Gleason, Southold, stated the plan proposed by the state and federal government is to establish the $6, 500. 00 exemption whereby if there is a death in a family the exemption goes to the remaining party. He cited the State of New Jersey and State of Connecticut 's plan for aged exemption, as well as the State of Florida with the Homestead Act. His report from Mr. Fox, Chairman of the Board of Assessors is that the tax assessment is up to almost $16, 000. 00, and 411 people took advantage of the deduction last year. Mr. Gleason asked that the board Qote favorably for the tax exemption. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that William J. Robb, Cutchogue, New York, be and he hereby is appointed to the Board of Assessment Review effective April 27 , 1976, through December 31, 1978 to fill the unexpired term of the late Alexander Bogan. Vote of the Town Board: Ayes : ''Supervisor -Martocchia, Councilman Rich, Councilman Homan; Justice Suter, gustice Demarest; Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that Anthony J. DeMaula Jr:-; Mattituck, New York be --and he hereby is appointed to' the Board of Assessment Review effective February '22, 1976 through `February-2-2 , 1981; five year term. Vote of'-the Town Board: Ayes : - Supervisor Martocchia-,- ,Councilman Rich, Couricil'man - Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that Robert Bergen, Mattituck, New York be and he hereby is appointed to the Board of Appeals-; Town of Southold, for ,a period of five years, effective April 19, 1976, term ending April 19, 1981. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, -CouncilmanHoman,' Justice Suter;- Justice' Demarest•; ,Justice Doyen. This resolution was declared duly adopted. On motion- of Councilman Rich,- seconded by Justice Demarest, it was RESOLVED that- Fra'nk' S. Coyle, Greenport, New York, be and he hereby is appointed to the Planning Board, Town of Southold, for a period of five years, effective April 30, 1976, term ending April 30, 1981. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich-, Councilman' Homan, Justice Suter; Justice- Demarest, Justice- Doyen. This resolution was declared duly adopted-: On- motion of - Councilman Rich, seconded by Councilman Homan, it was RESOLVED that Frank Lekich, Southold, New York;- be- and he hereby is appointed to the Board of Housing Appeals , Town of Southold, for a period of three years , effective January 9, 1976, term ending January 9, 1979': Vote of the Town Board: Ayes, : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice-- Suter, 'Justice- Demarest, , Justice Doyen. This resolution was declared duly adopted. 44t AIR '7197V Supervisor Martocchia reported: 5. In following the agenda - Item 12 - Leash Law - discussion, no decision. 6. Item 13 - Leisure .Greens property at Cutchogue - discussion, no decision. Item 14 - Building Code - Chairman of that committee needs more time for further study. Chairman is Councilman Rich. 6. William Pell asked the salaries of the prior appointments.--- Appeals Board - $2 , 500. 00; Planning Board - same, but Frank Coyle gets $2,400. 00 the maximum he can receive under his retirement. Board of Housing Appeals - no salary; Board of Assessment Review - pay scale of $50. 00 for Grievance Day, any days after Grievance Day for a day or part of a day $25. 00. Planning Board and Board of Appeals meets twice a month, Board of Housing Appeals meets once a month, and Assessment Review Board meets only during July. On. motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that John M. Helf, Peconic, be and he hereby is appointed Dog Warden for the Town of Southold from the civil service list, effective May 1, 1976 at a salary of $6, 500. 00 per annum, to be paid in regular semi-monthly payments. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that Lois Mellas, Greenport, be and she hereby is appointed Dog Warden for the Town of Southold from the civil service list, effective May 1, 1976 at a salary of $6, 500. 00 per annum, to be paid in regular semen.-monthly payments. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice. Doyen. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that a recess be called at 3 :30 R.M. for the purpose of holding a public hearing on the matter of the application of' Charles J. Zahra for permission to establish and operate a transient travel trailer ,paik in Cutchogue,` meeting to reconvene following the hearing. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Southold Town Board Meeting of April 27 , 1976 reconvened at 3 :45 P.M. Supervisor Martocchia : 7 . The Town is in the process of drafting a contract with the Village of Greenport for services provided by the Southold Town Police radio system. 8. Boy ScoutcDtihner at Colonie Hill at Hauppauge tkis evening (April 27 , 1976. ) ---The Town Board will be represented. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board directs that the $68,897..00 federal revenue sharing funds for the Seventh Entitlement .Period be directed to the proposed Southold Town Hall, Southold. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman ,Homan, Justice Suter,.- Justice Demarest, Justice Doyen. This resolution was declared duly adopted. Supervisor Martocchia: 9. Reported that the project on the Mill Creek bridge is again active. The road will be closed for one day at the time the temporary bridge is constructed. The work should be under way in October. 10. Summer jobs are available for youths in the age group of 14 through 21, and 15 through 18 at $2. 30 per hour. Applicants must . apply to the Department of Labor, Riverhead. ``APR 2 71976 441 11. Discussion will be held between the Suffolk supervisors relative to the Uniform Navigation Law. ---Scott Harris - suggested that the police boats be equipped with a marine radio VHF; which would be on the Coast Guard stand-by- 'emergency channel- and save a great deal of time. ---Justice Suter stated the Coast Guard then mast monitor too• many bands, and feel they should monitor only one channel and thereby- do a comprehensive job through that channel. 12. Letter from Thomas - O'Neill, .Southold; relative , to-- clam diggers encroaching on his property in front -of his house. Mr. O'Neill feels he has title to the underwater property•. The- letter- will be referred to the proper agency. 13. Request from Mattituck Senior Citizens for a bus to Shea Stadium on- June 3rd, but does not specify number of buses or cost of same. On motion. of Justice Suter, seconded by Justice Demarest, it wa-s RESOLVED that the Southold Senior Citizens- be granted- permission to contract for two buses at a total cost- of $900. 00 for an overnight trip to Philadelphia, Pennsylvania on May 17 and 18, 1976. Supervisor Martocchia: 14. Receipt from Long Island Railroad informing the Town of a slide show they would like to present to children between the ages of-8 and 14, entitled "What Makes The Trail Run" , "It' s Your Tomorrow" , and "Showcase of Railroad. " It might be feasible to incorporate it into the school 's summer programs. 15. Marjorie, -McDermott, .- Stenographer; - is- retiring in- June,-- and Supervisor -Martocchia suggested that - anyone- available•- for--such-•a job should-, take' the civil service -test to• qualify for- the position. 16. . .Request- from- the. -East End Slo Pitch League requesting fuadaiggfor, 'the it program. On motion of Justice Demarest-, seconded by• Councilman Rich, it was RESOLVED that the Southold Town Board support the East End Slo Pitch Leauge in funding their program at a proportion to match others who have applied and been approved. Design for some type •of- passive recreation for the Greenport Railroad Dock has been held up for the time=being as a request -has been made, for archaeological study of- the- area. ' The.- dock could qualify for the National Register of Historical Places. -18. -Boy- Scout Jamboree: - 1976- Bicentennial- Muster - to be.:held at Heckscher- State Park the weekend- of May- 14 and 15. Teri thousand scouts are expected, 375-•from. Southold' Town, and request the - Southold Town Board to attend and be on the reviewing stand. 19. - Program for youth services under the Youth Bureau of the County Executive 's Office, ameeting-will- be held -on- April ' 28th• -at 7 :30 P..M.- at Moreland Road, Commack. The Town Board will ,be represented. On motion of Councilman- Homan; seconded by Justice° Demarest, -it- was RESOLVED that the Village-Dry Cleaner, Greenport,- New York, lowest successful bidder, be and hereby is.-awa'rded:.the- dry cleaning contract for police uniforms for one year. William Pell asked the possible cost of the. mower.---Supervisor Martocchia.. stated-- it would- be around $1, 800. 00. ---Mr. Pell questioned it being under the $3, 500.00 figure mentioned prior in the meeting.--- Justice Demarest stated the Highway Superintendent still must have the approval of the Town Board to go to bid.. Supervisor- Martocchia : 21. Superintendent of Highways. Dean. would like to apply. for a federal- grant--under -the Donovan-- Plan for the improvement. of roads, striping, - etc. , . 100%- reimbursement.- -In order to -receive .this funding, it is necessary to hire an.- engineer-. to prepare the . necessary applica- tions and documentation. On motion of JusticeDemarest-, - seconded- by Justiee Su-ter, WHEREAS, the Town of Southold requires the services of an Engineer to prepare the necessary applications and documentation for the. Donovan Plan, NOW, THEREFORE, BE IT RESOLVED that the Highway- Superintendent of the Town of Southold be and-- he hereby is authorized to engage Greenman-Pedersen-, Associates,- R.C. to-prepare all necessary documentation and to do all work necessary to submit applications to the appropriate government agencies for- this program. IT -IS FURTHER RESOLVED that Greenman-Pedersen, Associates, .P.C_. shall do all of said necessary work .on the fee basis and within. the fee limits set forth in their proposal of April 8, 1976. APR- 2 719`76 443, On motion- of Councilman Rich, seconded by Justice Demarest,. it was RESOLVED that Chief Carl Cataldo be and he hereby is authorized to sign an agreement on behalf of the Town of Southold with Suffolk County Marine Science Laborabory, Cedar Beach, Sputhold, for the connection of a leased line alary system -to the alarm panel of the communications .console at police headquarters, Main Road; Peconic, New York. Vote of the Town Board: Ayes : Supervisor Mattocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. This resolution was declared duly adopted.- Supervisor Martocchia : 22. Letter from the Terry Waters Civic Assocation, Bayview, Southold, requesting a study be made along their road for yield and stop signs. The letter is being referred to the police department for, study and recommendation. Also submitted was a petition containing 30 names and a request for a sign to stop loitering at that area. On motion. of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Southold Town Board accepts the $20, 000. 00 bond for roads and improvements in the subdivision known as "Syloret Estates" , Bridge Lane, , Cutchogue, New York, submitted by Lorraine Hochman and Julius Hochman. Firemen' s Association., Mattituck, relative to,=a: traffic signal -at Wickham_ Avenue a-nd Route 2-7 ,.. Mat-tituck. The Association is requesting that a control be established to trigger the light from the -f-ire house. The- Board will-- -look -into -the- matter. Akscin applied to the Town Board .for. a temporary single-trailer permit dated April 20, 1976, now, therefore, be it RESOLVED that .the application of Raymond-.•J. -Akscin- to locate a. : single (4railer on his property on the north side of Bayview Road, Southold,-. New York, at the rear of buildings on the Akscin farm, be and hereby is granted for a period of six (6) months . Vote of: the. Suter,• it was RESOLVED. that -.a public hearing: -be held at the Supervisor ' s- Office, 16 South Street, Greenport, New York- on :the 25:th .day ,.of -May, 1976 at 3 :30 o' clock P.M. in the matter of the grant of scenic and/or conservation easement by Paul Kaloski to the Town of Southold to effect two parcels of real property owned by the said- Paul Kaloski and generally described as follows: 444 APR 2 71976 PARCEL I : A certain parcel of land consisting of 30 acres ; more or' less, of farmland and woodland located on the east side of Alvah' s Lane, Cutchogue, Town of Southold, Suffolk County, New-York, generally bounded northerly by land of Blachly; easterly by 75 Highland Road Corp. and Crown Land Lane subdivision; southerly by -lands of Grathwohl, Horton and Sawastynowicz; westerly by Alvahss Lane and lands of Sawastynowicz, Lipnicki and M. This resolution wa-s declared duly adopted-. - Supervisor Martocchia.: - - - 25. Receipt of an acknowledgement -letter from Senator James L. Buckley relative- to revenue sharing funds. Mr. Samuel Katz, Village Trustee, Greenport; asked for clarification of the ownership of a small beach water frontage at Gull Pond near Sandy Beach. Mr. Katz has been under the impression the Vi-llage. owns the property; •but notices mooring permits must- be- obtained from the Board .-of- Southold-Town Trustees:---Supervisor- Martocchia stated he believes the area is within the Town of Southold. He will= have the- matter- looked into,. - Mrs. Sher-ley Katz asked what the second year funding was under the ` Development Act of HUD?---Supervisor Martocchia stated it was $23 , 760. 00 for the first year, and indications were= the second year the amount would be double that= amount, and believes it was around $54, 000. 00. ---Mrs . Katz asked the Board if they heard whether it has been approved?---Supervisor Martocchia stated .it has been approved. The tentativelplans for the money is a Senior-Citizen-Youth Center. Tentative plans for the building is SO. ft: byy100 ft. to accomodate approximately 400 people. The projected cost for- the building would- be about $120, 000'. 001 plus- allocated amount of $23., 760. 00 for the land purchase. The third year the allocation should be three times the first year. - - - Mrs . Katz• stated she- unders.tands: John Klein tsa-id the .North Fork, Health Clinic is in limbo, but did not hear Supervisor Martocchia had made a series of calls the prior night to get it moving. Is it Superv-iso-,r- Martocchia '-s opinion it- will be inoved,.,?forward or remain in limbo?---Supervi-sor Martocchia stated he taked to- County -Executive Klein the prior night and if. thi ngs keep going the way they are he will stop funding the ones that ex-ist. There. is_ no way he can see he can -incorporate -it in -the Capital Budget for the County '.of Suffolk in '191/7 . - Supervisor Martocchia- -thought he could -see where the rail- road dock could be' delayed• and incopporate that amount in the health clinic: -'However,-- Mr Klein- saidl there is no way he= can see that being done-as- the rail-road' dock is a, one-shot deal ,and the health clinic is an annual item in the budget. Supervisor Martocchia has discussed. the matter with Joyce Burland and she is setting up a joint meeting with her committee and' Supervisor Martocchia and•iper-hags the ,Shelter= :Island supervisor and County, Executive Klein and- the- budget people--to- see if she can movethe proposed plan. AP P 2 7 1976 .4 45 Mr. William Pell asked the Supervisor to comment on item 9, dog cages.---Supervisor Martocchia stated the town appropriated out of revenue sharing $30., 000. 00 for the dog pound, $25 , 000. 00 for the town and $5, 000.•00 for' tY e work `the' highway superintendent did, such as water, electricity, sewer lines, etc. to the pound. The town told the company that"'did the project that the cages were not accept- able, and received a $2 , 000. 00 credit from the company. The town in turn had the cages put in by another firm and the total cast ran over only $61.30. On motion of Justice Demarest, seconded by Justice. Doyen, it was RESOLVED that there being no' further business to come before- this Town 'Board'- meeting adjournment be called at 4 :25 P.M.
