'Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin' Suter Justice Louis M." De'marest Town-Attorney Robert W. Doyen On motion of Justice Suter, seconded by Councilman Homan, it- was - RESOLVED that the next regular meeting of the Southold Town Board will be 'held at 3:00 p.m., Tuesday, January 20, 1976 at the' Town Board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman' Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. 1. Supervisor reported the receipt of the annual report of Justice Martin Suter. 2.. Receipt of a copy of .a .letter from Mr. Frank Hundley, Southold, to Assemblyman Perry Duryea suggesting an'� amendment to the •hunting laws. On motion' of Justice Suter, seconded by Justice Demarest, it was RESOLVED that Supervisor Albert M. Martocchia; be and he hereby-is- authorized,to enter into .an agreement on behalf of the Town of Southold with the County-of Suffolk for a -grant under the Housing and Community Development Act of 1974 from the Department of' Housing and Urban Development (HUD) ,for the year 1976. Vote of the Town Board: Ayes: . Supervisor Martocchia,. Councilman Rich, Councilman Homan, •Justice Suter, Justice Demarest. ' This resolution was declared duly adopted. Mr. William Pell asked Supervisor Martocchia if he is successful ' in getting the funds for •the second year, what does he anticipate it will be used for.--Supervisor Martocchia stated the approved' - project is two-fold, a senior citizen and teenage center. The site is on Peconic Lane, south of the Peconic school site. Supervisor Martocchia reported: 3. Study being made by Cable television on microvraving service and they are considering a small increase. 4., Letter from Jonathan Richmond, Festivities Chairman of th e' Bicentennial asking the Town of Southold if they would care to provide a trophy for a sailboat tournament. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that $6,500 be transferred from contingent acoount to the Nutrition Program, as temporary funds until reimbursement from the County. Vote of .the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted., On motion of JUstice' Suter, seconded by Councilman Homan, it was "RESOLVED that each Southold Town Building Inspector - Terry, Fisher, Hindermann - may make ,a selection of one building inspector conference or school to attend in 1976; no one may attend more than one during the year:. Association of Towns, New York;. New-.York State Building Officials Association Convention, Ellenville, New York; New York State Building Inspector' s School,, Babylon. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. JAN ` 6�-19n On motion of Councilman Rich, seconded- by Councilman Homan, it was RESOLVED-that Supervisor Albert M. Martocchia be and he hereby is author-ited to enter into a contract on behalf of the Town of Southold with Wiedersum Associates as architects for a 'town hall. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Mrs.,.Katz asked if the town hall would be located on the present town hall site.--Supervisor Martocchia stated it would.--Mr.. Pell asked if it would be put up to a vote.--Supervisor -Martocchia stated according to the law if the money is set aside and earmarked for that purpose you can spend it without going to the people. On hand during the. year '1976 there should be one-half million. The Board has asked the architect to design .a building in the area of $400,000.00 as a starter on the present site. Mr. David Driscoll asked why the other three proposals were put to a referendum.--Supervisor Martocchia stated they were asking for an .amount of money they did..not have at that time.--It was suggested that the building will be colonial..--The recommendations to the architect is that it be -fire resistant wood construction.--Discussion was held as to the architect' s fee, which will be 10% of the cost. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that. Lawrence- Tuthill, town engineer, and Frederick Gordon and Henrry Raynor be authorized to attend evening seminars at Riverhead, the registration fee of $12.00 per person to be a town charge. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Demarest, seconded .by Justice Suter, it was RESOLVED..that 'Deborah Scott, .Greenport, -New York,. be' and hereby .-is appointed.by the Southold Town,.Board to -represent-the Town of Southold in .the ;_CAST :program. -_- :-: Vote of -the Town Board:.. -Ayes: . Mrs. Katz asked if the CAST program is still connected in any. way with the town..--Supervisor Martocchia stated -it . just has -the Southold 'Town name, -- On motion of Justice Suter, seconded by Councilman Homan, WHEREAS -William Ruland- applied to :the Town Board for -.a single trailer permit dated;:January., 2, -1976-, _ NOW, THEREFORE, BE IT RESOLVED:that-_the.)application of William .Ruland to -locate a single trailer .on the corner of Main Road and Mill Lane, Mattituck-, New York, be and hereby is approved for a six month period. Justice Demarest, seconded by-Justice Suter, it was -. -RESOLVED. that Supervisor Albert -M. Martocchia be and- he hereby is authorized to enter into a, fixture . rental. agreement with Long . Island Lighting Company, and the eventual phasirg,out of the rental of fixtures. Vote :of -.the =Town. Board:. Ayes: . Supervisor .Mar_to.cchia, ._Councilman_ . ' _ Mr. David Driscoll asked if it would be appropriate to discuss the proposed dog leash control law.--Supervisor Martocchia -stated 'the appropriate time would be at the public hearing to be held January 20th at the Greenport High School..--Mr. Driscoll then asked how -the Sup`ervi`so:r 'feels. about a member of the Town Board who would be making public comment in the media about the dog leash: law not being enforce- able. . .There .sbe'ms to- be .-a conflict of purpose there.- Supervi'sor Martocchia ,stated .that what is said he has no control over. That would .be :the .individual' s. pers.onal opinion., Considerable discussion was held on this subject. .9. _.,.JAN 6-1976 Mr. . P.ell asked, in the year 1976, how many additional employees can the Supervisor see the Town .hiring.--Supervisor Martocchia stated one for the Supervisor' s Office, and two or three for Superintendent of Highway' s Dean. Mr. Pell mentioned October 28 meeting where the Town Board indicated they were putting in for six laborers and one mechanic.--Supervisor Martocchia stated they put in for them, but did not get any of them. Mr. Pell asked about the ' dog pound personnel.--Supervisor Martocchia said there would be the dog warden and a part-timer, and they hope there will be volunteers. (Mrs. Csajko discussed the dog pound) . Mr. Pell asked that "when the highway vacancies are to be filled that it be put out in the minutes so they can select the best possible person for the job.--Supervisor Martocchia stated they have a list already with about 300 names on it. Superintendent of Highways Dean has the right to hire highway personnel without consulting the Town Board. - Mrs. Csajko stated that she has received notification that the total calls in the east-west fire district for 1975 was 19, without rescue calls. Mr. Driscoll asked if the Town Board might feel it helpful if the Fishers Island representative appeared more often at board meetings. Is there anything that requires the sixth member- to be here a minimum number of times in a year.--Supervisor Martocchia stated that it is a special act of legislation to give Fishers Island representation on the Board. Justice. Doyen has attended more meetings than the representative in .the past. He does not get paid as much either.--He managed to get here when a major decision was needed stated Mr. Driscoll. '-Supervisor Martocchia stated that Justice Doyen has indicated -his availability when needed. He does not feel the things discussed here pertain to Fishers Island in most respects. He gets the minutes and confers by telephone. Mr. Driscoll asked how the Development Plan is coming along..-- Supervisor Martocchia stated that the last he knew the Secretary of the Planning Board was instructed to put together the material that *is. now available in the basement.--The last time the secretary was asked about it she knew nothing about it, stated Mr. Driscoll. Mr. Driscoll asked what happened to the proposed trailer for in back of the town hall in Southold, since $5,000.00 was trans- ferred out for it.--Supervisor Martocchia stated that the $5,00.0.00 is available if needed to purchase the trailer. Mr. Pell asked when the yearly reports will be available.--Super- visor Martocchia stated that he has the yearly report for all departments.--Mr. Pell asked how long after reports are approved by the town board that they are filed : in the Town Clerk' s Office.-- Supervisor Martocchia stated they should be back the next day. However, monthly reports are not required by all departments. The full town report will be in the newspaper. Mrs. Csajko asked how much the referendums cost the town for the town hall votes.--Justice Demarest stated that the original one about ten years ago cost about. $27;000.00. - The various proposals. were discussed.--The proposed town hall was discussed. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that a recess be called at 4:05 p.m. to reconvene at 5:00 p.m. Vote of the Town Board: . Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Meeting reconvened at 5:00 p.m. On motion of Councilman Homan, seconded by Justice Demarest, it was RESOLVED that the General .bills in the amount of $14,741.94; Fishers Island Ferry district in the amount of $13,869.64; Highway Depart- went bills in the amount of $ Special Districts bills in the amount -of $ be and the same are hereby ordered paid. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. r JAN V976 3 13 On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that there being no further business to come before this Town Board meeting, adjournment be called at 5:35 p.m. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity .or siltation. C. Cause saltwater intrusion into the fresh water. resources. D. Adversely affect fish, shellfish or other beneficial marine organismm; aquatic wildlife and vegetation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. ; F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the tovn.. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. r
