"April 12, 1962 at the Town Clerk office, -,-Main Roads; .Southold, :.New York. There were present: Messrs. Robert W. Gillispie, Jr. t Chairman, Robert 'Bergen, and Herbert 'Rosenberg. . Absent: Messrs. Charles Grigonis, Jr-. , .and Serge -Doyens Jr. PUBLIC HEARING.: Appeal No. 444 - 7: 3 0 P.M. (E.S.T.') , upon application of Harry, Pumillo, .Main Road, Cutchogue, New York, for a - special exception in accordance with "the `Zoning Ordinance, Article IVa .Sectioi-1 400, Subsection 7, for permission to construct a place of amusement.. Location of property: Main Road, Cutchogues New York, bounded north- by'.Main Road, east by J. Wickham Estate, south by Fire District '°Property, and west 'by H. . Pumillo .and Levin and others. Fee paid $15. 00. J The Chairman opened the hearing by reading application for a special exceptions legal notice of hearing .and affidavit -attest- ing to its publication in the official newspaper. Southold Town Board of Appeals -2- April 12, _1962 .THE CHAIRMAN: Is there anyone present who wishes to speak for this application? HARRY PUMILLO, JR. , .Cutchogue, New York: I have nothing to add to the application. . (In answer to questions posed by the. Chairman, Mr. Pumillo stated that the miniature golf course is all made of cement and is one continuous side walk. There will be objects such as wind- mill, telephone, lighthouse, etc. It will be fenced in on all sides by 6 ft. and 4 ft. barricade fencing. The longest length is over 30 ft. for the drives on the course. The area to be reserved for parking will be 100 ft. by 100 ft. and 100 ft. by 100 ft. is to be reserved for the course itself. ) THE CHAIRMAN: If this application is granted when would construction start? (Mr. Pumillo stated that construction will not start for approximately a year. He had intended to start this spring but had difficulty with the 'financing of the project. He hopes to start by February of 1963. ) THE CHAIRMAN: Is there anyone present who wishes to speak against--.this application? (There was no response. ) This is an application for a special exception to erect and maintain a miniature golf course with related facilities. approx- ; imately 160 feet from the Main Road property line, directly in the rear of the existing restaurant and residence..' At the present time. two access driveways exist. The proposed enterprise will occupy a plot approximately 100ft. by 100 ft. and will consist of the usual equipment. It will be properly enclosed and the proposed lighting will not cause a traffic hazard. The standards set forth in the Ordinance for consideration for a special exception have been met. After investigation- and inspection the Board feels that this enterprise meets all the requirements for the special exception and should be granted with the condition that substantial construction Southold Town Board of Appeals -3- April 12, : 1962 be completed. within 12 months from the date of this resolution. On motion of Mr. Gillispie, .seconded by Mr. Rosenberg, it was s RESOLVED that Harry Pumillo, .Jr. be granted permission• to erect and- maintain a miniature golf course on property located on the south side of Main Road, Cutchogue, New York. . Substantial construction must be completed within 12 months from the date of this resolution. Vote. of the Board: Ares:- Mr. Gillispie, Mr. Bergen, .and Mr. Rosenberg. -Mr. :Robert -Ketcham, Jr.. , East Marion, appeared before the Board of Appeals for an informal discussion. Mr.. Ketcham wishes to erect a directional sign for the Park Diner on the property of Sage in west Greenport and two directional signs for Rhodos Pavilion on the property of Sage in west Greenport and Edwin King in west Greenport. These directional. signs would be 4 ft. by 6 ft. The Board stated that the sign for the Park Diner seems reasonable but Rhodos Pavilion presently has two signs placed in the highway and they could not be allowed additional signs when they presently have two illegal signs. There was a brief discussion relative to the sign of Crescent Beach Colony which was ere cted on the Fismer property in Southold. Mr. Ketcham secured permission to erect this sign and when it was erected illegal wording was placed on the sign. Mr. Ketcham stated that he advised Mr. Corniburt that the additional wording would not be allowed but Mr. Corniburt wished the sign erected anyway. On motion of Mr. Bergen, .seconded by Mr. Rosenberg, 'it was RESOLVED that the minutes of the meeting of April 5, .1962 be approved as submitted. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Southold Town Board of Appeals -4- April 12, 1962 Appeals . 445, .446 and 447, applications of The Holy Trinity Church, Main Street., .Greenport for special exceptions were recessed until April 26, .1962 . to give the representative of the Holy' Trinity Church an opportunity to attend the hearings. PUBLIC HEARING: Appeal No. 448 - 8: 30 P.M. (E.S.T. ) , upon application of Kenneth. A. Raab,. P. 0. Box 116, Bay Avenue, -East Marion, New York, for a variance in accordance with the Zoning Ordinance, Article III, _Section 307, for permission to reduce side yard setback. Location of property: ::private road off Bay Avenue, East Marion, -.New. York, bounded northby private road, east by E. .C. Moore, south by Lake and west by K. T. Dimon. Fee paid $15. 00. The Chairman opened the hearing by reading application for a variance, legal notice of hearing and affidavit attesting to its publication in the official newspaper. . THE CHAIRMAN: Is there anyone present•�who wishes to speak for this application? MR. KENNETH RAAB, Bay':Avenue, - East Marion: I believe the application covers everything. . (The Board asked Mr. -Raab to indicate on a pencil tracing appearing in the file the location of other detached or attached garages in his neighborhood.. He indicated four detached garages located almost directly on the front property line and another setback several feet from the property line. He stated that his proposed garage would be in line with the house of his adjoining neighbor. The garage could not be placed in the ..rear yard area as the land drops off quite steeply. He has located the proposed garage in such a position as to make it possible to pass to the rear and so it will not cut off light and air to the existing house. ) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) This application for reduction of side yard is based upon a practical difficulty. The lot is 57 feet -wide and the residence is centered. The proposed attached garage will .be located about 60 ft. from the front property line which is further back than the average setback. The 2 foot side yard reduction is necessary Southold Town Board of Appeals -5- april 12, 1962 in order to locate the addition so that access to the rear of the house may be maintained and at the same time allow light, etc, to penetrate the residence. The nearest building on the side where the variance is sought 'is about 40 ft. After inspection and investigation the Board feels that there is a definite practical difficulty and the variance should be granted. On motion of Mr. G illispie, seconded by Mr. Bergen, it -was RESOLVED that Kenneth"A. . Raab be granted permission to reduce side yard- setback to 3 ft. on his westerly side yard. Location of property: private road off Bay Avenue, East Marion, New York. vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. On motion of Mr. Bergen, seconded by. Libby Avenue, Pompton Plains, New Jersey, for a special exception in accor-dance with the Zoning Ordinance, Article -X, Section 1007, Subsection (e) , for permission to reconstruct a non-conforming building. Location..of property: Camp Momowetar southwest side of Laurel Lake, Mattituck, New York. Vote .of the Board: Ayes: - Mr. Gillispie, Mr. Bergen, and Mr. :Rosenberg. .
