DEC SOUTHOLD TOWN BOARD December 6, 1977 A regular meeting of the Southold Town Board was held on Tuesday, December 6, 1977 at the Southold Town Hall, Main Road, Southold, New York. Supervisor Martocchia opened the meeting at 3 :00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman Hames Homan Justice Martin Suter Justice Louis M. Demarest Town Attorney Robert W. Tasker Town Clerk Judith T. Terry Absent: Justice Francais T. Doyen On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLEED that the minutes of the November 29, 1977 Southold Town Board meeting be and hereby are approved as submitted. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This Resolution was declared 'dulyaadopted. On motion of Justice Suter,:. seconded .by Justice Demarest, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3 :00 P.M. , Tuesday, December 20, 1977 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan, .Justice Suter, Justice Demarest. This resolution was declared duly adoptted. On motion of Councilman Homan,. seconded by Justice Suter, it was RESOLVED that the November 1977 reports of the Supervisor, Town Clerk, Building Department, Fishers Island Ferry District,. Justice Suter, .and Dog Warden be and hereby are accepted and placed on file. Vote of the Town Board: Ayes : Supervosor- Martocchia , Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia : J 1. The Building Department reports 20 new.buildings at an estimate of $759, 000;. six additions, 1 business addition, eleven miscellaneous, estimated at $864, 614. 00 total. 2 . A request has been sent to General Services Administration for a list of surplus equipment that is sold at a reduced . price. 3. The Board has received an outline from J. ,Douglas Glaeser on his presentation to be made Thursday, December 8th- at the Riverhead School relative to the effects of proposed jetties at Jamesport Nuclear Poiwer Plant: Site on coastal erosion._ 4. With reference to the Southold Town Marine Rescue Boat, the Board feels there has been quite a bit of neglect on the part of the people who have had the care of the vessel, therefore the Bay Constable is being requested to take an inventory of the vessel and put- a new lock on . it. The matter will be held in abeyance until the Mattituck group has .a chance to study the matter and determine whether'they�-w sh...to take the boat to the Mattituck Inlet area. 382 PEG ..�, 1977 ;. 5. Request from William Boscola, a shipyard owner near the Old Mill, Mattituck, for snow fencing where there has been a serious problem in previous years. Moved by Councilman Rich, seconced by Justice Suter, WHEREAS Howard M. Terry, a most valued member of the Southold Town Building Department, has submitted his retirement to the Town Clerk effective December 31, 1977 , �and - WHEREAS Mr. Terry has given generously of his time and talents in his faithful services to the Town of Southold officials and residents since March 1956, now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby expresses their most sincere appreciation to Mr. Terry for his unselfish and sholehearted cooperation and untiring efforts in bwhalf of the Town of Southold, and accept with sincere regret his decision to reitee andbe it further RESOLVED that a copy of this resolution be forwarded to Mr. Terry and entered in the permanent record 'of this Town Board meeting. Request from the Suffolk County- Department of Civil Service for the 1977 Budget, the Southold Town Police Benevolent Association, Inc. contract with the Town of Southold, and the Civil Service Employees Association, Inc. Suffolk Chapter Southold Town Unit contract with the Town of Southold. These items will be supplidd. Moved by Councilman Homan . seconded by Councilman Rich, WHEREAS, under Title I of the Housing and Community Develop- emtn Act of 1974, the Secretary of Housing and Urban Development is authorized to make grants to States and units of General local governemnt to help finance Community Development Programs ;. and WHEREAS, 'there is sufficient statutory authority under the , ', laws of New York State for the units of general- local government namely, the County of Suffolk, its towns and villages, to under- take by means of cooperative agreements , every form of community development referred to in the Act and Regulations as "Eligible Activities ", ; and WHEREAS itis desirable and in the public interest that the County of Suffolk make application for Community Development Block Grant funfs as an -Urban County;_ since the mu-nicipality May be more certain of receiving funds through the County than 'by applying as an individual community in competition with others and would be spared the expense of appl-ication preparation and management of the program and may utilize additional planning and professional skills available from the County; and WHEREAS, it is recognized that participation by the County of Suffolk, as- an Urban County, in the Community- Development Program requires the cooperation of the muri-icipalities, being the towns and villages within the County to undertake 'essential community development and housing assistance' activi.ties as set forth in the applications filed pursuant to this resolution, now, therefore, be it RESOINBED, that theTown Board of the Town of Southold, that this body will cooperate with the County of Suffolk in undertaking" the essential community development and housing assistance activities- during the fourth year of Federal funding of the Program, and will work together in a timely manner in the planning, preparation of application, and carrying out of ' activities that may result from such applications ; and be it further " RESOLVED, that the govetning body is fully cognizant of -the ' obligations and responsibilities that are imposed by this cooper= tion agreement, and that it is the sense of this body that such, obligations can and will be fulfilled. - Vote of the Town Board: Ayes'., Supervisor Martocchia, Councilman 383 DEC 64 1977 Rich Councilman Homan, Justice Suter, Justice Demarest. This resolution was. declared duly adopted. (Supervisor Martocchia stated that the Town Board adopted a revised resolution for the Year III funding, however, it is not known whether HUD has accepted it or not; they might not agree with the revised language in the resolution. This Year IV resolution must be adopted by the 15th of December t& qualify for the funding. ) 7 . Recommendations have been received from the Police Department for traffic congrol devices for Matthews Lane, Cutchogue and Highwood Road, Southold. The Highway Department has reviewed it and concurs with the Police Department, however the Highway Committee would like more study, as well as study of other signs which will require amendment of, the Vehicle and Traffic .Ordinance. 8. There will be bid openeings on Thursday December 8th 10 :00 A.M. for the town hall addition. -9. The decision on the change of zone application of William. and Barbara Schriever is being held for consideration of other alternatives. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that Supervisor Albert M. Martocchia be and hereby is authorized to enter into a lease agreement for the parking lot in the rear of the Riverhead Auto ,Parts , Main Road, Southold, New York, with the same conditions as the prior lease. Vote of the Town Board: Ayes : Supervisor Martocchia , Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared adopted. 10. Receipt of notice from the Corps .pf Engineers relative to application of - Robert T. Cooper, Inc. for permission to bulkhead, fill, and maintenance dredge at Greenport Harbor, .Greenport. Objections by December 29, 1977 . . . On motion .of Councilman Rich, seconded_ by .Justice Demarest, it was RESOLVED that the Town Board of the Town of Southold register their objection with the New York District Corps of Army Engineers upon the application of Robert Dier, 41 Manta Court, Oakdale, New York for permission to. construc,t an open timber pier to be approx- imately 250 f t. in- length extendin,g about 220 f t. off shore of the existing line of mean high water. Vote of the Town Board: Ayes : Supervisor Mattocchia,, Councilman Rich, Councilman Homan, Justice Suter., Justice Demarest. This resolution was declared duly adooted. . Supervisor Martocchia : 11. As a. result of the appearance of John Tuthill, and Robert Douglass of Orient at the last Toxin Board meeting protesting the bow and arrow deer hunting, season, Supervisor Martocchia contacted the Deaprtment of Enviromental Conservation at Stony brook who indicated the hunting season _is a. State law..- The DEC contacted both Mr: Tuthill and Mr. Douglass. The law .states .the hunters must have permission of the property owner before hunting. The Orient Gun Club understands the law, but it is not satisfied with it. 12. Receipt of a resolution adopted by the Town Board of the Town of Flip supporting John V.N. Klein ' s marine sanctuary proposal. The Town of Southold ha.s ,not taken a position on this. One of the biggest terminals is in Riverhead, and if the marine belt came into being there might be restrictions . on that. The Town Board of Southold will take. no . action at -this time. . 13. Receipt of a letter from the Greenport Drum Corps inviting the Town- Board to participate in the Greenport Christmas Parade and Party to be held December 11, 1977 . (rain date- December 18th) at 1:00 -P.M. 384 `c" 's On motion of Councilman Homan, seconded by 'Justice Demarest, it was RESOLVED that $13, 000. 00 be and hereby is transferred from New York :S;.tate Anit-Recession funds to Police Salaries B3120. 1 for holaday pay Vote of the Town Board: Ayes : Supervisor Martocchia , Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Demarest, seconded by Justice Suter, itwas RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to pay Tax Receiver George Mellas $1410.02 -from the General Fund Account, which amount --was excess payment of tax penalties and Merest on savings account made by the tax receiver to the General Fund. Vote of the Town Board: Ayes : Supervisor Martocchia, Councilman Rich, Councilman Homan-, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Homan, WHEREAS a petition was received from 'North Fork Manor, Inc. request- ing a change of zone on certain property at Mattituck, ' New York " from "A" Residential and Agricultural District to "B" Light Business District, now, therefore, be it RESOLVED that the Town Clerk of the Town of Southold be and she hereby is directed to trassmmt this application to the Planning Board in accordance with Article XV, Section 100-15- (B) . of the' Code of the Town of Southold. Vote of the Town Board: Ayes : Supervisor Martocchia , Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Moved by Justice Demarest, seconded by Councilman Rich, WHEREAS a petition was received from Nicholas Aliano and Patricia Krupski requesting a change of zone on' certain property at Cutchogue . New York from "A" Residential and, Agricultural District to "M-l" General' Multiple District, now, therefore, be it RESOLVED that the Town Clerk of the Town of Southold be and she hereby is directed to transmit this application to the Planning Board in accordance with Article XV, 'Section 100-150 (b) of the Code of the Town of Southold. Receipt of an application for employment as a Building Inspector from Thomas Ward of Wading River, New York. Mr. Ward will receive consideration at the proper time. (Justice -Demarest stated that 'due to the new double entry bookkeeping system the Town will be going into as of January ,l, 1978, according to the state- it is necessary to - pay- as .many bills .as can be paid in the year 1977, which in other years were paid after the first of January. Receipt of a post card from Mr. & Mrs. J. Hataier, Huntington Bouleuard, Pecon:hn, opposing the removal of the Goldsmith Jetty. 16. The Supervisor met on December 5th with the Cutchogue- Mattituck Senior Citizens -and Southold : Greenport Senior-: Ci'dzens relative to the Retired Senior Volunteer Program of Suffolk County. RSVP request space in the Town Hall for. desks and files and a telephone to make calls to homebound elderly in the Town . of Southold, to determine their needs and what can be done for them,. . The senior citizen groups recommend this program. . On motion of Justice Suter, seconded by Justice Demarest, it was , RESOLVED that the Town of Southold provide space in the Southold Town Hall for the location of desks and equipment by the .Retired. This resolution was declared duly adopted. Supervisor Martocchia : 17. The Southold Town Board has received an invitation from Mattituck Scout Troop 39 to:-.attend the Court of Honor for Mattituck. Eagle Scouts Drew C: Dillingham and Charles H. Smith on December 11 1977 at 5 :00 P.M. , Mattituck Presbyterian Church On motion of Justice . Demarest seconded by .Justice Suter, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to conduct negotiations with the New York State Department of Transportation for snow removal by local contractors on Route 25 in Southold Town. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the following audited bills be ordered paid: General Fund bills in the amount .of $3�764. 58; Highway Department bills in the amount of $26 , 867 . 14; Fishers Island Ferry District bills in the amount of $23 , 244.80; and Federal Revenue Sharing bills in the amoutn of $62 .28. Mrs. Gladys Csajko asked if the proposed change if zone by Alliano- Krupski from "A" to "M-l" was an existing zone?---Supervisor Martocchia stated it is the Beachcomber Motel and the request is for an expansion of the existing zone. Mrs. Csajko asked what negotiations the Town is having with the State?=-- Supervisor Martocchia stated they would discuss with people from the Department of Transportation what possibility where is for entering into a contract or sublet a contract to see that Route 25 is kept clear of ice and snow. The State has told the Town they have bought additional equipment for this area and will have additional manpower. Many residents are not confident the„ State will be able to fulfill their promises . To be on the safe-side the Supervisor would like to work out something that would be acceptable to the Board members in the way of a contta+tt between the Town of Southold and State of New York --- Justice Demarest i e� 3..87 stated the responsibilitye the ,respobsilility oor plowing a certairr portion of the Saate road no matter when it smows. The Town did have that at least twenty years ago and the Town plowed all of the State road, they contracted with the County and sub-let some of it, in fact Bob Douglass plowed all of the roads , state and Town east of Greenport, When the .Town gave up plowing the State roads, since former Highway Superintendent Price thought it was too much of a responsibility for him to do the State'!;s work so the County contracted with private contractss to do it. Now the County refuses to contract with the Sttte and the State will not enter into private contracts. They will contract with. the Town to take care of the Sttte road. Mrs. Csajko asked what the anti-recession funds are supposed to be for?-=-Supervisor Martocchia stated the State of New York has surplus money which they divided. amoung the towns and Villages. It is a one-shot deal of $13 , 000. some odd dollars. Then there is the Federal Anti-Recession money which the Town has done. Most of the Federal Revenue Sharing money was earmarked for buildings and there are a few bills that have- not been paid as yet on the new Town Hall. Personal services .is one area where the . Anti-Recession funds can be used, $17 , 0,00 was just allocated for holdidy day the police department.---Mrs . Csajko asked whether it did not have to be used to provide employment for new people?---Supervisor Martoccha '-stated it helps the Town in holding the tax rate down. It takes up for addDd pay for personal services and benefits , it must be spent for the. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that there being - no further business to come before this Town Board meeting adjournment be called at 3 :45 P.M.
