On motion of Justice Suter, `secoiided­by Councilman Homan, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 3 :00 P.M. , Tuesday, 1November 15, 1977 at the Southold Town Hall, Main Road, Southold, New York. ' This resolution was' declared duly adopted': On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that the October reports of the. Supervisor, Town Clerk, Dog Warden, Town Trustees', Justice Sitter be and hereby are accepted and ordered placed on file. Vote of the Town Board: 'Ayes : Supervisor Martocchia, Councilman Homan, Justice Suter_ ; Justice Demarest. This resolution was declared duly adopted. , Supervisor Martocchia: 1. The Building Department report for the month of October shows 10 new dwellings, 18 additions, 2 business additions, 22 miscellaneous, totalling to $660, 911. 00. 2 . Considerable correspondence has been received relative to Goldsmith 's Inlet jetty. Most of the recent letters oppose the removal of the jetty. There is a study being made by the Department of Public Works, Suffolk County, under the direction of Rudolph Kammerer. Mr. Kammerer will report bakc to Legislator Burland, and Mrs. Burland will begin action after that report is received. 3 . Receipt of a letter from Harry Mearns, Orient, relative to. a problem in his area about a week ago, concerning people who were in danger in the L.M. Sound. Mr. Mearns is offering the use of a part of his beach to have a steel portable launching ramp set on the property to make any further emergency effort more -efficient. The Board must study the matter, as a launching,. ramp placed on Mr. Mearns ' property by the Town would be considered open to the public. On motion of Councilman Homan, seconded by Justice Suter, it was .. .. . 353 RESOLVED that a recess be called .at. 3-: 15 .P.M. for the purpcse of holding a public hearing on .the 1978 Budget, and a apublic hearing . .at 3 :30 P.M. relative to the proposed use of Federal Revenue Sharing funds. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Homan, Justice Suter, Justice Demarest: This resolution was declared duly adopted. .(Councilman Rich arrived . at .the opening of the budget hearing. ) On motion of Justice Suter, seconded by Councilman Homan, ,it was RESOLVED that the public hearing 'on the 1978 Budget and the public hearing on the proposed use of Federal Revenue Sharing funds be recessed at 3 :49 P.M. , to reconvene at 8:00 P.M. and 8:15 P.M. respectively. : Vote of the Town Board: Ayes : .Supervisor Martocchia, .Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. The Southold Town Fire Chiefs Council has recommended the reappointment of three Deputy Fire Coordinators for the 8th Fire Division in the Town of Southold. On motion of Councilman Hmman, seconded by Justice Suter, :it was RESOLVED that the Town Board of The Town of Southold recommends to Ronald Buckingham, Director of Fire Safety for the County of Suffolk, the names of Edward A. Lademann, Jr. , Southold, Leander B. Glover, Cutchogue, and George Lessard, Mattituck, as Deputy Fire Coordinators -for the _8th Division in the Town ,of Southold, for the next two years. Vote of the Town Board: Ayer : Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, .Justice Demarest.. . This resolutiont:was declared .dul.y .adopted. Supervisor Martocchia : 5. Another;-letter was received from the Southold Town Fare Chiefs Council requesting an :immediate answer ,to their letters sent concerning their request for a ban on self-service gasoline stations . The .Board has asked Town Attorney Tasker to draft a proposed ordinance .to the considered; and -the theme of the ordinance says that the Town Board will. go along with self-service stations , provided they are attended. This is under study that, will .be _ discussed with the .Chiefs Council.---The-Chiefs Council would also like to know what. has been do.ne .concerning the proposed ordivance governing the use of aluminum wire within the .Town. The' County. of Suffolk did have a code on aluminum wiring, but it was ruled illegal. The Board. would like to meet with the Chiefs Council to discuss this matter . The Board would like every :possible safety precaution for the buildings- in the Town. ---The other matter discussed in the Fire Chiefs Council letter is a Fire Code. They did send the Board a book. to study. However. the. Board has held back on this somewhat as the Fore Commissioners Association and Fire Chiefs Council have been -at .odds on some issued, in the Code. New. York State does have a code, or a town code could be considered. 6. Receipt of a letter from the East End Health Coalition relative to the resignation of Elizabeth Zegzula from the Coalition due to the unfortunate. harassment directed at her as a result of her community involvement. They u:r?ge that all appropriate measures be taken to discover the perpetrator so -the persons of conscience may pursue their community duties without fear of danger to .lige or safety. The letter will be referred to Chief Cataldo, as the Board members know the measures that have been taken by the Sherr`uff ' s Office, District Attorney' s Office, the Southold Town Police Department. 354. Nov 1 o six On motion of .Councilman Rich, .seconded by Justice Suter, WHEREAS Leo Stack applied to the Southold Town Board . for a permit under the provisions of-the Wetla-nd Ordinance of the Town of .Southold., application dated June 7 , 1977 , and WHEREAS said application was referred .to the Southold . Town. Trustees and the Southold Town Conservation Advisory Council for their find ings and recommendations , and WHEREAS, a public hearing was held by the Town Board with -respect to said application on . the 25th of October 1977 , :at which time all interested persons were given an opportunity to be heard, NOW, THEREFOEE., BE IT RESOLVED that Leo- Stack, 800 Strohnson Road, Cutchgoue, .New York be granted permission under the provisions of the Wetland Ordinance of the Town of ' Southold to deposit eight ; yards of said from pool excavation in fromt of the pool on .the creek bank to support the bulkhead on his property on Mud Creek, -. 800 Strohson Road, ' Cutchogue; New-York. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that authorization is hereby given for the payment .of -. $1650. 00 to th& firm :of Smith, Finkelstein Lundberg and Yakabowski who represented the Town of Southold in - the -matter :of action commenced by Leroy J. Ostroski and Roy Ostroski against Sgt. Barney .Ha.rris of the Southold Town Police Department. Supervisor Martocchia : 7. About a week ago a meeting was -held with Jean Tiedke, the Town ' s intervenor- at the L.I.L.C.O. Jamesport Nuclear Plant -hearings, and Dr. Douglas Glaeser, a geogolist;_ who .presented a .slide program relative to beach erosion. The Board .would like, to have Dr. Glaeser be the Town 's respresentative at the U.S . Army Corps of Engineers hearings on December 8th and make a presentation on behalf of the Town. The Board feels they must do the utmost to protect the people of Southold Town and feel :they would, be tetaining the best person in the field. of coastal erosion., Dr. Glaeser. On motion of Councilman Homan, seconded by Justice Demarest, --it was RESOLVED that the Town of Southold retain the services -of- Dr. -J: Douglas Glaeser to analyze and interpret the effects of coastal.•erosion . likely to result from the proposed .construction -of jetties at Long Island Lighting Company's proposed nuclear :power plant at Jamesport and represent the Town of Southold; and make a presentation at the U.S . Martocchia be and he hereby is authorized to enter into a contract with Doris Helf for- the purchase of a parcel of land on Bray ,Avenue, Mattituck, to be us.ed. for drainage purposes, at a cost of $10,.500. 00 plus, closing costs . NOV, 1 a ,g7at 3.55 Supervisor Martocchia : 8. There will _be a specia.l:.meeting -at. the District .Court Building, Hauppauge on November 16 , 1977 at 3 :00 P.M. relative to the status of Year III and timetable of Year .IV of the Community, Development Block Grant Program. Year III is the one where the Town of Southold has an estimated $93 , 000. involved. However the agreement was changed somewhat and new language inserted and all of the towns involved have . rejected the agreement. As many board members as possible will be at that meeting to present a strong case so the Town will receive the- $93 , 000. 9. Boy Scout Troop 51, Gr.eenport, will hold an Eagle Court of honor on-December 2,. 1977 at St. Agnes Parish Ha; ; . Greenport, at which time the newest Eagle Scouts of Troop 51 , Kerry Heaney, Burt Parks and Andy Ficurilli will be sworn-in. All of the Board members are invited to attend. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVES that $1, 165. 50 be paid to the New York State Department of Environmental Conservation as a reimbursement .to the State of New York as per agreement in the Shellfish. Supervisor Martocchia : 10. Receipt of a letter from Pitney Bowes .stating .there will .be an increase in -the maintenance agreement rate on the anniversary date of the agreement. The amount of the -rate increase was not indicated. 11 . Receipt of a letter from John Slattery,- Nassau -Point, Cutchogue, relative to a road .in that area which is presently a private road. . The matter has been referred to the Highway Superintendent for his attention. On motion: of 'Just.ic.e Suter, seconded by. Councilman.- Rich. , it was . RESOLVED that the sum of $400.00 be and hereby is ordered paid to the Association of Towns of the _State of New York for_ dues, for the —I calendar year of 1978. On motion of Justice Suter, seconded by Councilman Homan, _.it was RESOLVED that the '.Southold Senior Citizens be -and hereby are authorized to contract for three buses to take them to Duke Gardens', Sumne rville, New Jersey on November 17 , 1977 . Receipt of forms from the: Suffolk..Coun:ty. Legislature requesting information on the: towns budge.t. and bonded indebtedness. The Town Clerk and Supervisor ' s bookkeeper will complete the forms. 13 . The New York State Executive Department,. Division for Youth has requested the Town of .Southold to- submit a letter of intent relative to reimbursement on yo.uttr .program expenditures under the provisions established for- counties engaged in Compr.eh:ensive Youth Services Planning. $2 . 25 if retutned to the Town for each child involved in the program. The Board is concerned, as. .each .school is entitled to receive a certain amount of .money :on their own. I.f the Town .applies and receives the money, the. amount. may not add up to what the schools are presently receiving, iand the schools will lose their-funds. RESOLVED that the Supervisor send. a- letter of intent to the Suffolk County Youth -Board indicating that the_..Town of'Southold will partic- 3>J-"6 O%t''4'p 1977 ipate in the Youth Program, provided that such, participation :will not deprive any •organ.ization ..in the Town of Southold of any State Aid that it,would otherwise .be entitled ..to.;. Item 22 on the agenda referring to Thomas• Towmey Jr. ;. this. matter -was in con.junction with Item. 11 _whereby Dr. -J. Douglas Glaeser was retained to study the jetty. problem at ..Jamesport. Mr. Toomey also wished to be involved in the jetty study. On motion of Councilman Rich, seconded by Councilman -Homan, WHEREAS the Southold Amercian Legion Auxiliary, Griswold-Terry-Glover Post, Southold, .New York .has applied to the Town -Clerk for a Bingo License and WHEREAS the Town Board has examined the application, and, after investigation, duly made findings and determinations- as -.required by .law, NOW, THEREFORE, BE 'IT RESOLVED tha.t. .Supervisor. (CONDITIONAL ORDER ESTABLISHING SEWER DISTRICT TO BE KNOWN AS FISHERS ISLAND SEWER DISTRICT IN THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK) WHEREAS, there has been filed with the Town Clerk 'a map *- and plan for the establishment of the FISHERS ISLAND SEWER DISTRICT in the Town of Southold, and . ,WHEREAS, there is likewise on file a petition verified June 6, 197T stating that the cost for the establishment. and improvement of said sewer district and faciliti6s shall be at no cost to the Town of Southold and shall be paid entirely by the 1977 �J owners of the real property within said district or the petitioner as supplemented by State 'nd Federal funds, and WHEREAS ( said map and plan and petition are on file in the Office of the Town Clerk for public inspection, and WHEREAS, such improvements consist of construction of a secondary treatment system connected to private mains as more fully set forth in said map and plan, all of which will be conveyed without cost to said Fishers Island Sewer District, and WHEREAS, by order dated June 21, 1977 , the Town Board .called a public hearing upon the question of "such establishment of the FISHERS ISLAND SEWER DISTRICT in the manner described above to hear all persons interested in the subject thereof concerning the same, and WHEREAS, notice of such public hearing was duly published and posted within the time prescribed by Section 209-d' of the - Town Law, and proof of such publication and posting has been duly presented to said Town Board, and WHEREAS, a public hearing was duly held at the- time and place set forth in said notice, to- wit, on the 12th day of July 1977 at 11 o 'clock A.M. prevailing timm, at which all persons desiring to be heard were duly heard, and WHEREAS, the Town Board has duly considered the -establish- ment of said- FISHERS ISLAND SEWER DISTRICT. , NOW, THEREFORE, BE IT ORDERED by the Town Board -of the Town of Southold Suffolk County, New York, as follows : Section I. - Upon the evidence given at the aforesaid public hearing it is hereby found and determined - that it is in the public interest to establish on Fishers Island . Southold, New York, a sewer district to be known as FISHERS ISLAND SEWER _ DISTRICT in the manner described in the preambles hereof, and . this conditional .order- establishing said district is adopted to signify the intent of the Town Board of the Town- of Southold tommake a oermanent -order- establishing such sewer- district as hereinafter provided on- condition .that said facilities are constructed and conveyed to said 'd-is.trict at no cost to the Town of Southold and in accordance with all the conditions, require- ments and limitations hereinafter set forth. Section 2 . The petitioner shall privide suitable engineering plans and specifications for the add-ition of a secondary treatment system to be connected to petitioner ' s existing mains, to the satisfaction of the New York State Depart— ment of Environmental Control, as well as any Federal and State agencies who will- supply funding for the completion of said facilities-. The petitioner shall provide to the district, within three months after installation, "as built" plans and location plans for its ekissi_ig-r faciltiies as well as any additional construction, bearing the- approving signature of the petitioner ' s engineers. Section 3'. The FISHERS ISLAND SEWER DISTRICT will execute any applications prepared on its behalf' by the petitioner or its engineering representatives to obtain Federal and State funding for the necessary construction. Section 4. When the plans for construction, to be used together with the existing facilities of petitioner, are approved by the New York State Department of Environmental Control, and are further approved for funding by the appropriate Federal and State agencies , and upon petitioner suitably' guaranteeing to the district the balance of funds- needed for� consturction' engineering and legal costs, the' FISHERS ISLAND SEWER DISTRICT shall advertise for bids to complete 'saidlwork in accordance with the provisions of the General Municipal Law of the State of New York reserving the right to reject all bids should the cost thereof exceed the combined amourit .of Federal and State financing as well as the additional amount as guar.anee.ted by petitioner. Section 5j` In the event bids are received and adequate funding is available to the FISHERS ISLAND SEWER DISTRICT, it,-will 8S,E1 3 award the bids in accordance with law .upon the, petitioner dedi- cating to the sewer .district all necessary .easements . ,and rights of way free and clear of all liens or other objections to title, together with a bill . of sale of. petitioner,'s existing facilities, to the sewer disttict .at no consideration to the petitioner. In addition, petitioner shall convey .to the sewer district, in fee simple, the premises with adequate ,.urrou-nding area on which the secodary treatment system is to be constructed., Petitioner..shall pay the cost of any ,title search and .titge examination required by the district.. -... . Section. 6. ,Notwithstanding :the foregoing, if at .any time the petitioner determines that the amount of omney to be guaranteed by it is more than it wishes. to; guarantee, it-.may. so notify the .dewer district, providing it does so prior to .the dist ict advertising for bids The cost of advertising.,.for bids shall be paid for by the petitioner. Section 7 . The petitioner is to provide the district a bond of $10Q, 000 idemnifying the. distiict for any loss occasioned by the malfunction of any part of ;said improvement as well as the costs to the district to make any reparis occasioned- by any aforesaid malfunction,•.. which bond shall. be for a period of nne year commencing .on :the .date of the final order confirming the establishment of the district; the Town Board as governing body of the district shall be .the sole one to- approve the form of said bond. Section 8. Upon compliance with all of the provisions for public bidding and dedication of facilties, easements and other lands, ws- well .as complete , f.inancing of the entire. con- struction ..such that .there will be .no .cost to the. FISHERS ISLAND SEWER DISTRICT, _the Town Board of the Town of Southold as governing body of the FISHERS ISLAND SEWER DISTRICT :_shall adopt and record with the Suffolk County Clerk an order confirming permanently the :aforesaid establishment of the, FISHERS ISLAND SEWER 'DISTRICT.; otherwise it shall adopt an order to be. filed with the Suffolk- County Clerk an- order donfirming permanently .the. aforesaid establishment.. of the FISHERS ISLAND SWEER DISTRICT; otherwise, it shall adopt an order to be filed with the Suffolk .County Clerk rescinding .this conditional order establishing such sewer district. Section 9, A description of . the FISHERS ISLAND SEWER DISTRICT, as. coriditionally estaiblished by this order, is s-et forth in Schedule "A" attached hereto. Martocchia stated .tha:t appointment is ,being kept open for study. Mrs. Gladys Csajko asked where in Mattituck is the property which is being purchased for drainage purposes?---Supervisor Martocchia: stated it is on Bray Avenue. Justice . Suter stated. it is about 500 feet south ofRoute .25 in the hollow near the Powder Puff Gas Station.. It drains all of the area around the railroad overpass. Mrs. Csajko asked what is the youth program that the Supervisor described before, what is it supposed to- do?.---Supervisor -Martocch.ia stated the program will pay $2. 25 for each child of a certain age that will participate in the :program. —We are- trying to determine' if the money is accepted, will the —Town--jeopardize the money the schools are now getting for state- aid, as ,-they get about $1000.. each. It is for the summer program. ---Justice Demarest� stated the Schools use what they get 'for their part of the summer program At one time the Town got $1; 000.:' which we distributed to the schools in some . proportion At that time the Board found out that the schools cou.ld make application, rather than the Town, they could each get $1, 000.00 The ,Town dropped out of it. This new matter- may be the same thing. If the Town makes application we ,might. get $1, 000 -and the schools would get nothing.
