SOUTHOLD TOWN BOARD
September 13, 1977
A regular meeting of the Southold Town Board was held on Tuesday,
September 13 , 1977 at the Southold Town Hall, Main Road, Southold,
New York. Deputy Supervisor Demarest opened the meeting at 3�,00 P.M.
with the following present:

Absent: Supervisor Albert M. Martocchia
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the minutes of the August 25 , 1977 Southold Town Board
meeting be and hereby are approved as submitted.
Vote of the Town Board: Ayes : Deputy Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter, Justice Doyen.
This resolution was declared duly adopted.
On motion of Justice Suter, seconded by Councilman Rich it was
RESOLVED that the next regular meeting, bf the Southold Town Board
will be held at 3 :00 P.M. , Tuesday, September 27, 1977 at the
Southold Town Hall, Main Road, Southold, New York.

Moved by Councilman Homan seconded by Councilman Rich,
WHEREAS, the Town of Southold has received an offer of Grant issued
pursuant to Southold "Town's - applicstibn for Federal assistance under
the provisions of. the- Local Public' Works Capital Development and
Investment Act og 1976, as amended by"the Public Works Employment Act
of 1977 in the total amount of $250, 000- 00 for the construction of
road improvements,
WHEREAS, to comply with the requirements to receive the Offeer of
Grant; (1) an individual must be authorized to sign the Offer of
Grant, (2) an individual must be authorized to certify the authorized
signature, (3) a bank must be authorized to handle the funds, (4)
individuals must be authorized to withdraw funds from the bank, (5) an
engineer, must be authorized to prepare the plans and specifications for
the project, and (6) anindividual must be designated as project
coordinator,
NOW, THEREFORE, BE IT RESOLVED by the Town of Southold:
1. that Deputy Supervisor Louis M Demarest is authorized to
sign the "Offer ' 'of Grant" .
2. That Town Clerk Judith T. Terry is authorized to certify
the Deputy Supervisor ' s signature on the "Offer of Grant" .

3. That the Valley Bank of New York -be authorized as the bank
to handle all transactions involving -the line of credit for this
project,
4. That the following two (2) individuals, be authorized to
withdraw funds from the Valley Bank of New York for this project:
1. Louis M. Demarest, Deputy Supervisor
2. Albert M. Martocchia, Supervisor
5. That Greeman-Pederson Associates, P.C. be authorized to
prepare plans, contract documents all. necessary engineering, and
inspection of construction in connection with this project.
6 . That John Robson of Greenmen-Pederson Associates, P.C. be
designated as project coordinator: His duties will include quarterly
reports, forms, correspondence meetings with the Economic Development
Administration and all necessary work required to administer the project.

This resolution was declared duly adopted.
(Deputy Supervisor Demarest stated that the -next resolution pertaining
to Offer of Grant for the Southold Town Hall addition is premature;
they have nett received the Offer of Grant yet, but it is one of the
projects approved and the reason it is being offered is there is a
deadline when these Offers of Grant must be signed and submitted,
and should the board not have a. meeting scheduled before, the deadline
and the resolution. is not submitted by the deadline the grant will be
lost. )

WHEREAS the Town of Southold has received an offer of Grant issued

Deputy Supervisor Demarest:
1. Notification from Department of the Army, New England .
Division,," Waltham, Massachusetts relative to application of Richard I.
"Purnell, Equestrian Avenue, Fishers Island, for per to con-
struct and maintain a pile and timber pier, ramp and float in Little
Hay Harbor, Fishers Island. Comments must be submitted in writing
by October 11, 1977.
Notification from the Department of the Army, New York
District relative to application of Suffolk County Department of
Public Works for maintenance dredging and beach nourishment 'at '
Cedar Beach Harbor, Little Peconic' Bay, Southold. Criticisms or
protests regarding the proposed work must be submitted by September
27, 1977.
Notification from the Department of the Army, New York
District relative "to application of Albert J. Moyse, 120 Rabbit
Lane, East Marion, for permission to construct groin extension at
Orient Harbor, Gardiners Bay, East Marion. Cfiticims or protests
regarding the proposed work must be submitted by September 24, 1977.
2 A matter of the Town Beach concession insurance has- been
discussed and will be further discussed with the insurance agent.
3. Request for dredging at Jockey Creek, Southold by "Charles
Wissemann, Wells Avenue, Southold dent to the "Suffolk County Depart-
ment of Public Works. The DPW asks for instructions, and the Board
instructed- Deputy Supervisor Demarest to request the DPW to. look"
into the project.
4. Communciation from the Department of Emergency Preparedness,County of Suffolk, containin,4 correspondence from people who had
charge ,of the Southold Town Marine Rescue Unit who requested funding.
The Department of Emergency Preparedness suggested the Town take care
of the matter. It will be discussed before the" budget is' drawn up,
and perhaps allocate -s"ome money for that purpose
5. Receipt of report from the Suffolk County Department of
Health Services with results of their testings of town bathing
beaches. In each case- the rating is excellent.
6. ,. Letter from the Suffolk County Department" of Labor stating
the CETA Title VIII Young Adult Conservation Corps which was in
operation this summer, they now intend to carry it on the year round.
7. _ Letter from the Suffolk County Department of Labor concerning
public works projects. The Town had people working for thaim this
summer under that category, and they now will return to. the prior
system under the Department of Social Services. whereby they work out
their .grants as they did in the past.
8. Notification from the New York State Department of Environ-
mental Conservation informing the Board of a Mariculture Symposium
to be held October 22, 1977 at the Fine Arts . Building, Southampton
College.
9. Communication from the Department of Environmental Conserva-
tion, State of New York, indicating that under a new law the Town
will be required to obtain a license to operate the disposal area.
(It is only a . matter of time.-before the Town will not7�be- permitted
open dumping as they have up to . the 'present- time. Perhaps this
year out of' the Federal Revenue Sharing monies, some money may be
allocated for a capital account to -eventually put" in a campactor.
Everything would be done inside -of a ,building. . .Hopefully by that
ime Long Island Lighting Company will have-',a .plant that will burn
the solid wastes so . there will be- a market for them. There .will be
several grants available from . various areas One now from the State
which is a* 50/ grant. Federal grants may be even .greater. . Under the
new law on Federal Revenue Sharing it now. allows it to be used as the
town's share of matching funds. It is felt if the Town starts . putting
some money aside it can be used for something' we eventually have to
have; and if" the". money is . not available at that time it will have to
be raised from taxes. )
10. Recently the Town made application to acquire surplus
government property on Fishers Island , known as the Fishers island
Station Quarters and" now find the General Services Administration
will only make the property available fo'r recreation purposes. "- The

Board cannot imagine how they can use three houses, a warehouse and
apartment building for recreation. The Fishers Island School is
interested in the three houses, so as of now they will notify the
Bureau of Outdoor. Recreation, Department of the Interior that they
are not interested, but at the same time they will write to the
Real Property Division-and indicate as far as -the three houses are
concerned they are glad not to make any request for them, But the
other buildings the Town can use, and if there is some other means
for making application they will do so.
11. Request for release of 'the performance bond on Inlet East
Estates. The report of the engineer recommending release of' the road
construction bond-, but the highway committee and highway super.intendmt
would like to look at the roads first.

RESOLVED that the Chemical Bank be and hereby is authorized to

Deputy Supervisor Demarest stated that the North Fork Bank & Trust
Company .has, requested that the following securities be substituted

Mr. Walter Kohnle stated he does not feel the New York State Housing
Bonds are equal in quality to the Treasury Dotes. He suggested that
a check be made to determine if it is a substitution for a similar
Triple A note for some that: is only rated- A. ---Councilman Rich
stated that it was discussed before the meeting and agreed it should
be looked into. ---Deputy Supervisor Demarest will look into it.
On motion of Councilman Rich, seconded by. Councilman Homan, 'it was
RESOLVED that the following proclamation be issued designating the
week of October 2 - 8 1977 as National 4-H Week:
WHEREAS, the 4-H program' of Cooperative Extension since its
beginning 75 years aga has contributed muc. A to the health and
welfare of the Nation and has encouraged many young people to
choose careers which help improve family and community living; and
WHEREAS, during this week 4-H members, leaders, and families will
observe National 4-H Week with the theme: "4-H Freedom- to Be".
WHEREAS, 4-H members put into practice the skills and science
they learn as. they develop their talents through 4-H projects
and strive to "learn for living; "
WHEREAS, in these changing times young people, who are the
<, citizens of tomorrow, must discover and acquire the virtues
of responsibility, thoughtfulness, morality and understanding;
WHEREAS, the more than 500 volunteers adult 4-H. leader8 are
organizing their 4-H clubs for the 1977-78 year, many others
are organizing clubs for the first time; and
WHEREAS, the nearly 74, 000 boys and firls participating in 4-H
programs throughout Suffolk County soon will be taking their

places in society by establishing homes of their own and joining
the ranks of community leaders.
NOW, THEREFORE, I LOUIS M. DEMAREST, Deputy -Supervisor of
the Town- of Southold, in recognition of the fine achievements
of 4=H members and their families do hereby proclaim the week
of October 2 - 8 1977 as NATIONAL 4-H WEEK.

On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the request of the North Fork Taxpayers Association,
Inca be -and hereby ' is denied permission to use the Southold Town
Hall fora general meeting during the week of October 24-28 ; which
meeting would be a "Meet -Your Candidates" night. This type of a -
meeting has political overtones and a precedent should not be set
in this respect.

RESOLW D that the action of the Board of Commissioners of the 'Fishers
Island Ferry District be and hereby is approved in awarding the bid
to Z & S Contracting, Fishers Island, for repair of the roof at
Building #$ 239, Whistler Avenue occupied by the N.Y. Stte Police.

Deputy Supervisor Demarest:
12. Receipt of* a fetter- from Edward A. Lademann Jr: , Secretary
of the •Southo-ld Town Fire- Chiefs Council•" asking if anything.,- has been
done by--the Town Board.'• twWard, banning se-l-f-service gasoline--dispensing
stations. - --This matter was 'discussed by> the Board prior to this meeting
and, the feeling is- they will ask. the, Town. Attorney, to: draw up.an
ordinance- in this- -respect.- Righ-t now the- feeling. of the Board is
that it would be wrong to- ban- self=service completely, but a self
service island should be allowed only in a full service service station,
the self-service island -be open only when the full service island
is open and they comply with all the rules and- regulations of the gas
companies have for self-service islands. Also some type� of fire
extinguishing system be installed around 'the island that can be
activated in one of.• several- placss-. This will go lto- a hearing-
eventually, but it is -the,-feeling of the.-board that the -advantage of
self-service to the public is great, but there is also a great
disadvantage -if there _were- _an unattended fully self-service station.
13 Receipt of= a ;-letter, from,, the Southold-.Town .Fine .District
Officers Association who are concerned with the new Environmental
Conservation regulation called the "Fugitive .Dust Law,. '.' This law
would�-force- almost•.anyone with any .dust in. their area- to -make sure
it is kept under control at all times. A DEC hearing is scheduled .
on this proposed law sometime in- October..
-14, ` Notice- has been received from Smith Haven Mall -Merchant' s
Association Lake Grove, N:Y.• stating that. -every Monday will '•be
Senior' Citizen -Courtesy Days at Smith='Haven Mall, and- enclosing a -
list .of participating merchants.

(This bus would be purchased at County .expense a twelve-passenger
bus for use of .senior citizens . A program will have to be set-
up ,
up for scheduling the use of this bus which will be purchased after
the necessary bids to specifications have been received. The County
will provide $3, 000 a year for the _first year for gas and _maintenance.
The Town will have to supply a . driver and insurance. It is hoped some
of the more able-bodied senior citizens will be drivers. The bus
will include facilities for- the -handicapped in the form of a
retractable ramp. )
Deputy Supervisor Demarest:
15. Receipt of a letter from .Pete.r E. Lynch, Jr. , relative to
dredging West- Lake in Cedar Beach. Deputy Supervisor Demarest has
informed Mr. • Carl Eisenschmeid of the Suffolk County Department of
Public Works and he will follow up the request.
16. Receipt of a letter from Sunset Motel, Route 27 A, .Greenport
complaining about the mosquito problem that exists in their area.
The mosquito control is no longer -under the- jurisdiction of the
Suffolk County Mosquito Commission; it now handled by Suffo-lk .
County Vector Control which is very ineffective. However, Deputy
Supervisor Demarest will get in touch with them and advise them of
Sunset Motel 's problem.
17. Letter from Mr-s. Gilda (Lawrence) Dodge, Mattituck, stating
the sandy beach in front of the home she and her husband purchased
five years ago is no longer there, and the retaining wall which was
buried in- the sand is now exposed to a height of five feet. She asks
if the T6wn could again dredge, .Brushes Creek as they did some years
in the past and put the sand_ back on the beaches. ---Justice Suter
stated there is an application on file with the County to dredge
Brushes Creek.
18.. , Letter- from Dorothy Auer, Mineola, New York, complaining
about;:the number of people who are lining both sides of Route 25
along 'the seawall between East Marion and Orient.---Deputy .Super.visor
Demarest stated he has witnessed this himself. Most of this land at
the shore is owned by the State, a little- by the Town, and some narrow
pieces by individual property owners. -More and more people are coming
to the east end ofr a day on- weekends and seeking beach areas. If
the regulated beaches are fil:led,,, the ,people search .for other beach
area to hold a ,picnic or swim. The road across the causeway is.- State
Route 25; signs have been erected- but they are pulled down as fast as
they are erected.

WHEREAS Sacred Heart R.C. Church, Cutchogue, New York has app,-ied
to the Town Clerk for -a Bingo License, and
WHEREAS the Town Board has examined. the application, and after
investigation, duly- made findings and determinations as required
by law,
NOW, - -THEREFORE, BE IT RESOLVED that the .Deputy Supervisor be- and.
he .hereby is authorized and directed to 'execute on behalf of the
Town Board of the Town of Southold the findings and determinations
as required by law, and it is further
RESOLVED that the Town Clerk be and she hereby is directed to issue
a Bingo License to the Sacred Heart R.C. Church, Cutchogue, New York.

WHEREAS, Harry W Smith has faithfully served. the citizens .of - ,
the Town of Southold since August .15-,.. 1947 as a police patrolman and
WHEREAS, such a record of service to the Town- of- Southold and its
people deserves the sincere gratitude od those with whom and for
whom he worked,
NOW, THEREFORE, BE IT RESOLVED, that the Town. Board of the Town of
Southold expresses its appreciation to Harry W. Smith for his long .
record of find service, and its best wishes for the years ahead,
and be it further
RESOLVED that this resolution be made a part of the permanent records

(Justice Suter announced that a testimonial dinner in Harry Smith's

20. The Board again today received the application of'James
Bitses for a cluster concept subdivision to be-known as "Old Town
Park at Southold". . It has been d.escussed, but - no dec-ision •-has been
reached at this time.
On motion of Councilman Homan, seconded by Councilman- Rich
IV0EREAS, to meet the Public Participation Requirements of the Federal
Revenue Sharing Regulations, and the legal requirements of the Town
Law, the ' Town Board of the Town of Southold wishes to hold a- public
hearing in the matter of proposed use of Federal Revenue Sharing
Funds as follows :
(1) . Amount of unobligated. entitlement funds in -the- Southold'
Town FRS Trust Fund is $2, 000. 00
(2) The amount of FRS funds- the Town-- of Southold anticipates
receiving during the 1978 fiscal year is $136, 000. 00
NOW, THEREFORE, BE IT RESOLVED that a public hearing , be held by
this Board with respect to said proposed use of FRS funds on -the
27th day of September, 1977 at 3 :30 o 'clock at the Southold
Town Hall, Main Road, Southold, New York, at which time all residents
of Southold Town have the right to present written and oral comments
on the proposed uses of .FRS funds . Copies of the proposed-use

Deputy Supervisor ' Demares-t .dhnounced that -the Town Clerk informed,
him that Dog Enumerators are needed for the Greenport-Orient area
and Southold-Peconic area. Enumerators are paid 50(� per dog listed.
Deputy Supervisor Demarest stated that Item #2.9 on -the agenda-
referring to Gotelski well. (8 in ) pertains to property purchas.ed----
by the Town on Peconic Lane and there were some irrigation points
on a portion of the property and part of the -agreement of- sale -was
that the Town would replace them on property still remaining in the
owner ' s hands. The Board did not have time to discuss it prior to' .
this meeting, but it will be discussed later today or at the next
meeting.
Item # 30 on the agenda refers to Jack. Sherwood, whom the- Board of
Assessors wish to hire to work in their office. This -matter will--
be discussed later today or at the next- meeting.

area in the amount of $20, 783. 26 was for -the contract to' repair- the

machine at the disposal area. It needed a complete overhaul The
price of a machine; tolir.eplace;_; t:i wasp 100,;'900�00. An offer of a second
hand machine, the same as the machine they have, which had been repaired,
and the cost was $60, 000. Instead of a new or repaired machine, ,they
had the machine at the disposal area repaired for $23 , 000.. At the
time they went to- ;yid on this repair there was revenue sharing money
available and .they intended to take. it from revenue sharing, but since
the law changed and they had to put revenue sharing money in certain
allocations, they did that without putting aside money for the repair
of the machine, so t' .e cost will come out of surplus, which they are
fortunate to have. )
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that Chief Carl Cataldo be and he hereby is granted permission
on September 18, 1977 to receive, on behalf of the Town of Southold,
a Pedestrian Saftey Citation for achieving a record of having no
pedestrian fatalities in the last three years from the Automobile
Club of New York.

papers, on behalf of the Town of Southold, seeking a grant from the
State of New York Division of Criminal Justice Service for the purposes
of implementation of an improved communications system for law enforce=
ment agencies in -the County of Suffolk and acknowledge the requincwd
expenditures ,of 5/ or $5200. 00 of the -$104, 000. 00 , cost .of .-the equipment
to the Town .of Southold, and are prepared to ex-tend -such -funds during
the 1978 fiscal year.

Mr. William Weinheimer asked if the Board has any statistics on the
relative amount o.f .dollar value of new .construction :this. year as
compared to last year in the Town of Southold?---Deputy Supervisor
Demarest stated .he_ does .not have any comparison, but- this year it
runs .jus-t. under $10, 000, 000. , which inc.ludes. add.itions, new.-buildings
and .so forth.
Dr. Myron Slater of the Greenport Presbyterian church asked if any
progress has been made- since the- last meeting relati.ve.1to considera-
tion of the singing. christmas tree. he .proposed?---Deputy. Supervisor
Demarest stated they had not discussed it asyet. as they.were.waiting
for Dr. Slater to submit cost figures. He suggested Dr. Slater talk
to the building inspector Howard Terry to see if he has any suggestions.---
Dr. Slater stated since a newspaper article appeared on this proposed
project they. have had considerable interest. He suggested individuals
might be employed through the- CETA program to work on the project. ---
Deputy Supervisor Demarest stated they have several CETA employees
. working for the . town. at the present time.---Dr. Slater asked what
had. happened in consideration of making the town hall addition and
removal of the. existing old building?---Deputy Supervisor Demarest.
stated they are waiting for an offer of grant to replace it. ---
Dr. . Slater asked what needs to be done .for a non-profit organization
to be considered for receiving the old building for a cultural arts
center in the area?---Deputy Supervisor Demarest- stated if there were
several organizations (non-profit) who wishes the building, the. Board
would have to make a choice of who it would go to. It is an historical
building and consideration would be given as to whether the building
would be maintained in its present state of completely changed.
Steve Katz asked whether the County is going to pay for buying
the 12 passenger bus or are they also going to pay for the modifications?
Deputy Supervisor Demarest stated the modifications would..be put into
the specifications when the bid is released and the cost Mould have to
be within a certain range.
Mr. Katz asked what is happening with the recreation center?--- .Deputy
Supervisor Demarest stated that right now the money the Town was
supposed to get in the third grant is tied up because none of the
participants in the consortium signed to give away their right to
control the zoning of land in their townships. The feeling is among
the people who are knowledgable of the law that it would be illegal
to pass a resolution which would in fact allow income multiple
housing anywhere the county wished. to have it placed. It would be
granting zoning without a hearing.---Mr. Katz asked if the .Board if
rejecting the proposed resolution the county sent down or are you
waiting to see what happens next?---Deputy Supervisor Demarest stated
that as far as the resolution is concerned, he can state for all the
members of the Town Board, and ,every -tither member of the consortium
except perhaps Riverhead, they will not sign it. He has met with
most of the members of the consortium in Mr. Klein ' s office in
Hauppauge, and they will not sign it, and if they did sign it, it
would lead to law suits, because the minute a change of zone 1;7as
granted based on the res9lution,' there would -.be a law suit, and ' --
the lawyers felt no court in the State of New York would allow.-.the
change of .zone. =--Mr. .Katz .asked if anything was being done -to press
the issue?---Deputy Supervisor Demarest stated the . proposal .at the.
meeting was that they contact some one in authority at the Housing . -.
and Urban Develppment in Washington and send a delegation there to
see if it can be changed. Of all the nnformation they .had at .;tn`a _
meeting.. they attended was that Suffolk County is the only place , in: .
the United Stated being asked to adopt .the resolution.
