Deputy Supervis.o.r, Demarest-, opened the meeting at 3 :00 P.M. with the following present: Deputy Supervisor Louis M. Demarest Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Town Attorney Robert. W. . Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Terry Absent: Supervisor Albert M. Doyen On motion of Justice Suter seconded by Councilman Homan_, it was RESOLVED, - that the next regular meeting of the Southold Town Board will be held at 3 :00 P.M. , Tuesday, September 13, ..1977 at the . - 'Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes : 'Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter. This resolution was declared duly adopted. _:, Deputy. Supervisor. Demarest: , 1. Receipt of letters from the Horth Fork Volunteer Fireman 's Association and the Long ,Island Gasoline. Retailers Association, Inc. relative to self-service gas stations. The Board discussed the matter at some length. The Chairman of the Board of Appeals has accumulated quite-'a bit ofinformation on the subject and the Board .wil.l ask Mr. Gillispie for that information and then try to come .up -with..some decision a.s to how self-service gas .stations will be handled. 2. A resolution has been received from the Fishers Island, Ferry District requesting permission to make a change in the existing ferry boat ramp to accomodate the proposed new vessel., A dock builder ,is.. at the Island now installing new dolphins, but before he can make the change to the ramp. permission is , required from the Town Board., The work will be done for under $2, 500. which . does not necessitate _ a bid. On motion of Councilman Rich, seconded by Justice Suter, it was RESOLVED, that the .Fishers. Island, Ferry District be .and hereby are authorized to engage -a contractor to -install a three ple. cluster on the east side of the . ferry boat ramp and one pile be .replaced on . the south end of the existing pier to accomdodate the . proposed new vessel which will replace the M/V Olinda. Vote of -the Town Board: Ayes : Deputy Supervisor Demarest,, Councilman Rich, Councilmn Homan, Justice Suter. This resolution was declared duly adopted. Deputy Supervisor Demarest:. 3 . Receipt of a letter from Robert L. Fraser,, author and publisher of Town Law for Town Officials. The town has approximately Ak`= 5 1977 10 copies of the publication. An annual supplement is received each year containing changes made by the legislature. Formerly Mr. Fraser had General Code Corp. furnish the book and supplements, however, they no longer have a contract and Mr. Fraser is going to supply them himself. The supplements will be sent to the Town Clerk and then distributed to the book holders. 4. A report has been received -from Chief Cataldo relative to the sale of various items on August 13th. A memorandum of sale for each item is included in the report'; total monies collected was $345.00. 5. Notification has been received of a legal action against one of the police officers for alleged police brutality. The matter will be turned over to the insurance company. 6. Receipt of a letter from John T. Beck, Sr. reporting a_ bicycle accident his son, had on Pequash Avenue, Cutchogue, allegedly, caused by soft gravel in' the, road. " Mr. ' Beck is interested in 'having some of- his 'son''s hospital bills paid. " The matter will be inves.tiga.ted. 7. From the Office of the County Executive has been received a copy of an agreement whereby the County will install traffic control signals on Route 27 A,: 'M ddle Road, `with Wickham Avenue,Mattituck. 8. Receipt of a letter from ' Wiedersum'Associates stating Morchel Heating & Air Conditioning las `completed its work on the addition to the Southold Town Hall and final payment is now in order. 9. Notification from the 'Department of Environmental Conservation of a hearing September 14, 1977" "at 10" 00 A.M. , Suffolk County Legis- lative Meeting Room, County Cen ter, Riverhead, upon application of Ralph T. Preston, Inc. for Albert J. Moyse for permission to extend an existing jetty by additional 20 1-in. ft. at Mr.Moyse ' s property located 300 lin f t. east of the. terminus 'of Bay Avenue, 'East `Marion, on Orient Harbor. Objections by September 8, 1977 . DEC' notice :o:f �a hearing 'on September 14 ' 1977 at" 2 :00 P.M." upon application of Ralph T. Preston', Inc.' for Henry H. Karlin for permission to construct b)xlkheading, extend an existing dock with a floating dock, and dredge in the vicinity of the floating dock on the south side 'of Jockey Creek, Southold. Objections by September 8, 1977. DEC notice of a hearing on August 31, 1977 at' 10 :00 A.M. upon appliaation of Robert Turner for permission to erect a single family dwelling on the south corner of Cedar Point Drive West and Little Peconic Bay Lam, on West Lake, off Hog Neck -Bay, Southold_ . Objections by August 25, _ 1977 . 10. Notice Trom the Department of the Army, Corps of Engineers stating they will no'L longer send notices of' public hearings unless requested. The Board will examine the listings and request notices on only those areas surrounding the Town of Southold. 11. Receipt' of a petition from residents around James Creek,. Mattituck, stating all of the necessary permits and paperwork have been- approved for the dredging o'f ' the entrance to James Creek. Deputy Supervisor Demarest has checked on' the matter, and "all that is needed now to accomplish the dre'dging' is for. 1a resolution to be :adopted by the Suffolk ' County Legislature for funding. 12 . ` Letter from the tong island Lighting Company asking what services the Town will require of them with regards to the proposed community center on Peconic Lane, Peconic. At the present time that information is not available. 13. Letter from the Automobile Club of New York stating the Town of Southold has been awarded a Pedestria'ri" Safety Citation for achieving a record of having no pedestrian fatalaties in the last three' years. 'There will—be a luncheon ' on September 19th at the" Tavern-on-'th.e-Green; ' Central "Park West, New York City to honor the the Town of Southold and other award-winning communities 'inthis area. There is also a press release which will be released next month. It is not believed anyone will attend the luncheon. 14. Receipt of a letter from the Suffolk County Office for the Aging stating any program which the Town initiates for senior citizens must be readily accessible to handicapped persons, except where structural changes are necessary. . 29 9 . 15. Receipt of a letter from County Legislator Joyce Burland stating the Senior Action Mobile Van will be at the Southold Town Hall on Wednesday, September 7th from 10 A.M. to 12 noon. It will be parked in front of the Town Hall, but in case of rain the Town Hall will be made available. 16. Request for a street light in the east-west lighting district Greenport, by Mary A. Heaney, Eighth Street. Councilman Homan stated the request will be considered when they go into the new lights in that area. At the present time the Town is converting the old lights , and no new -lights have been granted in some time. 17. Receipt of a copy of a resolution from .the Town of Shelter Island stating they would back a bill which has been introduced. in the State Legislature make, for a certain period to time, any energy saving device such as solar energy, be free of assessment. The Town of Southold has not received a copy of that particular bill as yet. i81. Receipt of a letter from George S. Case, Treasurer of the Cutchogue . Free Library, seeking an increase in the amount of monies the Town has allocated to the libraries. At budget time. the request will be taken into consideration. 19.. Letter from 11 year old Lisa Harris, Kenney's Road, Southold, suggesting the Town install a float at Kenneys Beach. Highway Superintendent Dean advised the Board that. due to the ,vandalism, such as burning the lifeguard stands at Kenney' s Beach it is question- able whether they would have much success with a float; however, it will be considered for another year. 20. Receipt of a letter from Town 'Hall, Southwold, England, expressing .the pleasure of having Southold Town send a telegram on the Silver Jubilee. of Her Majesty the Queen. They enclosed a program of. the Silver Jubilee with a picture of the Queen enclosed, along" w th Southold Town' s message.- On motion of Councilman Riche} seconded by Councilman Homan, it was RESOLVED, that the cluster concept subdivision of Wilsberg, east of Brown 's Hills , Orient, ' be" and hereby is approved by the Southold Town Board-. Vote of the Town Board: Ayes : Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter. This resolution was declared duly adopted. Deputy Supervisor Demarest: 21. 'A request has been received- for a".;No parking sign on East Inlet Lane, Greenport,. in the vicinity of the breakwater. Mr. Dean is checking to determine if that is in fact a'- town road. _ 22. Item 15' on the agenda referring to approval of. roads in Orient, ' pertains to 'property just east of Truman ' s Beach., The ' ' center'.of the parcel has been sold and there are two pieces on each side with proposed roads which are not up to town specifications. This would be a matter for the . Planning Board as to whether such roads would be allowed, however, the developer requested approval of the highway committee, ' and a decision will be forthcoming in a short time." On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that a letter be sent to Philip W. Mc Grade, Chief Regulatory Branch, Department of the Army, N.Y. District, Corps of Engineers commenting on the application of Long Island Lighting company- for installation of "jetties at- the proposed nuclear plant at Jamesport; and the installation of inlet and outlet pipes for water and some dredging. Vote of the. Town Board: Ayes- Deputy Supervisor Demarest, Councilman Rich, Councilman Homan, Justice Suter: ' This resolution was declared duly- adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED, that, Fishers Island Ferry District funds in the amount of $96.44 be and hereby are transferred from the Theatre Account to Property Tax. Vote of the Town Board: Ayes : Deputy Supervisor Demarest, Councilman W 2,5;, 1977 Rich, Councilman Homan, Justice Suter. , This resolution was declared duly adopted. (Deputy Supervisor Demarest stated the Fishers Island Ferry- district pays tax to the City of New London, Connecticut for the. prop.erty they pwn for their ferry landing.. They had $.2700..00 in, the_ budget for it and were $96.44short. ), On motion of Councilman Homan, seconded by Councilman Rich, it .was RESOLVED, that the Superintendentof. Highways of the. Town of .Southold be authorized to advertise for bids for repair parts for D-7 Caterpillar. Vote of. the Town Board:. On motion' of ,Councilmari Homan, seconded by Councilman Rich, it was RESOLVED, that Deputy Supervisor Demarest be- and, he- hereby-.is-auth-orized to enter into a contract with Bender & Dougherty for- the purchase of a parcel of ;1aialA at the rear of the town ,hall pcoperty,extending to Traveler Street. Vote of the Town Board: Ayes : Deputy Supervisor Demarest,. Councilman Rich, Councilman Homan, Justice Suter. This_,resoluton was declared duly adopted... ( In reply to the question of the size of the land, Town_ Attonne,y Tasker stated the- land is approximately 46 ft. _ in 'Width by 188 to 190 ft., 15 depth- running north to traveler Street. ---Deputy .Supervisor Demarest stated the, Town will be- deeded- free of charge two parcels of the same width which are pieces of the- property _immediately .next , door and the one east of that which wrap around and are. 46 ft.-wide.' ) On motion of Councilman Homan, seconded by Councilman Rich, it- was RESOLVED, that Deputy_ Supervisor Demarest be and he hereby is to .be compensated-, $50.00 per day. for his . position of Deputy .Supervisor: - - whenever he acts in that capacity in the absence of Supervisor.- Martocchia. Vote of the Town Board: Ayes : Deputy Supervisor Demarest, Councilman Rich, -Councilman Homan, Justice Suter. This resolution was declared duly adopted. Deputy. Supervisor- Demarest explained that the meeting of the Board was being held this date,, Thursday, .because the Town Clerk, Town Attorney and he went to New York City on Tuesday to sign for the Fishers Island Ferry District.---He stated that when the credit of the Town was discussed,at ,the New York meeting,, when drawing up the prospectus they went over the town ' s financial condition and were quite amazed to see a town in the financial s.tate, the. town is; and that coupled with an .article in the New York Times last year that rated at 100% evaluation the .Town of Southold had the second lowest rate of any municipality within 125 miles of New York City. The Board over the years deserves a lot of credit for runnigg the town in the sound financial manner it has. Mr. John G. Joannides of ,49 Sound Beach Drive,. Mattituck, , presented. a petition. .from the residents of Sound Beach Drive in Mattituck, - requesting the- Town place signs banning any motorized vehicles from riding on the beaches in front of their homes during the summer season. The vehicles are jeopardizing the lives of their children and have. become a nuisance. The petition contained 23 names. ---Mr. Johnn_ides elabora.ted on the petition, s.ta,ting motorcycles and other vehicles _ drive at high unsafe speeds during. the day and. during the night. They go so close as to even pass over the edge of beach blankets, where the residents are sitting. Children have been near victims, only , saved in a few incidents`by .quick,. action. of their parents or other residents. He cited Fire , Island. as having banned vehicles from the beaches. ---Deputy Supervisor Demarest stated that Fire Island is AUG 2 5� 1977 01 totally government controlled in most cases.---Town Attorney -Tasker stated that there are two different jurisdictions. The area above highwater mark. is private property and anyone using it is tresspassing. All that ,ne'ed be done is file an information. Below high water mark the land belongs to the State of New-.York. This question has come up many times . Several years ago the Town was in contact with the Attorney General and asked if he wished the State to do anything and he didn ' t want to get involved. Therefore it- raises the question as 'to whether or not the Town of Southold has the legal authority to regulate the use of State owned land below the ordinary high water mark. Above it it is private property.---Mr. D.G. Witschieben, a resident of Sound Beach Drive, concurred with and- elaborated upon Mr. Johnnides ' -state- merits. He started that the trucks and other .vecicles are gaining- access through public access roads and are breaking down the banks. they. -have no mufflers , remove their license plates -so they cannot be identified, ride day and night .at high speeds. He feels the town should- 'put -up signs and chains to stop all access to the beach.--- Deputy Supervisor Demarest stated they could consider cutting off access, but the gates have been torn down, and it is almost impossible to catch the .offenders. As far as a public nuisance is concerned, someone must make the accusation in court; there is a provision in the law to .take care of it: ---Justice Suter stated that he has had 10 motorcycle convictions:, in the past two weeks, so they are apprehend- ing th& offenders as they catch them, but they can ' t catch them' al,l. the Park District is keeping the gates open because they have lost so many gates. they gave up. They also tear the signs down. ---Mrs. Johnnides stated she called the police a week ago because her child was almost killed by an 11 year old child driving a motorcycle, and the police stated once they are off public property there is nothing they can do- �about it. =: =Deputy Supervisor Demarest stated that is. true, once they are off -public property they do not needia license, nor license plates.---Mr. Witschieben asked that the town pass a resolution to stop -,vehicles' from riding on private property.--Town' Attorney Tasker stated the town does -not have. the authority to pass such a regulation. If someone drives a vehicle, or 'walks on private property without permission :that is tresspass . As far as public nuisance as far as the. :Penal Law .is concerned, it takes seven or more people to be annoyed to bring a charge that would stand up in court.---Mr. Witschieben- continued to request the Town Board to take action to protect -them against the problem� of tresspassers and violators. ---. Deputy -Supervisor .--Demarest stated they would consider it and do what the. :law allows. them to do.'--Mr-. Witschieben continued to pursue this matter at._l:ength. Cha-rles .Hickey, Southold, asked if something couldn ' t be done about Kenney' s .Bea.ch,: burning of the life .guard stands ,.- and -.so forth. Couldn ' t .the poLi-ce make some extra .:trips to try and catch someone in the: act of vandalism?,"--Deputy.- Supervisor - Demarest stated he is certain. they ar:e keeping a better watch on it. It is believed they have :names of. some of the persons suspected of the vandalism. Mr. Henry Lytle, Peconic.;. stated._ at a meeting of the Southold-Peconic, Civic Association the other night the matter of the hazard which has been created by the. new parking lot east -of Chinam was discussed. It is :suggested that some sort of barrier or poles. be erected which would. force people to exit north to. Traveler. Street rather then onto the. Main Road by way of the Chinam parking lot.---Highway Superintendent' Dean said that procedure was discussed; but Chinam said they didn 't care-If people parked in the new parking : lot and them.. drove out through their .parking lotto, exit. However, thei matter of exiting onto the Main-:Road i's- a problem and hazard and will be looked into. Genev:ieve ..L. :Richards, Southold, New .York, read'. the following letter to the -Town Board which she asked be entered 'in full in ' the minutes : "August: 25, 19'77, Southold, N.Y. AUG;: 2 5 1977 Good Afternoon, members of the Board--I wish to introduce myself as Genevieve L. Richards. I have been a Southold Town resident for 53 years, 30 of which I_have been a taxpayer, as was my father before me, and members of my family are 'at this time. I won the historical land (as -so designated with an appropriate plaque erected by Southold Town) and residential property on the north side of Route 25, Main., Road, Southold, New York, beginning at the east side of Mill Creek Bridge and extending east to .the Railroad Bridge. My home, -which is my present residence is located on this property. From the inception of this bridge project, of which I was not made cognizant--legally, my family and . I have endured many hardships, such as the taking . of my land at a price far below its current real estate value for waterfront property, the devaluation of my property and the negative . effects on .my property and this area regarding its conservation . . laws--the contradiction of which resulted . from dredging, removal of valuable soil, accumulation of garbage, tidal waves and disturbance of wild life. Now, incredible, though it sounds, ..I am being asked to take a small sum of money, because. I am being denied the -right to live in peace and quiet in my own home, on my own property! This . God-given right is fandamently guaranteed to us by our government, and enjoyed by you members of - the board -and your -.families as. we,ll. Let me digress here--to clarify that-again, in this ..instance., as aforementioned, (regarding the taking of. -of my _property) , I was not made knowledgeable--before the above offer--of the -.plans of the Department of Transportation, and/or Lizza Industries in conjunction with this board .(who,. I understand, granted permission .for this 24 hour work- shift of excessive mechanical noise of both night and. day duration.. The Town Board .has seemingly completely ignored my right in .this matter: . I can appreciate that the increase of work -hours would accelerate the completion of the. new bridge, however, if it is accomplished in accelerated time., . it -will be done at my expense and with no regard for me as a human being, Southold Town ,resident;property and home owner and taxpayer! I ask you, please, to envision, .if you will, members -of this board, that, .being. alone, I must work to keep my home and property. and to earn my living expenses. It is necessary that I arise at a very early hour to report promptly to my position. I must have proper and sufficient rest.. I challenge any of you to be able, to have such rest with the- noise of, back hoes.; pneumatic drills, pile drivers--the rumbling of huge trucks, etc, .which the foreman informed me will be utilized in this 24 hour work shift.. The. loud voices alone would be a nightly distrubance in any residential area--notwithstanding .the constant mechanical clamor: Therefore, I. .am here now to ask this Board to kindly rescind the permis.sio.n you have given to allow this 24 hour work . shift and thereby protect, and. not deprive me of my God-given, legal right to live in my own . home, and on my own property--in peace and quiet. ! I wish to request the Southold Town Board to please record a copy of my remarks today and a copy of . an itemized list of expenditures that would be necessary if I .am forced to leave my home. Thank you. These figures represent the estimated . cost .of being forced to leave my home and live in a .motel. An accurate account cannot be presented at this time. Deputy Supervisor Demarest stated he is not going to let her blame the Town Board, the foreman come to him and asked if the Town would have any .objections to their accelerating the work by working ahifts beyond the eight hour shifts. Becuase. t-his project has been a thorn in the side of many people in the whole of Southold Town, he stated, in speaking for the Town-, they had no objection to getting. the job done as rapidly .as. it could be done.. He. subsequently had a , call from Mrs. Richards and he contacted the Department of Transportation and asked them about Lizza Construction working extra shifts and ' �977 303 BUG. 2 5` they .said they had. no jurisdiction over them as to the number of hours they -worked. Deputy Supervisor Demarest also talked to Mrs. Burland, whom Mrs.' Richards also contacted, and at her suggestion, he believed, Lizza Construction offered Mrs. Richards housing in another area. ---Mrs. Richards stated .tha.t is not true.. She would like to know why the Town Board gave permission to a private industry knowing she would not be able to live.-in -her home, sleep, rest.-- Deputy ..Supervisor Demarest stated -that when the foreman came in and asked -if the -town -had amy objection, he told him at the time he didn ' t think the town had. any jurisdiction to tell him whether he could or couldn't work, I didn ' t give ,-permission, the Town has no authority to give approval, but he felt with all the trouble the town has had with merchants in the area and traffic problems, the town would be happy to see the job done, and if. it took- extra hours to do it, we wouldnr' t have any ,objection.. He also, told %him .to make :sure to .contact anyone in -.the -area who lived there on a permanent basis. =-=Mr•s. Richards stated,,there isn ':t :anyone else there, everyone else is,.business. -- Deputy Supervisor Demarest stated the foreman said he would. see Mrs. Richards-:==-Mr.s. Richards stated the -foreman offered her $100 a .week, and,:it 'is. impossible to live and eat out for $100:00. a week. She asked that- -the -Board rescind -their permission:---Town Attorney ,T.asker stated that .he thinks what she is requesting is that .perhaps the person who indicated-.to the contractor that we had no objection now indicate that we do have an .obj:ection. That would -be .the most the town could do because the town has no authority to require thein .to work overtime or not work overtime. What we' have is the right to evidence our concern.--- Deputy Sup.er.visor. Demarest stated' that he informed the Board, at a meeting subsequent to his meeting with the foreman, of the action he had taken, and they no way.. indicated he ems wrong in the assessment of having .them go ahead and trying to get the bridge. done. He will now, after this meeting is over,. meet with the Board and if they indicate they,. want him to, he will inform Liz,za: that the Town does now have objection. ---Mrs. Richards stated they have an alternative, she has submitted a list of minimum expenses, if they want to go along with that she will give some thought to leaving her home while the work continues. The question of the LILCO plant jetties was brought up by Mr. Witschieben ---Deputy Supervisor Demarest stated he does not believe they have any permits as yet either by the Federal or State government or Corps of Engineers. He and Mr. Dean went to the office of the Attorney General in New York City and indicated that if they put the plants in there the jetties are going to be necessary. The Attorney General will give testimony , it is believed to the Corps of Engineers, and their idea was that the dredging that would be done initially would be spread to the east of their proposed jetties to build up the beach along the part that has been eroded. Mr. Dean and, he suggested that once this is done that they erect some short groins to hold it there and in their proposal they indiciate that once there is a 5, 000 yd. imbalance in the amount that either left ar built up onthe other side immediately LILCO would have to transfer and put it from one side to .the other. They intended to pump some 600 , 000 yards of fill from between the two jetties to get the depth of water for- their intake and outlet pipes and that would be spread 2 , 500 feet to the east and he suggested that in their proposal to the Corps of Engineers that when that. was put down there something be put on top of it, short groins, to hold that there so it would remain. The question was asked about the matter in the newspaper about the HUD funds. It was recalled that about six months ago when it was proposed, a question was asked at a meeting of the board, and a member of the board replied that the intent of the federal government in -giving HUD funds was for urban development and rehabilitate homes for the needy. At that time it was said the Board had permission from the powers to be to use the funds for a senior citizen center and a child care center was this given to the Board in writing before the I (� pUG'. 5 .19 77 town went into the expense of buying .the property?---Deputy Supervisor Demarest ..exp.lained that there was _no -expense 'to buy the property, -as it wa.s: the-, first .year a.11'otment -of. HUD .funds.. The town did not have a written guarantee that they would get all .of the money for the project._ The federal government, .for -some reason or .another, is a hlowed . to change the .rules .as they go along. He :received .a call today -from .Kerrin -Barnes, director .of -the low income housing:. aspect of .the program, and ,there is to be .-a meeting .in Hauppauge .to, try and straighten the matter .out and make recommendations to HUD in Washington to see whether some of their requirements can be waived. It is believed ther.e .has .been such. a violent reaction --to some of their criteria that must -be:_-followed to .get the :.final payment .they. are beginning to change their ideas: _ Dr.. Myron Slater,. 37 .Sunset Lane, Greenport, Greenport Presbyterian minister, spoke to the: Baor.d .about. a proposed cultural program. The Nor-th .Fork Choral is starting up again in September and he -proposes a singing ohuistmas tree.. It. has been done twice.. in the United Statesm in North Carolina and Kansas. He was involved in :such a christmas tree ;in Frankfurt, Germany, . although that was a stationary project. . He would- like to .see what it- would.. cos.t the' town to involve .themselves in the making of this. project so the •North Fork Choral people could utilize, it in carolling up and down the North Fork, and be used year after year. Dr.. Slater had blueprints for the construction of this tree.---Deputy ,.S.upervisor Demarest .stated it might 'very well be _'. feasible and might be a project. the ,town might wish to be involved in.
