SOUTHOLD TOWN BOARD
August 9, 1977
A regular meeting of the Southold Town Board was held on Tuesday,
August 9, 1977 at the Southold Town Hall, Main Road, Southold, New
York. Deputy Supervisor Demarest opened the meeting at 3 :00 P .M.
with the following present:

On motion of Justice Suter, seconded :by Councilman Homan, It was
RESOLVED that the minutes of the Southold Town Board meeting held on
July 26, 1977 be and hereby are approved as submitted.
Vote of the Town Board: Ayes : Deputy 'Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter, Justice Doyen.
This resolution was declared duly adopted.
On motion of Councilman Homan, seconded by Justice Doyen, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 1 :00 P.M. , Wednesday,. August 17 , 1977 at the Fishers
Island School, Fishers Island, New York.
Vote of the Town Board: Ayes : Deputy .Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter, 'Justice Doyen.
This resolution was declared duly adopted.
On motion of Councilman Homan, seconded by Justice Suter, it was
RESOLVED that the July monthly reports of the Supervisor, Police,
Building Inspector, Dog Warden, Town Clerk and Justice Suter be and
hereby are accepted and placed on file.
Vote of the Town Board: Ayes : Deputy. Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter, Justice Doyen.
This resolution was declared duly adopted.
.Deputy Supervisor Demarest:
1. The Town has been offered a 'used sand pit, originally owned
by Petrucci, and -now owned by Herbert 0. Cassidy. The board has con-
sidered it and at this time is not, interested in the purchase of this
sand pit.
2. The Board discussed the purchase of shelving for the Historian
and determined some should be ordered.- - Deputy Supervisor Demarest
will look into prices and report -back at the next meeting.

3 . Copy machines were discussed by the Board for Justice Suterd.s orifice
and Justice Demarest's office. Justice Demarest 's copier is not operating
as parts of his machine are being used on Justice Suter 's machine. The
machine at Police Headquarters only works intermittantly. There are
two copy machines in the Town Hall. The new larger machine which was
installed when the new building opened, and one in the other wing. After
research of the situation, it was determined that because of the cost of
the two machines, and the fact: the new larger machine is not being used
to its fullest capacity, the smaller machine should be moved to the
Police Headquarters.' This was a unanimous decision of the Board.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that one building inspector be and he hereby is authorized
to attend the annual New York State Building Official ' s Conference
at the Concord, Kiamesha Lake, New York, October 5 through 8, 1977,
and that actual and necessary expenses to travel, meals, and lodging
incurred while attending said conference be a "legal charge against the
Town of Southold.

Deputy Supervisor Demarest: _
4. Receipt of a letter from Charles A. Hickmann, attorney for
Lillian A. Gozelski who conveyed title to land on Peconic Lane, Peconic
to the Town of Southold in October 1976, stating that within one year
of purchase the Town had agreed to relocate irrigating apparatus from
Mrs. Gozelski ' s property to the parcel purchased from her by the Town.
This matter will be taken care of shortly by putting in a 6 inch casing
which would be less expensive , than points.
5. Letter from the New York State Department of Civil Service
stating that reserve moneys recently -transferred to the State from
the-insurance carriers for Health Insurance will be distributed to
participating agencies if certain eligiliility requirements are met.
The Town does not meet those requirements. The amount to be received
by the Town of Southold is $12, 977. 00
On motion of Justice Suter, seconded 'bytouncilman Rich, it was
RESOLVED that Deputy Supervisor Louis M.' Demarest be and he hereby is
authorized to execute the necessary papers for submission to the New
York State Department of Civil Service for the distribution of reserve
funds from the Health Insurance Reserve Receipts Fund, to the Town of .
Southold, in the amount of $12,"977. 00

Deputy Supervisor Demarest:
6. Item 6 on the agenda pertains to the order of the Department
of Environmental Conservation establishing the boundaries of tidal -
wetlands as shown on final tidal wetlands boundary maps, and the Tidal
Wetlands Land Use. Regulations which will go into effect on August 20th.
At that time the moratorium under which the DEC gave permits .under . .
certain conditions .will .no longer apply. Two copies of the regulations
have been received, one copy of which will be given to the Building
Department.
7. Notification has been received from the New York State Depart-
ment .of Environmental Conservation stating that a voucher has been
forwarded to Albany .to- begin the reimbursement process for the shellfish
transplant spawner. project. The town will receive $3 , 000. 00 reimbursement.
B. Receipt of .a letter from Ann M. _Hurley, Receiver of Taxes, ',
Huntington Town, stating she has been appointed to the Community Affairs

Advisory Board of the New York State-Se.nate. Mrs. Hurley states that
if any New York State law or mandate; is causing a problem .in its
implementation in any of the town departments, to please inform her so
she can bring it to the attention of the Advisory Board, or if any town
departments seek to enact new laws �o.r mandates to assist in the
efficiency of their operation to please let her know. Mrs. Hurley is
the only member on the Board from Long Island.
9.The bonds for the Fishers Island Ferry District were sold on
August 2nd. There were three bids on the bonds , two at 6% and one at
5. 90%. The- 5. 90/ bid was made by the North Fork Bank for Adams McEntee
& Co.
Justice Francais T. Doyen offered the following resolution and moved
its adoption: -
Resolution of the Town of Southold, New York, adopted August 9, 1977,
designating the Deputy Supervisor of said town to execute the $589, 000.
Fishers Island Ferry District Serial.; Bonds-197-7 of said Town and the
Coupons therefor, dated August 1, 19:7.7, in lieu of the Supervisor, who
has been taken ill and will be unable to perform such duties.
RESOLVED by the Town Board of the Town of Southold, in the
County of Suffolk, . New York, as follows :
Section I. Supplementing the Certificate of Determination
executed by'.the Supervisor of the. .Town of Southold (the"Town) ,
in the County of Suffolk, New York;, on July 19, 1977, setting out
certain details in connection with the terms , form, sale and issu-
ance of $589, 000 Fish rs Island Ferry District- Serial Bonds - 1977
of the Town (the "Bonds.") , dated August 1, 1977 , and as more
particularly described therein, including reference to and cita-
tion of the bond resolution adopted by the Town Board on January
11, 1977 theref.ore, ,it is hereby_,determined. that Louis M. Demarest,
the Deputy Supervisor of the Town, is designated to execute .thd:
Bonds on behalf of the Town and, .by...his facsimile signature, exe-
cute the coupons therefor, in lieu of such execution by Albert M.
Martocchia, the Supervisor of, the Town, who has been taken ill_
and will be unable to perform, .such duties.
Section 2. The action of. the Deputy Supervisor in executing
the Certificate of *Award on August 2,, 1977 with 'respect to award-
ing the Bonds and determining the interest rate , therefor, in the
absence of the. Supervisor, is hereby- ratified and confirmed..
Section 3. This resolution shall take effect immediately.
The adoption of the foregoing resolution was seconded by
Justice Martin Suter and duly put to-.a vote on roll call, which
resulted. as follows : Ayes : Deputy Supervisor Louis M. Demarest,
Councilman James-H. Rich Jr. , Councilman James, Homan, Justice
Martin Suter, Justice Francais T. Doyen. Noes : None.

Deputy Supervisor Demarest:
10. Receipt of a letter from the Surrogate ' s Court of Suffolk
County stating that Honorable Ernest: L. Signorelli, Surrogate of
Suffolk County has inaugurated a public information program whereby
the Surogate and members of his staff speak. before various public
groups throughout the county. This fall the Surogate is setting aside
one Fridayof each month so the Senior Citizens can visit the court,
meet with Surrogate Signorelli and his staff and -become familiar with
its operation.
1.1. No.tifi.dat on from the _Suffolk County Office .For The Aging
stating that the 12 passenger va.ns ..f.or Senior Citizen Transportation ,
has been cancelled, due to a strike at the factory where the vans were
ordered. The Office for the Aging- proposes ,that each town be allocated
a certain amount o.f money for the purchase of a van and the County is
in the process. o.f preparing . the necessary paper work for con,trgcts with
each :'of�. the ten towns, which would enable each town-to purchase their
own van. , _...
12. Information sheets have been received from the Office for the
Aging relative to the Special Crisis _Intervention Program whereby low
income residents who meet certain criteria, may receive as much as

13. Letter 'from the Suffolk County Department of -Social Services
relative to their efforts -to enlist -more non-public a-ssistance house-
holds into the Food Stamp Program, •and to supplement their current
outreach activities. Deputy Supervisor 'Demare'st will follow up on
the request •with the County to determine how the Town of Southold .
fits into this proposal:
14. Letter-'.from the- Suffolk County Office For The Aging stating
that -the amount of -$70. 00 has been allocated to the 'Town of Southold'
to conduct training/lecture 'sessions` for 'elderly membership 'or constit-
uency. The funds must be expended before September 30th.
Moved by Councilman Homan, seconded by Justice Suter,
WHEREAS the Lagoon Association of Nassau Point has applied to the Town
Board for financial assistance in dredging the south inlet on Nassau
Point, Cutchogue,
NOW, THEREFORE; BE IT RESOLVED, that' Deputy- Supervisor Louis• M.' Demarest
on behalf' of the Town of Southold, be and hereby is authorized to
contribute half of the total cost up to but not exceeding the sum of
$475. 00 toward the cost of dredging-the south inlet of the- Lagoon,
Nassau Point, Cutchogue, New York.

Deputy Supervisor Demarest:
15. A letter has been received"from the Reydon Shores. Property
Owners ' Association, Inc. , Southold requesting `assistance in the
payment for dredging the inlet to their harbor in Reydon Shores.
The work has been done and the bill-- paid- by the Association in the
amount of $850. 00. The Board cannot find any record of an application
to do this dredging. The letter mentions a previous conversation
with Mr. Martocchia. The request is-- being held for investigation.
16. Copies of two letters to 'the U.S . Army Corps of Engineers
from Mrs. W.C. Richardson and William R. Romaine relative to dredging
a small c'Ahrinel at Meadow Beach in- Horseshoe Cove, 'Cutchogue Harbor-,
Nassau Point. These two 'individual-s .request some of the sand 'dredged
be placed on their shore line along with their neighbors.
17 . Receipt of a thank you letter from•. the Southold-Peconic Civic
Association, Inc. who used the tvwn-hall meeting room for their annual
meeting on the evening of July 25-, 1977.
18. Two letters have been received from Nelson Axien, . and D.J.
Stanton relative to the erosion problem to the east of' Goldsmith_' s
Inlet jetr-y. Mr. Axien states the need, for the jetty, and Mr. Stanton,
On behalf of the Kenney' s Beach Association, Inc. , requesting that.
an immediate assessement of the effects of the Goldsmith ' s Inlet and
Jetty be made toward determining whether the removal and/or modific-
ation of -the existing jetty will improve the shamline conditions and/
or prevent their further deterioration. —At the direction of the
Board, Deputy Supervisor Demare-st will contact the County to request
their assessment of the situation.
Mr: Ed Schwindt, representing Peconic' Sound Shores Association, 'spoke
to the Board relative to the-`Goldsmith Inlet and Jetty problem. They
wish to go on record as saying it is extremely essential'. They do not
feel the erosion problem is a result of the jetty, they do not think 'it
could cause a problem 8, 000 feet away. Mr. Schwindt quoted several
newspapers back as 'far as 1963 when the jetty was built, citing the
need 'to prevent - further erosion. ---Mr:: Nelson Axien concurred with Mr.
Schwindt ' s remarks. --- Councilman Rich pointed out that before the jetty
was built the houses in the area - had to be moved back, because of the
erosion, several times If the jetty is removed, in his opinion, . the
!houses woule have to be moved back-again.---Deputy Supervisor Demarest
stated the County will be contacted and request :to make a survey .of
the situation.

Deputy Supervisor Demarest:
19. Receipt of a notice of public hearing from the Department of
Environmental Conservation in the matter of the Water Supply Application
of Ernest E. Wilsburg (Orient Point Water Company) for permission to
construct a water supply sytsem for the purpose of furnishing water to a
proposed subdivision that will consist of 39 plots. Date of the hearing
is September 15th, 10 :00 A.M. at the- Suffolk County Legislature Meeting
Room, County Center, Riverhead, - Objections by September 6, 1977 .
20. Letter from the General Code Publishers Corporation stating
they no longer have a contract with Robert Fraser, the author of "Town
Law for Town officials". Deputy Supervisor Demarest will write to Mr.
Fraser to determine how they may continue to receive the supplements
to this publication which all town officials now have.
21. Letter from the Mattituck Chamber of Commerce, Henry W. Drum,
President, stating the frequency of police patrols in the Mattituck
Village was discussed, and request that the- patrols be increased during
the hours of darkness in and around the village.--The matter has been
referred to the Police Department_ and they -indicate they will have more
patrols.

WHEREAS, ' certain -real property owned by the United Stated, located in
the County of Suffolk, State of New York, has - been declared surplus - and
at the discretion of the General Services Administration, may be assigned
to the Secretary of the Interior for disposal for public park or recrea-
tion purposes, under the provisions of Section 203 (k) (2) of the Federal
Propertyand Administration Services Act of 1949 (63 Stat. 387) , as
amended, and rules and regulations promulgated pursuant thereto, more
particularly •described as follows :

Fishers Island, Suffolk County, .New York

The property consists of three non-contiguous parcels containing a
-total of 1. 67 acres. The parcels are located on the eastern,-..portion
of Fishers Island, Town of Southold near Silver Eel Cove.
Parcel I contains 0.45 of an acre and is improved with 9, 890.. sq:; ft.
2 story brick storehouse. The par',cel is located on the north side
of Tyler Lane near Greenwood Road.
Parcel 2 contains 1 a-cre and is improved with three one family dwellings
It is located nort west of the intersection of Jones Road and Winthrop
Drive 'and' has frontage on the eastern shore of Silver Eel Cove.
Parcel 4 containing approximtaely 0. 23 of an acre (subject to sruvey)
is improved with a duplex apartment house. It is located on the
southeast corner of Tyler Lane adn Greenwood Road.
WHEREAS, The Town 'of Southold, needs --and will utilize said property in
perpetuity and a public park or 'wrecreation areasas set forth in its
application and in accordance with the requirements-of said Act and the
rules and regularions promulgated thereunder;
NOW, THEREFORE, BE IT RESOLVED, that .7the Town of Southold shall make
application to the' Secr.etary of the-lnterior for and secure the transfer
to it of the -above mentioned property for -said -use upon and subject to
such exceptions , reservations, terms ; convenanta., agreements , conditions
and restrictions as the Secretary of '.:the Interior, or his authorized '-
representative, may require in connection with the disposal of said
property under said Act and the rules and regulations issued pursuant
therrto; and 'Be -It Further Resolved that the Town of Southold, has legal

22 . The Board is in the process-of studying a ,map of a proposed
cluster subdivision by Wilsberg at Orient.
23. Application for a sand pit renewal by Leander Glover is not
complete and is being held. „
On motion of Justice Suter, seconded-by Councilman Homan, it was
RESOLVED that the application of Carl Frelix, Jr, dated June 15, 1977
for a trailer renewal on private road off north side Main Road,
Mattituck be and hereby is renewed for a period of six months.

RESOLVED that ,$620.37 be and hereby. .is -authorized to be transferred
from General Fund Surplus to Parks A7110.4

This resolution was declared duly adopted.
(Deputy Supervisor Demarest explained that this transfer to .parks
is a result of some of the things ..we get free, or think they are free.
Certain employees have been placed, through County and Federal funding
to work in the town, and consequently- to have the necessary equipment
for them to work with the- amount of money allocated to praks- has run ,
out. Now money must be transferred to pay . the necessary bills so , the
employees will have the equipment to .work with. ---This Board has been
quite cautious about how monies that. they have gotten have been spent
so as not to incur costs that will come later. This is not always
easy to get away from. )
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the low bidder, Tryac Truck & Equipment Co. , Inc.
Riverhead, New. York be and hereby is:-awarded the contract to supply
the Highway Department with an International Model 240 LoBoy Tractor
with .mid mount Lehara Hydro Flail boom mower and rear mounted Woods
Model MR105P razor back mower inthe amount of $10, 923. 00.

On motion of Councilman Homan, seconded by Councilman Rich, ' it was .
RESOLVED that the low bidder, J_.J_. .Ha_rt ' s, Riverhead. Ford, be and
hereby is awarded .the. contract t,o,.s.upply the Highway Department with
one new 1978 Ford F-100 Pickup as per specifications in the amount of
$4, 689.00 .

(Justice Suter stated that the Southold Blood Program who had
requested funds at the last meeting, has ' asked that their request
be held in abeyance until they prepare a budget. )

(Deputy Supervisor Demarest. regported that Supervisor Martocchia, who he
had been to visit once, is recovering quickly, and is vitally interested
in the affairs of the Town. )
Mrs. Gladys Csajko asked about one or two - items that were skipped on
the agenda.---Deputy Supervisor Demarest stated they were letter which
inadvertantly placed on the agenda pertaining to individuals other than
the Town Board and should not be brought before the public.
On motion of Justice Suter, seconded by Justice Doyen, it was
RESOLVED that a recess be called at 4 :05 P.M. , meeting to reconvene
at 5 :00 P.M. for the purpose of auditing the bills.

On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the following audited bills be and hereby: are ordered
paid: General Fund bills in the amount of $50, 691. 76; Highway.:Department
bills in the amount of $24, 825. 66; Fish.ers_Island Ferry District bills
in the amount of $49,434. 76 ; and Federal- Revenue Sharing bills in the
amoutn of $4, 765.00
