Doyen On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the minutes of the July 5, 1977 meeting of the Southold Town Board be. and hereby. are approved as submitted. Letter from John Gaillard, Fishers Island, relative to a hearing held on Fishers Island last week-. on a proposed sewer district. WHEREAS_, the-: Boa-rd-of.. Commissioners - of the Fishers � Island .Ferry District-,has-.heretofore advertised forbids for-the construction of a new ferryboat, which- .said bids -were received on June 11; 1977, and WHEREAS, the only bid received was bid of Blount Marine Corp. of Warren, Rhode Island, I. 27 NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Fishers Island Ferry District be and hereby are authorized to accept the bid of Blount Marine Corp. at the total bid price of $741, 100 with a trade-in allowance for the ferryboat "Mystic Isle" in the amount of $152, 000, making a total net cost of $589, 000, and IT IS FURTHER RESOLVED that Fishers Island Ferry District be and it hereby is authoized to enter into contract with Blount Marine Corp. for the consturction of said ferry vessel in accordance with plqns and specifications therefor.. Greene asking the Board for a donation of_. $250. 00 for. advertising, postage and printing to acquaint- all town residents with the Town of Southold Blood Program., Within the past year they have collected 675 pints of blood within the Town and have released b000d credit to 2- townspeople.---Justice Suter asked if a budget had .been submitted by them; he is aware that they have requested money ,from some of the community funds and wondered whether the total asked for was $250. 00 or they need more. --- Supervisor Martocchia will check .into the matter. 4. Public Works of Suffolk County. is empowered to erect and maintain these devices when authorized by the County Legislature. in order-. to improve these traffic conditions., and WHEREAS, the parties hereto desire to implement a program for such improvements and for the maintenance of traffic control devices., now, therefore,.be it RESOLVED-that the Town Boar.d' of the Town of . (Supervisor Martocchia explained .that a year ago the .town of Southold made. application for the aforementioned .traffic signal,. and were -given a date nine or ten months ago It would be put up shortly, - :now they were advised- it will be two years before a permanent light can be installed. They are going-" to put.-a temporary.: s-ignal-.-which .will . work on:a; :trip, and it. should-be.-done-.within three_: months-r.time. -=-Justice Suter-.stated than even a temporary light would be a great help, there have been' . three accidents at .that intersection in the last month.-.)-. Supervisor Mattocchia : 7. Information has been received on the new computer print-out .27y JUL 1 9 t977 on the money, E.D'.A.' Funds, of $2, 225-, 000. , that the Town of Southold has been designated lead agency, rather that Greenport as had been earlier indicated.. The amount of money has been reduced to $1, 600. 000, due to a computer error in 'the- a'llotment to Easthampton, ' which cut 27/' from all other areas.. 8. Receipt of two letters from "the Southold Town Fire Chiefs Council. One letter indicates they unanimously oppose any type of self-service gasoline dispensing stations within the Town of Southold and asking the Town Board to adopt an ordinance banning such installa- tions within the town and 'to deny •any present requests for -same., The second letter requests -the Town Board to adopt an ordinance regulating the use of aluminum wire within ,the- .Town of Southold. -They feel such prohibition of aluminum wiring would help eliminate any future fire hazards which could occur' by' the use of- this type of wire in buildings within the Township.---The board will take these matters into considera", tion. . 9. Receipt of letter from the Suffolk County genior Citizens Advisory Board and the Suffolk County Senior Citizens Council, Inc. informing the Board of the new senicr citizens exemption of $7, 200.00 Presently the' Town is allowing $5, 000.00 The Board will take' this matter under consideration. 10. : A letter had been= received from the 'Suffolk County Inter- governmental Relations ,Division informing the Board that the third payment in the Community Development Program will amount of $93,000.00, which has beeri� earmarked- for t-he, construction 'and site 'improvements of a Senior Cirizen=Youth Center to be located at Peconic, New York. 11. Notification has been received from the County of Suffolk that a meeting will be held on Wednesday, July 20, 1977 at 3 :30 P.M. in the Conference Room,of , the ,Suf folk County Planning.Department,. Supervisor Martocchia : 13. Receipt of a letter from Edmund J. Baumann and Carol A. Baumann, 325 Wood La-ne, Peconic requesting that the areas of Peconic Bay Beach, end of- Indian Neck Lane, Peconic. and Richmond Creek- Boat Ramp, north side: of Indian Neck Lane, Peconic be posted to the effect that facilities to be used by Southold Town residents only,. c.ar .- stickers required: . Many out of , town and out of state people have been using the areas and many have been camping over night. Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise. for bids .for th.e following items:. (-1)' one 1972 International 2400 Tractor with swale arm and (1) one rear cutter. Mr. Paul Mitchell, Town Harbor Lane, Southold spoke to the Board about a drainage problem in front of his house on the west side Town Harbor Lane. This condition has eroded his properly. He has spoken to Highway Superintendent Dean about it and they placed a drainage pipe along the side of his property. He feels a couple more street drains are necessary to take care of the excess water. Mr. Mitchell stated if he blocked off the drainage onto his property, the street would be so full of water no one would be able to get through.--Highway Superintedent Dean Stated Mr. Mitchell gave him permission to run the drainage pipe onto his property.--Mr. Mitchell is upset because everytime there is a rain storm the entire front of his property is flooded with water. For years he has spoken to the Highway Department. ---Supervisor Martocchia stated they would look into the situation and try to work out something to his satisfaction. Mr. Charles Hickey, Southold, stated that at a recent meeting of the Kenney' s Beach Property Owners Association it was indicated there would be a resolution forthcoming from the Town Board relative to the groins at Kenney's Beach.---Supervisor Martocchia stated they also discussed a speed sign, which is up already; and horses riding on the beach. As far as the erosion problem is concerned, Supervisor Martocchia is going to make a preliminary study and go further from that. Whether they suggest moving the Goldsmith' s' jetty completely and let things level off or put in a series of shorter ones ; that will be determined. Mr. Samuel Markel, Southold, spoke to the Board about the yard sales laws in the Town being flagrantly violated. The law states only one person owning the merchandise may get a permit for one yard sale a year. The person must own the merchandise he sells. Right now all over town five and six families are joining together to have a yard sale; families that are unrelated. Mr. Markel 's son is an auctioneer who obtains permit each time he holds an off-premises auction. Mr. Markel asked the Building Department why any individual who doesn' t obey the law is not brought before the law. The Building Department stated they are not the enforcement agency. All they are interested in doing is issuing permits. The enforcement is up to the Police Department.---Justice Suter stated that as. of .this weekend he has heard the police checking with the police headquarters to dttermine whether individuals have permits. Mr. Markel stated he knows for a fact many neighbors are involved in yard sales where only one individual has obtained a permit. If there is a law on the books it should be enforced, if it is not, take it off the books. These yard sales are being openly advertised in the newspapers.---Town Attorney Tasker stated the ordinance specifically requires that you can only sell your own property. If "Mr. Jones " is going to have a yard sale under the terms of the ordinance, he can't get property from "Mr. Smith" his neighbor. He is limited to sell only the property hw owns on his own property, anything else would be considered being in business. --- Justice Suter stated it started last year and there has been more of it this year. He feels the building department should be informed to. instruct the individuals when,: they obtain a permit, and they should inform the police department t6. check to see if there are more than one family involved.--Supervisor Martocchia stated they would look into it. ;9UL..19. 1977 On motion of Councilman Homan, seconded' by .Councilman- Rich, it was RESOLVED, that there being..no further business to. come- before- this Town Board meeting, adjournment be called at 3 :35 P.M.
