SOUTHOLD TOWN BOARD
April 12, 197,7
A regular meeting of the 'Southold Town Board was held on Tuesday,
April 12, 1977 at the office of the Supervisor; 16 South Street,
Greenport, New York. Supervisor Martocchia opened the meeting at
3 :00 P.M. with the following present:

On motion of Justice Suter, seconded by Justice Demarest, it was
RESOLVED that the minutes of the regular meeting of the Southold
Town Board held on March .22, 1977 be and hereby are approved as
submitted.

This resolution was declared duly adopted.
On' motion of Councilman Homan, =seconded by Councilman Rich, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 300 P.M. , Tuesday, April 26, 1977 at the office of
the Supervisor, 16_ South Street,' Greenport, New York.

RESOLVED that the - following reports for the month 'of March be and
hereby are accepted and ordered placed on file : Chief-'Cataldo, Supervisor

(Building Depart[nent -report indicates $1,668,787.00 in estimated
construction; 44 new dwellings; 23, 'additions to dwellings, five

-Supervisor Martocchia:
1. Receipt of a letter from the East End Arts 'and Humanities
Council, Ma•rdythe DiPirro, '•Executive Director-and Jim Knowles of
Custer ' Institute relative tolplans for an-ar"chitectural design
competition for the proposed community center. The Town Board is
looking - into this proposal, but no decision has been made at this
time. =
2. Letter from Lydia S:. . Wilson .r.equesting .that the town drain
on -Youngs Avenue, Southold be cleaned. out and fresh -gravel put in.

This matter has been referred to Highway Superintendent Dean who
has indicated he will correct the situation.
On motion of Justice Suter,, seconded by Councilman Rich, it was
RESOLVED that the Senior Citizens Club of Southold Township,
Mattituck Unit, be and hereby are granted permission to contract
for two buses at a cost of $350.00 each to take them to Hunter
Mountain to a German Festival on August 4, 1977.

attendance at the Annual Association of Towns Meeting in New York

3. Receipt of a letter from the North Fork Environmental
Council, .Inc. , Mer.l.on-_E. Wiggin, , President. •-. This -letter was, read
at the last Town Board meeting on. March 22, 1977 .
The Town Board met with Mrs. Jean Tiedke, .their..;intervenor at ,the Jciimes
Jamesport Nuclear Plant Hearings, this morning. The hearings are
going to start again next week. . We owent into. this to learn: more
about it and before a decision: is made all: the facts should -be ,_
heard. The Town .Board -for- the time -being, is . on record _as -wan_ ting
to hear more _about the project before-.,taking a position. -.- , .
4. Letter from. the Long Island ..Lightin-g-Company relative - to
the rental agreement we have- with them.. -,There has been a change .
in the tax adder rate.
5. Letter from Portnoy, Messinger,& Associates, Consolidated
:Corporate Constultants, - Inc.=, . Jericho, New -York, relative .-to.-the
fact the Town of Southold will become -. liable --for the •cost, of un-
employment insurance as of January 1, 1978. They are holding a
seminar at the Holiday Inn Restaurant, Riverhead, on Tuesda-y„ April
26,- 1977 , covering unemployment insur_ance._as_ _.applie.d to _ governn`ental
and educational employers. -
6 Receipt of a thank you letter-_f-rom the New York -State
Department. of Labor ,relative to assistance provided .by the Town
in supplying. a security guard at the,ir :local Greenport office on
March. l0th,. Without the -Town 's help ,th.e office would have had to
be closed as the workers would not have reported for work- that ,
day without the presence of a security guard. Since that time .
they have provided their own secuiity.
7. Thank you letters from the Institute of . Cultural Affairs
and 'Rev. Harry G. Dorman, Jr. Town Meeting Coordinator for Southold
Town Board' s support as a co-sponsor at the -Southold Town Meeting.
held at Southold-School- on March 12th.
R. Letter, from J. Stanley Parkin, .Committee -Chairman, .-Troop
39, Boys Scouts of -America, attituck, ,. advising -.that Geoffrey. L. ;
Penny •and .Richard E. Bascomb have attained-,the rank of Eagle Scout
and will be awarded their badges at a Court o.f., Honor to be held
on May 6, 1977. The Town Board will present each scout with a
scroll' to -that effect and participate. in the ceremony.
9. . -Letter from Kerry Heaney, Greenport wh-o .is preparing for
.APR.. I2P41977 211
his Eagle Scout badge asking for permission ,to, ,clean the -grounds,,,.
trim overgrown shrubs and erect a split rail fence around the old
cemetery on Albertson Lane in Arshamomaque. This .cemetery is privately
owned, however., if he .obtains permission to do the work from the
owners, the highway department will pick up .any debris .if it is -
left at the side of the road.
10. Request from Jonathan Y. Richmond, Scoutmaster, Troop 51
Greenport, Boys.• Scouts of America, requesting the town to provide
funds in the amount of $175. 00 ..to -cover . the cost of a bus .to take
Troop 51 .to .the Pan American Bui-lding in New_York- City on April 21,
1977, at which . tine they will be awarded an Honor _Certificate Award
for their 1976 Scout Program-by- the Distinguished- National Awards

Ferry District in granting a salary increase of 50� per hour to

stated CATV-has aggreed :to service every=area within,-reason.-'(.They
will provide ' service to outlying. ,area-s .if ' the res"idents ' in the area
pay A certain fee --as set-`forth -.in a schedule to cover --'installing the
lines and installation. If ..there i.s. ,-a -request -for ,a certain area
CATV will make a study and survey and indicate the cost to that area.
Nassau Point is in the process -at -the present time.--=Mrs. Csajko
suggested- that:perhaps the town •could =help ,some"'of the -'outlying.•areas
by, using the 3/- franchise 'fees:,---Mr:.--Martocchia further indicated
-that in the Mattituck area where reception has been poor; that area

and place all interested persons will `be :-given an opportunity -to
be heard upon the following matter: "A Local Law providing for written

(Justice Demarest stated the application of Leeton Drive. Beach
Association should be--looked- into, although he does not. know the
extent of what they are going to do, it is just west of Hortons Beach,
and =if.,.they,put. anything very—,far far out: into,the-.wate.r :west of Hortons
Beach there .will-:not be :any.;beach in_' frorit ,of. the parking._lot:
Virginia Moore feels it.all, comes from-the Goldsmith. Inlet,. 1etties,
is it possible to do anything about that?---Supervisor Martocchia
feels that the Goldsmith Inlet jetties went _out so far it :is-._creating
these.:problems.,---Mr.- Jim Bitses suggested that they. open.a- gap in the
Goldsmith Inlet. jetties it might help. . : It now stops- the' flow- in the
drift of ' the_ sand. .. If they opened the-. jetty somewhere-. in -its length
and let the sand drift through .it' milht start. replenishing those
beaches again. It should be looked into. )

18. The Board is in receipt of a drawing of the subidivision
of James Bitses to be known as' "Old Towne. Park"with a request as
to whether this property can be. developed in the cluster concept.
The Board Jxas not had an opportunity to study this map; and will
do so before the next board meeting.
Supervisor Martocchia opened the meeting to the public.
Mrs. Virginia Moore Moore read the following letter which she asked
to write by Merlon Wiggin, President of the North Fork Environmental
Council, Inc. : Mr. Supervisor and members of the Southold Town Board:
I 'm here .for the North. Fork Environmental Council. We want to know
whether you have made up your minds to ,take a stand against the
construction of two nuclear plants at Jamesport, just next door to
the Town of Southold, and sharing the same farmland, the same sea,
the same freshwater dome, and the same ecologic and economic head-
aches with us, but certainly giving us none of the benefit of' any
tax forgiveness that might be forthcoming. You will recall that we
asked this question at the last Town Board meeting. The acting
Supervisor said you had been awaiting recommendations', presumably
from Jean Tiedke, who has acted' as neutral intervenor for the Town
during the State Siting Board hearing. - From the Town Clerk ' s
Office I have obtained a copy of Mrs. Tiedke ' s March 3 memorandum
to the Town Board and would like to read the following condensation
of it: At the Federal level, the Administration is de-emphasizing
nuclear power. Conservation is coming increasingly to bear with the
Administration, the Federal courts, the State Public -Service
Commissions and indeed, everywhere but within the utilities them-
selves. ' Costs continue to soar; what LILCO and we, its customers
will have to pay for the two Jamesport plants has risen from a
projected $1.6 billion to $2. 7 billion so far. This is- high above
the rates of inflation, and doesn't ihclude 'enforcing the newly.
stringent NRC security regulations at nuclear plants. Alternative
energy- sources are gaining mementum and dropping in price. Along
with conservation measures such as improved home insulation,- these
will create many jobs for a long time., Mrs. -Tiedke 'cites fuel
cells already in production that can supply electricity to-' a
residential community of 20,000, for example, at a cost- of from
$200. to $350. per kilowatt of capacity; 'compared with about $.900.�'
for, a new coat plant and $1200.� per kilowatt for nuclear.

As for LILCO' s losses, so far it and NYSE&G together have spent less
than 2/ of the ultimate cost of Jamesport, and LILCO' s own projection of the
need for power continues to drop. On the basis of . such points as "these,
Mts. Tiedke writes, "It would seem appropriate to wait until LILCO has
had operating experience at Shoreham # 1 for several years----:perhaps 5 or
10 years--- before they tackle a Jamesport plant. " This delay, she
believes, would give time to assess at Shoreham the ,plant' s effects on
agricultural lands, groundwater levels, beach erosion, and commercial
sport fishing among other things, and to weigh the economic .and social
effects .on surrounding communities with their consequently mounting
populations, schools, roads, and other services, .a nd property taxes.
Mr. Supervisor and members of the Town Board, this is a very clear
recommendation by your own intervenor on the basis of her experience
at the hearings. It is a recommendation against building the Jamesport
plants .for some time if ever.. Do the people of the Town of Southold
agree with 'it? . When we spoke to you at the .,last .meeting, perhaps you
felt that you had no clear evidence of that. In the meantime, a news-
paper sampling of local opinion--The Traveler-Watchman poll--finds that
people in the Town of Southold, too, are opposing the .plants "by as much
as 5 to 1. The Long Island farm bureau .has 13, 000 signatures of
opposition as well, many from Southold. We urge you to take the stand that
repoesents us on this critically important matter: " . (Mrs. Moore submitted
copies of this letter' -to each member of .the Board. ) ,
Supervisor Martocchia stated the Board had a lengthly discussion
with Mrs. Tiedk i
e today, and it is her feeling, along with the feelng
of most ofIthe members of the Town Board that we wait and see. No one
on the board is saying they are .for it. In all fairness if someone .is
assigned to do a job for us, which Mrs.' Tiedke is, and doind a fine job,
she is well. versed, and reports regularly to the Board by memorandum and
often in person. She is of the feeling the board should wait, _ as of
12 o'clock today. Mrs. Tiedke, has 'not stated-whether bhe is for or
against it to the Town Board. ---Mrs. Moore feels the local opposition
to .this plant is- very definite and overwhelming.---Mrs.' Marie Johnson
asked, in the long run, whose will is going to win out; the town .Board's, :.rr
Town Board representative .or the citizens of the Town- of Southold? She
has. not seen the results of the poll, but it is five to one against
having.. nuclear 'power.---Councilman Homan stated that if .the town comes
out for or against, Mrs. Teidke loses her credibility as- an impartial
person as part of the inquiry. Right now the. contents and quality of the
questions .have been such she is commanding a lot of respect. If the
Board takes `a stand on this - it will eliminate a lot of Mrs. Tiedke' s
value to us. ---Supervisor Martocchia indicated the County of Suffolk has
not taken a position as yet; and Councilman Homan indicated the
Department of Environmental Conservation has not taken a stand 'as .yet.---
Justice Demarest stated that 'as Mrs. Tiedke indicated this morning, taking
a stand now. might possibly diminish her effectiveness in asking ,questions,
and waiting would not hurt the town's "position, because- when the hearings
come to an end they. are : not going to decide immediately, it will be
several months and possibly a year before 'they finally make their decision.
If the town.,waits until the. hearings are almost over or over our decision
will have enen more weight becuase we have listened to the whole thing
through Mrs. Tiedke. We will`be even more effective when we make our
decision.---Mrs. Johnson stated she has attended amny. of the hearings,
and several people who are very outspoken and violently opposed to the
plant have put. questions to people and have gotten just as truthful answers
as the prople who have not taken a posiyion, therefore ahe soes not think the
the town' s augument against taking 'a, stand is plausable. Supervisor
Martocchia indicated that he has learned that the League of Women Voters
are..no.t; opposed to the idea, they would just like to see it put off for
four or. f ive years..---Mrs. Johnson stated the League does not even In e
that much.-of a position. The only.' Position they ave is that -rhey
feel alternate sources of energy should be. looked into. They ave
taken. no other position whatsoever.
Mrs. William Graham, Vice President Southo.ld_ Senior Citizens, asked
if the Board has received any worr on the mini-bus that was offered
to the Town?---Supervisor Martocchia stated he wrote to Mr. John

requesting the mini '-bus, but has not received any word on`it" yet.--=
Mr. Graham also asked if a 'date'-has 'been set for the -Southold .Senior
Citizens 'trip, to ,Fishers Island?=--Supervisor Martocchia stated he
has not: _ .
Mrs. Gladys Csajko asked about the land 1purchased by the State at
Laurel Lake, won' t the situation be'worse than in previous years
when the police were called down there --so frequently?---Supervisor
Martocchia stated it will be worse. * ,-Mrs: Csajko asked if there ' "
is any truth to the story the land 'was offered to the "Town first?---
Supervisor Martocchia stated- it-was not offered 'to 'the Town._--
Justice Suter said th&.t 'several.years ago there was talk about it `
and it was looked at,- -but nothing came of it at the time.
Mrs. Csajko asked when the Master Plan is coming out in book'let' form?---
Supervisor Martocchia_said•_the Planning Board Secretary, Muriel "Bursh
has been putting it together'; but he does not know what the status
is at this time. Mr.- Martocchia will "look into it.
Mrs. Csajko asked. _if _any decision has "been made on the various
suggestions submitted '-relative 'to the pound?---Supervisor Martocchia
said he "is planning "_to" .meet with both wardens tomorrow. He' ha' s
read Mrs. Csajko's report -twice and there are several points" 'that
must be resolved and items that must be looked into. One of 'the
department 'heads was asked-'to set up .guidelines for the pound.
The reports of Dr. Zitek, and. dog wardens and •Town Clerk do `n`ot mesh,
and must "be studied. There will be some corrections:--=Mrs: Csajko
suggested at the last- meeting," that items be put into -the 'paper for
dogs to be adopted,' and would.'like to see " that followed through. It
would 'be much easier to drop a note at the newspapers"rather than
just killing the dogs after the prescribed .time.
Mrs. Csajko asked why the highway amendment is being proposed?--"
Supervisor Martocchia explained that .in the- event someone:breaks' a
spring on a car or, run over something; the individual can- sue. ' "This
amendment says that the Town must be-notified of -such a defect, and
it it is not corrected the town 'is liable. Of course, the town can
be sued anytime, but if they are not notified in 'advance the law
suit would not be as effective.
