Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present:. Supervisor Albert M. On motion of:.Justice Suter,, seconded by Justice Demarest; it was RESOLVED that .th_ e- next regular meeting of the Southold Town Board will' be. held,at 3:OO .P.M. , Tuesday, February 8, 1977 at the office of the Supervisor, 16 South Street; Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, .Justice' Demarest.._.. This, resolution'was declared duly adopted. Supervisor Martocchia announced that tye: were going to now set a date for the meeting following the February 8th meeting, as many of the town officials attend.-th6l,AsAociation of, Town' s Meeting in New York City which will be held on February 21,- 22; 23, 1977 _..And a meeting will not be scheduled ,that �week, therefore it will be..necessary .to •schedule two meetings in a row, February 8th and February 15th. On motion of Justice Demarest, seconded by Councilman Homan, it was RESOLVED that, a regular meeting of the Southold Town Board will be held on Tuesday, February 15, 1.977,�at 3:00 P.M. at the office of the Supervisor, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan., Justice Suter, . Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked, for reports from committees. Justice Suter stated that with reference to a proposed bond release for Oregon View Subdivision, all of the necessary papers have not been sumitted, therefore he recommends holding. thi , item until the February 8th: meeting. Supervisor. Martocchia: l.. Receipt of ,a letter from Dr. William J. Miller, Elmhurst, New York, a home owner in Southold for. about 18 .years, relative to vandalism. He included clippings from a. newspaper in Illinois explaining how the subject of vandalism is .ha.ndled there. The Board will study Dr. Miller's- suggestions.---A recent report from Chief Carl .Cataldo of the Southold. Town Police Department indicates . that vandalism has= decreased in 1976 from the amount in 1975. , 168 3AN`2`5 1977 - 2. Receipt of, a letter: from Elsi -Digons, Brooklyn,. .New York, home-.owner: on: Deephole Drive, Mattituck' stating the "bathing"beach" at the foot of Marratooka koad is in bad repair; full of old:; debris, and very unpleasant.---Supervisor Martocchh stated that this is merely, a road_ end of not_ quite 50 ft:. .in width, and, not considered a town -bathing beach.---Justice. Suter , stated that' Mrs. .Digons is in the Mattituck Park District and could take advantage of their three beaches. 3. Letter- from Nick Cyprus, 43 Sound Beach Drive, , Mattituck, relative to the erosion problem in Mattituck west of Breakwater. His house is in actual danger of -destruction.---Supervisor Martocchia. stated that some members of the Town Board have looked at the ' site and reported back; Mr. Latham of Orient has been consult to obtain a solution; Mr. Martocoh.ia has spent a great deal of time on the. phone trying to obtain ,loans from small business bureaus at a low interest; he .has talked to Frank Murphy, Chairman' of the Mattituck Park District, and had a` Mr. Kiernan from,Medford contact him. There is a hearing- being held February 2nd or 3rd by the Mattituck Park District relative to removing gravel, . and if that is granted, Mr. Mvphy stated he would supply as much gravel as is needed at no cost. Mr. Latham- indicates the" cost to do the job would be as much as $50,000.00 or more. No one he has contacted will guarantee the job. Congressman Pikehas, been contacted and he -has looked into it, but it. does not meet. the criteria whereby money can be loaned at a low interest. The criteria is 20 houses and 5. businesses: The figure at .the Mattituck .area is 14 cottages. It has been suggested to- 'him that the Mattituck area and the area at Kenney's Beach, Southold be joined and it would be more than 25. That will be looked into. Mr. Nick Cyprus stated that on the question of mining sand by- the Mattituck Park-Commission; it. is -felt that is -one of. the reasons for ,the present problem. - The flow of the •Sound..is from the west to the east. and they are' . miriing at the jetty and stopping the sand from: accumulating at 'beach in' :-front of the cottages: �.Ariother . problem is Levon Properties- in .Riverh.ead, where there are jetties 400 to 500 .feet out in the Sound. -They are faced with an immediate expense of approximately $99000.00 per, resident,. but the, measure will only be temporary. . Isn't it possible for the" State .or the Town to remove -the cause of the Problem?---Supervisor :Mar.tocchia stated he �believe'd: the .'Mattituck.Park-District had their application h,rprior to the severe erosion problem. Mr. Donald G. Witschieben stated that the application of the .. Mattituck Park District is dated December 21, 1976. The residents watched this problem occur, and it started. right after Labor Day. Mr. Witschieben presented a letter to the Town Board' signed. by Theofanis Kyvernitis, John G. - Johnnidis, Donald G. Witschieben, Gabriel Kousouros and Nick Cyprus 'all . of Sound Beach Drive, Mattituck concerning the disaster problem at their properties.. Their request io ,the Town Board is that they request the Mattituck Park District not to take any action to disturb the beach at this time. A year ago the Commission was called before the Department of Environmental Control and advised they. had .been violating the law'-for a period between 1971 and :1976, the wetlands .law;. they had- never -applied for 'a mining license, and in add ition 'they-' were caught -taking sand below the high water mark; and it was so serious, they were made to post a bond for $50,000.00 so -they, .would not do it again. Here they are again applying for a mining license. Not only do the residents have a --crisis 'to their property.,- ,but. ' now they must hire lawyers- to fight the Mattituck Park Commission. They ask that some type of a study be undertaken to determine. what they can do next. They think they could have a series of jetties or a large jetty to one end, followed by a series .of -small jetties. Mrs. Kiernan,,- another resident of the Sound Beach Drive area,; , suggested that the Board could use the wording "North: Shore of the Town of Southold" for the disaster area,, and by doin . that with the 17 homes ..(she. walked the beach and counted them on the Sound Beach Drive area, ,and 1.3 at Kenney's Beach, that would meet the criteria, with a total o.f. over 25 homes. Mr. Witschieben stated that t1ey are, suggesting in their.' letter to the Town Board several pos.s,ibilities:.. A serie's,�of jetties which -they feel would eliminate the- sand'_ problem with the Mattituck Park Commission and at the same time solve their problem; have the area declared a disaster area. They are prepared to get signatures -dANV$f,5 1977 169 on that.--Supervisor Martocchia stated he would call the proper agency and suggest the Sound Beach Area and Kenney' s Beach area be combined. Justice Demarest advised that a similar problem was solved at the State Parkin Orient by driving steel posts into the bottom,, and placing wire screening around it' and filling it with brush. It will bradually build up the beach. This can be done for a few hundred dollars. This would be a temporary solution until the beach can be built up.---Mr. Witschieben was grateful for the suggestion. Supervisor Martocchia: 4. Notice from the Department of Environmental Conservation of an application from the Mobil Oil Corporation for permission to construct two breasting dolphins between two existing dolphins in Greenport Harbor, 475 feet east of terminal shore line in . Greenport on Fourth Street. Objection date is February 11, 1977. 5. Notice from the Department. of Environmental Conservation of an application from Gloria A. McGuire for .permission to construct a one-family residence with cesspools' at the southwest end of Corey Creek Road on .lot 28, Bayview, Southold. Objection date February 17, 1977. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the TownBoard of the Town of Southold approves the action of the Fishers Island Ferry District in hiring the firm of DiCesare-Bentley & Welling Engineering Inc. to design the alterations required for the New London facility of the Fishers Island Ferry District. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the Town Board of the Town of Southold approves the action of the Fishers Island Ferry District in hiring the firm of Sparkman & Stephens, Naval Architects to assist the Fishers -Island Ferry District in reviewing specifications and drawings submitted by Blount Marine Corporation for the. purpose of bidding for the construction of a new vessel; they would also assist the attorney for the District in preparing and reviewing all bids received- and evaluate all bids for the Commissioners in determining the successful bidder. Compensation will be $750.00 per week, not to exceed three weeks. Vote of the, Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Cowinilman ,Homan, Justice Suter; Justice Demarest. This resolution was declared.-duly -adopted. Supervisor Martocchia: 6. About three weeks ago there was a meeting with federal representatives relative - to -Flood Plain �Insurance. On motion of Justice Suter, seconded by Justice Demarest, it was RESOLVED that the Mattituck Senior-Citizens be 'and hereby are granted permission to engage two buses at a cost of $175.00 each for a trip to New York City on April 20, 1977. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman RAch, Councilman Homan, Justice Suter, Justice Demarest. This �resolution was declared duly adopted. Supervisor Martocchia: 7: Request by letter from Stephen Hill, property owner .at Cedar Beach, 'Southold, that 'th:e Town of Southold ask -the County of Suffolk to consider dredging the inlet from Pecoriic Bay to Cedar Beach. On motion of Councilman Homan; seconded by Councilman Rich, it was RESOLVED that the Southold Fire Department- 'be and hereby `are' granted permission to- use' Southold- Town.' -roads -.for the purpose of -holding a parade on July 2, 1977-, rain 'date July 39 1977, at 6:00' P.M. , providing the 'Southold Fire Department provides- the proper insurance to hold the Town of Southold harmless. Vote of th& Town Board: ., Ayes: Supervisor Martocchia, Councilman .Rich, Councilman Homan, Justice Suter, Justice Demarest. ` This 'reaolu:tion was declared duly 'adopted'. JAN � 5 1977 170 On motionof Justice Suter;-- seconded- by Justice Demarest', it was RESOLVED that Rule and Regulation 76-4 of -the Southold Town Police Department Regulations be revised by the addition of a new paragraph to wit: "For the purposes of this rule and regulation, time served in a member' s present rank shall have added thereto time served in a higher rank or ranks. " Vote of the Town Board: Ayes: Supervisor -Martocchia; Councilman Rich, Councilman Homan,. Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: 8. There will be a referendum_ held on February 2, 1977 from 12 Noon to 8 P.M. relative to Games of Chance. This vote will be by paper ballot and will be held at the Southold Fire' House and the Fishers Island Fire' House. 9.` Wetland application of Leo Kwasneski, hearing was held on January 11, 1977 - , decision will be made on February 8, 1977. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that $1,500.00 be and• hereby is transferred from the Street Lighting Account to Traffic Control For Street Signs. Vote of the Town Board•: Ayes: Supervisor Martocchia; Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia: -10. Item No'. 3 on the agenda referring to bond releases: many of' the papers are -not• in proper form, therefore there is no action to be taken. 11. With reference to town insurance, the rates have multiplied tremendously, and serious study must be done as even projecting an increase in the budget for 1977 when. it was prepared in September, there will be about $10,000.00 shortage due to the increase in premiums. One policy alone, the umbrella policy, was $3,200.00 for 1976, is now over $9,000.00. 12. Consiu.eration of hiring the firm of Greenman & Pedersen is being studied. This is a consultant firm who aid town boards and highway departments in designing roads, etc. Action will probably be taken at the February 8th me.eting. '. On motion of Justice Suter, seconded by Councilman Homan, • it was RESOLVED that the application of Carl Frelix dated December 24, 1976 for- the renewal of a single family trailer on private road off the north side of Main Road, ' Mattituck, be and hereby is renewed for a period of six (6) months. Vote of the Town Board: ' Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This r:solution was declared duly adopted. On motion of Justice Demarest, seconded by Councilman Homan, WHEREAS the Southold Town Planing Board and Suffolk County Planning Department have prepared official reports and recommendations on the application of Joseph C. Cornell for a change of . zone from "A" Residential and Agricultural District to 11B-1" General Business District on certain property in Peconic, New York, NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held by the Southold Town Board at 3:30 P.M. , Tuesday, February 15, 1977 at the office of the-Supervisor, 16 South Street, Greenport New York on the abovementioned petition, and that the Town Clerk be and she hereby is authorized and directed to cause notice of said hearing to be published in the official newspaper pursuant to the requirements of law. Vote of the Town Board: Ayes-: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. Thisresolution was declared duly adopted. A description of the proposed community center at Peconic was requested.---Supervisor Martocchia stated it is part of the HUD program. It is in two parts, either you apply for low income housing or restoration or recreation. Southold Town chose recreation to see if they could do something for senior citizens and for the youth of Southold Town . for evenings. It is a three, stage project. State one has been completed with a funding of $23,760.00 for land acquisition south of the Peconic School on Peconic Lane. Stage two is in order and only requires an .impact statement; this funding should be received later this month or early February in the amount of $52,000.00. Stage three is in the amount of $93,000.00. A total of $140,000.00 should be received. J:AN 2�5 1977 171 Supervisor Martocchia appointed, the following individuals to serve on an advisory committee for the senior citizen-youth center: Two members from each senior citizen organization, the Southold and Mattituck groups, to be decided upon themselves. Two representatives from each of the three high schools, - Greenport, Southold, .Mattituck-Cutchogue, to be decided upon themselves. The above members will meet with the Town Board for the purpose of input. Supervisor Martocchia has plans for a building 50 ft. by 100 ft. on a cement slab, the 100 ft. facing Peconic Lane. This would be a completed building (turn-key operation) , paneled inside, air-conditioned, heat, tile floor, sanitation facilities for men and women, office space, cloak room, kitchen, possibly one small recreation area and one large one; the large one with accordian doors so it can be divided. Supervisor Martocchia lrs been studying plans from four or five different companies. The Chief of Police is working on an impact statement for traffic; and Sunrise Coach Lines has been contacted and they will make a run past. the building.-- Mrs.. Gladys Csajko asked if there is any, reason why it is limited to senior citizens and youth, what about middle aged people?--- Supervisor Martocchia stated that on the application they had to specify what the building would be for. He is sure there would be spaoeand time available for other groups.---The question was asked if it would also involve very young children also?---The answer was if there is time and space available; there would be no need for it to be empty; the point would be to get maximum use out of it.---Mrs. Csajko asked if the suit being filed against the consortium would affect-the town in any way?---Supervisor Martocchia stated Southold Town is in the clear. They have signed a letter of intent.---Mr. Dan Ruben asked if the town board voted unanimously to go with recreation rather than rehabilitation on the HUD applica- tion?---Supervisor Martocchia stated the entire board voted for it. Further discussion was held between the board and Mr. Cyprus and Mr. . Witschieben regarding the erosion problem at .Sound Beach, Mattituck. . On. motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that there being no further business to come before this Town Board meeting, adjournment be called at 4:10 P.M.
