SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject 18,741 square feet, .43 acre. rectangular-shaped, non- conforming, corner lot located in the Light Industrial (LI) Zoning District measures 150.00 feet along Main Road (NYS Route 25),then runs east 125.00 feet along Pipes Neck Road,then runs south 150.00 feet along an unimproved lot to the east, then returns 125.00 feet along a commercially developed lot to the west. The subject parcel is developed with a one-story wood-frame house with a brick stoop and entry steps,and two attached wood decks each with their own access stairs,a bilco-type cellar access,and two sheds as shown on the survey prepared by Ralph Neil last revised December 1, 2623. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-123 and the Building Ir_spector's May 12, 2025 Notice of Disapproval based on an application for a permit to legalize additions and alterations to an existing single family dwelling; at 1) a nonconforming building containing a nonconforming use shall not be enlarged, reconstructed, structurally altered or moved, unless such building is changed to a conforming use; located at: 68530 Main Road, Greenport,NY. SCTM No. 1000-53-2-1. RELIEF REQUESTED: The applicant requests a variance for the addition of 35 square feet of habitable living space to service an expanded "as-built" bathroom, measuring approximately 4.2 feet by 8.2 feet(to square off the house) a:�d the addition of a 186 square feet `as-built' deck measuring approximately 22.7 feet by 8.2 feet on the residence's southside, for a total of an additional lot coverage of 221 square feet, increasing the level of non-conformity for a single family residence located in,the Light Industrial Zoning District. A residence is not a permitted use in the LI Zone,and unless otherwise altered.to a conforming use,Zoning Board of Appeals relief is necessary for the additions and alterations to the habitable structure. Page 2,August 21,2025 #8025, Pittorino SCTM No. 1000-53-2-1 ADDITIONAL INFORMATION: The applicant provided architectural drawings, including a site plan, labeled A 1.00 through A3.00,A4.02,and A5.00 through A8.00 prepared by Jake LaChapelle,Registered Architect and dated January 9, 2024. Prior Zoning Board of Appeals relief was granted on this parcel in file 92158 dated July 22, 1976 permitting an off -premises directional sign for"Old Oyster Factory Ltd.". This sign no longer exists and it is presumed that the relief granted in this decision is now extinguished. Improvements on the subject parcel are covered by the following Certificates of Occupancy: #Z-6002 dated July 15, 1974 covering an accessory storage building #Z-11297 dated November 16, 1982 covering a seasonal one-family dwelling #Z-17026 dated June 24, 1988 covering the addition of a deck The applicant provided, as part of their application, a copy of the Town of Southold Board of Trustees permit No. 10508 dated December 13, 2023, which includes the following conditions: installation and perpetual maintenance of a 15 feet wide vegetated, non-turf buffer/rain garden to be placed landward of the split rail fence and the removal of the two sheds, among other things. Additionally,a stop work order, dated August 30, 2022 was included in the application. During the site visit it was observed that a hose extended from the cellar,below grade,to a distance of approximately 20 feet from the residence. The applicant's agent offered testimony that this hose is used to drain the sump-pump located in the cellar/crawl space. Furthermore,the applicant's agent indicated that while the subject lot is located in the LI Zoning District(which extends along Main Road from the west side of Kerwin Boulevard,east to Pipes Neck Road), the parcel is more closely associated with Peconic Bay Estates, and the residential lots to the east of the subject, beyond vast preserved wetlands, which are all located in the adjacent residential zoning districts: R80 and R40. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 7, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel has continuously been used as a seasonal residence as supported by the issuance of Certificate of Occupancy #Z-11297, dated November 16, 1982. While located in the LI Zoning District,the residence, was built prior to zoning, and is more in keeping with the character of other residences along Pipes Neck Road and the homes located to the east in Peconic Bay Estates. The modest addition of living space and decking is in keeping with the residential nature of other homes along Main Road. The subject dwelling is screened from view from Main Road by a mature hedgerow and on the opposite side of the other street frontage, Pipes Neck Road, there is a buffer of heavy mature natural vegetation. No adverse visual or other impact will occur as a result of the proposed additions and alterations.Given vast wetlands to the northeast and south, and other residences in the immediate area, a more intensive industrial use of this, small,corner property(leading to a residential, waterfront, neighborhood) would produce an undesirable change in the character of the neighborhood and a detriment to nearby properties. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of zoning, this residence is located in the LI Zoning District,which does not recognize a single-family residence as a permitted use. Any alteration to the existing structure will require some form of Board of Appeals relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However,the structure is covered by an existing Certificate of Occupancy as a seasonal residence and the alterations and additions to the structure are minimal when compared to other residences within the area. If the applicant's parcel was located in a residential zone or the property was re-zoned to allow residences within the LI Zoning District,the applicant would not be before the Zoning Board of Appeals seeking relief. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code.The applicant has obtained a Wetlands Permit from the Town of Southold Board of Trustees and proposes to establish a 15-foot-wide non-turf buffer or raingarden along the property line adjacent to the wetlands. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions, including 35 square feet additional habitable living space and 186 square feet of decking further expanding a non-conforming residential structure within the LI Zoning District,where residences are not a permitted use,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried, to GRANT the variance as applied for, and shown on the Site Plan (Sheet No. A4.02) and Architectural Drawings, sheets labeled A1.00 through A3.00, and A5.00 through A8.00 prepared by Jake LaChapelle, Registered Architect and dated January 9,2024. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. 4. The septic system on the subject property must be approved by the Suffolk County Department of Health Services. 5. The applicant is to apply for and receive a Certificate of Occupancy illustrating the conversion of the structure from a seasonal residence to a year-round dwelling. Town of Southold Board of Trustees conditions, as detailed in Permit No. 10508, are to be maintained. 8. The relief granted in Zoning Board of Appeals file No. 2158 dated July 22, 1976 is extinguished. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year,the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,siteplan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code.
