The meeting was called to order at 1:30 P.M. with the fo�lowing present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Booth. The Board sat at once as committee on Audit to examine claims against the Town concluding the audit work at 2:00 o 'clock P.M. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the minutes of May 20th and May 28th be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That a meeting of the Southold Town. Board will be held at the office of Supervisor Norman E. King of East Marion, N.Y.applied to the Town Board for a change of zone from "A" Residential and .Agriculural District to "B" Business District, and WHEREAS , Mr. King has since withdrawn the Application, NOW, THE EFORE, BE IT RESOLVED: that Supervisor Norman E. Klipp be and he hereby is authorized tnd directed to return to Charles M. King the $25.00 fee which accompanied the petition. Bingle and Anna Bingle have applied to the Town Board fora permit to establish a Tourist Court on their property on the north Road , Greenport, N.Y, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be hold by the Southold Town Board at the Supervisor 's Office in Greenport , on Tuesday, July 89 1958, at 2:30 P.M. on the application of William P. and Anna Bingle for a permit to operate a Tourist Court on their property in Greenport. Vote of Town Board: .Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS , a petition was received from. ;Athanasios and Helen Spinthowiakis , relative to change of zone , NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be -and hereby is directed to transmit this application to the Planning Board in accordance with Section 901, Subdivision C of Article 1X of the Building Zone Ordinance of the Town of Southold, Suffolk County. Moved by Justice Tuthill; seconded by Councilman Albertson; RESOLVED: That General Bills in the amount of $22,217.95, Lighting Dist- rict Bills in the amount of 61,469.80; Fishers Island Gerry District Bills in the amount of $18 155.67 be and the same are hereby ordered paid. Vote of Town Board: Ayes-Supervisor Klipp; Counilmen Albertson and Demarest; Justices Tuthill and Clark. The pliblic hearing on the application of LeRoy and Lorraine Brown for permission to establish a Tourist Court (Camp Cottages) at East Marion was opened by Supervisor Klipp at 2*30 P.M. . He read the call of the hear- ing and then called upon any person present who wished to speak either in favor or against the application. There was no response against the application. Mrs . Brown spoke in favor of the application. The hearing was duly closed at 2:45 P.M. The application was held for further delib- eration of the Board. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS , Chapter 606 of the Laws of 1958 amended the Town Law to pro- vide that a violation of a Zoning Ordinance shall be an offense , and WHEREAK, the Southold Town Building Zone Ordinance provides that a violation thereof shall be a iiisdemeanor , and WHEREAS, it is the desire of this Board -to amend said Ordinance so that the provisions thereof conform to the Town Law, NOW, THEREFORE, BE IT RESOLVED: that there be referred to the Planning Board of the Town of Southold for its. recommendation and official report the following proposal to amend the Building Zone Ordinance of the Toian of Southold, Suffolk County, New York: Section 1. Article X, Section 1012 of the Building Zone Ordinance of. the Town of Southold, Suffolk County, New York is hereby amended to read as follows: SECTION 1012- PENALTIES' For any and every violation of the provisions of this ordinance , the owner, general agent or contractor of a building or premises, where such violations have been committed or shall exist, and the general agent , architect, builder, contractor or any other person who knowingly commits , takes part or assists in any such violation or who maintains any building or premises in. which any such violation shall exist, shall be guilty of an offense . Each week's continued violation shall constitute a separate additional violation® Such fines or penalties shall be collected as like fines are now collected by law. Section 2. Marshut has applied to the Town Board for a single automobile Trailer permit , NOW, THEREFORE, BE IT RESOLVED: That the application of John P. Marshut to locate a single automobile trailer on his property on Minnehaha Blvd . at Laughing Waters , Southold, NY, be and is hereby granted, Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest ; Justices Tuthill and Clark® Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That Supervisor Norman E. Klipp be authorized to advertise for sealed proposald according to specifications for a contract to paint the Town Clerk Building and the buildings at the Southold Town Beach said proposals will be opened by the Town Board at 2:30 P.M. on July A, 1958. Tuthill: RESOLVED: That this meeting be recessed at 11:00 P.M. and be reconvened at the Supervisor 's Office on Friday, June 13 , 1958, at 1:30 P.M. Moved by Councilman Demarest; seconded by Councilman Albertson: WHEREAS , Henry F. Santacroce , a member of the Police Force of the Town of 6outhold, was involved in an accident with a school bus on Route 25 on the 9th day of June, 1958, causing damage to the police car which he was then operating, and WHEREAS,' this was the second accident in which Henry F. Santacroce was involved during his employment as a policeman, and WHEREAS , .the Town Board has examined into the happenings of the accident and has questioned Henry F. Santacroce concerning said accident to determine .the cause thereof, as will as to determine what action should be taken by the Town Board to prevent any future accidents of this nature , and WHEREAS . it was the opinion of the Board that some diciplinary action should be taken in order to deter any future occurances of this nature , NOW, THEREFORE, BE IT RESOLVED: That the said Henry F. Santacroce be and he hereby is assigned to the following duty for the next four weeks: One week on foot patrol; one week in a police car with another police officer operating the car; a further week' s duty as a foot patrolman; and a further week's duty in a police car with another police officer operating the car, after which he hhall be returned to his regular duties . The Chief of Police shall determine the areas to which He.nry F. Santacroce shall be assigned is foot patrolman within the Town. A public hearing was held by the Oouthold Town Board at Village Hall in Greenport on Tuesday, June 17, 1958, with the following present: Councilmen Albertson and Demarest; Justices Tuthill and Clark; Town Attorney Tasker and Town Clerk Booth. This hearing was on the proposal to amend the Building Zone Ordinance of the Town of Southold by changing from "A" Residential and Agricultural District to "B" Business District on a parcel of land situate in ,Southold and a parcel of land situate in Cutchogue , by changing from "A" Residentail and Agric. District to "M" Multiple Residence District on a parcel of land situate at Fleets Neck, Cutchogue, and from "A" Residential and Agric. Dist. to "C" Industrial District on a parcel of land situate at Peconic. Councilman Albertson opened the hearing at 7:30 P.M. . Town Attorney Tasker read the call of the hearing: Councilman Albertson called upon any person present who wished to speak either for .or against the pro- posal to amend the building zone ordinance on the aforesaid parcels of land. The hearing was duly closed at 9:00 P.M. The minutes of this hearing were recorded by George T. Lederle . The Board adjourned to the Supervisor 's Office to hold a Town Board Meeting. Moved by Justice Tuthill; seconded. by Councilman Demarest: WHEREAS , the Town Board, by resolution upon. its own motion on May 28, 1958, has proposed a change , modification and 'amendmert of the Build- ing Zone Ordinance including the Building Zone Maps made a part thereof by changing from "A" Residential and Agricultural District to "B" Business District the property described in said resolution, and WHEREAS , said resolution was duly regerred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said resolution having been duly held by the Town Board on the 17th day of June . 1958, and due deliberation ahving been had thereon, NO11T THTREFORE, BE IT RESOLVED: that the change proposed in said res- olution be and it hereby is adopted. ALL THAT CERTAIN tract or parcel of land , situate , lying and being at Cutchogue , in the Town of ''outhold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at the intersection of the northerly line of Main Road with the westerly line of Alvah 's Lane and running thence westerly along said northerly line of Main Road about 765 feet to land of Josephine Lenceski; thence northerly along said land of Josephine Leneeski 200 feet more or less ; thence easterly on a line para11&1 to and at all points 200 feet northerly from said northerly line of Main Road about 740 feet to the westerly line of said Alvah's Lane; thence southerly along said westerly line of Alvah's Lane 200 feet or more to the point of beginning.
