HomeMy WebLinkAboutTB-05/28/1958 31 MEETING OF MAY 289 1958 r A public hearing was held by the Southold Town Board at Village Hall in Greenport, on Wednesday, May 28, i958, at 7:30 P.M. with the follow- ing present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highw§rys Price; Town Attorney Tasker and Town Clerk Booth. This hearing was on the proposal to amend the Building Zone Ordinance of the Town of Southold by changing from ".A" Residential and Agricultural District to 11M" Multiple Residence District on a parcel of land in Arshamomaque , property of Perry E. Bendicksen and a parcel of land out- side the Village of Greenport , property of Harry Smith, also a Trailer Court, property of Jonathon T. Overton at Southold. The hearing was duly closed at 8:15 P.M. . The minutes of this hearing were recorded by George Lederle. The Board adjourned to the Supervisor 's Office to hold a Town Board meeting Moved by Justice Clark: seconded by Councilman Demarest: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, June 10, 1958, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Justice Clark: WHEREAS, Walter H.. Buckmeyer as chairman of the Bartley Association applied to the Town Board for some financial assistance in the dredging of an outlet to Peconic Bay from James Creek, NOW9 THEREFORE, BE IT RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby is authorized to contribute half of the cost up to but not to exceed the sum of Four Hundred and Fifty Dollars ($450.00) towards the cost of dredging anoutlet to Peconic Bay from James Creek at Mattituck, N.Y. providing they obtain a permit from the Southold Town Trustees , _ Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, it was the request of the Commissioners of the Fishers Island Ferry District that the Town of Southold approve a letter supplemental to a lease with the New York New Hamen and Harfford Railroad Company, lease dated July 309 1954, letter dated April 16, 1958, covering a two-inch cast iron water pipe at New London, Conn, whereby the annual rental of $12.00 as per originally, now, therefore , be it RESOLVED: That Norman E. Klipp, Supervisor, be and hereby is directed to approve of the letter supplement dated April 16, 1958. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor 's Office in Greenport, on Tuesday, June 17, 1958, at 7:30 P.M. on the proposals of the aforesaid property owners. HARRY LISTER for change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on certain real property situate at Fleets Neck, Cutchogue , NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the SoutholdTown Board at the Supervisor's Office in Greenport, on Tuesday, June 17, 1958, at 7:30 P.M. on the proposal of W. HARRY LISTER for change of zone on the aforesaid property. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Justice Clark: WHEREAS, the Southold Town Planning Board has prepared an official report and recommendation upon the proposal of the Southold Town Board for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situate at Southold, extending from a private road west of the Williams property East about 700 feet to the land of Adam Cierach, NOW, THEREFORE, BE IT RESOLVED: That a public hearing. ®ill be held by the Southold Town Board at the Supervisor 's Office in Greenport , on Tueday, June 17, 1958, at 7:30 P.M. on the proposal of the Tom Board for change of zone on the aforesaid property, Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Supt. of Highways Price; seconded by Justice Tuthill: RESOLVED: That inasmuch as the required dedication and release have been duly revived , map of same duly filed and the necessary papers signed, the Town Board take over and ma.iAtain as a public highway GRIFFING STREET, situated at Cutchogue , in the Town of Southold, New York. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS , a petition was heretofore filed with the Town Board of the the Town of Southold by PERRY E. BENDICKSEN requesting a change , modification and amendment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by changing from "A" Residential and Agricultural District to "M" Multiple Residence District the property described in said petition, and .WHEREAS , said petition was duly referred to the Planning Board for its investigation, recommendation and report , and its report having been filed with the Town Board, and thereafter, a public heating in relation to slid petition having been duly held by the Town Board on the 28th day of. ,May, 1958, and due deliberation having been had thereon, NOW, THEREFORE, BE IT RESOLVED: that the relief demanded in said petition be and it hereby is GRANTED. Moved by Councilman Demarest; seconded by Justice Tuthill:- WHEREAS , a petition was heretofore filed with the Town Board of the Town of Southold by HARRY SMITH requesting a change , modification and amendment of the Building Z one Ordinance including the Building Zone Maps made a part thereof by changing from "A" Residential and Agricultural D istrict to 4'M" Multiple Residence District the property described. in said petition, and WHEREAS, said petition was duly referred to the Planning Board for its. investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board on the 28th day of May, 1958, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that the relief demended in said petition, be and it hereby is GRANTED. Vote of Town Board: Ayes-Supervisor Klipp; Couniclman Demarest; Justices Tuthill and Clark. 33 Moved by Justice Tuthill; seconded by Justice Demarest: WHEREAS , Chapter 713 of the Laws of the Slate of New York provides that the Town Board of the Town of Southold, Suffolk County, New York may establish a park district in the Town of Southold to be administered by a separate board of park district commissioners pursuant to the pro- visions of Article '13 of the Town Law, and WHEREAS , the Town Board is now desirous of establishing a park district in said town in accordance with the provisions of Chapter 713 of the Laws of 1958, and the appropriate provisions of Article 12 of the Town Law, NOW, THEREFORE, BE IT RESOLVED 1. That the Town Board of the Town of Southold does hereby establish a park district ih the Town of Southold to be known as THE CUTCHOGUEw NEW SUFFOLK PARK DISTRICT. 2. That the boundaries of said district shall be as described in a detailed description attached hereto, whidh boundaries are intended to coincide with the present boundaries of the Cutchogue Fire District. 3 . Thatthe affairs of said park district shall be administered by the Town Board of Southold until the first annual election of a separate board of commissioners of said park district. 4. That after the first annual election of commissioners of the park district pursuant to Article 13 of the Town Law,. the provisions of Article 13 of the Town Law shall be applicable to such park district and the affairs thereof shall be administered in the manner therein provided. 5. That this resolution is adopted subject to a permissive referendum pursuant to the provisions of Section 91 of the Town Law. AMENDMENT NO. 18 NOTICE OF AMENDMENT OF ZONING ORDINANCE - AMENDMENT NO. 18 NOTICE IS HEREBY GIVEN that after a public hearing held pursuant to the requirements of Law, the Building Zone Ordinance (including the Building Zone Maps) of the Town of 0outhold, Suffolk County New York, was duly amended at a regular meeting of the Southold Town Lard, on May 28, 1958, as follows: 1. By changing from "A" Residential and Agricultural District to "M" Multiple Residence District the following described property: ALL that tract or parcel of land, situate, lying and being at Arshamomaque in the Town of Southold, L'ounty of Suffolk, and State of New York, bounded and described as follows: North by land now or formerly of John Hoffman and Mackie; east by land now or formerly of John Mackie; South by North Road; and West by Arsh-. amomaque Chapel and land now or formerly of John Hoffman.. 2. By changing from "A" Residential and Agriculural District to 1°M" Multiple Residence District, the following described property: ALL That tract or parcel of land lying and being situate near the Village of Greenport in the Town of Southold, County of Suffolk and State of New York and being more particularly bounded and described as follows: Beginning at the southwesterly corner of the premises herein described and being the point - of intersection formed by the easterly line of the land conveyed by Arthur M. Joost to Harry H. Reeve and the northerly line of North Road; running thence in a general northerly direction along the said easterly line of the land of said Harry H.
