The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilmen .Albertson and Demarest; Justices Tuthill and Clark; Supt.-of Highways Price and Town Clerk Booth. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of May 6, 1.958 be , and hereby are 'duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justices Tuthill and Clark. - _ Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVED: That a meeting of the Town Board will be held at the office of Supervisor Norman E. Klipp at Greenport , on Wednesday, May 28, 1958, at 7:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, LEROY and LORRAINE BROWN have applied to the Town Board for a permit to establish a Tourist Court (Camp Cottages) on their property on the North side of the Miin Road in East Marion, N.Y. , NOW THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor 's Office in Greenport, on Tuesday, June 10, 1958, at 2:30 P.M. on the application of LEROY and LORRAINE BROWN for a permit to operate a Tourist Court on their property in East Marion, NY. Vote of Town. Board: .Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Albertson; WHEREAS, THERESE A. LINDSAY\phas been employed in the office of the Supervisor of the Town of Southold, New York, for many years , and WHEREAS, Therese A. Lindsay holds a Civil Service classification as Senior Account Clerk and has been a valued employeeof the Town of Southold, and WHEREAS, Therese A . Lindsay has requested a leave of absence, NOW, THEREFORE, BE IT RESOLVED: That effective as of June 1, -1958, Therese A . Lindsay be granted a one-year leave of absence without pay, Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Justice Clark: WHEREAS, Mrs . Norman H. Knapp as president of the Wunneweta P and Association applied to :she Town Board for some financial assistance in dredging the Wunneweta Pond Inlet, now, therefore, be it RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby is authorized to contribute half of the cost up to byt not to exceed the sum of Three Hundred Thirty Dollars ($330.00) twards the cost of dredging the Wunneweta Pond Inlet at Nassau Point, Cutchogue, Town of Southold, N.Y, providing . they obtain a permit from the Southold Town Trustees. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by. Justice Clark: WHEREAS, Mr. W. HARRY LISTER, as president of Boatmen's Harbor Inc. applied to the Town Board for some financial assistance in dredging the ' entrance to Wickham's Creek, now, therefore, be it RESOLVED: That Norman E. Klipp; Supervisor, be and he hereby is authorized to contribute the sum of Three Hundred and fifty dollars ($350.00) twards the cost of dredging the entrance to Wickham's Creek at Fleets Neck', Cutchogue , Town of Southold, N.Y. , providing they obtain a permit from the Southold Town Ttustees. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, DONALD MUIRHEAD has applied to the Town Board for a single automo- bile trailer permit, NOW, THEREFORE, BE IT RESOLVED: That the application of Donald Muirhead to locate a single automobile trailer on his property at the intersection of Sterling Street and The gloaming, at Fishers Island, N.Y. be and hereby is granted. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen 'Albertson and Demarest and Justices Tuthill and Clark. 27 Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, ROSWELL COOX has applied to the Town Board for a single auto- mobile trailer permit , NOW, THEREFORE, BE IT RESOLVED: That the application of Roswell Cook to locate a single automobile trailer on the property owned by James. Warnaka , Main Road, Southold, N.Y. be and hereby is granted. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS, a petition was received from W. HARRY LISTER, relative to change of zone, now, therefore, be it RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 901, subdivision C of Article lk of the Build- ing Zone Ordinance of the Town of Southold,'Suffolk County, New YRrk. Moved by Councilman Albertson; seconded by Councilman Demarest: No. 4 BUDGET NOTE 1958 The TOWN OF SOUTHOLD, in the County of Suffolk, State of New York, hereby acknowledges itself indebted and for value received promises to pay The North Fork Bank & Trust Co. , Mattituck, N.Y. the sum of SEVENTEEN HUNDRED ($19700.00) DOLLARS on the 20th day of May, 1959, together with interest thereon from the date hereof at the rate of three per centum (3%) per annum, payable at maturity. Both principal of and interest on this note will be paid in lawful money of the United States of America , at the Office of the Supervisor, Greenport , Suffolk County, New York. This note may not be converted to registered form. This note is the only note of an authorized .issue in the amount of Seventeen Hundred ($1,700.00) Dollars . This note is issued pursuant to the provisions of a resolution entitled "Budget Mote Resolution Dated May 20, 1958, authorizing the Issuance of a Budget Note .of the Town of Southold, Suffolk County, .New York, in the amount of $1,700.00 to pay the Town's Share of Retroactive Social Security Covera e°B , which resolution was duly adopted by the Town Board of. the Town of gouthold on May 20, 1958, and the privilege is hereby reserved by the Town of Southold to prepay the whole or any part of the unpaid balance of the principal sum hereof at any time wihtoutpenalty. The faith and credit of the Town of Southold are hereby irrevocably pledged for the punctual payment of the principal of and interest on this note according to its terms. It is hereby certified and recited that all conditions , acts and things required by the Constitution and statutes of the State of New York to _exist, to have happened and to have performed precedent to and in the issuance of this note , exist, have happendd and have been performed .and that this note, together with all other indebtedness of such Town of Southold is within every debt and other limit prescribed by the Constitution and the lass of such State. NOTE RESOLUTION DATED MAY 209 1958, AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, HUFFOLK COUNTY,, NEW YORK, IN THE AMOUNT OF $1,700.00 TO PAY THE TOWN'S SHARE OF RETROACTIVE SOCIAL SECURITY-COVERAGE. BE IT RESOLVED: this 20th day of May, 1958, by the Town Board of the Town of Southold, Suffolk County, New Y rk, as follows: SECTION 1. That, pursuant to the provisions of subdivision (n) of Section 29.00 of the Local Finance Law of the State of New York, for the purpose of paying the Town's share of the cost of retroactive social security coverage provided to its policemen pursuant to Section 138-a of the Retivoment and Social Security Law of the State of New York, the same being .an expenditure for which no provision has been made in the current annual budget of the Town of Southold, there is hereby authorized to be issued a Budget Note of the Town of Southold in the principal sum of $1,700.00 which is the maximum cost of such object or purpose, which note shall mature on May 20, 19 59. SECTION 2. That, except as herein specified,, said note shall be of the date, terms , form, contents and plAce of payment, and at a rate of intee- est not exceeding three and one-half (32) per centum per annum, as may be determined by the Town Supervisor, ' consistent; , however, with the pro- visions of the said Local FiBance Law. of the. State of. New York, and shall be executed in the name of the 'Town of Southold by its Supervisor, and, the seal of said Town shall be attached thereto. SECTION 3. That said hote shall be sold at private . sale by the Town Supervisor at a. price of not less than par .value. and accrued interest, if any, and upon the due execution and s6le .of said. note, the same shall be delivered to the purchaser upon the payment by him to the Town. Super- vtsor of the purchase price in cash; and the receipt of such Supervisor shall be a full acquit%ance to such purchaser who shall not be obliged to' see to the application -of the purchase money. SECTION 4. The faith and credit of the Town of Southold are hereby irrevocably pledged for the payment of the principal of and interest on said note. SECTION 5. This resolution shall take effect immediately. The question of. the adoption of the foregoing resolution was duly put ..: to a vote which resulted as follows:- Ayes-Supervisor Norman E. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, a petition was heretofore filed with the Town Board of the Town of Southold, by HENRY G.-AND EVY C. STENSEN requesting a change, modif- ication and amendment of the Building Zone Ordinance including the Build- ing Zone Maps made a part thereof by changing from- "A" Agric. & Residential District to "B" Business District the property described in said petition, and WHEREAS, said petition was duly referred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter , a public hearing in relation to said petition having been held by the Town Board on the 21st day of January, 1958, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that the relief demanded in said petition be, and it hereby is GRANTED. AMENDYTELI 12 NOTICE IS HEREBY GIVEN that after a public hearing held pursuant to the requirements of Law, the Building Zone Ordinance (including the Building Zone Maps) of the Town of Southold, Suffolk County, New York, wqs duly amended at a regular meeting of the Southold Town Board on May 20th, 19579 as follows: By changing from "A" Residential and Agricultural District to "B" Business District, the following described property: -ALL that certain real property situate at Mattituck, in the Town of Southold, County of Suffolk and State of New York bounded and described as follows: Beginning at concrete monument set on the southerly. line of Mill Road at the northwesterly corner of land of George G. Terry Estate,, and running thence along the land last mentioned south 4 degrees 36 minutes 20 seconds east 367. 55 feet more or less to the shore of Mat.tituck Creek; thence north- easterly along the shore of Mattituck Creek a distance of 513 feet more or less to the southerly line of Mill Road';,; thence along the southerly , line of Mill Road, two courses 'as follows: (1) North 73 degrees 24 minutes 40 seconds east 125.0 feet; thence (2) South 85 degrees 05 minutes 20 seconds east 166.70 feet to a concrete monument and the point or place of befinning.
