MEETING OF MAY 6, 1958.
The Southold Town Board met at the office of Supervisor Norman E.
Klipp in Greenport, on Tuesday, May 6, 1958. The meeting was called
to order at 1:30 P.M. with the following present: Supervisor Klipp-
,-Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supi.
of Highways Price; Town Attorney Tasker and Town Clerk Booth.
The Board sat as a committee on Audit to examine claims against the
Town concluding the audit work at 2:20 P.M.
Moved by Justice Clark; seconded by Councilman Albertson:
RESOLVED: That the minutes of April 29, 1958, be and hereby are duly
approved as read.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Councilman Demarest:
RESOLVED: That the regular monthly meeting of--this Board will be
held at- the office of Supervisor Norman E. Klipp at Greenport, on
Tuesday, May 20, 1958, at 1:30 PSI:
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Clark:
WHEREAS , There is a vacancy in the office of Town Assessor caused
by the death of Ernest W. Morrell,
WHEREAS, It is the desire of the Town Board., Town of Southold, to fill
such vacancy,
NOW, THERREFORE, BE IT RESOLVED: That Edward W. Fox, of Cutchogue,
New York, be and he hereby is appointed Southold Town Assessor, to
hold such office until the commencement of the calendar year next
succeeding the first annual election at which the vacancy may be
filled, and be it further
RESOLVED: That Edward W. Fox be compensated for such position at the
rate of $2,800.00 per year, payable in regular monthly installments ,
and be it further
RESOLVED: That the Town Clerk be instructed to file such certificate
with the proper parties as required by Section 30, Sub-division 3
of the Town Law, and be it further
RESOLVED:. That this appointment become effective as of May 6, 1958.

WHEREAS, a resolution adopted on the 9th day of April, 1957, the Town
'Board authorized the Supervisor to proceed with negotiations for the
aquisition of a 32-acre tract of land then. owned by the Estate of
' Mary L. Dayton and
WHEREAS, said tract of land has since been sold to other persons,
NOW, THEREFORE, BE IT RESOLVED: That the authority conferred upon the
Supervisor by said resolution be and it hereby is rescinded.

WHEREAS, Harold Price has pppliedto the Town Board for a single auto-
mobile trailer permit,
NOW, THEREFORE, BE IT RESOLVED: That the application of .HAROLD PRICE
to locate a single automobile trailer on his property on Bay Avenue,
Peconic, N.Y. be and hereby is granted.

Demarest; Justices Tuthill and Clark.

WHEREAS, Edward C. Taborsky has applied to the Town Board for a single
automobile trailer permit,
NOW, THEREFORE, BE. IT RESOLVED: That the application of EDWARD C.
TABORSKY to locate a single automobile trailer on his property on
Depp Hole Drive, at Mattituck, N.Y. be and hereby is granted.

Demarest; Justices Tuthill and `Clark.

WHEREAS, JONATHON T. OVERTON has applied to the Town Board for a .permit
to establish a trailer court on his property on the south side' of. Terry
Lane, in Southold , N.Y. '
NOW THEREFORE,- BE IT RESOLVED: That ,a, public hearing will be held by: the
Southold Town Board at the Supervisor's Office in Greenport , on Wednesday,
May 28, 19589 at 7:30 P.M. on the application of JONATHON T. OV.ERTON for
a permit to operate a . trailer court.

WHEREAS, a petition was received from ANGELO G. PETRUCCI and GEORGETTE

NOW . THEREFORE BE IT RESOLVED: That the Town- Clerk:of the -Town of
Southold be ana he hereby is directed to transmit this -application to
the Planning ,Board in accordance - with Section 901 Subdivision C_.of Article
1X of the Building Zone Ordinance of the Town of Southold.

NOW, THEREFORE, , BE IT RESOLVED.z.: That the Town Clerk of the Town of Southold
be and he hereby: is directed to transmit this application to the Planning
Board in -.,accordance with Section 901, Subdivision C of Article 1X of the
Building Zone Ordinance of .the- Town of Southold.

WHEREAS, a request was received to rezone property along Route 25 in the
vivinity of Peconic End Cutchogue from "A" Residential and Agricultural
District to "B" Business District ,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town' of Southold.
be and he hereby is directed to transmit this request to the Planning Board
in accordance with Section 901 subdivision C of Article 1X od the Build-
Zone Ordinance of the Town of Southold.

and recommendation upon the petition of HARRY SMITH for a change of zone

District on certain real property situate west of the Village of Greenport,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the
Southold Town Board at the Supervisor 's Office in Greenport, on Wednesday,
May 28, 1958, at 7:30 P.M. on the proposal of HARRY SMITH for a changeof
zone on the aforesaid property.

Demarest; Justices Tuthill and Clark.

WHEREAS, the Southold Town Planning Board has prepared an official report
and recommendation upon the petition of PERRY E. BENDICKSEN for a change
of zone from "A" Residential and Agric. District to "M" Multiple Residence
D istrict on certain real property situate at Arshamomaque,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by
the Southold Town Board at Supervisor .Klipp's Office in Greenport, on
Wednesday, May 28, 1958, at 7:30 P.M. on the proposal of PERRY E. BENDICKSE
for a change of zone on the aforesaid property.

RESOLVED: That General Bills in the amount of $4,155.29; Lighting.,District
Bills in the amount of $1,639.80; Fishers Island Ferry Dis:tbict"Bills in
the amount of $56,022.23 be and hereby are ordered paid.

RESOLVED: That the Police Report 'for the month -of April be 'accepted
by the Town Board and placed on file.

WHEREAS ,' WOODHOLLOW PROPERTIES, INC.-, Walter Uhl, Vide-President, has
made application to the Town Board for the establishment of an Open
Development Area pursuant to .the provisions of "Section 280-A of the.
Town Law, and
WHEREAS, the Town Board has heretofore referred the matter to the Plan-
ning Board for 'its advice and recommendation, and-
WHEREAS, the Planning' Board has recommended that the application of
WOODHOLLOW PORPERTIES� INC. , be 'granted,
NOW, THEREFORE, BE IT RESOLVED: that the- Town Board of ,the Town of
Southold does hereby establish an Open Development Area over the prop-
erty of WOODHOLLOW PROPERTIES, INC. as shown forth on the map attached
to the Application.

Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Clark:
WHEREAS, ALEXANDER W. and. FREDERICK C. KOKE have made application to
the Town Board for the' ,establishment of an Open Development Area
-.pursuant to the provisions of Section 286-A of the Town Law- -and'
WHEREAS, the- Town Board has heretofore referred the matter to the -
Planning Board for its advice and recommendation, and' - :
WHEREAS , the Planning Board has recommended that the application of
ALEXANDER W. and FREDERICK C. KOKE be granted,
NOW, THEREFORE, BE IT RESOLVED: that the Town Board of the Town of
, ,Southold .does hereby establish an Open Development Area over the prop-
erty of .ALEXANDER W. and FREDERICK C. KOKE as shown forth on the map
attached to the application.
