MEETING OF APRIL 14, 1958.
The Southold Town Board met at the office of Supervisor Norman E.
Klipp at Greenport , on Monday, April 14, 1958, at Greenport. The
meeting was called to order at 7:30 ' P.M: with the following present:
Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill
:and Clark; Town Attorney Tasker and Town Clerk Booth.
'Moved by Councilman Albertson; seconded by Justice Tuthill:
RESOLVED: That the regular monthly Town Board meeting will be
held at the office of Supervisor Norman E. Klipp at Greenport, on
A pril 29, 1958, at 1:30 P.M.
Vote of Town Board: .Ayes-Supervisor Klipp; Councilmen 1'lbertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Tuthill:
WHEREAS , a petition was filed by ELLSWORTH AND WINIFRED GRATHWOHL
for a change of zone on certain real property situate at NIS of
Main Road, Southold,
Now, Therefore, Be It Resolved: That this petition be held in
abeyance until such time that the Williams property which is the
West boundary of siad property can be included.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; .seconded by Councilman Demarest:
WHEREAS , ARNOLD S . SACKS , of Mattituck, applied to the Board of
Appeals to establish a labor camp on the south side of Sound Ave-
, Mattituck, this application was denied,
NOW, THEREFORE, BE IT RESOLVED: That Supervisor Norman ,-I�. Klipp
be and he hereby is authorized and directed to return to William
Wickham, Attorney for Mr. Sacks , the 'Ten Dollars ($10.00) fee for
Building Permit which accompanied the petition.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Clark:
RESOLVED: That the Town Board- accept the following action which
was taken by the Southold Town Planning Board:
In the matter of storage of dynamite the Planning Board recommends
to the Town Board _a pplications for storage build-
ings for dynamite or high explosives that such cases be handled
by the Board of Appeals=,as a Special Exception.

Demarest; Justices Tuthill and Clark. '

WHEREAS , the Southold Town Planning Board' has prepared an offic ial
report and recommendation upon the petition of -Constance Kendrick
Overton for a change of zone from "A" .Residential and agre. Dist.
to 'B ' Business Dist. on certain real property situate at' Cutchogue ,
NOW, THEREFORE BE IT RESOLVED: That a public hearing will be held
by the Southold Town Board at the Supervisor 's Office in Greenport,
on Tuesday, April 29, 1958, at 2:00 P.M. on the proposal of Constance
Kendrick Overton.
Vote of Town Board: .Ayes-Supervisor Klipp; ' Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Demarest: Seconded by Justice Tuthill:
WHEREAS , the Southold Town Planning Board has prepared an official
report and recommendation upon the petition of JOHN WICKHAM for a
change of zone from "A" Residential and Agric. Dist. to "B" Business
Dist. on certain real property situate at Cutchogue ,
NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held
by the Southold Town Board at the Supervisor 's Office in Greenport ,
on Tuesday, .A pril 29, 1958, at 2:00 P.M. on the proposal of John
Wickham.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and
Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Councilman Demarest:
UTEREA.S,. the Town Board received a communication drom WOODHOLLOW PROP
ERTIES , INC . , relative to access to Orient By the Sea , at Orient , N. Y.
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk be and he hereby is
directed to transmit this communication to the Southold Town Planning Board.
Vote of Toian Board: Ayes-' Supervisor Klipp; Councilmen -Albertson and
Demarest; Justices Tuthill and Clark.
The public hearing wa-s opened at 7:30 P.M. on the proposal to amend the
Tourist Camp, House 'Trailer Camp, House Trailer and Similar Establish®
mentq , also change o zone from "A" Residential and Agric. Dist. to "B"
Business District on a parcel of real property situate at Arshamomaque,
Town of Southold, N.Y.
The minutes of this hearing were recorded ' by George T. Lederle.
Moved by ' Justice Clark; seconded by Councilman Demarest:
WHEREAS , a petition was heretofore filed with the Town Board of the
Town of Southold by CHARLES S. SAGE and B. S . GARDE requesting a change,
modification and amendment of the Building Zone Ordinance including the
Building Zone maps made a part of thereof by changing from "A" Residentidl
and Agricultural District to "B" Business District the property described
in said petition, and ,
WHEREAS, said petition was duly referred to the Planning Board for its
investigation, recommendation and report , and its report having been filed
with the Town Board, and thereafter, a public heating in relation to
said petition having been duly helad by the Town Board on the 14th day
of April, 1958, and due deliberation having.. been had thereon
NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition
beg and it hereby .is granted,®

Moved by Councilman Albertson; seconded by Justice Clark:
WHEREAS , THE Own Board adopted a resolution on March 25, 1958 providing
for a public hearing on 'proposals to amend the Southold Town Ordinance
entitled "Southold Town Ordinance providing .for the Regulation of Tourist
Camps . House Trailer Camps, House Tr-ailersli or similar Establishments10 ,
and
WHEREAS , said hearing was held on April 49 1958, after due not&ce , now
therefore be it
RESOLVED: That said Ordinance ' be and it hereby is amended as follows:
1. By amending Section 2 of said Ordinance to read as follows:
Section 2. It shall be unlawful for any. parson, .persons , firms , assoc-
iations , corporations, or co-partnership to establish or operate with-
in the limits of. the Town of Southold, any tourist .camp on any location
or plot of ground for use of transients by the day, wdek, month or xa
season, whether a charge is or is not made, who does not possess a
permit from the Department of Health and the Town Board, of the Town of
Southold. Such permit shall not be transferable or assignable. All
Town. Board permits may be revoked foD cause by such Board after a hearing.
2. By amending Section 19 of said Ordinance to' read as follows:
Section 19. On every Trailer Camp, a suitable planting shall be erected
and maintained to screen . the .Trailer Camp from public lans and public
highways . Such planting shall be not less than five ( 5) feet high, the
location of which shall be approved by the Town Board.
3. By amending Section 20 of said Ordinance to read as follows:
Section 20. Each applicatton for a permit shall .be accompanied by a fee
of Twenty-five ($25.00) Dollars. Upon receipt of an application for a
permit `providedin this Ordinance , the Town Clerk shall cause a notice
of Public hearing thereon, specifying the time and place thereof, to
be published once in a newspaper published in the Town at least 10
days before the day of the hearing.
4. By amending Section 21 of said Ordinance to read as follows:
Section 21. This Ordinance shall not apply to any territory included
within the limits of the incorporated Villa e of Greenport,

NOTICE IS HEREBY GIVEN that after a public hearing .held pursuant
to the requirements of law, -the Building Zone Ordinance (including
the Building Zone Maps) of the Town of Southold, Suffolk County,
New York was dul amended at a regular meeting of the Southold Town
Board' on _April 1 , 19.58, as follows:
By changing from "A" Residential and .Agricultural District to
"B" Business District, the following described property:
ALL that tract or parcel of land, situate, lying and being at Arsh
amomaque , in the Town of Southold, County of Suffolk?. State of New
York, bounded and described as follows:-Northerly and westerly by
Main Road (Route 25) to a depth of 200 feet; norhterly and easterly
by land of Long Island Railroad; southerly, bydother land of Charles
S . Sage and B. S. Garde, and westerly by land of Carrol Sledjeski.
