Klipp at Greenport, on Tuesday, ' March 25, 1958.- The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Booth. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of March 11, be and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; "ounilmen Albertson and Demarest Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Albertson; RESOLVED: That the regular monthly Audit Meeting of this Board will be held at the office of Supervisor Norman E. Klipp; at Greenport, on Ruesday, April 8, 1958, at 1:30 P.M. Vote of Town Board: .Ayes-Supervisor Klipp; ouncilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to install twelve (12) new Mercury lights in the Southold Lighting District as follows: Remove lights on poles Nos. 3 ,4 and 6 on Oak Lawn Avenue and on poles Nos. 75, 3699 3719 3739 3782, 3799 3859 756 and 741 on the Main Road, Install twelve (12) new mercury 600 cp lights on Poles -Nos . 3, 4 and 6 on oak Lawn Avenue and on Poles 36�+, 3699 3719 3739 3749 3859 7669 756 and 741 on the Main Road. At 2 o 'clock P.M. in accordance with a notice published according to law, bids were opened nor proposals to furnish to the Town of Southold four new 1958 2-door sedan 8 cylinder standard model automobiles for use as police cars , 'also five new 1958 2-door sedan 8 cylinder standard model automobiles for use as police ears. Klipp, Supervisor, be and he hereby is directed to enter into a contract with the Cutchogue Auto Sales for the purchase of five new 1958 2-door sedan standard model 8-cylinder automobiles at a total price of $5,650.00 to be delivered at the Police Dqpartment in Peconic, L.I. , in 30 days. Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVED: That pursuant to Article 271 of the Town Law, Archibald N. Young of Southold, N.Y. be and he hereby is appointed a member of the Planning Board of the Town of Southold until April 30, 19611 to fill the unexpired term of T. Paul Montgomery. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen .Albertson and Demarest and Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby is author- ized to place a full page advertisement in the brochure pfxblished by the Greenport-Southold Chamber of Commerce , the amount of said advert- isement not to exceed the sum of $125.00. Moved by Councilman Albettson; seconded by Justice Tuthill: RESOLVED: That Harold Price , Supt. of Highways of the Town of Southold, be authorized to make the necessary alterations on that portion of the sidewalk adjacent to the property of Henry Fisher and David DeFriest the property owners to pay cost of Ready Mix Concrete. Koke and Frederick C. Koke to establish an Open Develppment Area through their property at Bay View, Southold, N.Y. that upon the recommendation of the Planning Board it was decided by the Town Board .to return the application to have the corrections .mdde as the Planning Board recommended. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of Winifred and Ellsworth Grathwohl for a change of zone from "A" Residential and Agricultural District to "B" Business District on.-certain real property situate at Southold and t he petition of Charles S . S_ge and B. S . Garde for a change of zone from "A" Residential and .Agricultural District to "B" Business District on certain real property situate at Arshamomaque NOW THEEFORE, BE IT RESOLVED: TY}at a public hearing will be held by the Southold Town Board at the Supervisor's Office at Greenport-, on Monday, April 14, 1958, at 7:30 P.M. on the above mentioned proposals. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the Town Board of the Town of Southold approves the action of the Commissioners of the Fishers Island Ferry District on entering into a contract with the Thames Shipyard, New Londoid, Conn. for the install- ation of engines on the Mystic Isle in accordance with the contract pre- pared by DeWight S. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS,; a petition was heretofore filed with the Town Board of the Town of ''outhold by JOHN A . MUIR, GEORGE G. MUIR and A . B. ROSENBERG requesting a change, modification and amendment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by changing from "A" Residential & Agric. District to "B" Business District the proper- ty described in said petition, and WHEREAS, said petition was duly referred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board 6n the 25th day of Nov. 1957, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED: THAT THE RELIEF 'DEMANDED IN SAID PETITION be , and it hereby is denied. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, PARADISE SHORES ASSOCIATION, INC. % Mr. Thomas Lar.ck has made application to the Town Board for the establishment of an OPEN DEVELOPMENT AREA pursuant to *the provisions, of Section 280-A of the Town Law, and WHEREAS, the Town Board has heretofore referred the matter to the Planning Board for its advice , NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold does hereby deny an OPEN DEVELOPEMENT .AREA over the premises of PARADISE SHORES ASSOCIATION, INC.. Moved by Justice Tuthill;seconded by Councilman Demarest: WHEREAS, the Town Superintendent of Highways did, on the llth day of March. 1958, duly recommend the purchase of certain equipment pursuant to the provisions of Section 142 of the Highway Law, NOW, THErEFORE, BE IT RESOLVED that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways is hereby authorized, to purchase in accordance with the provisions of Article 5-.A of the General Municipal Law, with the approval of the County Superintendent of Highways , the following: One Nelson Model Q-11 Heavy Duty Bucket Loader with Rotary Screen and all standard equipment , plus scrub brushes on screen for a maximum price . of Twelve Thousand Eight Hundred Thirty Dollars ($12,830.00) delivered at Peconic, , N.Y. and to be delivered on or about May 1st, 1958. The Town Superintendent of Highways is hereby authorized 9 subject to the approval of the County Superintendent of Highways , to surrender to the vendor One Model Q-11 Nelson Bucket Loader with Rotary screen as part payment for the above equipment to be purchased. The terms of payment will be as follows: Trade-in allowance-------------------------------$ 2,830.00 Check drawn on Machinery Fund-®------------------ 10.000.00 Total $121 30.00 A contract of purchase for the item purchased shall be duly executed between the Town Superintendent of Highwqys and such -vendor, and when duly approved by the County Superintendent of Highways , it shall become effective. When such contract has been duly executed and approved , the Supervisor is authorized to complete such purchase upon delivery of the item purchase in accordance with the terms of such resolution and such contract , and to pay the above amount specified to 'be paid by a check drawn on the Machinery Fund for $109000.00. Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS, it is the desire of the Town Board to amend the Southold Town Oddinance Providing for the Regulation of Tourists 'Camps , HouB Trailers House Trailer Camps , or Similar .Establishments adopted on June 30, 1953 ) NOW, THEREFORE, BE IT RESOLVED: That this Board shall hold a public hearing for the purpose of amending said Ordinance , and that such hear- ing shall beheld at the Supervisor 's Office, 16 South S.-reet, Greenport, New Y rk, on the 14th day of April, 1958, at 7:30 P.M. and it is further RESOLED: That the Town Clerk cause a notice of said proposed hearing containing a copy of the proposed amendments to said Ordinance , to be published- in the Long Island Traveler-Mattituck Watchman the official Town paper at least 10 days before the date of said hearing. A RESOLUTION PROVIDING FOR THE DETAILS AND AUTHORIZING THE SALE OF AN $189000 STATUTORY SNSTALLMENT BOND OF THE- TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, HERETOFORE .AUTHORIZED FOR THE PURCHASE OF A WALTER SNOW FIGHTER FOR SAID TOWN.. WHEREAS , the . Town Board of the Town of Southold, Suffolk County' New York, adopted a bond resolution on March 11, 1958 authorizing the issu- of $18,000 serial bonds of said Town for the purchase of highway equipment , consisting of a Walter Snow Fighter, for said Town, and WHEREAS, it is now desired to provide for thh details and sale of said bonds ; NOW, THEREFORE, BE IT RtESOLVED: . by the Town Board of the Town of "outhold, Suffolk County, New York, as follows: SECTION 1. The $18,000 serial bonds described in the foregoing preambles shall be issued in the form of a statutory installment bond , to be des- ignated substantially HIGHWAY EQUIPMENT (SERIAL) BOND, 1958, shall be dated March 25, 1958, shall be in the denomination of $18,000, shall provide for the payment of such principal sum .of $18,000 as follows: $3 ,000 on March 25 in each of the years 1959 and 1960, and $4,000 on March 25 in each of the years 1961 to 1963 , both inclusive, and shall bear interest at the rate of three per centum (3%) per annum, payable semi-annually September 25 and March 25. Both principal of and interest on such statutory installment Bond will be payable in lawgul money of the United States of .America , at the First National Bank of Greenport, in Greenport, New York. Such Statutory installment bond shall be signed in the name of said Town by its Supervisor, sealed with its .eorporate seal, attested by its Town Clerk, and shall be in substantially . the following form, to wit: SECTION 2. All other matterq , except as provided herein, relating to such statutory installment bond , shall be determined by the Supervsor, and such statutory installment bond shall be in terms , form, and contents substant- ially as provided in Section 62,10 of the Local Finance Law. SECTION 1. It is hereby determined that subdivision 28 of paragraph a of Section ll.Q0 of the Local Finance Law applies to such object or pur- pose , and that .the period of probable usefulness thereof is five years , computed from March 255 1958, there having been no bond anticipption notes issued in anticipation of such bond. SECTION 4. The faith and credit of the Town of Southold, New York, are hereby irrevocably pledged to the payment of the principal of and inter- est on such bond as the same respectively becomes due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bond becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Town of Southold, New York, a tax sufficient to pay the principal , of and interest on such bond as the same become due and apyable , SECTION 5. Pursuant to the provision of Paragraph b of Section 63 .00 of the Local Finance Law, as last amended , said statutory installment bond hereby sold at private sale to the First National Bank of Greenport, in Greenport, New York, at par and accrued interest, if any, it being hereby determined that the total amount of bonds sold by said Town at private sale in accordance with the provisions of siad paragraph b of Section 63 .00 of the Local Finnace Law for its current fiscal year is not in excess of $40.000. The receipt of the Supervisor sahll be a full acquittance to the purchase. of such statutory installment bond, who shall not be obliged. to see to the application of the purchase money. SECTION 6.
