HomeMy WebLinkAboutTB-03/11/1958 MEETING OF MARCH 11, 1958. The Southold Town Board met at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, March 11, 1958. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilman Albertson and Demarest; Justices Tuthill, Clark and Edwards; Superintendent of Highways Price; Town Attorney Tasker and Town Clerk Booth. The Board sat at once as a committee on audit to examine claims against the Town, concluding the audit work at 2:00 o 'clock P.M. Mr. George L. Penny, 3rd, and five Boy Scouts of Mattituck attended . the meeting. Their purpose was to acquire some knowledge of how the Town Government is conducted. Supervisor Klipp introduced them to the Town Officers and explained to them the duty of each officer. He then gave them an excellent detailed account of the way the Town Government is managed. Moved by Justice Clark: seconded by Councilman Demarest: RESOLVED: That the minutes of the meeting of FEbruary 25 be and here- by are approved as read. Vote of Town Board:Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards. Moved by Jostice - Clark; seconded by Councilman Albertson; RESOLVED: That the regular monthly meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, March 25, 1958, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards. Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS , Charles 0. and Florence A. Ziegler have applied to the Town Bo*rd for a permit to operate a Trailer Camp for the year 1958, and- WHEREAS, the Building Inspector has stated that the Trailer Camp Ordinance requirements of Charles and Florence Ziegler are substant- ially complied with, NOW, THEREFORE, BE IT RESOLVED: That the Town Board does hereby grant a permit to Charles 0. and Florence A. Ziegler to operate a Trailer Camp at East Marion, N.Y. for the year 1958, providing that they do not have more than three trailers at the camp. Vote of Town Board: Ayes-Supervisor Klipp; councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the decision of the Town Board is not to acquire space for advertising Southold Town in this year's Vacation Guide. Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That in accordance with S ction 29, Paragraph 15 of the Town Law, Norman E. Klipp, Supervisor, be and he hereby is authorized to designate as his confidential secretary, Edna R. Angell, and com- pensation be fixed at Three Thousand Eight Hundred Dollars ($3 ,800) per annum, payable in regular monthly payments , and be it further RESOLVED: That this designation take effect as of April 1, 1958. Klipp be authorized to write to the Suffolk County Civil Service Commission that the Town of Southold approves the permanent transfer of MAX,W. NEWBOLD as highway foreman from the Suffolk County Highway Department as of April 17 ,1958. Moved by .Justice Tuthill- seconded by Councilman Demarest: WHEREAS, a quotation of 46,989.00 received from the Nelson Iron Works, Inc. Clifton, N.J., for rebuilding a Nelson Bucket Loader and Rotary Screen, now used in the Cutchogue Sand Pit by the Highway Department for loading and screening sand for use on Town Highways , appears to be excessive , and .it does not seem to be in the best interest of the Town of Southold to spend this amount of money to repair this machine, NOW, THEREFORE, BE IT RESOLVED: That the Supt. of Highways of the Town- of Southold be and he hereby is authorized to advertise for bids and to purchase from the lowest bidder, one new Model Q=11 Heavy Duty Bucket Loader with Rotary Screen and all standard equipment as per specific ations which may be obtained at the office of the Supt. of Highways, Peconic, L.I. or equal, plus scrub brushes on screen. One Model Q-111 Nelson Heavy Duty 1954 Bucket Loader with Rotary Screen must be taken in trade as part payment on new machine. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS , an application was received from ALEXANDER and FREDERICK KOKE for an .Open Development Area under the provisions of Section 280-A of . the Town Law, NOW, THEREFORE, BE IT RESOLVED: TUat the Town Clerk of the Town of Southold be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 901, Subdivision C of Article 1X of the Building Zone Ordinance of the Town of Southold. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards. Moved by Councilman Albertson; seconded . by Justice Demarest: WHEREAS , a petition was received from ELLSWORTH and WINIFRED GRATHWOHL relative to change of zone , NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 901, Subdivision C -of .Article 1X of the Building Zone Ordinance of the Town of Soulthold. Moved by Justice Tuthill; seconded by Councilman Albertson: - BUDGET NOTE RESOLUTION DATED MARCH 119 19581 AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $59000.00 FOR HOME RELIEF. BE IT RESOLVED: this llth day of March, 1958, by the Town of Southold, Suffolk County, New YBrk, as follows: SECTION 1. That, pursuant to the provisions of Subdivision 2 of Paragraph a and paragraph a of Section 29, and Section 108 of the Local Finance Law, Section 93 of the Social Welfare Law and Section 114 of the Town Law, for the purpose of paying the cost of home relief expenditures for which insufficient provision was made in the annual budget for the year 1958, there is hereby appropriated as a supplemental appropriation for home relief, the sum of $5,000.00, and there is hereby authorized to be issued, a budget note of the Town of Southold in the principal amount of $5,000.00 which is the maximum cost of such object or purpose , which note shall mature on March 11, 1959. SECTION 2. That, except as herein specifically prescribed, said note shall be of the date , terms , form, contents and place of payment, and at a rate of interest not exceeding three and one-half (3T) per centum per annum, as may be determined by the Town Supervisor, con- sistant , however, with the provisions of said Local Finance Law of the state of New York, and shall be executed in the name of the Town of Southold by its Supervisor and the seal of said Town shall be attached thereto. SECTION 3. That said note shall be sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and upon due execution and sale of said note , the same shall be delivered to the purchaser upon payment by him to the Town Supervisor of the purchase price in cash; and. the receipt of such Supervisor shall be a full adquittance to such purchaser who whall not be obliged to see to the application of the purchase money. SECTION 4. Thelfull faith and credit of the Town of Southold, New York, are pledged to the punctual payment of principal and interest on said note . SECTION 5. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly r put to a vote which resulted as follows:- Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill, Clark and Edwards. Absent-None. Noes-None. The Supervisor thereupon declared that the resolution was duly adopted. BUDGET NOTE 1958 No. 3 $5 9 000.00 The TOWN OF SOUTHOLD, in the County of Suffolk, State of New Y8rk, hereby acknowledges itself indebted and for value received, promises to pay to The First National Bank, Greenport, New York, the sum of FIVE THOUSAND ($5,000.00) DOLLARS , on the 15th day of March, 1959, together with interest thereon from the date hereof at the rate of three per centum (3%) per annum, payable at maturity. Both principal of and interest on this note will be paid in lawful money of the United States of .America , at the Office of the Supervisor, Greenport'--� Suffolk County, N.Y. This note may not be converted to registered form. This note is the only note o fan authorized issue in the amount of Five Thousand ($5,000.00) Dollars. This note is issued pursuant to the provisions of a resolution entitled 01Budget Note Resolution Datdd March 11, 1958, Authorizing the Issuance of a Budget Note of the Town of Southold, Suffolk County, New York, in the amount of 15,000.00 for Home Relief,61 which resolution was duly adopted by the Town Board of the Town of Southold on March 11, 1958, and the privilege is hereby reserved by the Town of Southold . to prepay the whole or any part of the unpaid balance of the principal sum hereof at any time without penalty. The faith&credit of the Town of Southold •are hereby irrevocably pledged for the puncual payment of the principal of and interest on this note according to its terms . BE IT RESOLVED: this llth day of March, 1958, by the Town Board of the Town of Southold, Suffolk County, New York' as follows:- SECTION 1. That, pursuant to . the provisions of subdivision (2) of paragraph (a) of Section 20.00 of the Local. Finance Law of the State of New York, for the. purpose of, paying the Town's share of the cost of current social security coverage provided to its employees pursuant to Section 138- a of the Retirement and Social Security Law of the State of New Yrk, the same being an expenditure for which no provision has been made in the current annual budget of the Town of Southold, there is hereby authorized to be issued a Budget Note of the Town of Southold in the principal sum of $6000.00 which is the maximum .cost of such object or purpose, which note shall mature on March 15, 1959• SECTION 2. DEVELOPMENT .AREA pursuant to the provi- sions of Section 280-A of the Town Law, and WHEREAS , the Tomn Board has heretofore referred the matter to the Planning Board for its advice , and WHEREAS , the Planning Board has recommended that the application of FISHERS ISLAND ESTATES be granted, NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold does hereby establish an OPEN DEVELOPMENT AREA over the premises of FISHERS ISLAND ESTATES as shown forth on the map attached to the application, and it is recommended that 50 feet be reserved for highwayj6 purposes wherever it is possible. Moved by Councilman Demarest; seconded by Justice Clark; WHE-REAS , at a meeting of this Board, held on Bebruary 25, 1958, a resol- ution was duly adopted referring to the Planning Board of the Town of Southold, proposals to amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York for its recommendation and report, and WHEREAS , the - Planning Board did thereafter file with the Town Board its written recommendation and report on said proposals , Now,`:therefore, be it RESOLVED: that this Board hold a public hearing be held at the Supervisor 's Office, 16 South Street, Greenport, N.Y. on the 8th day of April, 1958, at 2:30 P.M. o 'clock in th afternoon of that day, and it is further RESOLVED: That the Town Clerk cause a notice of said proposed hearing , containing a copy of the - proposed amendments , to be published once in the Mattituck Watchman-Long Island Traveler, the official Town newspaper at least 10 days prior to the time of said hearing. Moved by Justice Ralph Tuthill; seconded by Councilman Lester Albertson WHEREAS, the Town Superintendent of Highways did, on the 25th day of February, 1958, duly recommend the purchase of certain machinery pursu- ant to the provisions of Section 142 of ' the Highway Law, NOW, THEREFORE, BE IT RESOLVED that pursuant to Section 142 of the High- way Law the Town Superintendent of Highways is 'hereby authorized to purchase, in accordance with the provisions of Article 5-a of the General Municipal Law, with the approval of the County Superintendent of Highways, the following: One Model A . S. B. S. Walter Snow Fighter, 4-point positive drive for a maximum price of Twenty-two Thousand Seven Hundred Thirty-five Dollars ($22,732.00) , delivered at Peconic, L.I.., N.Y. , and to be .delivered on or about March 25th, 1958. The Town Superintendent of High- ways is hereby authorized, subject to the approval of the County . Superintendent of Highways , to surrender to the vendor One 1935 Walter Snow Fighter as part payment for the above machinery to be purchased. The terms of payment will be as follows : Trade-in allowance-------------- ----$29000.00 Check drawn on Machinery Fund-------- 2,732.00 Check from proceeds of obligations 18 000 00 Total 22,732.00 A cbnttact of purchase for the item purchased shall be duly executed between the Town Superintendent of Highways and such vendor, and when approved by the County Superintendent of Highways , it shall become effect- ive. When such contract has been duly executed and approved, the Supervisor is authorized to complete such purchase upon delivery of the item purch- ased in accordance with the terms of such resolution and such contract, and to pay the above amounts specified to be paid by checks (1) by a check drawn on the itilachinery Fund (Item 3) for ----$ 21732.00 (2) by a check in the amount of $18,000.00, drawn on the account estab- lished .from the proceeds of obligations to be issued pursuant to the Local Finance Law to finance such purchase. 'A RESOLUTION AUTHORIZING THE PURCHASE OF A WALTER SNOW FIGHTER FOR THE TOWN OF SOUTHOLD, SUFFOLK - COUNTY, NEW YORK, AT A TOTAL ESTIMATED COST OF $229732.00 AND AUTHORIZING THE ISSUANCE OF $18,000 SERIAL BONDS OF SAID TOWN TO PAY A PART OF THE COST THEREOF. BEAT RESOLVED, by the Town Board of the Town of Southold, Suffolk County, New York, as follows: SECTION 1. Pursuant to Section 142 of the Highway Law, the purchase of highway equipment, consisting of a Walter Snow Fighter, for the Town of Southold, New York, is hereby authorized at a total estimated cost of $22,732.00. SECTION 2. The plan of financing the aforesaid object or purpose is as follows:- a) The issuance of $18,000 serial bonds of said Town, Which are hereby authorized to be issued pursuant to the provisions of the Local Finance Law. Such bond will have a proposed maturity not in excess of five years . b) By delivery to the vender of said Walter Snow Fighter of a 1935 Walter Snow Fighter presently owned by said Town, and c) By current funds in the amount of $2,732. to be paid from the M;ghway machinery fund. SECTION 3 ® It is hereby determined that subdivision 28 of paragraph a of Section 11.00 of the Local Finance Law applied to such object or purpose , and that the period of probable usefulness thereos is five years. SECTION 4. The faith and credit of the Town of Southold, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal. of and interest on such bonds as the same become due and payable. SECTION �. It is hereby determined that no down payment is necessary in connection with the aforesaid object or purpose. SECTION 6. The validity of such bonds may be contested only if: 1. Such bonds. are authorized for an object or purpose for which said Town of Southold is not authorized to expend money, or 2. The provisions of law which should be complied with at the date of publication of t1is resolution are not substantially complied with, and an action, suit or proceeding contesting such talidity is commenced within twenty days after the date of such publication, or 3 . Such bonds are authorized in violation of the provisions o f the Constitutffion. SECTION 2,, This resolution, which takes effect immediately, shall be published in full in the Long Island Traveler-Mattituck Watchman, Southold, N.Y. together with a notice of the Town Clerkl n substant- ially the form provided in Section 81.00 of the Local Finance Law.
